BMW hit-and-run case: Vismay Shah gets 5 years imprisonment

Vismay Shah, who had recklessly driven his BMW on a busy city road in 2013 and rammed into a motorcycle leaving two youths dead, was on Monday sentenced to five years’ imprisonment by a local court.

Additional Sessions Judge PM Patel awarded the five-year jail term to 28-year-old Shah along with a fine of Rs 25,000.

The court also asked Shah to pay a compensation of Rs five lakh each to the families of the two youths killed in the accident.

The accident occurred in February 2013, when Shah, who was driving his BMW car at a speed of about 110 kmph on the busy Judges bungalow road of the city, rammed it into a motorcycle killing engineering student Shivam Dave (25) and his friend, Rahul Patel (21), near Premchandnagar.

The fathers of Shivam and Rahul, who were present in the court, broke down after the pronouncement of sentence.

Unhappy with the quantum of punishment, they have decided to challenge the verdict in the High Court for a harsher punishment.

“We are not satisfied with the sentence, we will approach High Court in the coming days. He should have been given maximum punishment,” Rahul’s father Ghanshyam Patel told reporters outside the court.

“We will fight the case up to the Supreme Court to ensure that the convict gets maximum punishment and the case is seen as an example for those who kill people on roads. My son will not come back, but I am fighting this case to ensure that such incidents do not take place,” he said.

Regarding compensation, he said they were never fighting the case for money.

The court convicted Shah under IPC Sections 304(2) (culpable homicide not amounting to murder), 279 (rash driving) and 427 (mischief causing damage) and various sections of Motor Vehicle Act.

Under IPC Section 304 (2), the maximum sentence could go up to 10 years of imprisonment.The court has also issued notice to one Lalit Gupta, who was a witness in the case but had turned hostile during the trial.

SC dismisses Vijay Mallya’s plea in FERA violation case

The Supreme Court on Monday dismissed liquor baron Vijay Mallya’s plea seeking quashing of criminal proceedings against him in a case pertaining to violation of foreign exchange rules.

A bench headed by Justice J S Khehar also imposed Rs 10 lakh as costs on Mallya in the case.

Earlier, the apex court had issued notice to the Enforcement Directorate (ED) on the UB Group chief’s plea against the Delhi High Court order turning down his appeal for quashing criminal proceedings in a trial court for alleged “wilful” disobedience of summons issued to him by the ED.

The ED had alleged that Mallya violated the provisions of Foreign Exchange Regulation Act (FERA) in arranging funds to advertise his liquor products abroad over a decade ago.

The agency wanted to question Mallya in connection with a contract signed in December 1995 with London-based firm Benetton Formula Ltd for promotion of the Kingfisher brand abroad.

Mallya had allegedly paid 200,000 dollars to the British firm for displaying the Kingfisher logo in Formula One World Championships in London and some European countries in 1996, 1997 and 1998.

The money was allegedly paid without prior approval from the RBI in violation FERA norms.

40-member CBI team arrives in Bhopal to probe Vyapam scam

A 40-member team of the Central Bureau of Investigation (CBI) arrived in Bhopal on Monday to take over the probe into the recruitment scam in the Madhya Pradesh Vyavsayik Pareeksha Mandal (Vyapam) and the over 40 deaths linked to it.

The team has arrived in Bhopal in accordance with the directions of the Supreme Court.

The team held discussion with MP police officials and the Madhya Pradesh High Court-appointed Special Investigating Team (SIT), which hitherto monitored the investigation on a day-to-day basis, official sources said.

The CBI, tasked with the responsibility of probing the massive rigging of examinations for jobs and admission to various educational institutions, including medical colleges, conducted by the MP Professional Examination Board (MPPEB), also known as Vyapam, will take stock of the progress made in investigation so far and ascertain the number of cases needed to be registered by it.

The apex court had recently handed over to the CBI the investigation into criminal cases related to the Vyapam scam and the deaths linked to it.

Sources said the Special Task Force (STF), which was earlier looking into the Vyapam scam, will submit to the CBI around 10 tonnes — or two truckloads — of documents related to the case.

Around 2,100 people have been arrested in the Vyapam scam, and at least 491 accused are absconding.

The Congress has alleged so far 49 people linked to the scam in some way have died, though the official figure of “unnatural deaths” submitted by the SIT to the MP High Court so far stands at 25.

The scam involves several professionals, high-profile politicians and bureaucrats. The Congress has even accused Madhya Pradesh Chief Minister Shivraj Singh ​Chouhan of complicity and demanded his resignation.

Senior Uttar Pradesh minister Azam Khan has asked Prime Minister Narendra Modi to bring back terrorists from Pakistan with him when he goes there next year for the SAARC summit.

“The Prime Minister while returning should bring back terrorists wanted in the country in his own plane from Pakistan the way they were taken to Kandahar on a flight,” the UP Parliamentary Affairs and Urban Development Minister told reporters here last night after attending an Iftar party.

Khan was referring to the release of three hardcore terrorists including Maulana Masood Azhar, who were taken out of the country in a special plane, by the Indian government in exchange for the lives of the 155 passengers and the crew members of Indian Airlines plane IC-814, which was hijacked and taken to Kandahar in Afghanistan.

India has been demanding that Pakistan hands over 26/11 Mumbai attacks mastermind Zaki-ur-Rehman Lakhvi, Jamaat-ud- Dawah chief Hafiz Saeed and others involved in terror activities in India. India has also sought custody of underworld don Dawood Ibrahim and his aides, who are believed to be in Pakistan.

Prime Minister Modi had last week accepted his counterpart Nawaz Sharif’s invitation and agreed to visit Pakistan next year for the South Asian Association for Regional Cooperation (SAARC) Summit to be held in Islamabad. The two leaders met on the sidelines of the Shanghai Cooperation Organisation (SCO) summit in Ufa in Russia.

Along with a fully clothed image of himself, Bieber shared: “Hey I Deleted the photo of my bu** on Instagram not because I thought it was bad but someone close to me’s daughter follows me and she was embarrassed that she saw my bu** and I totally wasn’t thinking in that aspect.

“And I felt awful that she felt bad. To anyone I may have offended I’m so sorry. It was completely pure hearted as a joke but didn’t take in account there are littles following me!!! Love u guys (sic).”

Taylor Swift shares nostalgic picture with Nick Jonas

Taylor-SwiftTaylor Swift and Nick Jonas teamed up for an unexpected performance of “Jealous” at the country star’s gig in the Met Life stadium.

Swift, 25, who is on her “1989 World Tour” in New Jersey, surprised all her fans by bringing up former Jonas Brothers member onto the stage to perform along.

Work for development of the nation

We erroneously feel that development starts by inviting tenders, laying foundation stone, getting photographed and making speeches. Later the government mostly tends to forget it or pass the responsibility towards the entrepreneur. Several hospitals and dispensaries exist in rural and semi-urban areas where there is no doctor and lack of medicines. The government must take initiative to upgrade and equip them for providing affordable healthcare services to the common man.

For cleaning Mithi river one doesn’t have to acquire land and dig another one. There has been a rise in the number of farmers committing suicide. The government must address this issue quickly and offer compensation to farmers. Steps must be taken to offer subsidies to farmers. The Congress has been attacking the BJP government for its failure to waive farm loans. Few days back, Maharashtra Pradesh Congress Committee President Ashok Chavan had held demonstrations in the state to press for his demand for offering compensation package to farmers. Air India had to delay the departure of its Newark flight from Mumbai by nearly an hour after it was reported that the principal secretary to Maharashtra Chief Minister Devendra Fadnavis had not carried his passport with a valid visa.

Former Maharashtra Chief Minister Prithviraj Chavan had demanded an inquiry into the delay of the flight to US. Chavan added that Air India officials have flouted rules due to pressure. He said that Fadnavis should demand an apology for causing inconvenience to passengers. Fadnavis is upset with the media reports of him delaying the Air India flight. He took to twitter to clarify his stand over the issue. Few passengers came in support of Fadnavis and said that he was not responsible for the flight delay. The PMO has intervened in this matter and asked for a report.

Not Troubled by Shuddhi Cast Changes: Alia Bhatt

Alia, 22, said she will approach Shuddhi, which was announced in early 2014, like any other project.

The film, to be produced by KJo’s Dharma Productions and directed by Karan Malhotra, originally had Kareena Kapoor Khan and Hrithik Roshan as the lead pair.

But the film was delayed due to Hrithik’s health issues leading to his exit following which Kareena also walked out. Later, Salman was roped in but his leading lady was undecided. After some time, Salman also opted out.

“I feel pressure before every film whether it’s big or small. I don’t feel like I should take anything for granted. There is pressure but it is good pressure. I am not feeling bogged down. I am excited about the film and I want to put up a great show,” said Alia.

This is the third time she will be teaming up with Varun after Student Of The Year and Humpty Sharma ki Dulhaniya.

“I hope we live up to that expectation and entertain our audience.”

This is the fourth film that KJo is producing a film starring Alia after Student Of The Year, 2 States and Humpty Sharma Ki Dhulania. They will work together again in Kapoor and Sons co-starring Sidharth Malhotra and Fawad Khan.

“Karan is like a father to me. That is the relation I have with him. Whether we are working on a film together or any other project it is so much fun. We are comfortable with each other and the chemistry is right,” Alia said.

All of Alia’s films till date have been hits and she is glad with the success each of her projects.

“I am not sitting, taking a backseat and thinking I have achieved something. I don’t feel I have achieved anything. I feel I have a long, long way to go. I have just started. More than being content I am excited, energetic and nervous to do more good films,” Alia said.

As there are a lot of newcomers and even established actresses around, Alia thinks competition is important.

Arjun Kapoor won’t host ‘Comedy Nights with Kapil’ episode

Arjun-KapoorArjun Kapoor has denied rumours that he will take on as the host of a few episodes of ‘Comedy Nights With Kapil’ while Kapil Sharma recuperates from an injury. However, he says he remains a fan of the show.

“Have woken up to random things before in the media…but this is a different level…they have attached my name to be part of comedy nights. I love television in India & @KapilSharmaK9. I remain a fan of the show as a viewer…that’s it not gonna host episodes. #randomnewsday (sic),” Arjun tweeted on Monday.

Comedian Kapil Sharma, who hosts the show, is recovering from a slip disc and he has been advised three weeks’ rest, a source close to him said, adding that in his absence, every episode of the show will have a different host.

Names like Arshad Warsi, Riteish Deshmukh and filmmaker Sajid Khan are reportedly going to host episodes of the show.

However, officials at the channel, which airs ‘Comedy Nights With Kapil’, were not available to comment on the matter.
