Final phase of Bihar elections ends with COW politics

A day before Bihar votes for final phase of the electrifying assembly elections, an advertisement issued by the Bharatiya Janata Party (BJP) showing a woman hugging a holy cow has become the talk of the town. The BJP advertisement was carried by several newspapers, which highlighted some of the controversial comments on beef row made by the allies of ‘Mahagathbandhan’ – an alliance floated by the Janata Dal (United), Rashtriya Janata Dal (RJD) and Congress. The advertisement questions JD (U) leader and Chief Minister Nitish Kumar’s silence over the controversial remarks made by his alliance partners. Over the years, a majority of Indian states, including the New Delhi area, have passed controversial slaughter laws.

The animal is known by Hindus as “Kamdhenu”, that which fulfils human needs, and it has a central place in religious rituals as well as free rein to roam in streets — scenes familiar to anyone who has visited India. Bharatiya Janata Party (BJP) is the driving force behind the spread and hardening of cow rights legislation across the country. Critics say the law deliberately targets Muslims, who tend to be the butchers, fuelling religious tensions that explode periodically in India with deadly consequences. Early this year, violence erupted in the hilly state of Himachal Pradesh when a Muslim butcher killed a cow in a fit of rage after it had failed to give milk for more than three years. Indian Hindu pilgrims feed a cow at Sangam, the confluence of the Ganges, Yamuna and Saraswati rivers, in Allahabad.

Amidst outrage over the lynching of a 50-year-old Muslim man in Uttar Pradesh over allegedly eating beef, RJD president Lalu Prasad had said ”Hindus too eat beef ”and accused BJP and RSS of communalising the issue. Another RJD leader Raghuvansh Prasad Singh had kicked up a political storm by saying that in Vedas it is mentioned that ‘rishis’ and ‘maharishis’ used to consume beef. Amidst controversies and uproar around beef ban, Karnataka Chief Minister Siddaramaiah recently said, “I will eat beef now. Who are you to question me? Though I’ve not consumed beef till now, I will do it now. It’s my right.” Meanwhile, Delhi Chief Minister Arvind Kejriwal, who has openly advocated for Nitish Kumar, tweeted: “Have these ads in Bihar been given by BJP’s fringe elements? Or by BJP top brass?” Life for 42-year-old Ashok Malik, a hardline Hindu activist who lives on the outskirts of New Delhi, is dedicated to one cause: stopping the slaughter of cows. Malik’s cow protection team of 30 men is trained to chase trucks transporting cows and raid slaughter houses with the police to nab those selling beef in the Indian capital. The law allows police to search houses, shops and warehouses and arrest anyone who stores, sells or consumes beef from Indian cows. Offenders face jail terms of up to seven years and fines of Rs. 50,000.

At the end of July, the state of Madhya Pradesh passed an amendment to a Cow Slaughter Act 2004, so that offenders should also face a jail term rather than just a fine. The issue of cow care and protection has often dominated state politics owing to patronage from the BJP, which relies on the votes of Hindus for its main support. Every year, young BJP workers are chosen to be a part of the Gau Raksha Samiti (Cow Protection Committee), where they are trained to gather information about butcheries and conduct surprise raids.

The biggest losers in this mix of politics, religion and animal rights are India’s 300 million Muslims, one of the country’s most economically deprived groups. Official reports frequently put Muslims at the bottom of India’s social and economic ladder — beneath even low-caste “untouchable” Hindus. They tend to be the butchers, meat traders and leather workers for whom the ban has the biggest impact. At a later stage, the concept of worshipping the cow was introduced by several rulers and temples to save the animals, which were vital to provide milk for communities. Despite the ban on slaughter, beef is still available to those with the right contacts and it can be eaten legally if it is imported from abroad from a previously slaughtered animal. Cow protection activists, however, project a very different economics.

Let’s come back to Bihar and Cow politics, the Election Commission has directed political parties not to publish ads in newspapers without its approval in Bihar. This is the first time in the history of the poll panel that it is pre-censoring political ads. It also means that any ad that has not been submitted to the Election Commission for clearance cannot be published on Thursday, the crucial last and final day of polling before votes are counted on Sunday in the bitterly fought Bihar assembly election. The Election Commission had last week issued a strongly-worded advisory asking the chief electoral officer of Bihar to ensure that two controversial BJP ads were not published till the election process was over. One attacked RJD chief Lalu Prasad and Nitish Kumar on reservation, the other on vote-bank politics. The Grand Alliance had complained about both. The fifth and the final phase today will see voting in 57 of Bihar’s 243 constituencies. Let’s see how this last attempt of BJP casts it magic over voters.

Shiv Sena comes in support of SRK, says he shouldn’t be targeted because he is Muslim

SanjayEven as he came under attack from sections in BJP, Bollywood actor Shah Rukh Khan received support from ruling ally Shiv Sena which said the superstar should not be targeted only because he is a Muslim and that the minority community in India is “tolerant”.

“This country is tolerant and the Muslims are tolerant as well. Shah Rukh Khan should not be targeted only because he is a Muslim,” Shiv Sena MP Sanjay Raut said.

BJP leader Kailash Vijayvargiya had yesterday triggered a controversy when he tweeted that Shah Rukh’s “soul” is in Pakistan though he lives in India. His remarks came a day after the 50-year-old actor said there is “extreme intolerance” in the country.

Earlier controversial BJP MP Yogi Adityanath compared Shah Rukh to Pakistani terrorist Hafiz Saeed, the mastermind of Mumbai carnage, over his “extreme intolerance” comment and also suggested that he go to Pakistan.

Slamming Vijayvargiya, Raut asked the BJP general secretary not to bring Pakistan into this debate on tolerance, saying that it is India’s internal matter.

He said Shah Rukh is a superstar only because India is tolerant.

“Shah Rukh Khan is a superstar only because the country is tolerant and has never thought in the name of religion,” the Sena leader said.

However, Raut said Shah Rukh spoke quite late on the issue.

“First of all Shah Rukh Khan should not have gotten into this debate on tolerance and secondly, out of the people who have returned their awards, the number of Muslims is almost negligible. Also, Shah Rukh spoke on the issue very late,” he said.

Chhota Rajan to be brought to Delhi, CBI to get initial custody

Chhota-RajanSecurity agencies have decided to bring arrested gangster Chhota Rajan with CBI keeping him in custody for initial period before any other police force is allowed to take him for their respective investigations.

Sources said it has been decided that Rajan will not be taken directly to Mumbai from Indonesia, where he was arrested last week.

Security arrangements are being beefed up at the agency headquarters where Rajan is likely to be kept with regular security drills being carried out to identify any possible loop hole in the security apparatus, they said.

The sources said the decision to bring Rajan here was taken during meetings of various stakeholders including CBI, central security agencies and Delhi and Mumbai Police.

On Tuesday also a meeting of senior officials of Delhi Police Special Cell and CBI took place, they said adding that that during the one-hour long meeting various aspects related to transport and security of Rajan were discussed.

They said the agency team is waiting for the first available window to bring back the ganglord as ash cloud arising of volcano eruptions near Bali have halted flight operations from there. The sources said as soon as the flight operations start the team will move out with Rajan.

Rajan, who was arrested in Bali on his arrival from Australia on October 25, is wanted in over 75 heinous crimes ranging from murder, extortion to smuggling and drug trafficking.

Rajan, whose original name is Rajendra Sadashiv Nikhalje, was arrested in Bali on the basis of a Red Corner Notice from Interpol and following a tip off by Australian authorities to the police in Indonesia.

In the absence of an extradition treaty, Indian authorities have already provided documents to their Indonesian counterparts about his Indian identity to facilitate his deportation.

In 2000, there was an attempt on Rajan’s life when his arch rival and India’s most wanted terrorist Dawood Ibrahim’s men tracked him down to a hotel in Bangkok but he managed a dramatic escape.

The Indian team, comprising officers from CBI, Mumbai and Delhi police, had arrived in Bali on Sunday with a detailed dossier on 55-year-old Rajan and his involvement in various crimes in India.

Mumbai coastal road project set to get Centre’s nod

Costal-RoadThe Centre is all set to give approval to the ambitious Mumbai coastal road project which will connect south Mumbai to Kandivali in the north of the city.

Union Environment Minister Prakash Javadekar, after a meeting with Maharashtra Chief Minister Devendra Fadnavis, said that the process will be completed soon.

He also said that the issue of Mumbai Trans-Harbour Link (MTHL) will be taken up in the upcoming Forest Advisory Committee (FAC) meeting.

“On the coastal road issue, we have decided that within a week we will give it approval and the process will be completed.

“We have also decided to approve the sewage treatment plant which has to be set up in Mumbai. On the issue of MTHL, it will be processed in the upcoming FAC,” Javadekar said.

Fadnavis said that while Javadekar has assured him that the final notification of the coastal road project, which will become a lifeline for the city, will be done within a week to ten days, during the meeting resolving of various issues regarding MTHL were discussed.

“We discussed around 13 proposals today. Mumbai’s coastal road which will be like a lifeline to the city, its final notification has to come out.

“Environment Minister has assured that within a week, it will be given clearance and after that it will take around ten days for the notification to come out. This is one of the important decisions taken today,” Fadnavis said.

The 35.6km-long coastal road project, to be built at an estimated cost of Rs 12,000 crore, was hanging fire for the past five years and opposed by transport activists and environmentalists alike.

The Maharashtra Chief Minister said that on MTHL issue, the state had some issues and there was an attempt in today’s meeting to resolve them.

The 22-kilometre sea link, costing upwards of Rs 11,000 crore, is meant to connect Navi Mumbai with Sewri and also develop large parts of Navi Mumbai.

Gutka ban led to drop in consumption: Study

Stringent laws banning gutka have had a positive impact on consumers in Maharashtra and many have agreed that they consume less since the ban was enforced, according to a report released.

The Maharashtra state report is part of a larger eight- state research study undertaken last year by the Johns Hopkins Center for Communication Programs (CCP) and Centre for Communication and Change-India (CCC-I),New Delhi with support from the Johns Hopkins Bloomberg School of Public Health’s Institute for Global Tobacco Control (IGTC) and the World Health Organisation (WHO) Country Office for India.

The findings specific to the state of Maharashtra were released from a study that had been conducted across the country to understand the impact of state laws that ban the sale and distribution of gutka.

The study aimed to understand the impact of state laws that ban the sale and distribution of Gutka. It was conducted in eight states including Assam, Bihar, Delhi, Gujarat, Odisha, Madhya Pradesh, Maharashtra and Karnataka.

In Maharashtra, surveys were conducted in the districts of Thane and Mumbai with current and former gutka users and tobacco product retailers to determine the impact and effectiveness of the gutka ban.

In addition, observations of 60 retail environments and in-depth interviews with government officials, enforcement officials and citizens working with civil society groups were conducted to find out different stakeholders’ reaction to the ban.

Considering the harmful effects of gutka and paan Masala, the Maharashtra government disallowed the sale, manufacture, distribution and storage of gutka from July 19, 2012.

Of the respondents who continue to use pre-packaged gutka, a considerable proportion – about 83 per cent — reported that they consume less since the ban.

The study also showed that there is a universal agreement that gutka ban is good for the health of the youth in the country with 99 per cent responding affirmatively in support of the ban.

Jail medical officer, another person held for accepting bribe

A medical officer with the Aadhar Wadi Jail at Kalyan and another person were arrested for allegedly accepting a bribe from a complainant, ACB officials said.

The complainant’s relative was lodged at the Aadhar Wadi jail in a crime. He wanted him to be shifted to the Ulhasnagar central hospital for which he needed a clearance from the jail medical officer, Deputy Superintendent of Police Thane ACB Sanjay Mohite said.

When approached the medical officer made a demand of Rs. 5,000 for giving the clearance letter, following which he lodged a complaint with the ACB, an official release said.

A trap was laid this morning and 28-year-old Nilesh Pagare was caught while taking the bribe on behalf of the medical officer Dr. Sandeep Shinde, it added.

The duo were arrested and a case under relevant sections of Prevention of Corruption Act 1988 has been registered and investigations are underway, police said.

HC uphold life sentence to 2 brothers for murder

The Bombay High Court has upheld the conviction and life sentence awarded to two brothers for murdering their neighbour for allegedly staring at them.

A division bench of acting Chief Justice V K Tahilramani and A S Gadkari dismissed appeals filed by brothers Santosh Rajput (35) and Jitu Rajput (20) challenging a July 2007 sessions court order convicting them and sentencing them to life imprisonment for murdering Mahesh Deshmukh as he used to look at them angrily.

The deceased Mahesh used to reside with his wife Sharmila and children in neighbouring Thane district. The accused were also living in the same building.

It is the prosecution’s case that Jitu told his brother and family that the deceased Mahesh used to always look at him angrily. A fortnight before the incident, Jitu and Santosh’s mother called Sharmila to their apartment and asked her to warn her husband to stop staring at Jitu or else face dire consequences.

Sharmila told the convicts’ family that her husband naturally had such a look on his face and did not mean any harm and requested them to let go of the matter.

On December 13, 2004 Sharmila, her nephew Hemant and two others saw Jitu and Santosh stabbing Mahesh with knives near the building entrance. When Hemant tried to stop them, the duo stabbed him too. While Hemant sustained injuries, Mahesh was declared dead in the hospital.

The high court last month after perusing the facts and evidence of the case was of the opinion that the prosecution has proved beyond reasonable doubt that the accused had assaulted Mahesh due to which he died.

“We are of the considered view that the evidence provided by the prosecution is sufficient to sustain the conviction and sentences imposed on the two (Santosh and Jitu),” the court held.

Regularisation of 99 illegal buildings in Navi Mumbai demanded

As the date to demolish 99 illegal buildings constructed at Digha in the satellite city of Navi Mumbai inches closer, activists today demanded that these structures be regularised.

Officer-bearers of Maharashtra Society Welfare Association (MSWA), which works to bring transparency in real estate sector, met the affected owners, and assured them to raise the issue with the Chief Minister.

Acting on a PIL, the Bombay High Court has directed the Maharashtra Industrial Development Corporation (MIDC) and the City and Industrial Development Corporation (CIDCO) to demolish these 99 structures, illegally constructed on lands belonging to them in Digha village.

These state-run agencies are likely to start razing the buildings after Diwali (which falls on November 11).

Spokesperson of MSWA Sunil Sharma said thousands of families are on the verge of being thrown out on the streets and their future is ruined.

He blamed rampant corruption for mushrooming of illegal buildings and demanded strict laws to prevent such structures from coming up in the future.

“These families are going to lose their life-long savings. Strict law should be put in the place so that in future no one dares to construct illegal buildings,” he said.

Advocating a humanitarian approach to the issue, MSWA Chairman Ramesh Prabhu said, “When slums could be regularised, why not these buildings, which were bought legally by paying stamp duties, registration fees and other levies to the Government.”

Alleging that builders have deceived the gullible flat buyers, Sharma added, “There are about 3,300 flats in these buildings, where around 20,000 people reside. If these constructions are illegal then why the administration gave electricity and water connections to them.”

“Similarly, how come banks and financial institutions sanctioned housing loans for them? The Government should answer all these questions.”

Two FIRs have been lodged against eight persons – six builders and two real estate agents – in connection with the construction of these illegal buildings.

Charges framed against Abu Jundal in 26/11 Mumbai attacks

A sessions court framed charges against Lashkar-e-Toiba operative and key plotter of 26/11 terror strikes, Sayed Zabiuddin Ansari alias Abu Jundal, in connection with the 2008 Mumbai attacks case.

“The court has framed charges against Jundal in the 26/11 case and he has pleaded innocence,” special public prosecutor Ujjwal Nikam said.

Jundal was produced in the court of judge GA Sanap who read out and explained the charges to the accused and he pleaded not guilty to the charges.

The prosecution had filed draft charges against Jundal in December 2013.

Jundal was charged on 23 different counts, including criminal conspiracy, waging war against the nation, criminal conspiracy, murder, attempt to murder, kidnapping for murder, cheating, forgery and for abetting the terror attack from Pakistan under Indian Penal Code (IPC).

Other charges are under sections of Unlawful Activities (Prevention) Act, Explosives Act, Explosive Substances Act, Prevention of Damage to Public Property Act, Railways Act and Customs Act.

Meanwhile, Nikam said the court will start hearing his arguments on the police plea for making Pakistani-American LeT terrorist David Headley an accused in the 26/11 case.

On October 8, police had moved an application to try Headley along with Jundal and sought issuance of Letter of Request (LR) against him for his production through video conference.

A native of Beed district of Maharashtra, Jundal was interrogated after he was brought here from Delhi where he had been arrested following his deportation from Saudi Arabia in June 2012.

The Mumbai terror strikes of November 2008 left 166 dead and many more injured.

The charge sheet against Jundal has details about his training in Pakistan, preparations ahead of 26/11, LeT hierarchy, the precise role played by those involved, etc.

According to Jundal’s confession, LeT training camps enjoyed full support from local, federal police and paramilitary organisations in Pakistan.

As per the charge sheet, after fleeing Maharashtra, Jundal entered Bangladesh in May 2006, where he was received by an ISI agent. He then used a boarding pass issued in a fictitious name to fly PIA flight to Pakistan.

In Maharashtra, Jundal is also accused of involvement in Aurangabad arms haul case, 2010 German Bakery blast case in Pune and Nashik police academy attack conspiracy case.

Government shouldn’t blame bureaucracy for its failures: Oppn

Terming the remarks of Maharashtra Chief Minister Devendra Fadnavis about non-cooperation from bureaucracy as “unfortunate”, the opposition Congress-NCP on Wednesday said the government should not make someone else a scapegoat to hide its failures.

Congress leader and Leader of Opposition in the Assembly Radhakrishna Vikhe Patil said that Fadnavis had failed to give direction and vision to the bureaucracy.

“Comments of the Chief Minister against the bureaucracy is unfortunate. He should not cover up his own failures by making the bureaucracy a scapegoat. He is not willing to give direction and vision to the bureaucracy. It is only then desired results will be achieved,” he said.

Similarly, NCP spokesperson Nawab Malik speaking to reporters wondered if the bureaucracy which is known to be efficient and meritorious is being asked to do any illegal work.

“If that is so, the law abiding bureaucrats will never listen to Fadnavis,” he said.

Criticising the Chief Minister for targeting the bureaucracy, Malik said 50 per cent of the bureaucracy is in government service taking benefits of reservations.

“RSS has recently spoken against reservations. Fadnavis is targeting the bureaucracy to create a divide on caste lines,” he charged.

Malik said there is unrest in the bureaucracy after Chief Minister’s remarks.

“Fadnavis is trying to run the government with few privately appointed OSD (officers of special duty). The clarification given by the Chief Minister’s Office that appointing ODS is an old practise of Congress-NCP is not true. We did appoint OSD but the appointment was made from the government cadre only,” he said.

Recently, Fadnavis in Nagpur had said the state bureaucracy was not fully co-operating with the new government and this was posing a hurdle in implementing policies.

Meanwhile, the Congress and the NCP also took a swipe at the government over the proposed 10 per cent fare hike of state transport buses.
