Government stays sentence of cops in Lakhan Bhaiya encounter case

The Maharashtra government has stayed the jail sentence of the 11 cops, convicted in the Lakhan Bhaiya fake encounter case of 2006, for six months, prompting to their immediate release.

The policemen were convicted by the Mumbai Sessions Court in July, 2013, and are currently serving life imprisonment at the Thane Central Jail.

Following the decision, all the 11 convicts will walk out of the jail with immediate effect.

According to a circular issued by Home Department on Wednesday, the stay for six months will start from the day, the convicts walk out of the prison.

The conditions also said that the convicted cops will not meet witnesses in the case and family members of Ramnarayan Vishwanath Gupta alias Lakhan Bhaiya to intimidate them. They will behave well and not commit any crime during the six-month period.

Lakhan Bhaiya was considered to be underworld don Chhota Rajan’s close aide. Four days after his killing on November 11, 2006, his brother moved the Bombay High Court alleging that Bhaiya was killed in cold blood by the Mumbai Police.

“The convicts will have to surrender their passports and personal weapons in the police station. If they want to convert or change their names during the six month period, prior permission of the government will be required. The government will have the powers to lift the six month stay without informing the convicts.”

“Similarly, if the High Court upholds the Sessions court verdict against them, the six month stay will be lifted. Also, the government can cancel the stay if the convicts violate any of the conditions,” the circular said.

The 11 convicts include — Dilip Sitaram Palande, Nitin Gorakhnath Sartape, Ganesh Ankush Harpude, Anand Balaji Patade, Prakash Ganpat Kadam, Devidas Gangaram Sakpal, Pandurang Ganpat Kokam, Ratnakar Gautam Kamble, Sandeep Hemraj Sardar, Tanaji Bhausaheb Desai, Vinayak Balasaheb Shinde.

It said that all the convicts had made an application to the government about granting them relief.

The government before taking a decision on the stay on the jail sentence, sought opinion of the Sessions court, National Human Rights Commission, collector and district magistrate Mumbai suburbs, Police Commissioner of Mumbai and IG prisons.

Pistorious-Steenkamp: Tragic end of beautiful love story

A beautiful love story came to an end with a very unfortunate note. No one knows what exactly happened on that day. Even, one cannot imagine how the couple landed in such a painful scenario. With various legal arguments, if one has to believe, then Pistorius, 29, killed Steenkamp in the early morning of Valentine’s Day. He insisted that he thought she was an intruder behind the door of a toilet cubicle in his home. The prosecution said Pistorius shot Ms Steenkamp during an argument. Justice Leach said regardless of who might have been behind the door, Pistorius should have known someone could be killed if he fired. Under the concept of “dolus eventualis” in South African law, a person can be convicted of murder if they foresaw the possibility of someone dying through their actions and went ahead anyway. A date for Pistorius’s new sentencing will be announced in the city of Pretoria, where he had been tried and imprisoned. Reeva Rebecca Steenkamp was a South African model.

Pistorius, a young man overcomes huge physical disabilities to reach Olympian heights as an athlete. He meets a young woman of great natural beauty and a successful model. Romance blossoms and then ironically, on Valentine’s Day, all is destroyed when he takes her life. Pistorius could receive between 15 and 20 years for murder, although his sentence already served will be deducted. Under South African law, he will serve at least half of the sentence issued. It is also understood that Pistorius has one more possible avenue of appeal – the Constitutional Court. The judgement of this court is based on the constitution and is required to consider international human rights.

Pistorius, a multiple Paralympic champion, became one of the world’s most famous athletes and the first amputee to run at the Olympics and the able-bodied world championships. He was known as “Blade Runner” for his carbon-fibre running blades. The case has prompted a fierce debate in a country beset by high levels of violent crime. Some rights groups say the white track star – dubbed “Blade Runner” because of the carbon fibre prosthetic blades he uses to race – got preferential treatment. Although, both of Pistorius’ legs were amputated below the knee when he was 11 months old, he has competed in events for single below-knee amputees and for able-bodied athletes. After becoming a Paralympic champion, Pistorius attempted to enter able-bodied international competition, over persistent objections of the IAAF and charges that his artificial limbs gave an unfair advantage. Pistorius eventually prevailed in this legal dispute. At the 2011 World Championships in Athletics, Pistorius became the first amputee to win an able-bodied world track medal. At the 2012 Summer Olympics, Pistorius became the first double leg amputee to participate in the Olympics when he entered the men’s 400 metres and 4 × 400 metres relay races. At the 2012 Summer Paralympics, Pistorius won gold medals in the men’s 400-metre race and in the 4 × 100 metres relay, setting world records in both events. He also bagged silver in the 200-metre race, having set a world record in the semifinal.

On Valentine’s Day 2013, Pistorius fatally shot his girlfriend in his Pretoria home. At his trial the following year, Pistorius was found guilty of culpable homicide. He received a five-year prison sentence for culpable homicide and a concurrent three-year suspended prison sentence for a separate reckless endangerment conviction. In November 2014, prosecutors asked the sentencing judge for permission to appeal the verdict. Permission was granted in December, and the case was presented to a five-person panel at the Supreme Court of Appeal. His release from prison to house arrest was announced on 21 August 2015. On 15 October 2015, it was confirmed that Pistorius was to be released from prison on 20 October 2015, however, he was released on 19 October 2015. On December 3, 2015, a South African appeals court overturned Pistorius’ culpable homicide conviction and found him guilty of murder in the death of Reeva Steenkamp. His new sentence will be decided when the high court reconvenes in mid-January, 2016.

BJP, RSS have no faith in ‘Ram’, they only believe in slogan shouting: Nitish Kumar

NitisA day after Rashtriya Swayamsevak Sangh chief Mohan Bhagwat hoped that the construction of Ram temple might be completed in his lifetime; Bihar Chief Minister Nitish Kumar on Thursday said that raking up the ‘mandir’ issue is just a ploy of Bharatiya Janata Party and the RSS to make political gains.

The Janata Dal (United) leader said, “Both the BJP and RSS only believe in the slogan ‘Ram lala hum layenge, mandir wahin banayenge’,” adding that both the groups would never announce the date for the construction of the Ram temple in Ayodhya.

Nitish further accused the BJP and RSS of not having any faith in Lord Ram and said that both want the temple row to keep burning for the sake of political gains.

“By giving political colour to the Ram temple issue, sentiments have been inflamed till date,” the Bihar CM asserted.

Meanwhile, Congress leader Digvijay Singh also accused the BJP and RSS of raking the Ram Mandir issue for political gains.

Nitish’s comments came a day after Bhagwat said, “The grand goal may be realised in our own time. May be we can see it with our own eyes. None can say when and how the temple will be constructed, but we need to be prepared and ready.”

Osmania University shows the way: ‘Nothing academic in beef festival’

Caught in the eye of a bitter storm over a ‘beef festival’ scheduled to be held on December 10, the Osmania University has finally called off the event, saying that the varsity is a ‘seat of learning’ and there is ‘nothing academic’ in the proposed event.

A release from the Public Relations Officer of the Osmania University said, “Primary objective of the University is purely academic and research oriented. It is therefore informed to all the concerned including the teachers, students and staff that activities such as beef festival, go-puja which are unrelated to the academics and research will not be permitted on the campus.”

The announcement was made by the authorities on Wednesday evening, making it clear that no “beef festival” would be allowed to be organised on the varsity campus.

Husband can’t divorce wife if she is terminally ill, rules Supreme Court

In a judgement that will protect women in need of medical attention, the Supreme Court on Wednesday ruled that a husband cannot be allowed to separate from his wife if she is terminally ill.

According to the apex court ruling, the couple cannot be granted divorce even under mutual consent if woman partner is terminally ill.

The Supreme Court bench headed by MY Eqbal said the plea for divorce can be accepted only when the wife has recovered.

While passing the judgement, the court advised husbands to stand by their wives in their difficult times as in Hinduism, a wife considers her husband as God.

The court disallowed the divorce plea after it was informed that the wife was suffering from advance stage of cancer and needed immediate medical care.

The wife had, however, earlier given her consent for divorce after her husband agreed to pay Rs 12.5 lakh as alimony to her.

“Hindu marriage is a sacred and holy union of husband and wife by virtue of which the wife is completely transplanted in the household of her husband and takes a new birth. It is a combination of bone to bone and flesh to flesh. To a Hindu wife her husband is her God and her life becomes one of the selfless service and profound dedication to her husband. She not only shares the life and love, but the joys and sorrows, the troubles and tribulation of her husband and becomes an integral part of her husband’s life and activities” the bench said, as per The Times of India.

“It is evident that the wife needs sufficient amount of money for the treatment of breast cancer. Hence, it cannot be ruled out that in order to save her life by getting money, she agreed for a settlement of dissolution of marriage,” it said.

Govt to start electronic transfer of MGNREGA wages from 2016

To prevent leakages in the MGNREGA programme, the government will introduce the system for electronic transfer of wages to the beneficiaries from January 1 next year in Kerala; Lok Sabha was informed on Thursday.

An additional Rs. 2,000 crore would be sought from the Finance Ministry towards ensuring that MNREGA wages are at par with the agriculture wages fixed by some states, Rural Development Minister Birender Singh said.

Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA) provides 100 days of employment to registered workers on their demand.

During Question Hour, Singh said electronic transfer of wages under MNREGA would be introduced in Kerala from January 1, 2016. “If it is successful, we will introduce it (e-transfer of wages) in other states,” he noted.

According to him, there are around 11 crore accounts and out of them, 65 per cent are in banks and the remaining in post offices.

Noting that MNREGA is a demand-driven wage employment programme, the Minister said various modalities have been put in place to prevent leakages in the scheme.

To avoid bogus attendance as well as instances of tampering and misuse of muster rolls, the e-Muster system has been introduced. For smooth fund flow, the electronic Fund Management System (e-FMS) has been made mandatory from April 1 this year, the Minister said.

Responding to a query about low wages being paid under MNREGA, Singh said the government wants the wage amount to be equal to that fixed by respective states. In this regard, the Ministry would seek Rs. 2,000 crore from the Finance Ministry, he added.

Solar panel scam: Sexual favours allegations pained me, says Oommen Chandy

Pained at charges that he sought sexual favours in the Rs. 6 crore solar panel scam, Kerala Chief Minister Oommen Chandy on Thursday said his “conscience is clear”.

Biju Radhakrishnan, prime accused in the scam, while testifying before the judicial probe committee, said on Wednesday that he had given Rs. 5.50 crore as bribe to Chandy.

He also said he was in possession of a video showing Saritha Nair, the second accused in the scam, in a compromising position with Chandy and another video of Nair, again in a compromising position, with two cabinet colleagues of Chandy.

The Left opposition led by senior CPI-M legislator E.P. Jayarajan raised the issue in the house on Thursday.

To this, Chandy responded: “My conscience is clear. I will not fall a victim to blackmail politics and I will walk with my head held high… it (the allegations) has pained me. I have done nothing wrong.”

He said the judicial commission was probing the scam which surfaced in 2013 and that he will take legal steps against the fresh allegations.

Chandy said there is no truth in the accusations made by Radhakrishnan, an accused in a murder case and in 58 other cases of cheating.

“Radhakrishnan is angry towards my government because we started a probe into the murder of his wife in which he (Radhakrishnan) is an accused,” Chandy said.

Soon, Labour Minister Shibhu Baby John was also on his feet and said he was hurt when his name was dragged in the scam.

“Yesterday, when my name came, it hurt me… I wish to place on record that if it’s proved that I have ever met this person (Saritha Nair) or even made a telephone call, I will resign as minister and quit public life,” he said.

When Speaker N. Sakthan disallowed an adjournment motion, the entire opposition was up in arms and trooped near the speaker’s chair, shouting slogans. The Speaker then adjourned the house for the day.

After AAP leaders, Bhushan meets Anna over Janlokpal Bill

Former AAP leader Prashant Bhushan on Thursday took his fight against Arvind Kejriwal government’s Janlokpal Bill to veteran activist Anna Hazare, whom the AAP had approached earlier this week.

Both the ruling Aam Aadmi Party and Swaraj Abhiyan, a group led by expelled party leaders Bhushan and Yogendra Yadav, are hoping to get Hazare on their side to get an upper hand in the ongoing tussle.

Hazare has already supported the proposed legislation, which has been tabled by the Delhi government in the Assembly, albeit with riders.

The activist-lawyer met Hazare at the latter’s residence in Ralegan Siddhi. They were a part of the India Against Corruption forum of the 2011 anti-corruption Janklokpal movement.

Bhushan has been maintaining that the current Bill is a “diluted” version of the one that was tabled in 2014 in terms of several provisions including that in appointment, removal and jurisdiction of the ombudsman.

Hazare has suggested changes in the selection panel and in the removal process, which the government is likely to incorporate.

Mariah Carey doing well after flu

Mariah-CareySinger Maria Carey, who was reportedly rushed to a hospital here after falling ill with a severe flu, is doing well now. The 45-year-old attended the Pier 1 “Christmas Pop Up Storybook” launch in SoHo Tuesday night and was the “ultimate professional”, reports people.com.
