Supreme Court upholds abrogation of Article 370 and calls for polls by September next year 2

The Supreme Court on Monday upheld the government’s decision to abrogate Article 370, which bestowed special status on the erstwhile state of Jammu and Kashmir, and said steps should be taken to conduct elections in the assembly by September 30 next year. Writing the judgement for himself and Justices Gavai and Surya Kant, Chief Justice of India D Y Chandrachud said Article 370 of the Constitution was a temporary provision and the president has the power to revoke it.

The apex court also upheld the validity of the decision to carve out the union territory of Ladakh from Jammu and Kashmir in August 2019. The erstwhile state of Jammu and Kashmir does not have internal sovereignty different from other states of the country, he said. ”… all provisions of the Indian Constitution can be applied to J-K,” the CJI said. ”We hold the exercise of presidential power to issue constitutional order abrogating Article 370 of Constitution as valid,” the CJI said. Jammu and Kashmir became an integral part of India and this is evident from Articles 1 and 370, he said while pronouncing the judgment. “The Constituent Assembly of J&K was never intended to be permanent body,” the CJI stated. Article 370, which was abrogated on August 5, 2019, was an interim arrangement due to war conditions in the erstwhile state, Justice Chandrachud said.

The princely state had become an integral part of India and this is evident from Articles 1 and 370, the CJI said.

The bench comprising CJI D Y Chandrachud and Justices Gavai, Surya Kant, Sanjay Kishan Kaul, Sanjiv Khanna, assembled at 10.56 am to pronounce the three separate and concurring judgements Justices Kaul and Khanna wrote their judgments separately.

The apex court reserved its verdict in the matter on September 5 after a 16-day hearing on a batch of petitions challenging the abrogation of the provisions of Article 370.

The pronouncement of the verdict by the CJI is underway.

Once again, Nawab Malik brought the BJP into an awkward position 4

There is no ethics in politics. The BJP already lost its moral ground by aligning with Ajit Pawar. Just before the State Assembly polls, the BJP was eager to see Ajit Pawar in jail in connection with the alleged Rs 70,000 crore irrigation scam. And the next day, Sharad Pawar’s nephew took oath as deputy to CM Devendra Fadnavis, claiming the support of all NCP MLAs. He was once the main target of the BJP. In fact, before coming to power in 2014, Devendra Fadnavis gained popularity across the state by launching a scathing attack on Ajit Pawar, whose political life has been mired in corruption allegations since 2009. To tame Pawars, the so-called social activist Anjali Damania was made to quit the Aam Aadmi Party and chase the irrigation scam of Ajit; she was muted as soon as the BJP came to power in 2014. Now Damania has no problem with Ajit Pawar and all the other corrupt leaders in the state. Similarly, the BJP’s veteran leader, Kirit Somaiya, was very vocal about corrupt politicians until they joined hands with the BJP.

During the Maha Vikas Aghadi rule, Malik was on the front foot by trolling the BJP on various occasions, especially on the issue of Sushant Singh Rajput’s suicide and fake narcotics case. Mallik was very aggressive and somewhat successfully exposed the nexus of the BJP and Sameer Wankhede, then the Zonal Director of the Narcotics Control Bureau. Mallik gave him a good run and finally, Wankhede was transferred to Delhi. Mallik was not ready to settle when it came to counterattacking the BJP and its conspiracy. As a result, he was accused in an old land case. Malik was arrested in February 2022 by the Enforcement Directorate (ED) in a case allegedly linked to the activities of fugitive gangster Dawood Ibrahim and his associates. It was perhaps an attempt to silence Nawab.

There are talks in political corridors that Ajit Pawar has already bargained for Nawab’s release with Fadnavis before the alliance. Soon after his oath-taking ceremony, Nawab came out on medical bail in mid-August. Malik attended the winter session of the state legislature and was later seen in the office of the Ajit Pawar-led faction of the Nationalist Congress Party (NCP) in the legislature complex. In the House, he was seen sitting in the last row, next to an MLA of the Ajit Pawar faction. The Nawab entering the house has once again put Devendra in an awkward situation. In a letter to his cabinet colleague Ajit Pawar, expressing opposition to the induction of Nawab Malik in his group, Shiv Sena (UBT) MLC and LoP in Legislative Council Ambadas Danve, he asked the BJP leaders whether he would also oppose the induction of senior NCP leader Praful Patel in the Grand Alliance. Four floors of NCP leader Praful Patel’s Ceejay house in Mumbai were attached by ED in a case related to gangster Iqbal Mirchi, who was the right-hand man of Dawood Ibrahim.

Looking at the attacks from all sides, Maharashtra BJP chief Chandrashekar Bawankule defended Devendra Fadnavis over his objection to NCP MLA Nawab Malik’s inclusion in the ruling ‘Maha Yuti’ alliance. Bawankule said he and the Bharatiya Janata Party (BJP) support the stand taken by Fadnavis in this matter. Ajit Pawar and other NCP leaders who were on the radar of the ED and CBI are now in power. The BJP has conveniently forgotten the promises it made to the people of Maharashtra. All these while they were attacking Maha Vikas Aghadi as an “Auto Rikshaw” (three-wheel vehicle), now came in the same situation for the greed of power. The BJP joined hands with all corrupt leaders, including those who were under the ED scanner. If the BJP can stoop so low for power, they will certainly find some solution to induce Nawab Mallik into their government. Tomorrow, we may hear the news that he is out on bail and has been proven innocent by the court of law. After all, hurting the sentiments of aligned partners will now go in favour of the BJP. Fadnavis has already said that if the charges against Nawab are not proven, he must be welcomed. But when there are such allegations, it is not right to make him part of the grand coalition. Fadnavis had earlier in his speeches referred to Malik’s “Dawood” connection.

Time and again, Nawab Mallik gave tough times to the BJP and Devendra. It’s interesting to see what solution is drawn to induce Mallik into a grand alliance. Ajit will definitely not sacrifice his veteran leader for the BJP.

Supriya Sule slams BJP for 'insulting' Nawab Malik, says it has trapped Ajit Pawar group 10

NCP working president Supriya Sule has described the BJP as the “Bhrashta Jumla Party” and accused it of “insulting” former Maharashtra minister Nawab Malik and ”trapping” the Ajit Pawar group.

Reacting to Deputy Chief Minister Devendra Fadnavis’s letter to Ajit Pawar opposing Malik sitting on a treasury bench seat, Sule said, “I read that letter and the way Nawab Malik has been insulted is wrong.” Speaking to PTI on Thursday, she alleged that the BJP has turned into the “Bhrashta Jumla Party,” and they have ”trapped” the Ajit Pawar group.

Fadnavis on Thursday wrote to Ajit Pawar, conveying his reservation about including Malik, an accused in an ED case, in the ruling ‘Maha Yuti’ alliance.

Out on medical bail after the ED arrested him in February 2022 in a money-laundering probe, Malik attended the winter session of the state legislature here for the first time on Thursday and was later seen in the office of the Ajit Pawar-led faction of the Nationalist Congress Party (NCP) in the legislature complex. In the House, he was seen sitting in the last row, next to an MLA of the Ajit Pawar faction.

The opposition targeted the BJP, which is part of the government, pointing out that it had once dubbed Malik a ”traitor” after he faced allegations of doing a land deal in Mumbai with fugitive gangster Dawood Ibrahim’s aides. Malik himself has not yet made it clear whether he belongs to the Ajit Pawar faction or the Sharad Pawar-led NCP.

In his letter to Ajit Pawar, who too is a deputy CM, Fadnavis said Malik has the right to attend the assembly as an MLA and added that ”we (the BJP) do not harbour any personal animosity or grudge” against him.

“However, considering the kind of allegations he is facing, we are of the opinion that it would not be appropriate to induct him in the Maha Yuti,” the BJP leader said while also noting that Malik was out only on medical bail.

“We agree that it is your prerogative (to decide) who should be inducted in your party. But every constituent party (of the Maha Yuti) has to think as to whether it would harm the alliance. Hence, we are opposed to this,” Fadnavis added.

RBI retains repo rate at 6.5 pc for fifth time in a row 12

The Reserve Bank of India on Friday decided to keep the policy rate unchanged at 6.5 per cent for the fifth time in a row as it maintains a tight vigil on inflation.

The rate increase cycle was paused in April after six consecutive rate hikes, aggregating to 250 basis points since May 2022.

Announcing the bi-monthly monetary policy, RBI Governor Shaktikanta Das said the Monetary Policy Committee (MPC) unanimously decided to keep the repo rate unchanged at 6.5 per cent.

He said the MPC will remain ”actively disinflationary”.

According to him, the growth projection has been raised to 7 per cent for the current financial year from 6.5 per cent earlier.

The central bank projected consumer price-based inflation (CPI)-based retail inflation at 5.4 per cent for the current fiscal year.

The MPC meeting took place against the backdrop of inflation declining to 4.87 per cent in October. The November print of inflation is expected to be released next week.

The government has mandated the RBI to keep CPI inflation at 4 per cent with a margin of 2 per cent on either side.

Dog Bite Cases are on rise In Maharashtra, Mumbai tops the list with 41,828 dog bite cases in 2023. According to the civic body, it is important for people to avoid provoking dogs. If bitten, they should immediately seek medical assistance at civic dispensaries where anti-rabies vaccines are available. The doctor will assess the severity of the injury and determine the appropriate vaccine dosage. It is crucial not to overlook or disregard the need for vaccination.

The actual figure of dog bite cases could be higher as private hospitals, which treat a large number of such patients, often don’t report them to the BMC. viral disease that impacts the central nervous system, causing severe neurological symptoms and, ultimately, death. It spreads through the saliva of infected mammals, with transmission commonly occurring through bites. In 2017, a total of 75 people died due to rabies, decreasing to 66 in 2018. The numbers surged to 78 in 2019. During the Covid-19 pandemic, with limited outside movement, fatalities dropped to 35. In 2021, following the relaxation of Covid-19 restrictions, the numbers rose to 56. In 2022, fatalities stood at 51.

Insufficient resources for stray dog sterilization and vaccination, coupled with citizens limited first-aid training and delayed care after dog bites, contribute to the increasing rabies cases. From January till June, Maharashtra officially reported 3,89,065 dog bite cases. At 41,828, Mumbai has the highest share followed by Thane (36,060), Palghar (13,301) and Raigad (13,598) districts. The state tallied 17 fatalities in the same period.

The killing of Sukhdev Singh Gogamedi brings unrest in Rajasthan

The killing of Sukhdev Singh Gogamedi brings unrest in Rajasthan 18

On December 5, when the BJP was celebrating its massive win in assembly elections, Rajasthan was in festive mode. On the other hand, some goons killed Sukhdev Singh Gogamedi, a prominent Rajput leader from Rajasthan, who was sipping tea with four other men at his Jaipur residence around noon. While in the middle of a conversation, two of the men got up from their chairs and fired extensively at Gogamedi, leaving him in a pool of blood on the floor. Navin Shekhawat, a garment trader from Jaipur, the capital of Rajasthan, came to Gogamedi’s house with two youths. Sukhdev was sitting on one side of the sofa. There was a call on Sukhdev’s mobile. As soon as Sukhdev picked up the call, the two youth sitting right in front of Gogamedi opened fire. One of them returned again and gave the remaining bullets to Sukkhadriv. In spite of having personnel security, the shooters reached Gogamadi and killed him. The question arises about the involvement of security guards in the killing plot.

Sukhdev Singh Gogamedi is known as a strong leader of the Rajput community. Before his assassination, he was the president of the Rajasthani organisation Shree Rajput Karni Seva. He joined Karni Sena in 2013. He has been associated with this organisation since then. Sukhdev Singh Gogamedi is well respected in Rajput society and followed by the youth. In 2017, a woman accused Sukhdev Singh Gogamedi of rape and intimidation in Rajasthan’s Hanumangarh district. During this time, the victim also said that she was taken to various places by Sukhdev Singh to rape her. However, this case was later proven to be malicious in the police investigation.

The Rajput leader’s sensational murder, caught on CCTV, has sparked protests in Rajasthan, which is in the process of a regime change after the BJP unseated the ruling Ashok Gehlot-led Congress government in the recently held assembly elections in the state. Police have identified two accused in the case. Among them, one shooter is Rohit from Makrana and the other is Nitin Fauji, a resident of Mahendragarh in Haryana. Nitin is still in the army. He shot Gogamedi in the head. After the murder of Sukhdev Singh Gogamedi, a Facebook page created under the name of gangster Rohit Godara took responsibility for the murder.

In the Facebook post, it was written: Ram Ram, all my brothers, Rohit Godara Kapoor, and Goldie Brar. Brothers, today Sukhdev Gogamedi was killed. We take full responsibility for it. This murder was done by us. Brothers, I want to tell you that he used to compromise with our enemies. He used to work to strengthen them. It is being said that Nitin will be home on vacation in November. After killing Gogamedi with the first bullet, one of the shooters allegedly fired the second bullet at Naveen. It is being said that Rohit Rathore Makrana and Nitin Fauji Haryana are the two shooters who escaped. However, no official confirmation has come from the police so far.

Sukhdev Singh Gogamedi is known for many controversies. Gogamedi’s rise to fame led to protests against the Deepika Padukone, Ranveer Singh, and Shahid Kapoor-starrer 2018 Bollywood film ‘Padmavat’. Rajput groups in Rajasthan, including the Gogamedi-led group, protested and vandalised the sets of the film, claiming it portrayed Padmavati, a Rajput queen, in a bad light. The film’s director, Sanjay Leela Bhansali, was assaulted at Shri Rashtriya Rajput Karni Sena Jaipur’s Jaigarh Fort. The protests made national headlines when a bounty of ₹ 10 crore was placed on Deepika Padukone by a member of another Karni Sena group.

Gogamedi also protested against the police encounter with gangster Anand Pal Singh. Singh’s death became a rallying point for Rajputs in the state, who claimed that the gangster wanted to surrender but was shot dead by the police in cold blood. During the exchange of fire at Gogamedi’s residence, one of the three shooters, identified as Naveen Singh Shekhawat, was also killed. A security guard at Gogamedi was critically injured in the firing. Gangster Rohit Godara is closely associated with both Goldie Brar and Lawrence Bishnoi’s gangs and has claimed responsibility for the murder.

Godara, a resident of Bikaner’s Lunakaran, is believed to be in Canada. He has over 32 cases registered against him at various police stations in India. The Special Operation Group of the Rajasthan Police also alerted the ADG Police Security. Gogamedi himself also raised concerns about threats and demanded security everywhere, from public forums to government offices. During this period, weapons were collected from private security in anticipation of the elections. This issue raises questions about fatal negligence or a conspiracy within the government machinery. The main question remains: Why was he not provided with security?

Every other day Mumbai sees fire incident: HC raps Maharashtra govt; says laxness cannot be accepted

Every other day there is a fire incident in Mumbai in which people lose their lives, the Bombay High Court said on Wednesday, pulling up the Maharashtra government for dragging its feet on implementation of fire safety rules and regulations.

A division bench of Chief Justice D K Upadhyaya and Justice Arif Doctor said this was a ”very very serious” issue and ”no laxness can be accepted”.

”Fire incidents appear to be on a rise. Every other day in this city there is a fire incident and there are reports of people losing their lives,” CJ Upadhyaya said.

The court said it was not its job to keep prompting the government on what steps need to be taken.

”This is not done. Are we sitting here to prompt you (the government) for every action? Is this our job? What is all this happening here?” CJ Upadhyaya said.

The bench referred to the fire incident that occurred recently in a four-story residential building in south Mumbai, where an 82-year-old woman and her 60-year-old son lost their lives.

”The manner in which these two deaths have occurred…is this what you (government) want for the people in this city…to lose their loved family members like this?” CJ Upadhyaya asked.

Additional government pleader Jyoti Chavan informed the court that an expert committee, formed last year, had in February 2023 submitted its report.
