Falsely portraying husband as womaniser extreme cruelty by wife: Delhi HC

Making unsubstantiated allegations of extramarital relationship against a husband and portraying him as a womaniser in public space are acts of extreme cruelty that merit dissolution of marriage, the Delhi High Court has held.

A bench headed by Justice Suresh Kumar Kait, while upholding a family court order granting divorce on the husband’s plea of cruelty, said a spouse expects his partner to respect him and ”act as a shield of protection” in times of need, and ”constant nagging” on other person’s character and fidelity leads to mental agony.

Any successful marriage, the court said in a recent order, is built on mutual respect and faith and, if either is compromised beyond a level, the end of the relationship is inevitable.

”Unfortunately, here is a case where the husband himself is being publicly harassed, humiliated and verbally-attacked by his wife, who had gone to the extent of levelling allegations of infidelity during his office meetings in front of all his office staff/guests. She even took to harassing the woman workers of his office and left no stone unturned to portray him as a womanizer in the office. This behaviour is but an act of extreme cruelty to the respondent/husband,” said the bench, also comprising Justice Neena Bansal Krishna, while dismissing the wife’s appeal against the divorce order.

”Casting aspersions of the alleged extramarital relationship with another married lady who was the wife of his friend, would lead to the inevitable conclusion of cruelty… such reckless, defamatory, humiliating and unsubstantiated allegations by one spouse, which has the impact of publicly tarnishing the image of the other spouse, is nothing but acts of extreme cruelty,” the court said.

The court noted that the wife claimed her husband was impotent and compelled him to undergo a potency test which found him fit. Such allegations, it observed, caused mental cruelty him.

The wife also alienated their child from the husband which also amounted to mental cruelty, it added.

”Nothing more can be more painful than experiencing one’s own flesh and blood i.e., the child, rejecting him or her. Such wilful alienation of the child by a parent amounts to mental cruelty to the other parent. In the present case as well, the child has not only been totally alienated, but has also been used as a weapon against the father,” stated the court.

”All these acts which happened in a span of about six years that they spent together, proved that the respondent was subjected to cruelty and harassment which is sufficient to create mental agony and trauma in his mind to the extent that he at times even thought of committing suicide. The acts of the appellant (wife), as proved, can only be termed as acts of cruelty towards the respondent (husband),” it said.

The court, however, said certain alleged acts of the wife, such as her being unable to complete an English speaking course, did not amount to cruelty to the husband.

It also said her complaints to her teachers and classmates about alleged ill-treatment by her mother-in-law and husband, by which she ”may have shared her stresses in matrimonial life”, was not an act targeted towards humiliating the husband.

The Supreme Court on Tuesday asked the Bihar government to put in the public domain the break-up of the caste survey data to enable those aggrieved to challenge the findings.

A bench of Justices Sanjiv Khanna and Dipankar Datta refused to grant any interim relief to the petitioners who have challenged the caste survey and the Patna High Court order upholding the Bihar government’s decision to conduct such an exercise.

”There is no question of interim relief as they (the government) have a high court order in their favour. Now that the data has been put in the public domain, there are two-three aspects which remain. First is the legal issue—the correctness of the high court judgement and the legality of such an exercise,” the bench said.

Senior advocate Raju Ramachandaran, appearing for the petitioners, said since the survey data is out, the authorities have started implementing it in the interim and raised the reservation for SCs, STs, Other Backward Classes, Extremely Backward Classes, and Economically Weaker Sections (EWS) to a total of 75 per cent from the existing 50 per cent.

The bench said this issue needs to be heard at length.

”As far as increasing the reservation is concerned, you have to challenge it before the high court,” the bench told Ramachandaran, who said it has already been contested before the high court.

Ramachandaran said the issue is important, and since the state government is acting upon the data, the matter will be listed next week so that the petitioners can argue for interim relief.

”What interim relief? They (the Bihar government) have a high court judgement in their favour,” the bench said.

Senior advocate Shyam Divan, appearing for the Bihar government, said the data, including the break-up, has been put in the public domain and anyone can see it on the designated website.

Justice Khanna said, ”What I am more worried about is the availability of break-up of data. To what extent the government can withhold the data. You see, the entire break-up of data should be in the public domain so that anyone can challenge the inference drawn from it. Unless it is in the public domain, they can’t challenge it.” The BJP, the main opposition party in Bihar, has accused the Nitish Kumar government of irregularities in conducting the caste survey and called the data collected ”fake”. The bench then asked Divan to file a report on the caste survey and posted the matter for further hearing on February 5. On October 6, 2023, the top court had questioned the Bihar government as to why it published its caste survey data. It had, however, refused to restrain the state government from making public further data, and said it may examine if the state has the power to conduct such an exercise.

It had issued a formal notice on a batch of pleas challenging the August 1, 2023 order of the Patna High Court that gave the go-ahead for the caste survey in Bihar.

It rejected the petitioners’ contention that the state government has already published some data preempting a stay. They had sought a complete stay on further publication of data.

On October 2, 2023, the Nitish Kumar government had released the findings of the caste survey, a move its detractors claimed was made keeping in mind the 2024 Parliamentary elections. The data revealed that the OBCs and EBCs constituted a whopping 63 per cent of the state’s population.

According to the data released, the state’s total population stood at a little over 13.07 crore, out of which the Extremely Backward Classes (36 per cent) were the largest social segment followed by the Other Backward Classes at 27.13 per cent.

The survey also said the Yadavs, the OBC group to which Deputy Chief Minister Tejashwi Yadav belongs, were the largest caste in terms of population, accounting for 14.27 per cent of the total.

Dalits accounted for 19.65 per cent of the total population in the state, which is also home to nearly 22 lakh (1.68 per cent) people belonging to the Scheduled Tribes.

On August 7, 2023, the top court had refused to stay the high court’s order giving the go-ahead for the caste survey.

Besides a plea by NGO ‘Ek Soch Ek Paryas’, several other petitions have been filed, including one by Nalanda-resident Akhilesh Kumar, who has contended that the notification issued by the state government for the exercise is against the constitutional mandate.

Kumar’s petition says, according to the constitutional mandate, only the Union government is empowered to conduct a census.

The high court had said in its 101-page verdict, ”We find the action of the state to be perfectly valid, initiated with due competence with the legitimate aim of providing development with justice.”

The Privileges Committee of Lok Sabha will meet next week to examine the issue of suspension of three Congress members from the House during the Winter Session for unruly behaviour.

The Committee, chaired by BJP member Sunil Kumar Singh, at its meeting on January 12 will record oral evidence of Congress members K Jayakumar, Abdul Khaleque and Vijayakumar Vijay Vasanth, who were suspended for creating ”grave disorder in the House” on December 18.

During the Winter Session of Parliament, 100 Lok Sabha members from the opposition ranks were suspended from the Lower House for unruly behaviour after they brought placards and raised slogans demanding a statement from Home Minister Amit Shah on the issue of breach of Parliament security.

While 97 members were suspended for the remainder of the Winter Session, the issue of Singh, Khaleque and Vijayakumar, who had reached the presiding officer’s chair, was referred to the Privileges Committee.

The suspension of the three members will continue till the Committee submits its report to the Lok Sabha Speaker.

In Rajya Sabha also, 46 members were suspended during the Winter Session including 11 members whose case was referred to the Privileges Committee of the Upper House.

The Privileges Committee of Rajya Sabha is chaired by Deputy Chairman Harivansh and is yet to convene a meeting to examine the case of suspension of 11 members referred to it.

Opposition members Jebi Mather Hisham, L Hanumanthaiah, Neeraj Dangi, Rajmani Patel, Kumar Ketkar, G C Chandrashekhar (all Congress); Binoy Viswam and Sandosh Kumar P. Unidentified militants shot and killed six barbers from Pakistan’s Punjab province after abducting them from the restive northwest region, police said.

The incident took place in the Mir Ali area of the North Waziristan district of the Khyber Pakhtunkhwa province bordering Afghanistan, ARY News reported on Tuesday.

The victims, who were from the Punjab province, ran barbershops in the local bazaar, police said, adding that they were abducted a day earlier and their bodies were recovered on Tuesday.

However, no one immediately claimed responsibility for the killings.

Police have launched a search to arrest the culprits who shot and killed the six barbers.

The latest incident from North Waziristan came after five labourers were killed in the same province by unidentified militants while they were in their tents.

The gruesome act took place at a time when the province wrestled with a worsening law and order situation due to the rising terrorism at a time when the much-awaited countrywide elections were just over a month away.

The increase in terrorist acts – including attacks on military and police as well as targeted killings – is on the rise in Khyber Pakhtunkhwa, especially the former tribal belt.

However, the region around Bannu and Dera Ismail Khan has been worst affected.

Recently, Pakistan has been hit by a wave of terrorist activities orchestrated by various terror outfits. According to a recent report by the Pakistan Institute for Conflict and Security Studies (PICSS) think tank, the Khyber Pakhtunkhwa province was the most affected by terror attacks in November, recording 51 attacks with 54 deaths and 81 injuries.

A BJP MLA from Thane, Sanjay Kelkar, has appealed to Maharashtra Chief Minister Eknath Shinde to facilitate the settlement of the dues of rubber company workers before initiating a cluster development project on a plot where the firm was located.

Kelkar, whose party is an ally of the Shiv Sena led by Shinde, said in a statement on Sunday that he was hopeful that the chief minister will empathise with the workers of the company, which is now closed, and take positive action in the matter.

Shinde performed the ground-breaking ceremony for the cluster development scheme in the Wagle Estate area of Thane on Saturday.

The CM said that following the deaths of 18 people in the Sairaj building crash in 1998, he decided that the city needed cluster redevelopment of old and dilapidated buildings.

Six people were killed and two others injured as the car they were travelling in hit a road divider in Jamshedpur city, Jharkhand, on Monday morning, police said.

The accident took place near Circuit House Square in the Bistupur police station area around 5 am, an officer said.

Jamshedpur Senior Superintendent of Police Kaushal Kishore told PTI, ”Eight persons were travelling in a five-seater car, which first hit a road divider and then a roadside pole. Five of them were killed on the spot, while three were taken to a hospital, where one more person succumbed to injuries while the remaining two are undergoing treatment.”

Further details are awaited. The SSP said that the car was at a high speed. ”The impact of the accident was so high that all eight people got trapped inside the car and they were taken out by using a gas cutter,” he said.

He added that all of them were residents of Baba Ashram in the RIT police station area of Saraikela-Kharswan district.

They had a ‘Litti (a famous cuisine of Bihar) Party’ till late night on Sunday, as per information, he said. ”Then, they left for Jamshedpur around 4.30 am on Monday. Their family members had told them to avoid the trip but they did not listen to them, as per the information available,” he said.

Jharkhand Chief Minister Hemant Soren expressed grief over the loss of six lives in a road accident.

”Heartbroken by the sad news of the deaths of six people in a road accident in Jamshedpur. May God grant peace to the departed souls and give strength to the bereaved family members to bear this difficult time of grief,” Soren wrote on X.

He also wished for speedy recovery to those injured in the accident.

Mumbai Anti-Narcotics Cell (ANC) arrested a man along with 250 grams of Mephedrone (MD) drugs in the Mahim area on New Year’s Eve, officials said. The estimated value of seized drugs is Rs 50 lakh, they said.

According to officials, a team from the Worli unit of the ANC was patrolling late at night. While patrolling near Mahim Railway Station, they noticed a man standing on the footpath near platform number one. The man appeared suspicious, prompting ANC officials to stop and search him.

During the search, they found a white powder in a plastic bag, identified as MD drugs, leading to the arrest of the person. Upon interrogation, he identified himself as Benedict Francis Godgift Cyprian alias Dinku (37).

The police registered a case under the NDPS Act and arrested him. The ANC seized 250 grams of MD drugs from Dinku, valued at Rs 50 million in the international market.

Dinku resides in Nalasopara, and the police are investigating the source of the MD drugs, they said. The ANC presented Dinku in court, where he was remanded in police custody until January 3, officials added.

On November 1, a Banaras Hindu University student who is a resident of a hostel there left her room for the walk inside campus at around 1.30 am. The girl is a student of B.Tech. in mathematical engineering. He met a friend of his on the way. They were both walking together. Suddenly, from nowhere, one motorcycle and three men approached them from behind. They parked their motorcycles and separated from both friends.

First, they forced the girl to take her clothes off; they fiddled with her body and one of them was shooting this video. Then another man took his turn and raped the girl, while one was raping and the other was taking video. Gradually, they ended up beating her for resisting. These guys pushed her friend away so that he could keep him out of the crime scene. The victim was forcibly taken to an isolated area, where she was sexually assaulted. Threats were issued and his phone was confiscated.

They forcibly kissed her and molested her for hours at gunpoint. After raping her one by one, the girl was left behind in bad condition, and the accused fled from the university campus. A friend somehow managed to reach the victim and dropped her back at her hostel.

A day later, hundreds of students protested at the institute’s director’s office to demand better security on campus. Varanasi Police took two months to trace these rapists. Those arrested are Kunal Pandey of Bridge Enclave Colony Sunderpur, Anand alias Abhishek Chauhan and Saksham Patel of Jivadhipur Bajardiha. The police have also recovered the motorcycle used in the crime.

After the crime, the police launched a thorough investigation and extracted footage from more than 170 CCTV cameras across the BHU IIT campus. After about two months, with the joint efforts of the Crime Branch and Lanka Police Station, Kunal Pandey and his friend were detained from the Susuwahi area and interrogated. This arrest is an important breakthrough in the case, giving the victim hope of getting justice.

There was a ruckus for many days; the issue of dividing BHU into two parts was heated. After this incident, the students of IIT BHU demonstrated fiercely at the director’s office, where the students of BHU supported them. After this, the issue of separating the IIT campus from BHU by raising a wall was raised, and then the students of BHU as well as the professors and alumni got angry and created a ruckus, did many marches, and warned of agitations, terming it wrong, after which the matter went into cold storage.

The accused are Kunal Pandey, Anand Chauhan, and Saksham Patel. All of them are in their 20s and are residents of Varanasi. Days after the incident, another female student of the varsity claimed that he was molested by a driver of the university bus. BHU has become the most unsafe place for female students. The BJP’s youth workers have become arrogant and fearless due to the supreme authority of the party. Unfortunately, Hindu girls are attacked by Hindu boys; earlier, the same state in Uttar Pradesh bashed Muslim youth even if they were seen around Hindu girls and these boys are given every right to ride on their whims and fancies.

It’s very shameful even to say what’s happening at BHU. Students are protesting not for a state-of-the-art laboratory, fully air-conditioned classrooms, or international faculties but for security. They have a very simple demand: a secure campus. Varanasi, which is the electoral constituency of PM Modi, is not bothered to provide safety to female students at Hindu University. What could be the worst fate for Hindu girls here?

Isn’t it very fundamental to provide security to students? An atmosphere where one can walk without being scared of harassment or being judged? An atmosphere where we don’t distinguish boys and girls and, above all, treat them as students? An environment that promotes overall development for students? If we are not even able to provide this basic safety, I think we are letting down not only ourselves but the whole of humanity. We need to understand that not only the BHU administration is responsible for this whole fiasco but we as a society also need to take collective responsibility. This is not the first time such an incident has happened; BHU was not the first institute where it happened. Every day in the newspaper, we read of cases where someone was harassed, raped, groped, or misbehaved. When the BJP was in opposition, they always attacked the UPA over women’s security. Since the BJP came to power, there has been a rise in such crimes against women, but now they are all mute spectators.

A Sessions Court on Saturday declined to stay former Maharashtra minister and Congress leader Sunil Kedar’s conviction in a bank scam case and also rejected his plea for suspension of sentence, observing it was a well-planned crime involving the hard-earned money of poor people and farmers.

Nagpur District Judge RS Patil also rejected the bail plea of Kedar, noting that granting any relief to him at this stage would send a wrong message to society, Government Pleader Nitin Telgote told PTI. The sessions court also noted that in view of strong evidence, there is prima facie no need to re-evaluate the lower court’s decision, Telgote added.

A magistrate’s court in Nagpur on December 22 sentenced Kedar and five others to five years’ rigorous imprisonment for misappropriation of funds at the Nagpur District Central Cooperative Bank (NDCCB) in 2002. Kedar was chairman of the bank at the time of the scam.

The court also fined the six convicts with Rs 10 lakh each.

Keadar had challenged his conviction and sentencing before the sessions court through an application filed by his lawyer Deven Chavhan, which was heard on Saturday.

As per the prosecution, the NDCCB lost Rs 125 crore in government securities in 2002 as rules were flouted while investing funds through Home Trade Private Limited.

”The sessions court observed that it was a well-planned crime involving Rs 153 crore which was the hard-earned money of poor people and farmers,” Telgote said after the district court rejected Kedar’s petition. ”The (sessions) court also observed (on Saturday) that the lower court’s decision was based on documentary evidence and a strong message regarding how strict the court is in such cases should go out. If the accused is released on bail or his sentence is suspended, it will give a wrong message to the society,” Telgote quoted Judge Patil as saying.

When there is such strong evidence, there is prima facie no need to re-evaluate the lower court’s decision today. Hence, it would not be appropriate to grant any relief at this moment, the judge noted. The magistrate court had convicted Kedar under Indian Penal Code Sections 406 (criminal breach of trust), 409 (criminal breach of trust by public servant), 468 (forgery for purpose of cheating, 471 (whoever fraudulently or dishonestly uses as genuine any document which he knows or has reason to believe to be a forged document), 120(b) (criminal conspiracy) and 34 (common intention).

Following his conviction, the state legislature secretariat disqualified Kedar as MLA from the date of his conviction on December 22 under provisions of Article 19 (1) (e) of the Constitution of India and Section 8 of the Representation of the People Act, 1951.

Prime Minister Narendra Modi on Saturday inaugurated the Maharshi Valmiki airport and the redeveloped Ayodhya railway station, from which he flagged off two Amrit Bharat and six Vande Bharat trains, some virtually.

This visit by the prime minister comes weeks ahead of the ‘pran pratishtha’ or consecration ceremony of the Ram temple here. The temple is currently under construction, with the ceremony to be held on January 22, which will be attended by the prime minister. He also inaugurated, dedicated to the nation and laid the foundation stone of multiple development projects worth more than Rs 15,700 crore.

These comprise projects worth about Rs 11,100 crore for the development of the city and its surrounding areas, and those worth about Rs 4,600 crore related to other works in Uttar Pradesh.

After he arrived in the temple town earlier in the day, Prime Minister Modi held a roadshow from the airport to the railway station and was greeted by a large number of people who had gathered along its route. Modi greeted people from his car, and at one point, opened the door of his vehicle to wave back at them. People showered flower petals, waved BJP flags and raised slogans in his praise. The prime minister also witnessed performances by cultural troupes along the route. In a post on X, Uttar Pradesh Chief Minister Yogi Adityanath, who received Modi at the airport, said, ”Hearty welcome and greetings to respected Prime Minister Shri @narendramodi ji in Shri Ayodhya Dham…” The inauguration of the airport and railway station were scheduled after the roadshow.

After inaugurating the station, the prime minister took a tour of the facility. He was accompanied by Adityanath, Railway Minister Ashwini Vaishnaw and others. Modi was briefed by Vaishnaw about the station, the facade of which is inspired by traditional temple architecture.

The Phase-I of the redeveloped station — Ayodhya Dham Junction Railway Station — has been completed at a cost of more than Rs 240 crore, officials said.

The three-storey railway station building is equipped with features such as lifts, escalators, food plazas, shops for puja needs, cloak rooms, child care rooms, waiting halls. The station building is ”accessible for all” and an ”IGBC certified green station building”, according to the officials The prime minister flagged off two new Amrit Bharat trains — the Darbhanga-Ayodhya-Anand Vihar Terminal Amrit Bharat Express and the Malda Town-Sir M Visvesvaraya Terminus (Bengaluru) Amrit Bharat Express.

He also flagged off six new Vande Bharat Trains. These include the Shri Mata Vaishno Devi Katra-New Delhi Vande Bharat Express, the Amritsar-Delhi Vande Bharat Express, the Coimbatore-Bangalore Cantt Vande Bharat Express, the Mangalore-Madgaon Vande Bharat Express, the Jalna-Mumbai Vande Bharat Express and the Ayodhya-Anand Vihar Terminal Vande Bharat Express.

Following this, Prime Minister Modi visited the Lata Mangeshkar Chowk, where a giant-size Veena has been installed. A devotional song sung by Lata Mangeshkar was being played during his visit.

During the inauguration of the airport, Union Minister for Civil Aviation Jyotiraditya Scindia, Union Minister of State for Civil Aviation Gen (Retired) VK Singh, Chief Minister Adityanath and other leaders accompanies Modi.

The facade of the terminal building depicts the architecture of the upcoming Ram temple here, while its interiors are decorated with paintings and murals depicting the life of Lord Ram.

The Phase-1 of the airport has been developed at a cost of more than Rs 1,450 crore, according to officials. The airport’s terminal building will have an area of 6,500 sqm, equipped to serve about 10 lakh passengers annually.

The airport will improve connectivity in the region, leading to a boost in tourism, business activities and employment opportunities, they said.
