NCP under I-T scanner over Rs. 34 crore cash deposits

The Maharashtra unit of the Nationalist Congress Party (NCP) has come under the scanner of the Income Tax department after it recently detected cash deposits of over Rs. 34 crore in the party’s account without depositor details like PAN card.

The I-T’s investigation unit in Mumbai issued summons to the party to furnish documents and relevant details to it after the taxman detected the movement of funds in the NCP’s account in the Bank of Maharashtra Nariman Point branch between April 1, 2013-April 21, 2014.

The inquiry, official sources said, has been made part of the Election Commission (EC) mandated expenditure protocols in view of the ongoing polls.

The I-T raised a query as none of the deposits prima facie reflect the Know Your Customer (KYC) details required for such cash deposits, like Permanent Account Number (PAN) or other banking details of the depositors, sources added.

The total cash deposits during the same period have been found to be at Rs. 34.75 crore.

In its reply, NCP’s Chartered Accountant firm in Mumbai — U G Devi and Co — said that the deposits “represent the collections made by the party from the various district and constituencies in Maharashtra by way of coupons which are in the denominations of Rs. 1,000, Rs. 500 and Rs. 100.”

Under current rules, political parties have to furnish vital details of depositors and donors like PAN, bank account number and addresses in case the cash amount is above Rs. 20,000.The CA firm has asked I-T authorities for time till the first week of June to provide its explanation as at present the rank and file of NCP is busy with polls.

“The collections from various individuals/well-wishers of the party are made under the supervision of office bearers and district and elected representatives.”

“Coupon booklets are issued to the party functionaries for raising donations from the party’s well-wishers. All collections are in small denominations, i.e. Rs. 1,000, Rs. 500 and Rs. 100, taken from various individuals in the various districts of the state.”

“No amount exceeding Rs. 20,000 from a single individual is taken hence there are no PAN, account numbers, bank details which can be furnished,” the CA firm said in its reply to the summons issued on April 17 under Section 131 of the I-T Act (Power regarding discovery, production of evidence).”

The CA firm has said it will take time to collect all the details after correlating all the contributions received from each district with the coupons issued by NCP.

Sources in the I-T department said that the time as sought had been granted to the party.

Reacting to the development, an NCP spokesperson said in Mumbai that all the deposits in the party’s bank account were “in order” and it would soon give details to the Income Tax department.

“All our bank deposits are accounted for. They are from our party workers, people’s representatives and the public,” NCP spokesperson Nawab Malik told.

“We are going to explain in detail (to I-T authorities) about the bank deposits,” Malik said.

Singer Ankit Tiwari sent to judicial custody till May 26

Playback singer Ankit Tiwari, who is facing rape charges levelled against him by his girlfriend, has been remanded to judicial custody till May 26. The `Aashiqui 2` singer has been accused of allegedly raping his female friend on several occasions on the pretext of marriage.

Although the 24-year-old singer has refuted the claims made by the victim, a case has been registered against him at the Versova police station, Mumbai. The singer has been booked under IPC sections 376 (rape), 493 (cohabitation caused by a man deceitfully inducing a belief of lawful marriage), and 506(2) (criminal intimidation) while his brother Ankur Tiwari was charged with criminal intimidation.

Nagesh Mishra, the lawyer from Ankit`s side has however denied the charges saying they were completely fabricated and filed to extort money from Ankit.

“Why was the victim silent all this while? When she learnt that Ankit has become successful in his career, she came to us to demand money. But when we flatly refused to pay, she filed a false complaint against my clients,” he said.

Rhea Pillai rents out her apartment?

It`s raining trouble for Rhea Pillai, and there seems to be no end to her worries. Just few days back, it was reported that her live-in partner Leander Paes had allegedly forced her out of their home in Mumbai.

And now, it is learnt that she is living off the rent from her flat in a Bandra building, a possession she had acquired from her former husband Sanjay Dutt.

Pillai is currently engaged in a legal battle with Paes seeking permanent custody of their eight-year-old daughter Aiyana.

Hospitalised Man Thrashed to Death by another Patient

A 65-year-old man, undergoing treatment at a private hospital in south Mumbai, was thrashed to death while two other patients were seriously injured when a fellow patient attacked them with an iron stand, police said.

According to police, the deceased was identified as Lilabihari Thakur, who underwent treatment for tuberculosis (TB), was repeatedly hit with the iron stand this morning in the general ward of the Bombay Hospital, police said adding that Thakur was to be discharged from the hospital today.

The accused Shahabuddin Talukdar (42), suffering from AIDS and kidney failure and undergoing treatment in the ward, was arrested in this connection, police said.

According to police, Talukdar suddenly lifted the iron stand with hooks used for hanging blood and glucose bottles and began hitting Thakur and another patient Prafulchand Parmar (70) and his relative Janardhan Arte (66).

“The motive behind the attack is not yet clear as the accused is presently undergoing treatment in J J hospital,” senior inspector at Azad Maidan police station Narendra Singh said.

Parmar and Arte sustained grievous wounds, while Thakur succumbed to his injuries, police said adding that further probe was on.

Whom will AAP support?

The Aam Aadmi Party ruled out backing the Third Front to stop BJP from coming to power. With the marathon Lok Sabha elections wrapping up, senior AAP leader Gopal Rai said AAP will consider offering issue-based support to a Third Front government if such an initiative was launched based on election results which will be out on May 16. However, later Arvind Kejriwal ruled out Rai’s statements and denied that they will back Third Front to stop NDA. AAP has denied this news and alleged media for playing ‘Dirty Politics’. Kejriwal tweeted, “There is absolutely no question of supporting third front. Media should stop playing dirty games on the eve of elections. Media will spread rumours against us till the last moment. AAP have categorically denied this news and issued an official statement on it. This last minute tactics by the opposition camp to confuse the voters is highly condemnable. Media should not be running after sensational news. The craziness to be first amongst the media to report the news without a basic verification will hugely backfire on their credibility.

The talk of possible cobbling together of “secular forces” to stop BJP from coming to power has gained momentum in the last couple of weeks with Samajwadi Party supremo Mulayam Singh Yadav and a number of other leaders exuding confidence of such a formation, expecting that Congress would not do well to form UPA-III. AAP wants to defeat the BJP this time, as it is rightly feared, if the BJP comes to power now, it will definitely retain its hold on the masses, that there will be no scope for the AAP/Congress to fight for power or position. Therefore, the present election is crucial for the BJP. If it manages to come in power this time, then no one will stop them ever. tBJP will be refreshed with new vitality and new force to win over all is adversities. AAP is rootless. The Congress is slackening. The Left and Right have lost hope. Lalu Prasad Yadav, Mulayam Singh Yadav, Mamata Banerjee, Nitish Kumar, Prakash Singh Badal, Omar Abdullah, J Jayalalitaa all will be confined to the territories of their activities. The BJP is the only party with national agendas and worry about progress, development and unity in the Country. Modi is not the only leader in the party. BJP will provide leadership to the country. Kejriwal is a court Vidushaka – Sundaram.

Rai, considered close to AAP chief Arvind Kejriwal, however, said a decision on future role of the party will be taken after analysing the outcome of the election. AAP has fielded candidates in 422 Lok Sabha seats and Kejriwal had earlier claimed that his party will win at least 100 seats. However, reality is that of winning ten seats is also very difficult for Aam Aadmi Party. It is hazardous to guess AAP would bag seats in double digit numbers. The AAP had in a stunning victory in its electoral debut bagged 28 seats in Delhi Assembly elections in December last year and a number of senior party leaders said they will repeat the “surprise” in the Lok Sabha polls as well. The party is hoping to perform well in Punjab, Haryana and Delhi.

Many political pundits say that, Kejriwal has rejected the people who earnestly voted for him rejecting two major political parties BJP and Congress. How much money is spent for conducting elections? His sudden and immature decision has disappointed many good people who voted for him. AAP may take decision to support anybody after getting seats in LS Polls. To stop BJP, every other politician wants to contribute something. However, majority of common people are supporting BJP. Mr. Kejriwal is the real hero who is trying to bring the much wanted change this country needed in the present scenario. He doesn’t want media attention, but media want to cover him as majority of people are supporting him. Again, anyone can stand against anybody in the true spirit of our democracy. Don’t do hero worship, one person is not capable of doing everything for the entire 120 crore population. Neither is he a super human nor an angel to do so. There is always conflicting comments from AAP leaders. Party leaders are confused as common man is baffled about AAP. Anyway, this election has become fight between Modi and Kejriwal. Both have done their best in convincing people and promoting themselves in cut throat competition. At this crucial time, any wrong statement from party members can lead to controversy. AAP is a newly emerged party and yet has to go long way. Let’s wait and watch, whom they support in future. If they want to stay for long run here then they have to support any one group.

Manmohan Singh to hold last Cabinet meet on May 17: Report

Prime Minister Manmohan Singh will on May 17 hold his last Cabinet meet before demitting office after 10 years as the head of a UPA coalition government, a report said on Monday.

The Prime Minister would be demitting office on May 17, a day after the Lok Sabha elections results are announced. He had earlier this year announced his retirement, after a decade at the helm of two successive United Progressive Alliance (UPA) governments.

On January 03, 2014, Prime Minister Manmohan Singh addressed his final press conference, and only his third one in 10 years. He announced his retirement from politics at the press conference.

Known as a workaholic who has never taken a holiday, Manmohan Singh has not even now drawn up any holiday plans after retirement, say people close to him.

The Prime Minister will address the nation before demitting office.

Manmohan Singh, India’s 13th prime minister and the first technocrat to rule the country, will still be visible in public life – as a Rajya Sabha member. He was re-elected for a six-year term last year, his fifth successive since 1991.

The 81-year-old Prime Minister had announced earlier this year that he would not seek a third term in case the United Progressive Alliance (UPA) comes back to power.

The Oxford and Cambridge-educated Manmohan Singh has been prime minister since May 2004 when Sonia Gandhi hand-picked him for the job.

CBI constitutes SIT to probe multi-crore Saradha chit fund scam

Central Bureau of Investigation (CBI) on Monday constituted a Special Investigation Team (SIT) under a joint director to probe the multi-crore Saradha chit fund scam in which investors in West Bengal, Odisha and Assam were duped of Rs. 10,000 crore.

The Supreme Court had handed over the probe to the CBI last week after West Bengal police department investigating the case failed to make any headway.

It directed the police forces of the three states to cooperate in the probe with CBI.

The apex court had said that no breakthrough was made in the conspiracy angle, money trail and seizure of properties in the scam.

The CBI will also look into the role of regulators like SEBI, authorities under the Companies Act and the Reserve Bank of India (RBI) as directed by the apex court.

The court in its order had pointed out that there was yet another aspect which relates to the role of the regulatory authorities.

“Investigation conducted so far puts a question mark on the role of regulatory authorities like SEBI, Registrar of Companies and officials of the RBI within whose respective jurisdictions and areas of operation the scam not only took birth but flourished unhindered,” a bench headed by Justice TS Thakur said in its order.

No inquiry pending against Gadkari: IT Department

The Income Tax department has made it clear that there was no pending investigation against former BJP president Nitin Gadkari.

In response to an application filed by a RTI activist Sumit Dalal of Delhi, the Directorate of Income Tax (investigation), Nagpur has said, “There is no inquiry or investigation presently pending in this directorate against Nitin Gadkari of Nagpur”.

BJP sources said today this had vindicated the former party chief’s position that “the allegations of wrong doing levelled against him in January 2013 when he was about to get a second term as the BJP president, were baseless and politically motivated”.

Gadkari, in all his public utterances over the last more than one year, has been asserting that “the timing of this malicious and sinister campaign, mounted through a motivated high voltage media blitz, was part of a conspiracy to tarnish my image,” the sources added.

Dalal had filed an application under the RTI Act, 2005, seeking details of the Income Tax cases pending, if any, against Gadkari.

Killing of inmate: Jail authorities draw court’s ire

Terming as serious matter the killing of an undertrial by other inmates, a Delhi court has suggested that the possibility of a “cover-up” by the Rohini Jail authorities to save senior officers cannot be ruled out and said it required an independent probe.

The court pulled up the jail authorities for failing to prevent the April 25 murderous assault on Rajvinder, who was also a witness in a criminal case against his attackers, on the prison premises and not informing it about the incident until the case came up for hearing 10 days later.

The court sought a detailed report from the jail authorities regarding the circumstances under which witness Rajvinder was housed in the same jail and barrack accessible to the accused persons and why the aspect of his death was concealed and withheld from it.

Noting that the jail authorities had suspended junior officers, the court said it could have been an attempt to save those who were actually guilty of culpable negligence.

Additional Sessions Judge Kamini Lau slammed the jail authorities for their failure in keeping a check over inmates who had managed to sneak into a different ward and had killed an undertrial, who was a witness in the case against them.

The court said it was a serious matter that undertrials were having a free access to any place in the jail complex without any inhibitions and added that it required an independent probe.

“…It is a serious matter that the undertrials can have a free access to any place in the complex without any inhibitions in the manner in which it has happened. How is it that undertrial prisoners housed in a different ward could have easily managed to sneak into a different ward duly armed with a ‘kattan’ (a dangerous weapon) without any inhibition, obstruction or anybody stopping them?

“This in fact is a serious matter requiring an independent probe/inquiry. This I say because the manner in which an action has been hurriedly initiated against comparatively junior officers of the rank of Head Warden and Warden by suspending them, is something which gives me a lurking feeling that perhaps something is amiss.

“And therefore, the possibility of this being a cover-up to save the officers of the jail administration actually guilty of culpable negligence cannot be ruled out,” the judge said.

The court’s observation came in a case in which it had received an information on April 26 from the Rohini Jail Superintendent that on April 25, accused Manpreet Singh along with two other inmates assaulted their fellow prisoner Rajvinder, who was lodged in a different ward and was a witness in the criminal case against them.

The authorities informed the court that Rajvinder was attacked on his neck and other body parts with the weapon causing grievous injuries and was taken to hospital.

The judge, however, was not informed by the authorities about Rajvinder’s death and it was only on May 5 when the case came up for hearing, the advocates appearing in the matter disclosed this to the court.

Accused Manpreet was lodged in ward number 2 while Rajvinder was housed in ward number 6.

AAP attacks EC for not taking action against media houses

The Aam Aadmi Party (AAP) today attacked the Election Commission for not taking action against “erring” media houses for showing Narendra Modi’s video speech on the polling day, which is a violation of the Model Code of Conduct and termed it as an “ostrich approach”.

“Aam Aadmi party is shocked to see the gross violation of the MCC by media houses and the ostrich approach of EC today wherein TV News channels have been broadcasting Narendra Modi’s live speeches.

“The whole of India is aware that Modi is a contestant in Varanasi and broadcasting his political speeches today amounts to influencing the voters of Varanasi. Aam Aadmi party hopes this complaint will wake the EC from its stupor and the people will witness consummate action instantaneously,” AAP said in a letter to the Election Commission.

It has also urged the Commission to take “strong” and “exemplary” action and questioned its silence against media houses. Channels of more than three media houses aired Modi’s speech.

“Model Code of Conduct is applicable on all citizens of India and media houses are no exception. By not initiating suo-moto action against these media channels, is the EC indicating its submissiveness.

“During an election, it is the ECs bounded duty to conduct it in a free and fair manner. Why isn’t the EC issuing any direction to these news channels to stop the broadcast forthwith Why is the EC silent on this violation” the letter added.

“We demand the EC to take strong and exemplary action against the erring TV Channels immediately and upholding its role of the sentinel of the constitution during polls,” the letter added.

With polling in Varanasi underway, the BJP’s Prime Ministerial candidate Modi, in his message, spoke about the ‘Ganga Jamuna tehzeeb’ of the holy city and appealed to its voters there to reflect its spirit of unity and harmony through their votes.

“I appeal to people to cast their votes in the last phase of polls with the same zeal and enthusiasm they have shown so far. My brothers and sisters in Kashi, the honour of Kashi is in peace, harmony and unity….We should love each other and take everybody along,” Modi said.
