(She is) very emotional (and can go from) screaming one minute and then apologising the next. (She) goes off on rant after rant, pointing the finger at Danny at ever opportunity. (He’s) had enough!,” a source said.

And Roberts has had a tough two years after losing her half-sister Nancy and mother Betty.

“(She’s) suffered an emotional collapse. She was already reeling from her mom’s cancer crisis. Now, she’s been deeply hurt and stung by all the criticism after Nancy’s death and feels she doesn’t deserve it. Julia insists that Nancy’s death was not a suicide.”

Their plea could not save Yakub Memon

Even Asaduddun Owaisi said that Yakub doesn’t deserve capital punishment as he had himself surrendered before the law.

The Supreme Court has rejected Yakub Memon’s plea against the dismissal of his curative petition and said that the same was disposed off rightly without any procedural lapse. The apex court also held that there was no lapse in the death warrant issued to Yakub Memon. The issuance of death warrant is in order and we do not find any kind of legal fallacy,” a bench comprising Justices Dipak Misra, Prafulla C Pant and Amitava Roy said. Maharashtra Governor C Vidyasagar Rao too rejected the mercy petition of Yakub Memon.

On the other hand, Muslim leaders are unhappy with the Supreme Court verdict. According to them, why should capital punishment be awarded to a person who himself came forward to surrender before the law. They said that injustice is being meted against Yakub.

Yakub-hangAsaduddin Owaisi, President of the All India Majlis-e-Ittehadul Muslimeen said, “Only three persons have been convicted for Mumbai riots. Why did Tamilian parties defend the murderers of former Prime Minister Rajiv Gandhi? Yakub had surrendered and had given a vital evidence against the involvement of ISI and Tiger Memom in the Mumbai blast incident. Even Ram Jethmalani, Shatrughan Sinha and Justice Katju had said that Yakub doesn’t deserve capital punishment. Police has been asking Muslim leaders to cooperate but they must ask people belonging to every religion to cooperate. Yakub lacks political backing hence he is being executed.”

“B Raman’s statement clearly shows that Yakub Memon had surrendered in Nepal and helped our intelligence agencies with vital information about ISI’s operations. His death penalty should be converted to life imprisonment as the senior R&AW officer had pleaded,” said Samajwadi Party state chief and MLA Abu Asim Azmi.

“Srikrishna Commission had made some vital recommendations for bringing the guilty of Mumbai 1992-93 riots to book but successive governments have kept it on the backburner. If Yakub Memon is being hanged for his role in the 1993 serial blasts, the guilty of the riots, which happened before the blasts, should also be brought to justice,” demanded All India Milli Council’s general secretary Maulana Mehmood Daryabadi.
Senior lawyer Ujjwal Nikam said, “Supreme Court has rejected petition (curative) filed by Yakub and dismissed all the contentions raised by him.”

Memon’s wife, Rahin, has left for Nagpur jail where she hopes to meet him one last time before his execution. “I have full faith in the judiciary, I have full faith in the Almighty,” Yakub’s brother Suleman said after the Supreme Court verdict.

Few days back, BJP MP Shatrughan Sinha, Ram Jethmalani, eminent jurists and persons from different walks of life had submitted a mercy petition to President Pranab Mukherjee requesting him to commute the death sentence of Yakub Memon. The signatories had claimed that there were “substantive and fresh grounds” that can be considered on merits.

In the 15-page petition, the signatories had cited various legal points and international commitments to argue that Memon should not be hanged.

“We most humbly request your Excellency to consider the case of Yakub Abdul Razak Memon and spare him from the noose of death for a crime that was master-minded by someone else to communally divide the country.”

“Grant of mercy in this case will send out a message that while this country will not tolerate acts of terrorism, as a nation we are committed to equal application of the power of mercy and values of forgiveness, and justice. Blood letting and human sacrifice will not make this country a safer place; it will, however, degrade us all,” the signatories said.

Besides Sinha and Jethmalani, those, who had signed the petition include MPs like Mani Shankar Aiyar (Congress), Majeed Memon (NCP), Sitaram Yechury (CPI-M), D Raja (CPI), KT S Tulsi and HK Dua (nominated) and T Siva (DMK), former CPI(M) general secretary Prakash Karat, CPI(ML)-Liberation general secretary Dipankar Bhattacharya, Brinda Karat (CPI-M) and filmmakers and actors like Naseeruddin Shah and Mahesh Bhatt, MK Raina and Tushar Gandhi.

It also included various academicians, members of the legal fraternity, activists and retired judges – Justice Panachand Jain, Justice H S Bedi, Justice PB Sawant, Justice H Suresh, Justice KP Siva Subramaniam, Justice SN Bhargava, Justice (retd) K Chandru, and Justice Nagmohan Das, noted lawyer Indira Jaising and academicians like Irfan Habib, Arjun Dev, DN Jha, and social activists Aruna Roy, Jean Dreze and John Dayal.

Finally, Yakub Memon hanged

The lone death rows convict Yakub Memon, in the 1993 Mumbai Bomb Blast, is executed today on July 30th. Nothing could have saved him to go on gallows. His family told media that he was seen stressed for the first time in these years. He never expected death sentence. Yakub knew, he had to take this fate because of his brother Tiger Memon. He wanted to open a school; in jail also he was educating people. With his help, five people in the jail could clear their SSC exams. Yakub has a written acknowledgement of this work. He wanted to work for India. His entire youth has been spent in jail and finally he had to face death keeping all his dreams aside. He concluded by saying that death is fixed for everyone and he will die when it’s fixed in his destiny.

Yakub Memon, the CBI says was arrested in New Delhi in 1994 but the family has always maintained that he came back with the intention of helping the authorities and that he was innocent. Yakub ran an accounting firm and stands accused of providing tickets to the accused to flee to Pakistan and Dubai. Memon’s wife, parents and three other brothers, Suleiman, Essa and Yusuf also returned. Both Essa and Yusuf are serving a life sentence while Suleiman was acquitted. Tiger Memon, Dawood Ibrahim, Javed Chikna, some of the principal accused, are all still absconding. The primary chargesheet in the case was filed in 1994 and in April 1995 the trial started. The prosecution presented more than 600 witnesses and it was in 2000 that the testimony of all of them was wrapped up. In September 2006 the court pronounced its judgement.

Yakub surrendered to the police as he was told by the then home minister that he will not be punished. The family was waiting since last 23 years and they did not expect a death sentence. Yakub gave them a lot of information on the blast. There should have been some sympathy from the government. At least, he would have been awarded life imprisonment if death could be avoided. Main culprits are still scot free and roaming across the globe.

Justice Kode announced death sentence to Yakub Memon for treachery. Kode himself told a journalist of rediff.com’s Sheela Bhatt that “Yakub didn’t plant bombs or RDX, nor did he take part in the landing of the weapons. Those who have been awarded the death penalty were involved in one of these deadly actions. The charges against Yakub don’t involve any of these crimes.” Inspite of knowing and advocating involvement of Yakub, what must have really provoked Justice Kode to announce death sentence to the person who is just a kind of victim. If justice is delivered in this manner then how one should expect justice from judicial system of this country.

Adding to my surprise, the man who prosecuted Yakub Memon, Ujjwal Nikam (who famously lied about Pakistani Ajmal Kasab demanding biryani) made these observations about Yakub Memon: “When he was first brought to court, I remember seeing him as quiet and reserved person. He is a chartered accountant so took detailed notes of the evidence. He was quiet and aloof, never mingled with the others and only spoke to his lawyer. An intelligent man, he closely monitored the entire trial.”

“I noticed the same things in my time in the court. Memon was silent and observant. There was only one time I noticed him showing emotion. It may have been in late 1995 or early 1996,” said JN Patel, who was at that time the trial judge, was giving bail to many of the accused in this period. There was some hope but not for the Memons. I remember Yakub shouting and acting violently (without hitting anyone). He said: “Tiger was right. We should not have come back.” I’m surprised that, why Ujjwal Nikam could not get success in putting other terrorists with same fate.

Senior Journalist Barkha Dutt, Aakar Patel and R Jagannathan of firstpost.com wrote fine arguments on why the state should not hang Yakub Memon. He argues that those scheduled to hang for two other crimes, the assassinations of Rajiv Gandhi and Punjab Chief Minister Beant Singh, have not yet been hanged. Three of Rajiv’s assassins — Santhan, Murugan and Perarivalan — had their death sentences commuted after the Tamil Nadu assembly asked for mercy. SC upholds commutation of death to life sentence for Rajiv Gandhi killers. They should also be hanged by now. Beant’s assassin Balwant Singh Rajaona has proudly acknowledged his guilt and has in fact been demanding that he be hanged, but has been kept alive, perhaps also due to the efforts of the Punjab assembly.

Jagannathan writes: “What is apparent to all but the innocent eye is this: where a convicted killer or assassin or terrorist has strong political backing, neither the centre nor the courts seem to develop the spine to deliver justice impartially as intended. Now consider how the same centre, states and courts are keen to “uphold the law” when it comes to another category of killers: Ajmal Kasab, Afzal Guru, and, now, possibly, Yakub Memon. All Muslims and their only common link to the hangman’s noose seem to be that they lack political support.” Anyway, till today Muslim remained as a vote bank. BJP is in power majority votes and Hindutva agenda, minorities are feeling insecure in this country. Yakub’s death has given tremors to some.

At the last moment, everyone made noise to save his life but this time judiciary was not very kind to him. Even my intention is not to support crime or criminal, just a thought to save someone who is a victim of politics. Yakub died and his death leaves a series of question behind. Twenty two long years, 600 witnesses and 100 guilty sentences. Later on, one hanged but can government deport the main culprits, Dawood Ibrahim and Tiger to India? Can anyone ever be booked and punished for Babri demolition and post demolition riots in India, where thousands were killed? Whosoever are the rioters, propagators, masterminds and murderers, should be hanged or butchered mercilessly for killing innocents. Or there will be always a selective justice?

Shiv Sena, BJP want Yakub Memon ‘sympathisers’ to be charged with treason

SalmanControversy over execution of 1993 Mumbai serial bomb blasts convict Yakub Memon found its echo in the Maharashtra Legislative Assembly on Wednesday with the Shiv Sena-Bharatiya Janata Party demanding that Congress MLAs who have sent a letter to the President seeking commutation of his death sentence to life, be booked for treason.

The Lower House saw six adjournments amid sloganeering and uproarious scenes by Sena-BJP and Opposition Congress-NCP legislators.

As soon as the House assembled for the day and the Speaker Haribhau Bagde called for the Question Hour, Leader of Opposition Radhakrishna Vikhe Patil demanded discussion on allegations of corruption against BJP ministers and also debate on Marathwada development.

The Speaker asked the Opposition to allow Question Hour to be taken up after which decision on the issues raised by them be decided.

Congress-NCP members aggressively pressed for their demand and came into the well shouting slogans. Gulabrao Patil (Sena) said seven Congress MLAs who signed a letter to the President opposing death sentence to Yakub should be tried for treason.

“They are anti-nationals as they have questioned the verdict of the Supreme Court,” he said. Sena-BJP members raised slogans demanding “dalals” (agents) of Yakub Memon be punished.

Sena members also brought actor Salman Khan’s photo with a noose after his alleged controversial tweets on Yakub. Vikhe Patil said there was no point in raising sub-judice matters in the House and the Congress has never questioned the decision of the Supreme court.

Amid slogan shouting, Aslam Sheikh (Congress) tried to clarify on the letter to the President but was shouted down by the agitated Sena-BJP members.

The Chair also rushed through day’s agenda of laying of papers, adopting resolution not to accept Supreme Court notice regarding breach of privilege to writer Shobha De.

Similarly, the House passed Co-operative Institutions Amendment bill, Municipal Corporation Amendment bill, Official Language Amendment bill, Maharashtra Regional Town Planning Amendment bill and another bill to postpone elections to management council and senate in universities.

Prashant Bamb (BJP) initiated the debate on Marathwada development and irrigation and Yogesh Sagar, who was in the Chair adjourned the House for the day.
