Man gets three-year RI for selling drug

A 31-year-old man from Mumbra in the district was convicted and sentenced to rigorous imprisonment for three years by a local court for possessing and selling MD powder, a party drug.

District Judge N N Shrimangale found Firoz Shaukat Khan guilty under section 328 of IPC (causing hurt by means of poison) and also imposed a fine of Rs. 5000.

Khan was prosecuted under Indian Penal Code as MD powder was not classified under Narcotic Drugs and Psychotropic Substances (NDPS) Act when he was arrested in 2014.

Police had received a complaint that a youth in the area had fallen sick and hospitalised after consuming the stuff sold by Khan who works in construction industry.

He was arrested outside a building at Amrut Nagar in Mumbra on November 20, 2014 and police seized 8 pouches, each containing 2 gms of MD powder, from his possession, Assistant Public Prosecutor Prakash Pujari said.

The prosecution examined seven witnesses including a physician during the trial.

The court rejected the plea of the defence for leniency on the ground that Khan was the sole bread-winner for his family.
