HC convicts man let off in rape case 21 years ago

The Bombay High Court has overturned a 1997 trial court order acquitting a 41-year-old man in a rape case of a minor girl in 1996.

A division bench of Justices Indrajit Mahanty and V K Jadhav Saturday convicted Macchindra Sonawane (who was 19 years old at the time of the incident) and sentenced him to seven years in jail for raping the 11-year-old girl.

The bench, in its judgment, said the trial court had erred and acted in a “casual or cavalier” manner, in determining the victim’s age as that of being a major.

The prosecution case is that on December 1, 1996, Sonwane allegedly raped the victim who had gone to his shop to buy medicines.

A sessions court in Nashik had in July 1997 acquitted Sonwane after determining the victim’s age as 16 and not 11.

The court had taken into consideration the victim’s X-ray ossification test that estimated her age as 14.

The trial court applied the plus two minus two margin of error and determined that victim was 16, which was the age of consent at that time.

The trial court had also disbelieved the victim’s statement that she had resisted the rape after observing that there were no injuries on her body to show resistance.

Thereafter, the Maharashtra government approached the HC in appeal against the acquittal and said the trial court had erred in determining the victim’s age and claimed that she had not even hit puberty at the time of the crime.

The HC, in its judgement, noted that the trial court had mechanically determined the age of the victim.

The bench also took note of the victim’s statement to the police and her deposition before the trial court in which she had categorically denied having consented to the act.

“Lack of any resistance or absence of injury on the body of the victim are of no consequence vis a vis the issue of consent,” the High Court said.

The bench, while convicting Sonwane, directed him to pay a fine of Rs one lakh as compensation to the victim.

It asked the Nashik District Legal Services Authority to locate the victim and get an application from her for consideration of payment of compensation under the government’s scheme of financial assistance for women victims/ survivors for sexual assault and other crimes.

“We hope and trust that such application will be dealt with necessary sympathy that the case deserves,” the HC said.

The bench refused to show leniency for the accused and said, “Even though the incident took place in 1996, we remain with fervent hope and confidence that protecting the confidence of the common man in the institution entrusted with the administration of justice is reaffirmed.

Opposition parties, media “twisted” my statements: Gadkari

nitin 2Union Minister and BJP leader Nitin Gadkari Sunday said some opposition parties and a section of the media have “twisted” his statements, an assertion that comes in the backdrop of his reported “leadership should own up defeat” remarks.

The BJP stalwart was Saturday reported as saying that nobody is willing to own up to failure unlike success and maintained “leadership should have the ‘vrutti’ (tendency) to own up defeat and failures”.

The minister, who was speaking at an event in Pune, did not elaborate, but his comments assumed significance in wake of the BJP’s defeat in just-held assembly polls in Madhya Pradesh, Chhattisgarh and Rajasthan.

However, Gadkari, known for speaking his mind, said Sunday his statements have been twisted.

“In the last few days, I have noticed a sinister campaign by some opposition parties and a section of the media to twist my statements and use them out of context and draw politically motivated inferences to malign my party and me,” he wrote on the micro-blogging site Twitter.

Gadkari claimed there was a “conspiracy” to create a wedge between him and the BJP leadership.

“I have time and again strongly refuted such insinuations and once again condemn all these malafide and mischievous out of context reports attributed to me.

“Let me make it clear once and for all that conspiracies to create a wedge between the BJP leadership and me will never succeed,” he tweeted.

“I have been clarifying my position at various forums and shall continue to do so and expose these nefarious designs of our detractors,” he said.

 

Under-construction structure collapses in Mumbai; 3 killed

At least three people were killed and six others injured when a two-storey under-construction structure in a chawl collapsed on Sunday morning, police said.

The incident took place at around 9.15 am at Motilal Nagar in Goregaon (West) when the slab of the two-floor building gave way during construction, an official said.

The structure was part of a chawl (tenement) of the Maharashtra Housing and Area Development Authority (MHADA), he said.

Fire brigade and police personnel rushed to the spot after getting information about the collapse and started a rescue operation, he said.

At least three fire engines, one rescue van and an ambulance were deployed for the operation, the official said.

At least nine people trapped inside the debris were rescued and rushed to Siddharth Hospital in Goregaon, he said.

A 27-year-old man, Shravan Kumar Goremandal, was declared dead on arrival, he said.

One Subhash Chavan (38) and an unidentified person also succumbed to injuries, the official said.

Three of the injured, Mangal Bansa (35), Munna Shaikh (30) and Shekhar(35), were admitted in the hospital, while the others discharged after treatment, he said.

An accidental death report was registered at the Goregaon Police station and a probe is underway, he said.

Easy to fire blanks when you are million miles away’ - Ravi Shastri slams critics

Ravi Shastri was dismissive of all the flak the Indian team has copped and took a dig at critics for “firing blanks while sitting million miles away”.

India were humbled by Australia in the second Test in Perth by 146 runs, prompting the likes of legendary Sunil Gavaskar to question the team management’s selection policies and demanding more accountability from captain Virat Kohli and the head coach.

Shastri didn’t take any names but in his inimitable style rubbished all criticism, making it evident that he has not taken it too well.

“When you are millions of miles away, it is very easy to fire blanks. Their comments are too far away and we are in the Southern hemisphere. We have to do what’s best for the team, as simple as that,” the India head coach fired a counter salvo at all the ex-cricketers, who haven’t had exactly charitable comments about the team.

There was no surprises when Shastri backed skipper Virat Kohli, whose on-field behaviour has been questioned by the Australian experts.

“He was fantastic. What is wrong with his behaviour? Of course, you can question but as far as we are concerned, he is an absolute gentleman,” said Shastri.

Shastri however admitted that top-order has been an issue for the team with both KL Rahul and Murali Vijay failing in four successive innings in the two Tests.

He did gave indication that team management is seriously looking at Mayank Agarwal as an option.

When asked if India have lost any momentum in Perth, Shastri said that the team are in a unique position at 1-1 in the series, one they didn’t experience in South Africa or England.

“We have not lost any morale in Perth. We knew we had our chances there in Perth as well, so we are ready. We are at 1-1 in a Test series in Australia.”

“Very rarely have we been in a position (this year) where we are 1-1, and it is not often for a team, when they travel overseas, that they are placed 1-1 with two Tests to go. So the boys know what they can do and what they are capable of. The potential lies ahead. We will be third time lucky (after South Africa and England),” Shastri signed off.

Indian woman becomes the fastest Asian to cycle the globe

In an incredible feat for any Indian, 20-year-old Pune woman Vedangi Kulkarni has become the fastest Asian to cycle the globe.

Vedangi, who hails from a suburb of Pune, cycled into Kolkata in the wee hours of Sunday, completing the 29,000 km distance required to qualify as bicycling across the globe.

She started off from Perth in July and will now be flying back to the Australian city to complete the record.

Talking to PTI over the phone, Vedangi said the 159 days spent peddling up to 300 km a day in 14 countries has shown her the “best and worst” of both herself and also the world.

Her father Vivek Kulkarni said that a very few people undertake this gruelling campaign and his daughter has become the fastest Asian to cycle the globe.

British adventurer Jenny Graham (38) is the fastest woman to have cycled the globe in 124 days in 2018, which was three weeks faster than the previous record.

‘Need to develop world class drag-flickers’

Former captain Dilip Tirkey on Sunday said that India missed a golden chance to rewrite history in the just-concluded Hockey World Cup and stressed on the need to develop world class drag-flickers.

In the absence of Rupinder Pal Singh, India had three dragflickers in young Harmanpreet, Amit Rohidas and Varun Kumar but their conversion rate was poor, recording just 30.7 per cent.

India failed to convert three of the five penalty corners they got in their 5-0 mauling of South Africa in their World Cup opener in Bhubaneswar last month.

“We need to have world class flickers. We presently have Harmanpreet, Amit Rohidas and Varun. We have to pay focus on them. We have to have a 60-70 per cent conversion rates in important matches,” Tirkey said on the sidelines of the Beighton Cup hockey tournament here.

Having topped their pool featuring eventual champions Belgium, the hosts made a quarterfinal exit, going down to the Netherlands 1-2 in the World Cup.

Tirkey said the youngsters failed to live up to the expectations against the Netherlands as they missed a golden chance to win the World Cup.

“I feel our youngsters could not play as per their standards. Otherwise team’s performance was very good. There was some good tackling. It’s bad luck that we could not live up to the expectations in the quarter-final. Overall it was a good show. I feel we missed the World Cup,” he said.

“After a long time, we saw development in Indian hockey team. With a lot of talented youngsters, we looked fit. We drew with Belgium in the league stages,” he said referring to their 2-2 draw against the champions.

He further said that India coach Harendra Singh was doing a fine job.

“Harendra Singh is doing extremely well with team. We lost to Australia in the shoot-out (in the Champions Trophy). It was an impressive show (at the World Cup).

“All the foreign coaches have their contribution for the Indian team but as of now, Harendra Singh is the best coach for the Indian team. We need to work on this Indian team,” he said hailing the 2016 Junior World Cup winning coach.

“The coach has done well. Definitely there has been a development in the standards of coaching.”

Tirkey further lavished praise on the Naveen Patnaik-led Odisha government for hosting a successful World Cup.

“It was a grand success. Stars of every field be it in sport or glamour world were involved in making of the tournament. It’s time that everyone including the corporate sector to come forward and support hockey,” he concluded.

Films might take a while but I won’t go slow, says Neha Dhupia

Neha Dhupia says doing films would take a while as she does not know what her character would require her to do in terms of the look.

The actor welcomed baby girl, Mehr last month with husband Angad Bedi.

“If I have to mould myself into a certain character, it could be a little while before I could commit myself to it. I don’t know physically what the character will expect out of me. I have worked through all shapes and sizes.

“I was pregnant when I did ‘Roadies’ and am coming back for a new season after becoming a mother. But for me to play a part, something like a ‘Tumhari Sulu’, I need to be there physically 100 per cent. But I won’t go slow. I want to be a mom, be on stage, do everything,” Neha told an agency.

The actor recently began shooting for the 16th season of the MTV adventure reality show “Roadies”.

Neha, 38, says though it is good to get back to work, she had to overcome the guilt of leaving her daughter at home.

“It feels great but initially you are struck only with guilt, the kind you have never known before. You constantly feel ‘Oh my God what is my child doing?’

“When you are with your child you are like I must cope up with work, because I am a workaholic. The balance is extremely important.”

The actor says it is important to move past the guilt.

“There are constant reminders you give yourself that just because you are going to work doesn’t mean you love your child less. A mother who decides to be at home after giving birth is as beautiful a mother as the one who decides to work. I have had the luxury to take her with me wherever I go. I will work around it,” she said.

The theme for the latest edition of “Roadies” is about hailing real-life heroes by giving them a chance to be a part of the series, “Roadies Real Heroes”.

Aishwarya celebrates Christmas with children suffering from cancer

Christmas is considered a festival of spreading love. Keeping this in mind, Cancer Patients and Association organised a Christmas party for 300 cancer-affected children in Wadala area of Mumbai.

Aishwarya, who is known for her grace and dedication towards special causes, graced the event. To make the party more pleasing, the 45-year-old sang and danced with the children on ‘Kajra Re’ and other songs.

Looking every bit elegant, Aishwarya donned a floor-length pink and golden Anarkali and completed her look with just the right amount of make-up and accessories.

According to reports, Aishwarya adopts 20 children every year and funds all their expenses, including education.

Indian audience expects comics to deliver joke every 10 seconds, says comedian Amit Tandon

Stand-up comedian Amit Tandon, who has bagged the upcoming global Netflix series “Comedians Of The World”, says lines are blurring today between the taste and preferences of Indian and international audiences.

After years of corporate experience Tandon decided to go back to his first love comedy after his videos exploded the YouTube in 2016, he realised he had chosen the right path.

He has performed shows in several cities in India and internationally as well in countries like the US, UK, Australia, Thailand and Singapore etc. Tandon has performed at Jaspal Bhatti Humor Festival and was also seen in “CEO’s Got Talent” show.

“When you’re performing for international audiences, they are more supportive, better listeners and they’ll give you the required time to set-up and deliver your joke.

“Whereas, in India, the expectation of audience is for you to deliver a joke every 10 seconds. Having said that, things have changed now in the last three years. Audiences are getting closer to the international audience,” Tandon told an agency.

He is one of the three Indians handpicked for Netflix series “Comedians Of The World” and he sees it as a fantastic opportunity.

“Comedians Of The World” is the first series on Netflix that has been taped in eight languages other than English. This is great as we get full creative freedom over our material and we’re still reaching out to 100 plus countries.”

Tandon is thankful to the digital platform as Indian stand-up comedians are getting opportunities to cross borders.

He said, “Earlier television and movies were the only mediums to reach out to massive audiences. TV though was still restricted to national audiences, whereas digital platforms are way more democratised.

“With TV and movies, you had to go as per the creative insights or the idea of entertainment of the producers or directors of the show. Here you know you put out exactly what you want to and your audience will find you.”

“The audiences aren’t just for comedy as now we have various genres in stand-up comedy and they enjoy that.”

He asserts earlier performing arts wasn’t looked at with the right amount of respect in India.

Citing example of performing at a bar, Tandon said, “So you’ll be invited for a show, the bar is open and people are talking over you and those challenges are slightly tricky to handle. Today audiences enjoying stand-up. Now you don’t have to educate people, you need to set up the right room for comedy.

PM says Mahagathbandhan incoherent alliance of rich dynasties

Prime Minister Narendra Modi Sunday hit out at the proposed Mahagatbandhan for the 2019 Lok Sabha polls, saying it was an “unholy alliance” of various political parties for “personal survival”.

People will see through the “incoherent alliance of rich dynasties,” Modi said during his interaction with booth workers from Chennai Central, Chennai North, Madurai, Tiruchirappally and Tiruvallur constituencies in Tamil Nadu through video conference.

The prime minister recalled that the key constituent of the mega alliance – the Telugu Desam Party– was formed against the very “high-handedness” of the Congress by the veteran, late chief minister N T Rama Rao but said the party was now keen to join hands with the Congress.

Some parties in the Mahagatbandhan claimed to be inspired by socialist leader Ram Manohar Lohia, but the veteran himself opposed the Congress and its ideologies, Modi said.

“Today several leaders are talking about a grand alliance or Mahagathbandhan. This alliance is for personal survival, and is not ideology-based support. This alliance is for power, not for the people. This alliance for personal ambitions, not people’s aspirations,” he said.

While several parties and leaders in the coalition claimed to be deeply inspired by Lohia, he said “was deeply opposed to the Congress,” Modi said.

Many leaders in the coalition were “arrested and tortured” during the Emergency, he said without referring to anyone.

The Congress “ecosytem” spared none, he said and pointed out at the dismissal of the AIADMK government of late chief minister MG Ramachandran in 1980 though he had people’s support.

Mahagathbandhan is a grand alliance of opposition parties against the BJP for the 2019 Lok Sabha polls.
