HC dismisses PIL on pension to illegitimate kids of government staff

The Bombay High Court refused to entertain a petition which sought a direction to the Union Government to grant a share in pension to illegitimate children of government employees across the ranks, instead of only in the case of class I officers.

The division bench headed by Chief Justice Mohit Shah said that aggrieved children themselves can approach the appropriate forum if they want to.

The petition, filed by activist Ketan Tirodkar, quoted a newspaper report saying that the Centre had amended the All India Services (Death-cum-Retirement Benefits) Rules 1958 to provide for a share in the pension to children of illegally wedded wives of officers of Indian Administrative Service, Indian Police Service and the Indian Forest Service.

The petition said this should be also applicable to children of government employees at subordinate levels.
