A progressive judgement

The Supreme Court delivered a verdict on Tuesday incorporating eunuchs in a third category of gender. In doing so, it has restored their dignity, self-confidence and worth. It is also a step towards upholding human rights.

Recognising it as a minority community, the SC has included them in OBC’s and thus they are entitled to quotas in jobs. The apex court has also promised to provide them better amenities such as good education, medical facilities, passport, driving licence and voter card. It promises to grant them the right of social equality. This means any social discrimination against them should be done away with. This is a huge step towards restoration of their self-respect.

Eunuchs all over the nation are overjoyed and indulging in celebrations. After all, after being discriminated for so long, they have finally been delivered justice. Lakshmi Narayan Tripathi, transgender rights activists, was overjoyed with the verdict. She said that while entering the court premises, people’s gaze was on her. But after the delivering of the landmark verdict, she did not care about people at all as justice has been delivered to transgenders.

This verdict is not only an attempt to uphold their rights and restore their dignity, but this is also a step towards their empowerment. It is also an attempt to lessen their sexual exploitation. India is the first country which has placed transgenders into a third category of gender. This reflects a progressive mindset of our judiciary. Transgenders who have earlier been shunned by their families might now be treated better by them. The so-called socially outcast community might now just be a part of this society. Although, one wonders whether this is not a tactic adopted by politicians to lure the voters during election season to cast the votes in their favour. One has to see whether SC retains its verdict on this issue even after the formation of new government.

The verdict is a victory for transgenders, the legal recognition of them as genders. However, tough challenge lies ahead of them. They might be subjected to ridiculing and verbally abused by people when they try to be a part of the mainstream society. People too need to evolve as human beings to understand their worth and be sensitive towards them. May eunuchs see better days in future and may the society accept them to be a part of them. After all, they have been naturally born like that. It is not their fault.
