The search and rescue operation by the Indian Army for the 22 missing soldiers continues. Meanwhile, troops of the Trishakti Corps are extending medical aid and telephone connectivity to civilians and tourists stranded in the areas of Chungthang, Lachung, and Lachen in North Sikkim.

As per reports, continued efforts are being made to dig out the vehicles submerged under the slush at Burdang, near Singtam. The search for the missing people is now focused on the areas downstream of the Teesta River. Out of the initial 23 missing persons, one was recovered alive on the evening of October 4.

The family members of the missing persons have been contacted and informed about the situation. All other Indian Army personnel posted in Sikkim and North Bengal are safe and they are unable to contact their family members due to disruptions in mobile communication.

The disaster operations are being carried out in the state by the Indian Air Force.

Wing Commander Irfan Jairal Commanding officer of Helicopter unit in Jammu said that people of Sikkim should have faith in the airforce and people will be saved.

The Air Force said different equipment was being used during the disaster operations and that the great challenge was that there was no place to land. Equipment like special leadders, oxygen, water boats, cradles to lift people and slings used in the operations are being transported to Sikkim. The MI-17 1V helicopters are specially modified for disaster operations, with strechers being used inside the helicopter.

The National Crisis Management Committee (NCMC), under Chairmanship of Cabinet Secretary Shri Rajiv Gauba, met on Wednesday and reviewed the situation in Sikkim. National Disaster Response Force (NDRF) has already deployed three teams and additional teams are on standby in Guwahati and Patna.

The Sikkim Government on Wednesday confirmed that 14 people have died so far in the flash floods that occurred in Sikkim in the early hours of Wednesday. The 14 deceased are all civilians while 102 people are still missing. Over 3,000 tourists are feared to be stranded in different parts of the State.

12–14 workers working in the Teesta Stage 3 dam in Chungthang are still stranded in the tunnels of the dam.

Injuries and persons missing have been reported from Chungthang in Mangan district, Dikchu, Singtam in Gangtok district and Rangpo in Pakyong district.

Actor and politician Pawan Kalyan said on Thursday that he has come out of the BJP-led NDA to support the TDP during difficult times.

He said that Janasena TDP is needed for good governance and development of Andhra Pradesh.

“TDP is a strong party and Andhra Pradesh needs the Telugu Desam Party for good governance, for the development of the state. Today TDP is in a struggle we will support them. TDP needs Janasainks young blood support in this situation.

“If TDP and Janasena join hands YSRCP will be submerged in the state,” Pavan Kalyan said in a public meeting held at Pedana, in Krishna District.

On September 14, Pawan Kalyan had visited Chandrababu Naidu in the Rajahmundry Central Jail where the latter has been lodged after he was sent to Judicial custody in a “skill development scam”.

Janasena party chief Pawan Kalyan had attended a meeting of the NDA held in Delhi on July 18.

Speaking after the meeting the actor, politician said that his party would support PM Modi’s vision.

“The entire meeting was extremely good and we discussed Atmanirbhar Bharat, skill India. And from our (party) side I promised PM Modi that we will stand by his vision and we will give our best” Pawan Kalyan had said.

Pawan Kalyan had also proposed an alliance of TDP, BJP, and his party in Andhra Pradesh) to fight YS Jagan Mohan Reddy’s YSRCP in Andhra Pradesh. The BJP had yet to make a decision on this.

Now Pawan Kalyan has decided that his party will no longer be part of the NDA.

In the last assembly election in Andhra Pradesh in 2019, Pawan Kalyan’s Janasena had won just one seat with 5.6% vote share while the TDP had won 23 seats with 39.7% vote share. YSRCP swept the polls winning 151 seats with 50.6% vote share.

Meanwhile TDP supremo Chandrababu Naidu continues to be in judicial custody. The ACB Court on Wednesday had adjourned the hearings on the bail and custody petitions of Chandrababu Naidu in the Skill Development case till October 5, Pramod Dhube, his advocate said.

“Arguments were heard from both sides in today’s sessions,” he had said.

The former Andhra Pradesh chief minister and TDP chief was arrested by the Criminal Investigation Department (CID) on September 9 in connection with the multi-crore skill development scam case.

TDP National General Secretary Nara Lokesh Tuesday said the Andhra Pradesh Chief Minister was implicating Opposition leaders in false cases and his father’s arrest was nothing but a political witch-hunt.

While condoling the loss of lives in the Sikkim cloudburst and subsequent flash floods, Congress President Mallikarjun Kharge on Thursday said that such tragedies, also including the recent rain-related calamities in Himachal Pradesh, should be declared as national disasters by the Centre.

In a lengthy post on X, Kharge said: “The situation in Sikkim is precarious as several people have lost their lives and many including our brave Army personnel are missing due to cloudburst and flash floods. Our thoughts are with the people of Sikkim who are battling these distressing times.”

The Congress president went on to say that the Centre “must do everything possible to rescue people in safer locations and find the missing persons, whose count is reportedly steadily increasing”.

“A lot of damage has been done to the infrastructure, and the Union and the state governments must work together in the medium and long term to rebuild this beautiful state.”

He also said that the Congress and workers will provide help in “all possible ways in this humanitarian crisis”.

Drawing a similarity, Kharge said that the Centre “must recalibrate its strategy in dealing with ecologically fragile Himalayan states and must declare such tragedies, like Sikkim and Himachal Pradesh, as national disasters so that these states get adequate funds to rebuild themselves in a more sustainable manner”.

On Wednesday, the Defence PRO in Guwahati said that one soldier has been rescued so far while search and rescue operation by the Army continued for the remaining 22 soldiers who went missing after the sudden cloudburst over the Lhonak Lake in north Sikkim. Release of water from the Chungthang dam led to further sudden increase in water level upto 15-20 feet high downstream, the Army spokesman said.

“Sudden increase in water level has led to Army vehicles parked at Bardang near Singtam getting affected,” he said. The Sikkim State Disaster Management Authority has said that in Pakyong district, 59 people including 23 Army personnel have been reported missing, while at least five people were confirmed dead. The National Disaster Response Force has deployed three teams in the affected areas and rescued many people.

The Enforcement Directorate on Wednesday arrested Aam Aadmi Party Rajya Sabha member Sanjay Singh in connection with the Delhi excise policy case, officials said.

This comes after the agency conducted searches at his residence earlier in the day in connection with the case.

The officials said premises belonging to some others connected to the case were also covered during the operation.

The ED had earlier questioned the members of staff and those linked to the 51-year-old Rajya Sabha MP.

It is alleged that the Delhi government’s excise policy for 2021-22 to grant licences to liquor traders allowed cartelisation and favoured certain dealers who had allegedly paid bribes for it, a charge strongly refuted by the AAP. The policy was subsequently scrapped and the Delhi lieutenant governor recommended a CBI probe, following which the ED registered a case under the PMLA.

The three-day bi-monthly monetary policy committee (MPC) meeting of the RBI started on Wednesday, with financial market participants set to closely monitor the outcome and the policy stance of the central bank.

The RBI typically conducts six bi-monthly meetings in a financial year, where it deliberates interest rates, money supply, inflation outlook, and various macroeconomic indicators. According to SBI Research, the Indian central bank is expected to yet again pause the key repo rate this week.

“Domestically, we believe at 6.50 per cent, we are in for a prolonged pause as seasonality of inflation is tapering first…,” SBI Research report, authored by Soumya Kanti Ghosh, Group Chief Economic Adviser, said recently. “We believe the (RBI’s) stance should continue to be withdrawal of accommodation as inflation is unlikely to tread below 5 per cent in rest of 2023-24,” the SBI Research report said.

RBI in its past three meetings – April, June, and August — held the repo rate unchanged at 6.5 per cent. The repo rate is the rate of interest at which RBI lends to other banks. Rating agency Crisil too believed the monetary policy committee would again hold the policy rate in the October meeting.

A 25 basis point rate cut in early 2024 is a conditional possibility for now, it asserted in an August report titled ‘RateView – CRISIL’s outlook on near-term rates’. Informerics Ratings is also of the view that the RBI will keep repo rate unchanged for the fourth successive time.

With sticky retail inflation – breaching the MPC’s upper threshold of 6 per cent and the US Fed’s persisting hawkish stance, the RBI is likely to keep the repo rate unchanged for the fourth time.

A relative decline in inflation, barring the latest spike, and its potential for further decline may have prompted the central bank to put the brake on the key interest rate.

Inflation has been a concern for many countries, including advanced economies, but India has managed to steer its inflation trajectory quite well. Barring the latest third straight pause, the RBI raised the repo rate by 250 basis points cumulatively to 6.5 per cent since May 2022 in the fight against inflation.

Raising interest rates is a monetary policy instrument that typically helps suppress demand in the economy, thereby helping the inflation rate decline. Headline inflation in India rose to 7.8 per cent in July due to a surge in prices of food items like wheat, rice and vegetables, to later fall to 6.8 per cent in August.

After the August monetary policy meeting, the RBI upwardly revised the country’s retail inflation projections for 2023-24 at 5.4 per cent, against the 5.1 per cent it projected in its previous monetary policy meeting in June.

A “substantial increase” in headline inflation would occur in the near term, RBI Governor Shaktikanta Das had said as part of his remarks after the policy meeting.

He reiterated what he said after the June meeting – “Bringing headline inflation within the tolerance band is not enough; we need to remain firmly focused on aligning inflation to the target of 4.0 per cent.” The outcome of the central bank’s meeting will be announced on Friday morning.

North Korea slammed the United States over a recent Pentagon report that labelled it a “persistent” threat because of weapons of mass destruction, saying it will counter any US aggression or provocations with “the most overwhelming and sustained response strategy.”

Last week, the Pentagon released the unclassified version of its “2023 Strategy for Countering Weapons of Mass Destruction” describing WMD challenges and methods to address them.

The report stated that while China and Russia present “the principal WMD challenges,” North Korea, Iran and violent extremist organisations remain “persistent regional threats” that must also be addressed.

Such US descriptions of North Korea and the North’s angry response aren’t unusual. But the latest exchange comes as concerns grow that North Korea is pushing for a weapons transfer deal with Russia in violation of UN Security Council resolutions.

“The US has just revealed its dangerous intention for aggression to seriously violate the sovereignty and security of (North Korea) and other independent sovereign states by threatening them with WMDs, and realize its wild ambition for seizing global military hegemony,” an unidentified spokesperson for North Korea’s Defence Ministry said in a statement carried by state media.

North Korea’s military will “counter the US imperialist aggressor’s military strategy and provocations with the most overwhelming and sustained response strategy,” the statement said.

North Korea’s nuclear programme has taken on new urgency since it enacted a law last year that authorises pre-emptive use of nuclear weapons.

Since the beginning of 2022, North Korea has conducted more than 100 missile tests, many of them involving nuclear-capable weapons potentially able to target the US and South Korea.

Last week, North Korea’s parliament amended the country’s constitution to include the nuclear law, an indication that the North is further boosting its nuclear doctrine.

During the parliament meeting, leader Kim Jong Un called for an exponential increase in the production of nuclear weapons and for his country to play a larger role in a coalition of nations confronting the United States in a “new Cold War.”

South Korea’s Defence Ministry warned in a statement on Wednesday that any attempt by North Korea to use nuclear weapons would result in the end of the Kim government. It said North Korea’s inclusion of the nuclear law in its constitution will further deepen its international isolation and the suffering of its people.

The Pentagon report cited the North Korean nuclear law in explaining its security threat. The report said North Korea is developing mobile nuclear capabilities that place the US homeland and regional allies and partners at risk.

The report also said North Korea maintains up to several thousand metric tons of chemical warfare agents and the capability to produce nerve, blister, and choking agents. It said North Korea’s potential chemical deployment methods include artillery, ballistic missiles, and unconventional forces.

The US and South Korea have been responding to North Korea’s advancing nuclear arsenal with expanded joint military exercises and temporary deployments of US long-range bombers and a nuclear-armed submarine. North Korea calls such moves grave provocations that force it to further strengthen its nuclear programme.

North Korea’s Defence Ministry said in the statement that the term “persistent threat” is more suitable for the US, citing its intensifying military drills with South Korea and the deployment of the nuclear-armed submarine that it said carried weapons “large enough to totally destroy one state.”

In September, Kim travelled to Russia’s far eastern region to meet with President Vladimir Putin and visit key military sites. North Korea and Russia said the trip was meant to boost their cooperation but neither side disclosed details.

Foreign officials and experts believe North Korea hopes to obtain advanced Russian technologies to help it develop spy satellites, nuclear-propelled submarines and powerful long-range missiles in return for supplying Russia with conventional arms exhausted by its war with Ukraine.

The Enforcement Directorate (ED) has summoned Trinamool Congress national general secretary Abhishek Banerjee to appear before its officers on October 9 in connection with their probe into the alleged irregularities in the West Bengal teacher recruitment scam, a senior official said on Wednesday.

The probe agency also summoned Banerjee’s wife, Rujira for questioning on October 11, the official added.

“Our officers will question Banerjee on October 9 and his wife on October 11 in connection with the school jobs scam. Both have been asked to come to our office at the CGO Complex,” the officer told PTI over the phone.

Earlier, the ED had summoned the TMC leader’s parents, Amit and Lata Banerjee, to appear before its officers this week in the same case.

The Diamond Harbour MP, who was asked by ED to appear before it on October 3, had skipped the summons and participated in the party’s protest rally in New Delhi against the BJP-led central government, demanding immediate release of central funds allegedly owed to the state.

The Bombay High Court on Wednesday took suo motu (on its own) cognizance of the deaths at the state government-run hospitals at Nanded and Chhatrapati Sambhajinagar and sought details from the Maharashtra government.

A division bench of Chief Justice D K Upadhyaya and Justice Arif Doctor asked Advocate General Birendra Saraf, appearing for the state government, to submit to the bench details about the state’s budgetary allocation for health on Thursday. Earlier in the day, an advocate, Mohit Khanna, had submitted a letter to the bench requesting it to take suo motu cognizance of the deaths.

The bench initially directed Khanna to file a petition and said it wanted to issue effective orders. It also asked the advocate to gather data regarding vacancies in hospitals, the availability of medicine, the percentage (of funds) the government is spending and so on.

However, in the afternoon session, the bench said it was taking suo motu cognizance of the issue, noting that reasons given by the doctors at the hospitals citing shortages of beds, staff, and essential medicines cannot be accepted. The HC said it would hear the matter on Thursday.

Khanna stated in his letter that 31 deaths, including those of infants, were recorded at the Dr Shankarrao Chavan Government Medical College and Hospital in Nanded in 48 hours since September 30.

The letter also mentioned that the deaths of 18 patients, including infants, were recorded between October 2 and 3 at the Government Medical College and Hospital at Chhatrapati Sambhajinagar.

A seven-judge bench of the Supreme Court on Wednesday said it will deal with the issue of whether immunity granted to lawmakers is available if there was criminality attached to their acts.

The bench, headed by Chief Justice D Y Chandrachud, commenced hearings to reconsider the apex court’s 1998 verdict granting MPs and MLAs immunity from prosecution for taking bribes to make a speech or vote in Parliament and state legislatures.

“We have to deal with the immunity as well and decide a narrow issue — can the immunity (to the lawmakers) be attached when there is an element of criminality,” a constitution bench headed by Chief Justice D Y Chandrachud said.

Solicitor General Tushar Mehta, at the outset, said that possibly the controversy can be narrowed down in view of the fact that the offense of bribery is complete when a bribe is given and accepted by the lawmaker.

Now whether the lawmaker performs the criminal act is irrelevant to the question of criminality and it is a question under the Prevention of Corruption Act rather than under Article 105, which deals with the immunity available to the lawmakers, the law officer said.

The bench, referring to the 1998 judgment, said it was held that irrespective of the criminality, immunity is available to the lawmakers.

“We will ultimately have to deal with the issue of immunity,” said the bench, which also comprised justices A S Bopanna, M M Sundresh, P S Narasimha, J B Pardiwala, Sanjay Kumar, and Manoj Misra.

Nearly 25 years after the JMM bribery scandal rocked the country, the apex court on September 20 agreed to reconsider its 1998 judgment, saying it was an important issue having a significant bearing on “the morality of polity.”

A five-judge bench of the apex court had decided to refer the issue to a larger seven-judge bench.

The top court, in its 1998 five-judge constitution bench verdict delivered in the PV Narasimha Rao versus CBI case, held that parliamentarians have immunity under the Constitution against criminal prosecution for any speech made and vote cast inside the House as per Article 105(2) and Article 194(2) of the Constitution.

Article 105(2) of the Constitution stipulates that no member of Parliament shall be liable to any proceedings in court in respect of anything said or any vote cast in Parliament or any committee thereof.

A similar provision exists for MLAs under Article 194(2).

In 2019, a bench headed by then chief justice Ranjan Gogoi, which was hearing an appeal filed by Sita Soren, JMM MLA from Jama and daughter-in-law of party chief Shibu Soren, who was accused in the JMM bribery scandal, referred the crucial question to a five-judge bench, noting it had “wide ramification” and was of “substantial public importance”.

Sita Soren was accused of taking bribes to vote for a particular candidate in the Rajya Sabha election in 2012. She had contended that the constitutional provision granting lawmakers immunity from prosecution, which saw her father-in-law being let off the hook in the JMM bribery scandal, be applied to her.

The three-judge bench had then said it would revisit its verdict in the sensational JMM bribery case involving Shibu Soren, a former Jharkhand chief minister and ex-union minister, and four other party MPs who had allegedly accepted bribes to vote against the no-confidence motion challenging the survival of the P V Narasimha Rao government in 1993.

The Narasimha Rao government, which was in a minority, survived the no-confidence vote with their support.

The CBI registered a case against Soren and four other JMM Lok Sabha MPs but the Supreme Court quashed it, citing the immunity from prosecution they enjoyed under Article 105(2) of the Constitution.

Sita Soren had appealed against the Jharkhand High Court order of February 17, 2014, refusing to quash a criminal case lodged against her. The CBI had accused her of accepting bribes from one candidate and voting for another.

The Bihar constable recruitment examination, which was held on October 1, has been cancelled due to a paper leak, according to an official statement.

The Central Selection Board of Constables (CSBC) said on Tuesday that dishonest candidates were caught cheating during the examination.

“There were complaints of using electronic devices and other fraudulent methods by the candidates at certain centres. As a result, the exam has been postponed until further notice. The individuals who were caught cheating were arrested on the spot,” the CSBC statement said.

A lot of complaints regarding irregularities in the examination were received by the board, it said, adding that the sanctity of the examination was lost, which led to the cancellation of the October 1 test.

“Further, the examinations scheduled for October 7 and October 15 have also been postponed until further notice,” the statement said.

Disturbing reports emerged that some candidates had access to the exam answers through mobile devices and other illicit means.

Many were caught red-handed with handwritten answer sheets, the CSBC said.

The matter is being investigated by the Economic Offence Unit (EOU) of the Bihar Police.

The EOU has so far registered a total of 67 FIRs in 21 districts and arrested 148 people for their alleged role in the leak of question papers.

Talking to reporters here on Tuesday, Nayyar Hasnain Khan, Additional Director General (ADG) of the Economic Offences Unit (EOU) of the Bihar Police said, “EOU sleuths have seized several electronic devices from the possession of the arrested accused, and those are being scrutinised and analysed.

More arrests are expected by the EOU in the coming days in this regard.” Bihar Police Constable 2023 recruitment was scheduled to fill up 21,391 vacancies in different wings of the state police.

The examination was conducted at 529 centres in 37 districts and a large number of aspirants had appeared.
