SC suggests settlement to end Ramjanma Bhoomi-Babri Masjid dispute; BJP welcome court ruling

The Supreme Court on Tuesday advised the concerned parties in Ram Temple dispute case to resolve the matter outside the court after BJP leader Subramaniam Swamy sought an urgent hearing on the matter.

A bench headed by Chief Justice of India J S Khehar while hearing the plea of senior BJP leader Subramaniam Swamy for early hearing the case, said, “It’s a sensitive issue…religious issue…parties should sit together and try to resolve it.”

Its been five years after the Allahabad High court verdict that Hindus have the right to the makeshift temple under the central dome of the Babri Masjid on September 30, 2010 and since then appeals from both sides are pending in the apex court.

CJI J S Khehar also said he was ready to sit down as principal negotiator with the mediators chosen by parties to settle the disputes between Hindus and Muslims over the nearly century-old issue.

The CJI told Swamy that if the parties wanted any other sitting judge of SC as the principal negotiator, he was ready to make the judge available.

However, the bench stressed that both parties must adopt ‘give a bit and take a bit’ approach for a meaningful and sincere negotiations for settling the dispute.

However, BJP welcomes the verdict. Union Culture Minister Mahesh Sharma welcomes an out of court settlement and said that it was in national interest. “We have always stood for Ram Mandir through Constitutional means and court suggestion is welcome.” he said.

Mahesh Sharma“The state of Uttar Pradesh has a good administrator; our government is in state as well as the center so the problems we faced earlier will not be there. We have got Rs. 154 crore funds under Ram Circuit and the work will speed up,” he added.

“The court has given us a direction. It will lead to solution. All parties involved want to come out of it as there are other issue to worry about like employment agriculture etc. The parties involved can have a middleman to broker peace. If nothing happens then court is going to take it,” said senior BJP leader Jagdambika Pal.

Uma BhartiUma Bharti said, “Question of whether Ram was born there or not was settled by the three judges bench of Allahabad High Court. Now, it is a question of who owns the land.

“When SC is asking for an out of court settlement, there will be a way. There was a way out for Somnath temple. Can’t say when it will be completed, but building can start anytime soon,” she added.

Vinay KatiyarBJP’s firebrand leader Vinay Katiyar too welcomed the apex court ruling, saying, ”We have government in UP and the Center. We all will find the solution after conversation.”

 

However, petitioners are not seems to be happy with the decision. Advocate Harishankar Jain of Hindu Mahasabha, a petitioner in the Ram Janma Bhoomi-Babri Masjid case said, “No out of court settlement acceptable. Before approaching us, Subramaniam Swamy should make sure that other side is ready to give its claim. We can’t play with sentiment of Hindu community, no compromise possible on this issue. We will not give even an inch of land, like action committee, we too are not ready to relent.”

Zafaryab JilaniEven, the Wakf board ruled out the out-of-court settlement, stating that the case has been in the court for long. “An amicable solution is impossible. This has to be dealt in the court itself. After all, it is long pending in the court,” said Zafaryab Jilani, Convenor of the Babri Masjid Action Committee.

SQR Ilyas, joint convenor of the Babri Masjd Action Committee, too rejected the SC offer saying saying talks so far have not yielded any results.

Meanwhile, Mohd Iqbal Ansari, appellant in the Babri Masjid Case, said, ”If the matter is sorted with discussion we have no problem.”
