While continuing to hear the suo-moto petition on the stripping and assault case in Belagavi district, the High Court of Karnataka on Monday called for fixing collective responsibility on the society. “It is not ‘beti bachao, beti padhao’. It is ‘beta padhao’, to save the girl child. Unless you tell the boy child, you will not be achieving it. The girl will naturally be respectful to the other lady. It is for the boy to be told to respect and protect the lady,” the HC division bench headed by Chief Justice Prasanna B Varale said.

The HC on December 12 took suo motu cognisance of news reports of the incident of 42-year-old woman in Hukkeri Taluk allegedly tied to an electric pole, stripped and assaulted after her son eloped with a girl from the same village and ST community.

The HC in its hearing called for the need for fixing collective responsibility in such cases. “Some collective responsibility measures have to be taken, which Lord William Bentinck took in history. It is not the action of offenders, but the inaction of those standing at the spot that is more dangerous. These people standing mute spectators will make the assailant a hero,” the HC said. The HC orally observed that Lord William Bentinck imposed collective fines on villages that harbored criminals.

The HC noted that only one person in the village came to the rescue of the woman. The village has a population of 8,000 and during the incident there were “around 50 to 60 in addition to 13 assailants. And to the misfortune of the victim, only one person namely Mr Jehangir showed the courage to assist the victim and made an attempt to save the victim from assailants. In that process, he was subjected to physical assault. In this situation, out of 50 to 60 people only one person could gather the courage and rush to the rescue of the victim whereas others were just mute or silent spectators of the incident,” the HC noted.

Referring to a book on the Roman Empire, the HC said, “’Rise and Fall of the Roman Empire’, read it. Unless you build a good society you cannot build a nation. Unless we instill these values in the next generation nothing will happen. There will be other judges and advocates and other spectators but things will go on,” the HC said.

During the arguments, the HC asked why the villagers remained mute spectators and whether they were ”afraid of the police?” The HC said that it may be because the police did not treat witnesses properly. “Sometimes witnesses are picked up and not treated friendly. It makes them apprehensive. Police stations, subject to exceptions, don’t differentiate between witness and accused,” the HC said.

Suggesting new laws for collective responsibility, the HC said, “So many bystanders. But nobody did anything. It is collective cowardice. That is to be addressed. Police are not of British Raj. Something needs to be done. Some factors should be collected and provided to the Law Commission and they may come out with the law. This is how law marches. The law should have pace with people’s lives. How will you ensure that such incidents are not repeated? This also needs to be addressed.” In its order on Monday, the HC noted that the District Legal Services Authority (DLSA) had awarded an interim compensation of Rs.50,000 for the rehabilitation of the victim of which 50 per cent was allowed to be withdrawn and another 50 per cent kept in fixed deposit. After consulting with the medical officer, the HC noted that the women needed treatment for six to eight months and modified the DLSA order and ordered the release of the entire compensation amount unconditionally. The HC also noted that Rs.5 lakh has been deposited in the woman’s account by the Chief Minister relief fund and the Karnataka Maharshi Valmiki Schedule Tribes Development Corporation had allotted 2 acres 3 guntas (40 guntas are one acre) of land to the victim at Chulki village, Belagavi. “We appreciate these steps taken by the State of Karnataka as a solace to the victim,” the HC said.

The HC also recorded that the Police Inspector Vijay Kumar Sinnur was suspended for lapses. Noting that the investigation has been handed over to the CID, the HC said, “We have observed that the state government has handed over the investigation to CID. We are of the opinion that it will be necessary to give time to carry out further investigation.” Recording that all except two offenders were arrested, the HC listed the matter for next hearing in the third week of January when the authorities were directed to file a further status report.

The Lok Sabha suspended 33 opposition members, including Adhir Ranjan Chowdhury, T R Baalu and Sougata Ray, from the House on Monday for displaying placards and raising slogans over the Parliament’s security breach issue.

The opposition members disrupted the House’s proceedings, demanding a statement from Home Minister Amit Shah on the issue.

While 30 members, including 10 from the DMK, nine from the Trinamool Congress, eight from the Congress, and one each from IUML, JD(U) and RSP, were suspended for the remainder of the Winter session, three other Congress members were suspended pending a report of the Privileges Committee.

Last week, 13 opposition members were suspended from the Lok Sabha and one was suspended from the Rajya Sabha for disrupting the proceedings. The total number of suspended opposition members now stands at 47.

The Lok Sabha was adjourned for the day soon after the suspension of 33 members was announced.

Among those suspended on Monday were Adhir Ranjan Chowdhury, Gaurav Gogoi, K Suresh, Amar Singh, Rajamohan Unnithan, Su. Thirunavukkarasar, K Muraleedharan, Anto Antony (all from Congress), Kalyan Banerjee, Aparupa Poddar, Prasun Banerjee, Sougata Ray, Satabdi Ray, Protima Mondal, Kakoli Ghosh Dastidar, Asit Kumar Mal, Sunil Kumar Mondal (all from TMC), T R Baalu, A Raja, Dayanidhi Maran, T Sumathy, K Navas Kani, Kalanidhi Veerasamy, C N Annadurai, S S Palanimanickam, G Selvam, S Ramalingam (all from DMK), ET Mohammed Basheer (IUML), N K Premachandran (RSP) and Kaushalendra Kumar (JD-U).

Three Congress members—K Jayakumar, Vijay Vasanth, and Abdul Khaleque—who had climbed on the speaker’s podium and raised slogans were suspended from the Lok Sabha pending the report of the Privileges Committee on their unparliamentary behaviour.

As the Lok Sabha met at 3 pm, BJP member Rajendra Agrawal, who was in the chair, named the 33 opposition members. Parliamentary Affairs Minister Pralhad Joshi read out a motion suspending 30 members from the House for the remaining part of the Winter session. Joshi also moved a separate motion referring the conduct of Jayakumar, Vasanth, and Khaleque to the Privileges Committee of the Lok Sabha and suspending them pending the submission of the report by the panel.

The Winter session has witnessed uproar and repeated adjournments since the breach in Parliament security by two protesters who jumped into the Lok Sabha chamber from the public gallery and opened smoke canisters on December 13, the anniversary of the 2001 terror attack on Parliament.

Lok Sabha Speaker Om Birla has ordered a high-level inquiry into the breach in Parliament security and urged members not to politicise the issue.

Parliamentary Affairs Minister Joshi made a statement on the issue in the Lok Sabha, but opposition members have been insisting on a statement from the Home Minister.

Maharashtra Chief Minister Eknath Shinde is scheduled to chair a meeting of the Cabinet Sub-Committee on the Maratha reservation on Monday. The meeting of the Cabinet Sub-Committee constituted for Maratha reservation and facilities will be held this evening.

Maharashtra is witnessing protests by the Maratha community led by activist Manoj Jarange-Patil, founder of Shivba Sanghatana, who is seeking reservation in government jobs and education under the OBC category. Jarange-Patil withdrew his indefinite strike in the second phase on November 3 after setting the December 24 deadline for the government to take a decision on the Maratha reservation.

The Maratha community agitation gained momentum after Jarange sat on an indefinite hunger strike on October 25. The agitation has witnessed violence, suicides and the resignation of legislators in support of reservations.

The process of issuance of Kunbi certificates has already begun in Maharashtra. The Kunbi community is eligible for reservations in the OBC category. Earlier on Sunday quota activist Patil refused to give time to the Eknath Shinde-led Maha Yuti dispensation after December 24 over Maratha reservations.

“We would not give even one hour after December 24, 2023, ensure reservation to Marathas by then. There will be more than 3 crore people in the next movement,” he said. He further said that the direction of the next protest movement will be announced in the meeting to be held on December 23.

Jarange pointed out that the state government has not withdrawn cases against Marathas who participated in the protests for reservation. Earlier on Saturday, Rural Development Minister Girish Mahajan and Employment Guarantee Scheme Minister Sandeepan Bhumare met Jarange and sought an extension of the time frame after informing what the government has done so far.

Maharashtra State Backward Class Commission (MSBCC) chairperson Justice (retd) Anand Nirgude submitted his resignation from the post to the state government earlier this month. Following this, the state government appointed Bombay High Court (Retired) Judge Sunil Shukre, who played a key role of mediator in persuading Jarange to end his hunger strike last month, as the chairperson of the commission, overlooking the Maratha quota.

Nationalist Congress Party (NCP) President Sharad Pawar took a swipe at his age critics on Sunday, saying that he had not grown old and still had the power to “straighten some people out.” Pawar was speaking at a bullock cart race programme organised on the occasion of his birthday in Haveli taluka of Pune’s rural part.

Addressing the crowd, Sharad Pawar said, “I have a complaint with you people. You people often comment on my age that I am 84 years old, I am 83 years old, what have you people seen in me till now? I have not become old. I still have so much strength in me. I can straighten some people out.” Pawar also spoke about the bullock cart racing event, saying that it could be included in the Olympics if planned decisions are taken.

“This event is a competition of speed, strength and determination. If planned decisions are taken, then I am confident that this event can be brought to par with many other sporting events in the world, and you (bullock cart racing organisers) are doing other work as well,” he added. His statement is seen as a clear rebuttal to his opponents, who have often targeted him for his age and called for his retirement from politics.

Meanwhile, Prime Minister Narendra Modi extended his greetings to Nationalist Congress Party (NCP) chief Sharad Pawar on his 83rd birthday on December 12. Taking to the social media platform ‘X’, PM Narendra Modi said, “My best wishes to Shri Sharad Pawar Ji on his birthday. May he be blessed with a long and healthy life.”

Pawar founded the NCP in 1999. He became an MLA for the first time at the young age of 27, before becoming the youngest Chief Minister of the state at the age of 38 in 1978. The four-time chief minister of Maharashtra has also served as Defence Minister. He was Agriculture Minister in the cabinet of former Prime Minister Manmohan Singh. He was the first and former president of the Nationalist Congress Party (NCP), which was founded in 1999 after separating from the Indian National Congress.

Sharad Pawar founded the NCP after his ouster from Congress. He, Tariq Anwar and PA Sangma raised a revolt in the Congress Working Committee on the issue of Sonia Gandhi’s foreign origin, leading to a split in the party. NCP soon earned the recognition of a national party after registering its presence in the states of Maharashtra, Goa, Meghalaya and Manipur. However, it lost the tag this year. Pawar belongs to rural Maharashtra and is sometimes referred to as ‘Chanakya’ in political circles. He played a crucial role in the formation of Maha Vikas Aghadi, the alliance between Congress, Shiv Sena and the NCP.

Maharashtra is set to undergo polls next year. The Mahavikas Aghadi, comprising the Shiv Sena, NCP and Congress, which came to power in the state, collapsed after Eknath Shinde revolted and joined hands with the Bharatiya Janata Party (BJP) along with MLAs of the Shiv Sena. This led to the formation of the Shiv Sena (Eknath Shinde faction)-BJP government in the state.

A year later, Ajit Pawar, from the NCP, revolted against his party chief and joined hands with the BJP along with some of his party colleagues. The state is now run by the Mahayuti alliance, comprising the BJP, Shiv Sena, led by Chief Minister Eknath Shinde and the Ajit Pawar faction of the NCP.

The Congress on Sunday accused Prime Minister Narendra Modi of running away from a debate on the security breach in Parliament and said the reason for it is that questions will be raised on the role of the Mysuru BJP MP in facilitating the entry of those who jumped into the Lok Sabha chamber.

The opposition party’s attack came after Modi said the seriousness of the security breach in Parliament cannot be underestimated and called for no squabbling over the issue amid the Opposition’s protests over it in Parliament.

In a post on X, Congress general secretary Jairam Ramesh said, ”The Prime Minister has finally broken his silence on the extraordinary events in the Lok Sabha on December 13th. He says probe is needed and not debate and that such a probe is on.” ”All that INDIA parties are asking for and will continue to press for is a statement by the Home Minister on what happened on December 13th and how exactly it happened,” Ramesh said.

”The PM is running away from a debate for a very simple reason. Questions will be raised on the role of the Mysuru BJP MP Pratap Simha in facilitating the entry of the intruders into the Lok Sabha on December 13th,” he said.

In an interview with the Hindi daily ‘Dainik Jagran‘, Modi said probe agencies are investigating the incident and taking stringent measures, noting that it is equally necessary to go to the root of people behind it and their motives.

The newspaper said he described the breach as painful and a matter of concern.

”Efforts should also be made to look for a solution with collective spirit. Everyone should avoid squabbling over such an issue,” he said.

The gravity of the incident which happened in Parliament should not be underestimated, the prime minister said, adding that the Speaker has also been taking necessary steps with all seriousness.

Two people jumped from the visitors’ gallery into the Lok Sabha chamber on December 13, with opposition parties, demanding a statement from Union Home Minister Amit Shah. Some members have also sought Shah’s resignation.

The government has insisted that the security in Parliament complex is the responsibility of the Lok Sabha secretariat and it has been following the Speaker’s directives.

It has also cited numerous such violations in the past, accusing the opposition of politicising the issue.

Delhi LG gives nod to prosecute 11 people involved in false passport cases

Delhi Lt Governor V K Saxena has sanctioned the prosecution of 11 people allegedly involved in cases of obtaining passports by furnishing false and forged documents, Raj Niwas officials said on Sunday.

With this, the LG has granted prosecution sanction against 69 people whose names have figured in 46 FIRs under the Passports Act, 1967 that have been sent to him since April this year, they added.

The sanction for prosecution was sought by the home department under Section 15 of the Passports Act for the offences enlisted in Section 12 of the act for obtaining passports and travel documents like visa etc. on the basis of false, fabricated and forged documents, an official said.

The LG expressed concern that the agents who are co-accused and more often than not kingpins of rackets take innocent people for a ride yet remain untraced, the official said.

The LG was informed that eight agents involved in six cases of forged documents have not been traced as yet, the official said.

Between April and November, 40 more FIRs have previously come to the LG for which prosecution sanction were granted by the LG.

In the six cases, in which separate FIRs were lodged by Delhi Police between 2007 to 2019, the LG has expressed displeasure over delays in taking action and pointed out that in one case there was a lapse of more than 16 years, the official said.

”He underlined that to avoid undue delays in processing such cases, instructions had been issued earlier which were not being followed by the Delhi Police as well as the home department, and there had been inordinate delay in processing and submission of cases for seeking prosecution sanction,” the official said.

Saxena directed the Delhi government’s home department and Delhi Police to strictly adhere to the instructions and also examine the delay in the matter and fix responsibility of erring officers.

He called on the Delhi Police to intensify its efforts to identify and trace the agents involved in these cases to examine their culpability and expeditiously process the matters under the Passports Act.

Giving his approval for prosecuting the 11 accused, Saxena noted that all the cases are ‘fit’ for granting prosecution sanction under Section 15 of the Act, saying materials placed on record and facts of each cases prima facie makes out a case against the accused.

The LG in one such case also ordered the Delhi Police to examine the culpability of staff of RPO, Mumbai as well as officials concerned in Maharashtra Police who facilitated the issuance of two passports to the accused in Mumbai, he added.

British Prime Minister Rishi Sunak, who was in Italy over the weekend on an official visit, has warned that illegal migration threatens to ”overwhelm” Europe and indicated that it may be time for an update of international law.

At an event in Rome on Saturday, the British Indian leader also cautioned that ”enemies” could use immigration as a ”weapon” by ”deliberately driving people to our shores to try to destabilise” European society. He was addressing the Atreju political festival, organised by Italian Prime Minister Giorgia Meloni’s right wing Brothers of Italy party.

”If we do not tackle this (illegal migration) problem, the numbers will only grow,” said Sunak.

“It will overwhelm our countries and our capacity to help those who actually need our help the most. If that requires us to update our laws and lead an international conversation to amend the post-war frameworks around asylum, then we must do that. Because if we don’t fix this problem now, the boats will keep coming and more lives will be lost at sea,” he said.

Sunak has made “stop the boats” a government pledge on the domestic front and has faced several hurdles in efforts to control the large numbers of migrants crossing the English Channel to enter the UK illegally.

”Criminal gangs will find ever cheaper ways to ply their evil trade. They will exploit our humanity. They think nothing of putting people’s lives at risk when they put them in these boats at sea,” he told the festival in Rome.

While in Italy, Sunak also held bilateral talks with counterpart Meloni during which tackling illegal migration was stated as a key area of discussion.

“They committed to continuing to strengthen the collective effort to fight criminal people smuggling gangs and ensure control of Europe’s borders,” Downing Street said in an official readout of the meeting.

“The Prime Minister and Prime Minister Meloni also discussed wider geopolitical issues, including the situation in Israel and Gaza and their unwavering support for Ukraine. They noted progress on cooperation on Artificial Intelligence following the UK summit and agreed to continue driving forward initiatives on AI safety,” the readout added.

During a trilateral between the UK, Italy and Albania, Downing Street said the leaders welcomed progress to date and agreed to intensify joint activity to tackle organised immigration crime, including law enforcement cooperation.

“They agreed that innovative structural solutions, like the UK’s Rwanda policy, were necessary to break the model of people smugglers and regain control of movement into and across Europe,” Downing Street said.

The Rwanda policy, which seeks to deport illegal migrants from the UK to the east African country while their asylum claims are assessed, survived a feared rebellion earlier this week when a new bill cleared its first stage in the House of Commons.

However, further hurdles are expected as the Rwanda Safety Bill, which gives ministers the right to disapply the UK’s Human Rights Act, progresses through further stages in Parliament in the new year.

The Ministry of Home Affairs (MHA) has directed all the Indian Police Service (IPS) officers across the country to submit their Immovable Property Return 2023 by January 31 next year.

The Ministry conveyed the direction in a written note circulated at the beginning of this week to the Chief Secretaries and the Director General of Police (DGP) of all state governments and Union Territories (UTs), stating, “The Immovable Property Return for the year 2023 is required to be filed online latest by January 31, 2024 at https://ips.gov.in or https: / /sparrow-ips.eoffice.gov.in by using existing nic-e-Mail ID and password.” The note with the header “Online filing of Immovable Property Return (IPR)-2023 by IPS officers” was issued on December 11 with a reminder that in terms of Rule 16 (2) of All India Services (Conduct) Rules, 1968, every member of the service shall submit his or her Immovable Property Return (IPR) in the prescribed form by January 31 every year in respect of the previous year ending December 31.”

In this connection, the note mentioned a ‘User Manual’ to facilitate filling up the online Immovable Property Return (IPR), which is available at the welcome page of SPARROW (Smart Performance Appraisal Report Recording Online Window). “The Immovable Property Return for the year 2023 online, after filing, is required to be authenticated by using the Digital Signature Certificate (DSC) already issued under SPARROW,” said the note.

“Immovable Property Returns filed in any other form shall not be accepted,” the note emphasised. It is clarified that filing of Immovable Property Return under Rule 16 of the All India Services (Conduct) Rule, 1968, by all IPS officers is mandatory, reads the note, adding, “In case the officer fails to submit the IPR (online) within the stipulated time limit, his/her vigilance clearance will be denied in terms of DoPT (Department of Personnel and Training) Office Memorandum No.104/76/2022-AVD.IA dated September 28, 2022.”

Furthermore, the MHA note reminded that as per DoPT notification dated December 30, 2021, timely submission of IPR has been made mandatory for appointments at the next level of pay in the pay matrix. “No request for condonation of delay in filing of IPR will be entertained by the Ministry of Home Affairs.” Stating all the pointers, the note further said, “It is requested that these instructions may widely be circulated to all concerned officers for strict compliance.”

“In case of any difficulty in accessing IPR module through SPARROW, the grievances may be sent to support-sparrow@nic.inor or sparrow.ips@nic.in,” said the note.

The University Grants Commission (UGC) will take action against all the EdTech companies offering degree and diploma courses in online mode in association with foreign universities, officials said on Saturday. In a public notice, the UGC said that no foreign higher educational institution can offer any programme in India without the prior approval of the commission.

This comes as the Delhi High Court in September directed the University Grants Commission (UGC) to take necessary action against the universities and colleges offering unspecified degrees and ensure compliance with the law, including penal provisions on the issue. The UGC notice dated December 12 mentioned that some EdTech companies are giving advertisements offering degree and diploma programmes in online modes in association with some foreign universities and institutions.

Such a franchisee arrangement is not permissible and any such programme or degree shall not have UGC recognition, the officials asserted. “Action will also be taken against all the defaulting EdTech companies as well as the HEls under applicable laws, rules, and regulations,” the notice mentioned.

The notice also mentioned that many higher-education institutions (HEIs) and colleges have entered into collaborative agreements and arrangements with foreign-based educational institutions and providers not recognised by the Commission and have been facilitating the issuance of degrees to the students enrolled in those institutions and colleges from such foreign-based educational institutions and educational providers. “Any such kind of collaboration or arrangement is not recognised by the University Grants Commission and accordingly, the degrees issued after such collaboration and arrangement are also not recognised by the Commission,” the notice mentioned.
