Hardik, the Patel’s face in Gujarat

On Tuesday, the 21 year old guy dent ripples to Narendra Modi and Gujarat Government. Addressing amass gathering at GDMC rally ground in Ahmedabad, Hardik Patel attacked Gujarat government for turning down their demand for giving OBC status to Patels and warned that protests would turn violent if their demands are not met. Patel, a B.Com graduate, helped his father run a small submersible-pumps business in rural Ahmedabad. He was a member of the Sardar Patel Group (SPG), a leading Patidar youth body. He was one of the leading supporters of Sardar Patel statue by Gujarat government. Later on, he disconnected himself from the SPG and formed his own organisation – Patidar Anamat Andolan Samiti (PAAS). Patel feels that Patidars are lacking behind in the development race because of the present reservation regime. Patidar students with 90 per cent marks does not get admission in an MBBS course, while SC/ST or OBC students get it with 45 per cent marks. The 1931 caste census states that Patels constitute 15 per cent of the state’s population but since its formation in 1960, the community dominated the political and financial power of the state.

Way back in 80s, Patel community rallied against Congress party to remove caste based reservations. Patels played a crucial role in overturning Congress rule in Gujarat and helped BJP to come in power. Caste based reservations are still there. It started when a son of a farmer from Patidar caste with 90 per cent marks, couldn’t get into medical school, whereas an OBC caste student was admitted into medical college with less marks. Now, the farmer would have to cough up large sums of money to get his son admitted into a private medical college. One needs to understand that not every single Patel is affluent. There are two extreme Patels in Gujarat, one are richer whereas some belongs to a lower middle class and under privileged. Apart from the fact that the BJP depends on the Patels for its grip over Gujarat, the Anandiben Patel’s government in the state is stuck in a Catch-22 situation. Not just her, but 6 other members of her rather lean 18-member Cabinet belong to the Patel community. Of the 120 MLAs in the Gujarat Assembly, 40 are Patels. So, to say the community is under-represented in government or in the bureaucracy would be grossly inaccurate.

This 21-year-old Hardik Patel grabbed the headlines when he took to the streets demanding inclusion of Patel community in the Other Backward Castes (OBC) quota. Hardik launched the movement because he demanded that Patel community be counted as one of the socially and economically weaker communities in the state. Patel has now become the face of the movement and has been holding massive rallies in small towns and large cities for the past two months with the warning that they can make and break governments in Gujarat. The section of Patels who did not abandon farming for other businesses, feel they’ve got a raw deal.

Discontent rose gradually among the Patels under Narendra Modi as he did not favour any one caste in his 13 years as Chief Minister. In comparison, the community wielded more clout under Keshubhai Patel during his years as CM briefly in 1995 and again between 1998 and 2001. Protesting Patels argue that if the community can fall under the OBC category in states like Rajasthan and Madhya Pradesh, then why not in Gujarat.

Nevertheless, the immediate catalyst to this sudden grouping and massive following by the Patidar Anamat Andolan Samiti seems to have been the state government’s recruitment drive for permanent jobs. Posts were being filled up after a three-year gap, and those protesting feel the Patels did not get enough jobs. The Patels form roughly 18-20% of Gujarat’s population. Since the mid-1980s, this group has been united and unwavering in its support for the BJP.

Caste based reservations are inherently wrong. When we say that caste is abhorrence to a civilized society, how do you justify caste based reservations? It was originally meant to secure social justice to the marginalized sections of society. If after 68 years you have not been able to secure social justice, it is a good bet that you will never secure social justice down this road. Better admit your mistake and reverse course. At most, it has helped certain segments of the backward castes to spoil the corner at the cost of other backward castes. Secondly, it is known fact that reservations come at the cost of merit. The issue here is not reservations by itself, but the fact that by inducting huge numbers of the less meritorious into public service, we have compromised seriously on development and economic progress. Thirdly, serious agitations like the Gurjars in Rajasthan and the Patels in Gujarat arise only because of the competitive urge to declare one backward only to secure government jobs. This gives rise to major law and order breakdowns, apart from creating unwanted social fissures. It is only a matter of time before the reservation policy breaks down due to its own contradictions.

Mumbai Police inspector had links with Dawood Ibrahim’s D-company, claimed US cable

Dawood-IbrahimEven as former Home Secretary and now BJP leader RK Singh made a sensational claim that a covert operation was planned by the Indian authorities to kill the fugitive underworld don Dawood Ibrahim sometimes back but was compromised by some corrupt Mumbai Police officials, a report has revealed that a senior police inspector had links with the D-company.

The US Embassy in New Delhi had sent a confidential telegram to Washington on August 8, 2005, the title of which was – “Terrorist Dawood Ibrahim haunts India from afar as daughter weds in an American branded hotel.”

The telegram talked of arrest of Vicky Malhotra and Farid Tanasha in Delhi.

At the same time the cable questioned whether the arrests were linked to a plot to eliminate the underworld don.

The sensational part of the cable is when it talks of the then Mumbai Police Commissioner AN Roy firing senior police inspector Aslam Momin.

This was a few days after the arrest of the Chota Rajan gang members.

The American cable says that Momin’s phone records had revealed his links with Dawood and his brothers.

Also as per the cable, the underworld don had used the inspector to tip off the Mumbai police to arrest gangster Vicky Malhotra.

On the other hand the Intelligence Bureau reportedly gave Mumbai police evidence which showed that Momin’s had underworld connections.

The report quoted US cable as follows – The publicly acknowledged link between a police hit man and Ibrahim highlighted the well-known interaction between police and the underworld. Our Indian contacts are perplexed at how Ibrahim could brazenly host such an event.”

Earlier, disclosing details of the highly secret operation in an interview to Aaj Tak news channel, RK Singh had said that it was launched when Atal Bihari Vajpayee was the PM and current NSA Ajit Doval was the chief of the IB.

The former home secretary had said that the Indian government had roped in some elements from Dawood’s rival Chhota Rajan’s gang and they were later imparted training at a secret location outside Maharashtra.

However, some Mumbai Police officials who were in regular touch with the D-company landed up at the training camp with arrest warrants for the covert operatives who had been engaged by India, Singh said.

The entire operation to take down Dawood failed due to these rogue elements in Mumbai Police, as per Singh.

HC seeks information about action taken on complaints against Radhe Maa

RadheThe Bombay High Court on Tuesday asked the city police to file an affidavit stating what steps they have taken regarding the complaints received against self-styled godwoman Radhe Maa.

The division bench of Justices V M Kanade and Shalini Phansalkar-Joshi was hearing a public interest litigation filed by advocate Falguni Brahmbhatt seeking an FIR against Radhe Maa on charges of obscenity, cheating and hurting religious sentiments. Brahmbhatt moved the court after suburban Borivali police allegedly failed to take action on her complaint.

Senior advocate Milind Sathe, appearing for Radhe Maa, argued that the PIL was nothing but a publicity seeking petition and that the allegations levelled in it were frivolous.

Prosecutor Sandeep Shinde told the court that police had recorded Brahmbhatt’s statement. “If the police find some material (against Radhe Maa), then appropriate action will be taken,” he said. The bench adjourned the hearing to August 27, asking police to file a short affidavit.

Jain portal launched for community awareness on social issues

JainA portal was on Tuesday launched to provide Jain community across the country information about various provisions made by the government for their uplift after they were provide minority status last year and also to galvanise and educate them on social and developmental issues.

The portal – www.Jass.in – was inaugurated by Maharashtra’s Minority Affairs Minister Eknath Khadse, who praised the efforts of Shri Jain Alpsankhyak Sewa Sansthan (JASS), an NGO, which has designed and developed the portal.

The portal would facilitate the Jains across the country to get information about various provisions made by the government for the uplift of the community, especially after it was accorded the minority status last year, said Sanjay Shah, a member of the government-appointed Jain district minority development panel. He is also the vice president of JASS.

In January 2014, the Jain community was granted minority status by the Central government that enabled them to avail benefits in government schemes and programmes.

“There is a large chunk of our community members who are unaware of their rights and the various initiatives taken by the Central and state governments for the uplift of the community,” Shah said.

“Apart from the state-provided facilities, anyone who becomes our member would be provided sufficient discount on medical treatment, scholarships, free coaching classes, helping in studying abroad etc,” he said while claiming that already 60,000 people from the community have become members of the portal.

“We have also decided to run few Gaushalas, to which our minister Khadseji has assured to help us,” he said.

JASS also aims to open 100 branches across the state and then expand its wings all over the country by tying-up with local Jain community centres.

Consumer forum rejects Gurudev Siddhapeeth’s claim for damages

The Thane District Consumer Redressal Forum (TDCRF) has rejected a claim by Gurudev Siddhapeeth for the damage to its property during the 2011 flash floods in the state.

Gurudev Siddhapeeth is an ashram, run by the Gurudev Siddhapeeth Trust, and is located at Ganeshpuri in Thane district.

In its complaint, the Sidhapeeth stated that it had taken a fire insurance of Rs. 1.50 crore from National Insurance Company for its structure and for mango saplings on 28 acres of its land.

During the flash floods on August 27 and 28, 2011, the saplings planted by the Trust were washed away and hence, it lodged a claim with the insurance company.

After due survey of the losses, the insurance company honoured the claim for damge to the structure to the tune of Rs. 1,72,706 and returned the premium of Rs. 13,236 paid towards the mango saplings to the claimant.

However, the Trust had filed a claim of Rs. 13,48,008 for damages to the mango saplings and Rs. 2,01,404 for the civil work, based on the surveyor’s report.

In their recent order, TDCRF president Manohar Y Mankar and members Madhuri S Vishwarupe and N D Kadam stated that the Trust was registered as Shree Gurudev Ashram under the Bombay Public Trust Act of 1950 and later on the name was changed as Gurudev Siddhapeeth.

Citing rulings of the National Consumer Disputes Redressal Commission, the forum said that the complainant does not fall under the category of consumer, as per Consumer Protection Rules Section 2(1)(d).

Therefore, the complaint does not come under the purview of TDCRF and hence, needs to be rejected, the forum added.

After repairs, Wadia Hospital to reopen: HC told

The Bombay High Court was told that Bai Jerbai Wadia Children hospital, specialising in organ transplants, now under renovation, will be ready for operation by March next year.

The hospital building in central Mumbai went under repairs in 2009, following which, it has been operating from the adjoining Nowrosjee Wadia Maternity hospital. Both the hospitals are run by the Wadia Trust.

Senior counsel Rafiq Dada, appearing for the hospital trust, today assured the court that no third party rights will be created for the renovated building and it will be used solely for hospital purposes.

A division bench of Chief Justice Mohit Shah and Justice A K Menon was hearing a petition filed by social activist Kamayani Mahabal seeking a direction to government and civic authorities to ensure that all necessary permissions are granted and the hospital is started at the earliest.

The Wadia Trust had initially submitted a proposal to the state for starting of an organ transplant centre at the Bai Jerbai Children’s hospital. However, since the hospital is under renovation and would take some time for completion, the Trust sought to start the organ transplant centre at the Nowrosjee Wadia Maternity hospital from where the children’s hospital is also functioning.

According to the proposal sent in July last year, if the centre is approved, then it will be one of its kind in the world. After the repairs are completed, the hospital will be able to house 150 beds in the neonatal intensive care unit, 24 beds in the paediatric intensive care unit.

No change in airport tariff at CSIA 

The GVK-run Mumbai International Airport Ltd (MIAL), which is seeking an upward revision in airport charges, would have to wait for the same till November as the tariff regulator has decided to continue with the existing rates for another three months.

The Airports Economic Regulatory Authority of India (AERA) said in an order yesterday that rates approved in its order of January, 2013, are to continue till the end of November this year or till the time that tariffs for the second five-year control period (2014-2019) are determined.

“Aeronautical tariff(s) approved by the Authority vide order dated January 15, 2013, shall continue up to November 30, 2015, or until the final determination of the tariffs for the second control period (2014-2019), whichever is earlier,” AERA said in its order.

Aeronautical revenue consists of charges such as aircraft landing and take-off fees, aircraft parking charges and passenger services fees.

“The revenue so collected by the airport operator (MIAL) during such period shall be adjusted from the Aggregate Revenue Requirement for the second control period, starting with effect from April 1, 2014,” it said.

MIAL is a 74:26 joint venture between a GVK-led consortium and Airports Authority of India.

The User Development Fee paid by passengers flying out of the Chhtrapati Shivaji International Airport (CSIA) currently stands at Rs 274 for domestic departures and Rs 574 for the international ones.

As against a demand for an increase of 881 per cent, CSIA had got approval for a 164 per cent hike in aeronautical charges last time for the first control period.

AERA had earlier extended the continuation of the existing tariff till rpt till August 31, suggesting that it has not been able to come up with its consultation paper on tariff revision for Mumbai airport.

AERA has to prepare a consultation paper and invite feedback from stakeholders, including MIAL, before finalising the revised tariff.

Onion prices fall below Rs. 50/kg at Lasalgaon on export curbs, retail prices still high

On Tuesday, wholesale prices of onion fell below the Rs. 50 per kg mark, at the Lasalgaon in Maharashtra, Asia’s biggest onion market, due to curbs on exports and fear of action against hoarding.

Even at Azadpur mandi in Delhi, wholesale onion price declined by Rs. 3-5 per kg to Rs. 53 on increase in arrival of new crop from Karnataka and Andhra Pradesh.

However, retail onion prices across the country continue to rule as high as Rs 80 per kg.

At Lasalgaon, which sets the price trend across the country, the wholesale onion price declined to Rs 48.5 per kg today from Rs 57 per kg last week, according to the data maintained by Nashik-based

National Horticultural Research and Development Foundation (NHRDF).

“Prices declined due to increase in arrival in the mandis,” NHRDF Director R P Gupta said. Arrival of onion increased as farmers/traders brought more stock for sale after the government imposed restriction on overseas sale by raising export price sharply to USD 700 per tonne from USD 425, Nashik-based traders said. Also, fear of action against hoarding along with MMTC importing 10,000 tonnes of onion helped, they added.

On Monday, the Centre had asked the Maharashtra government to crack down on hoarders and take adequate measures. Onion prices both in the retail and wholesale markets have been rising unabated in the wake of shortage of five lakh tonnes of onion in the country.

There is apprehension that this year’s kharif output may get affected because of deficit rains in the growing states. Thanks to increased arrival of new crop from these two states, the wholesale prices in Delhi markets have declined by 3-5 per kg to Rs 53 today, Azadpur Agricultural Produce Marketing Committee (APMC) member Rajendra Sharma said.

Maharashtra amends jail manual, won’t allow furlough to rape convicts

In a major development to tighten the noose, Maharashtra has amended its jail manual. As per the new rules, rape convicts will not be entitled to any furlough. Earlier, a prisoner was entitled to be released on furlough for 14 days in a year.

As per the new manual, there will be no commutation of sentence for rape convicts serving a life term as against the earlier practice where the sentence could be reviewed after a convict serves 14 years. The new jail manual essentially incorporates SC directives.

The parole will be granted to rape convicts only under exigencies like death or serious illness in the family or a natural calamity.

CR employees on day-long hunger strike against YTSK scheme

Central Railway employees sat on a day-long hunger strike on Tuesday against Railway Board’s recently launched Yatri Ticket Suvidha Kendra (YTSK) scheme.

Nearly 50 employees of Group C and D, including commercial and running staff, under the banner of Central Railway Mazdoor Sangh (CRMS), sat on a day-long fast at Chhatrapati Shivaji Terminus to oppose the Railway Board’s decision to permit authorised ticketing agents to book tickets under YTSK scheme that will enable agents to book tickets by applying additional charges on fare.

CRMS has termed the move as “unnecessary” and said it is exploitation of passengers. They demanded the Board to roll back its decision.

President of CRMS R P Bhatnagar said the move is a violation of Contract Labour (Regulation & Abolition) Act, 1970 and asked “without making amendments in it, how can Railway violate it by outsourcing private players?”

“Because of corruption prevailing in all departments (of railway) and due to hand in glove dealing with administration and private players, railway is adopting such means of outsourcing,” alleged Bhatnagar.

Under the scheme, YTSK operator will levy an additional charge of Rs 30 for Sleeper class (per ticket) and Rs 40 for AC class.

“This is just like a fare hike of Rs 30 and 40 and through this an operator will earn Rs 50,000 daily. I ask what kind of benefit Railway and passengers would be getting by this means,” he said.

CRMS members observed similar fast in Nagpur, Pune, Solapur and Bhusawal divisions.
