Criminalisation of Triple Talaq is irrational from Constitutional point of view

triple talaqOne of the most influential thinkers in the history of liberalism, John Stuart Mill, who contributed widely to social theory, political theory, and political economy, wrote in his conception of liberty that if a misconduct is harmful to any individual or harmful to the society, then it becomes a crime. He said, “The only purpose for which power can be rightfully exercised over any member of a civilised community, against his will, is to prevent harm to others.”

This principle is also known as the harm principle.

Now let’s analyse the triple talaq matter: As we all know that a five-judge constitution bench of the Supreme Court termed the practice of triple talaq as unconstitutional void and illegal with 3:2 majority, which means that the marriage will not be dissolved, subsequently there is *no harm caused* therefore making triple talaq a crime according to the harm principle is not at all rational.

The other issue of triple talaq is: How we fix the three-year punishment and from where this three-year punishment thing has come? If we look at the Indian Penal Code which is the general law of the land, it tells us about the criminal policy of the country.

We have three years of imprisonment for the major offences like 1) Sedation, 2) Rioting, being armed with a deadly weapon (Section 148 of IPC)

3) Promoting enmity between classes of people (Section 153A)

4) Making, buying or selling the instrument for the purpose of counterfeiting Indian coins (Section 233)

5) Import and export of counterfeit coins (Section 237)

6) Malicious insulting of any religion or religious belief of any class (295A blasphemy) for these major crimes we have three year imprisonment, these crimes cannot be compared with an inconsequential three words uttered by a man which doesn’t dissolve a marriage; in fact, if we look at IPC, we have less than three years of punishment for several major crimes Let’s cast a cursory glance at these crimes :

1) Rioting whenever force or violence is used by unlawful assembling – imprisonment of only two years.

2) Bribery (such a major crime)- imprisonment of only one year.

3) Negligently doing any act known to be likely to spread infection of disease which is dangerous to life – punishment of only six months.

4) Causing the death of any human being by rash and negligent act – imprisonment of only two years.

5) Destroying damaging or defiling a place of worship or sacred object with intent to insult the religion of any class – punishment of only 2 years.

6) Undue influence in the election – imprisonment of only two years.

7) False statement in connection with the election – no imprisonment only fine.

8) Illegal payment in connection with the election – only a fine of Rs 500.

9) Adulterating food or drink intended for sale so as to make the same noxious – imprisonment of only 6 months or fine of Rs 1000 .

10) Dealing with explosive substance- imprisonment of only six months and fine of Rs 1000.

11) Public nuisance- fine of only Rs 200.

12) Forgery – imprisonment of only two years.

13) Wrongfully restraining any person – imprisonment of only one month or fine of Rs 500.

14) Assault or use of criminal force – imprisonment of only three months or fine of Rs 500 or both.

15) Criminal trespass – imprisonment of only three months.

16) Cheating 420 – imprisonment of only one year.

These punishments undoubtedly and certainly state that there is no rationality in providing thee years imprisonment on triple talaq as we have less than three years imprisonment for more severe and dreadful crimes, therefore, this three-year imprisonment is irrational and arbitrary.

Now let, us look at the impact and ramifications of this: if the man who has uttered divorce three times is sent to jail for three months how will he maintain and sustain his household, how about his children who will look after them with respect to the monetary matters?

Therefore I request, Let us not take matrimonial matters to the *criminal courts*.

If we really want to tackle this menace even under civil law imprisonment is possible. Since the Supreme Court has said that triple talaq is illegal anyone who gives triple talaq, in my opinion, commits civil contempt of the court.

Lawmaking is a serious business it should not be politicised; criminal law is an instrument of state and it should be used in rarest of rare cases; it should be used only when the harm to the individual and to the society cannot be tackled by other branches of civil law.

EEPC for timely, affordable bank credit for exporters to boost shipments

Trade

The Reserve Bank and the government need to ensure timely and affordable bank credit for exporters to boost outbound shipments, EEPC India said on Thursday.

Engineering Exports Promotion Council (EEPC) said there was a sharp annualised drop of over 54 percent in the gross bank credit deployment in the export sector.

“Against a gross credit deployment of Rs 434 billion (Rs 43,400 crore) till October-end 2017, the figure dropped 54.6 percent year-on-year to Rs 197 billion (Rs 19,700 crore) in 2018,” the council said in a statement.

EEPC India Chairman Ravi Sehgal said while several global factors such as trade war between the US and China and uncertainties over Brexit are hitting the export demand, the cost of credit remains a big concern for exporters.

“Subdued flow of credit is also seen in the engineering segment as well, as per RBI data. Credit is the lifeline of the industry and exporters and the situation need to be addressed sooner than later,” he added.

Besides, exporters are facing many problems in the wake of RBI’s instructions to banks to not to honour shipping bills older than two years under the Export Data Processing and Monitoring System, he said.

“Ironically, these irritants are surfacing at a time when the going is difficult in the global market due to trade tensions between the US and China and other issues,” Sehgal said.

The sector contributes about 26 percent to the country’s total merchandise exports.

Engineering exports were USD 76 billion in 2017-18 and are expected to touch USD 80 billion this fiscal.

During April-October 2018-19, these exports stood at USD 48 billion as against USD 43.11 billion in the same period previous fiscal.

Shipments to the US and Europe account for about 40 percent of the total exports from the sector.

Toll collections may witness double-digit growth in FY’20: ICRA

toll

Toll collections are likely to witness a double-digit growth in the next financial year, propelled by an increase in commercial vehicle sales and wholesale price index (WPI), rating agency ICRA said on Thursday.

“Driven by strong growth in Medium and Heavy Commercial Vehicles (M&HCV), along with an increase in WPI, toll collections are likely to witness a significant growth in 2019-20,” ICRA said in a statement.

A high growth in automotive sales would subsequently lead to growth in traffic volumes, it said.

Typically, commercial vehicles account for around 65-70 per cent of the total vehicular movement on a majority of national highways. Passenger vehicles account for the remaining 30-35 per cent.

The latest commercial vehicle (CV) sales trend is encouraging with the M&HCV cargo segment witnessing a robust growth of 38 per cent during first eight months of 2018-19, Rajeshwar Burla, Assistant VP & Associate Head, Corporate Ratings, ICRA said.

“Further, the average increase in WPI (toll rates are linked to WPI) for 2018-19 is expected to be around 4 per cent. The combination of high M&HCV sales and the increase in WPI would result in toll collections witnessing double-digit growth in 2019-20,” he said.

ICRA, in its latest study on performance of toll road projects, analysed 48 projects with a median operational track record of six years.

Based on the study, it observed that traffic volumes started decelerating in 2012-13 due to prolonged slowdown in economy.

Rai recommends 2-ODI ban for Pandya, Rahul; Edulji seeks legal view

ban

The Committee of Administrators chief Vinod Rai on Thursday recommended a two-ODI ban on India players Hardik Pandya and KL Rahul for their controversial comments on women in a TV show but fellow COA member Diana Edulji has referred the matter to the BCCI’s legal cell.

Pandya’s comments, slammed as misogynistic and sexist, drew a lot of flak from all corners, prompting CoA to issue a show cause notice on Wednesday. The all-rounder, in response, said that he was sincerely regretful and would not repeat the behaviour.

“I am not convinced with Hardik’s explanation and I have recommended a two-match ban for both players. However the final decision will be taken once Diana gives her go ahead,” Rai told agencies.

On the show, Pandya boasted about hooking up with multiple women and also how open he has been about it with his parents.

Rahul, the more restrained of the two in the show hosted by film-maker Karan Johar, has not yet reacted to the social media storm. The two players were given 24 hours to explain themselves by the BCCI.

It is learnt that Edulji has also sought the opinion of BCCI acting President CK Khanna, acting Secretary Amitabh Chaudhary, and treasurer Anirudh Chaudhry on the issue.

PM-led panel meets for second time to decide fate of CBI Director Verma

CBI Director VermaA high-powered committee headed by Prime Minister Narendra Modi met Thursday for the second time to decide the fate of CBI Director Alok Verma, reinstated by a Supreme Court order after he was sent on forced leave by the government, officials said.

The other members of the committee included Congress leader Mallikarjun Kharge and Justice A K Sikri, who was nominated by Chief Justice of India Ranjan Gogoi to represent him.

The panel’s meet held on Wednesday remained inconclusive, they said, without giving further details.

The CBI chief and his deputy Special Director Rakesh Asthana were sent on the forced leave over two months ago to stop the “kilkenny cat fight” between them. They had accused each other of corruption.

Verma, who resumed office on Wednesday, had revoked most of the transfers done by M Nageshwar Rao, who was appointed as the interim CBI chief in his absence.

Ahead of the meeting, Kharge said he has sought documents, including enquiry report by the Central Vigilance Commission into the matter.

“I have asked for certain documents from the government concerning the matter including the CVC’s enquiry reports,” he told reporters here on Thursday.

He said that Verma should also be given an opportunity to appear before the committee and represent his case.

Congress President Rahul Gandhi also attacked the government ahead of the crucial meeting and said Modi is in a “tearing hurry” to “sack” CBI chief Alok Verma because of the Rafale deal.

“1. Why is the PM in such a tearing hurry to sack the CBI Chief?

“2. Why will he not allow the CBI Chief to present his case in front of the selection committee ? Answer: RAFALE,” Gandhi said on Twitter.

The top court had asked the government to convene the meeting within a week of its order. It had quashed the government’s unprecedented “overnight” order issued in October last year, stripping Verma of his powers and sending him on leave after he and his deputy traded corruption charges, sparking a bitter feud.

The court, while reinstating Verma, however, made it clear that he will desist from taking any major policy decision till a high-powered committee considers the issue of “divestment of power and authority”.

Verma had challenged his ouster from the CBI in the apex court.

Asthana has also approached the Delhi High Court for quashing of an FIR registered by the CBI, reportedly at the instance of Verma, in an alleged corruption case. A decision in this regard is pending in the high court.

Verma’s two-year fixed tenure as CBI director ends on January 31.
