HC upholds framing of charges against gangster under MCOCA

Framing of charges against a member of Ayub Chikna gang under Maharashtra Control of Organised Crime Act (MCOCA) for firing at a person and robbing his gold ornaments in 2009 has been upheld by the Bombay High Court.

A bench headed by Justice V M Kanade held that Anwar Elahi Fazal Elahi Khan had been rightly booked under MCOCA for being a member of an organised crime syndicate. It opined that the trial court was justified in framing charges against him.

Anwar had filed an appeal against the trial court’s order, framing charges against him under MCOCA, on January 16 this year, for committing robbery and firing at a person, in order to create terror in the locality.

“We have scrutinised evidence available against the appellant and are of the firm opinion that the evidence is more than sufficient to frame charges under Section 228 of the Criminal Procedure Code and to proceed against him in the matter,” judges said.

The court observed that before framing charges in this case, the appellant did not seek discharge under Section 227 of the CPC and the charge has now been framed. Therefore, judges said that they were of a firm opinion that the court was right in framing charges under various provisions of law.

“Accordingly, we do not find any legal infirmity in the court’s order and dismiss the appeal,” the judges said.

On April 24, 2009, Suresh, a resident of Dahisar in North Mumbai was robbed by unidentifed men who opened fire and took away gold bangles he was carrying in a bag.

According to the police, Anwar was among a group of people who had fired at Suresh. He was arrested on July 21, 2012, and booked under MCOCA. The complainant also pointed at Anwar during the identification parade, saying he was the person who had opened fire and robbed him of valuables.

Expedite probe in forgery plaint by Kuwaiti envoy: HC to cops

The Bombay High Court directed the police to expedite probe into the complaint of alleged forgery, filed by former Kuwaiti Consul General Faisal Essa Al-Yousuf Al-Essa against city businessman Sanjay Punamiya.

Essa holds administrative powers of the Al-Sabah Court building, owned by the royal family of Kuwait, in south Mumbai. Essa has been locked in a dispute over Punamiya’s alleged illegal possession of one of the flats in the building.

A division bench of Justices N H Patil and Anuja Prabhudessai directed the senior police inspector of DCB, CID to expedite probe into the complaint filed by Essa against Punamiya and produce the investigation papers before the court on June 30.

The court was hearing a petition filed by Punamiya seeking to quash the complaint lodged against him.

Essa, who left for Kuwait in April 2013 following a kidney replacement surgery after spending three decades in India, had alleged that Punamiya forcibly occupied a flat in the Al-Sabah Court building in his absence.

Punamiya’s counsel, Ashok Mundargi, argued that Essa had handed over the flat’s tenancy to him (Punamiya) in September 2012 for a monthly rent of Rs. 50,000.

Additional public prosecutor K V Saste said that their probe is still on and they are waiting for the hand writing expert’s opinion about the signatures.

The Al-Sabah Court building was bought by the royal family in the early 1950s, while the neighbouring Al-Jaberia building is in possession of fellow royals, the Jabars of Kuwait.

Essa had administrative powers of both the buildings till 2010. He later requested the then king of Kuwait, His Highness Shaikh Saad Al-Abdullah Al-Salem Al-Sabah, to transfer Al-Jaberia’s administrative powers to another person while he would continue looking after Al-Sabah. After the king’s death in 2012, his heir renewed Essa’s administrative powers over Al-Sabah.

People who tend to sleep better, usually have a tinge of glow on their faces, and the under eye skin seems more taut and healthy. This renders a natural touch of “makeup” to the entire face.

Use facial creams carefully

Many women commit the crime of using their usual moisturisers and creams for their under eye area also. It should be understood that the demands of the skin under the eyes differ from that of the rest of the face. This area is three times more sensitive than the entire face. Therefore, you need to invest in gentler, more absorbable and nutrient-fortified creams that are dermatologically tested and specially recommended for the under eye skin.

Your pillows matter too!

Most under eye skin problems are attributed to improper circulation of blood. It has been established that the circulatory pattern can get disturbed by the angle of your head, which is affected by your choice of pillow. If you use pillows that are too hard or too soft, they can upset the supply of sufficient nutrients to the under eye area, by making your head tilt too low or too high. Use a pillow that does not induce too much of an incline or dip in the angle of your head.

Increase vitamin K intake

The delicate under eye area needs particular nutrients in greater concentration than the rest of the facial skin. This includes vitamin K. This vitamin is found in some of the premium under eye creams and rub-ons. But you can get a higher amount of this vitamin by including large amounts of green leafy vegetables and soybeans in your diet.

Massage does help!

It is often recommended that the under eye skin should be left untouched, given the extra sensitivity of it. However, the entire layer of skin over and around the eyes needs to be gently massaged, just like the rest of the face. Just shut your eyes, take some a good under eye cream and massage it all over the eye and under it, in circular motions, very gently. This should be done at least once every week to ensure proper circulation of blood.

Keep it cool

Most women don’t know that apart from cucumber slices, there are many other options for cooling and reinvigorating the under eye skin. This area consists of many blood vessels that tend to become visible over a period because of constriction that makes them more obtuse. A simple way of healing such vessels is using a pack of ice cubes. You just need to place some ice cubes on your eyes and below it for 2-3 minutes. This needs to be done two times during the week for quicker results.

BJP’s prime ministerial candidate Narendra Modi’s close aide and party in-charge of Uttar Pradesh Amit Shah on Tuesday made a blistering attack on Congress vice president Rahul Gandhi by questioning his leadership skills and ability to take important decisions.

Mocking the Gandhi scion, Shah said, “Sometimes his mother says something, now his sister said something, God forbid, if he becomes PM will he go back to his mummy asking what to do?”

Shah made this remark while addressing a rally in Uttar Pradesh’s Hathras.

Both the sides have attacked each other ever since the beginning of the Lok Sabha Elections with the BJP blaming the ruling coalition for ruining the country’s economy and failing to stem corruption and the Congress accusing Modi of making his party a one-man show.

Shah’s attack on Rahul Gandhi comes on a day when Congress chief Sonia Gandhi said that the BJP’s prime ministerial candidate has created a crazy situation throughout the country in order to grab the prime ministers chair.
“In order to grab the prime minister’s chair he has created a crazy situation around the nation. It seems as if he has no belief on our socio-constitutional apparatus. Therefore, it makes us to think whether the country will be safe in the hands of such a person who dreams like this. Congress has always sacrificed for the unity of this country,” Sonia Gandhi said at a rally in Islampur.

In another development, Sonia Gandhi’s daughter Priyanka also reacted to BJP’s allegations against her husband Robert Vadra in connection with latter’s alleged land deals, saying the charges are politically motivated.

As Priyanka Gandhi vowed to fight back the allegations against her husband, Congress too pulled out all the stops in his defence and slammed Narendra Modi for levelling “cheap and baseless” allegations against members of the Gandhi family.

Shedding its inhibitions, Congress, which was describing Vadra as a “private individual” till the other day, went hammer and tongs against Modi and BJP for “practising politics of malicious persecution with a revengeful attitude against the Gandhi family”.

Vadra has been under attack from BJP and some other parties for quite some time over controversial land deals in Haryana and Rajasthan.

SC orders government to disclose details of black-money probe

The Supreme Court on Tuesday ordered the government to disclose details of black-money probe to the petitioner.

The apex court also pulled up the Centre for not complying with its directions, including to hand over probe to SIT, on black-money issue.

The Supreme Court had earlier rejected Centre’s plea to recall its order for setting up a Special Investigation Team (SIT) to probe all cases of black-money, saying it stepped in as for over six decades “the government failed to bring back the money stashed in foreign banks to the country”.

The apex court by its July 4, 2011 order had converted the High Level Committee (HLC) formed by the government to monitor all issues relating to black-money into an SIT by appointing former apex court judge B P Jeevan Reddy as its head.

Another former apex court judge M B Shah was appointed as the Vice Chairman of the 13-member SIT into which Director of Research and Analysis Wing (RAW) was inducted.

It included directors of CBI, Intelligence Bureau, Enforcement Directorate, Chairman of CBDT, Director General of Revenue Intelligence, Director General of Narcotics Control, Director of Foreign Intelligence Office (FIO) and Joint Secretary of Foreign Trade.

The erstwhile HLC was headed by the Revenue Secretary.

BJP ‘well wishers’ deviating campaign focus with petty statements: Narendra Modi

Sensing that irresponsible statements by party leaders and members of the Sangh Parivar may derail his pro-development poll campaign, BJP’s prime ministerial candidate Narendra Modi on Tuesday sent out a stern message saying petty statements by claiming to be well wishers of BJP are deviating the campaign.

Though Modi did not name any individual, Modi expression of unhappiness can be seen as his disapproval of the vitriolic rants by the likes of Pravin Togadia and BJP leader Giriraj Singh.

Modi tweeted: “With great happiness, the entire nation is looking towards BJP for going to people solely on the issues of good governance & development.”

“Petty statements by those claiming to be BJP’s well wishers are deviating the campaign from the issues of development & good governance.”

Modi’s attempt to set the record state comes amid suggestions that certain sections with the BJP and the larger Sangh Parivar are actively trying to discredit and derail his campaign given the increasing possibility that he will actually make it to 7 Race Race Course Road on May 16.

The Congress has also responded to Modi’s tweets. Senior party leader Abhishek Manu Singhvi said, “Modi has not even cancelled ticket of Giriraj Singh,so these are crocodile tears.”

Priyanka defends husband Robert Vadra, says he is being defamed, humiliated

Coming out in strong defence of Robert Vadra, Priyanka Gandhi alleged, on Tuesday, that attempt is being made to malign her husband but ultimately truth will prevail.

Addressing a rally in support of her mother and Congress candidate Sonia Gandhi she said, “Lot of harsh words are used for my family, my husband, I feel sad. I feel sad not for myself but because someone is being defamed and truth is not coming out.”

“I tell my children that truth will come out one day….I have learnt from Indiraji how to bear all this…when there is truth is the heart and when the intent is right then a shield forms inside us and the more we do good the stronger it becomes,” she said, adding, “I will fight with all my might.”

Priyanka also ruled that the elections are not being fought on issues of development and aspirations of the youth of the country.

Appealing for votes, she said, “I have no doubt that you will support Sonia ji, it is not because we have a long standing relationship but don’t vote for Sonia ji, you should give your vote for the country, for the future of your children.”

Vote for a country where people love each other, she added.

“My mother wasn’t born, but you’ll accepted her. That’s the beauty of this country,” she said.

Priyanka’s strong defence of her husband comes at a time when Robert Vadra’s business deals are increasingly being put under the scanner by the BJP and the media.

BJP leaders like Uma Bharti have even announced that Vadra will have to go to jail if the BJP comes to power.

Party’s prime ministerial candidate Narendra Modi has also often targeted Vadra by calling him ‘damaad’ and ‘jija’ while alleging that Vadra had made millions through largesse of the Haryana government under Congress’ Bhupinder Singh Hooda. Man commits suicide in Ghaziabad, requests Modi to take care of daughter

A 35-year-old man committed suicide by jumping in front of a speeding train in Masuri area and left behind a suicide note requesting Narendra Modi to take care of his daughter after his death, police said on Tuesday.

The deceased has been identified as Om Prakash Tiwari, who lived with his family in Loni area of Ghaziabad.

The suicide note recovered from his possession says, “Dear Narendra Modi Ji, you are going to become the Prime Minister of India. I am committing suicide due to financial problem. I request you to take care of my daughter after my death.”

Om Prakash has also stated in his one-page suicide note that nobody was responsible for his death.

“We have got to know that Om Prakash’s family had been facing financial problem for the past few years following which he took such extreme step last night,” said a senior police officer. His body has been sent for post mortem and further investigations are on, police said.

Coalgate: CBI summons PC Parakh for questioning on April 25

Former Coal Secretary P C Parakh has been summoned by CBI for questioning on April 25 in connection with allocation of coal block to Hindalco.

The agency has finished examining top executives of the Rs. 2.4 lakh crore Birla company in connection with the allocation.

CBI had registered a case naming 46-year-old Birla, Parakh and unknown officials of Hindalco and coal ministry last year under various sections pertaining to criminal conspiracy and corruption for alleged irregularities in the allocation of coal blocks nine years back.

The probe in the case gained momentum after the agency took written answers from T K A Nair, Advisor to Prime Minister Manmohan Singh, in connection with entire coal scam especially on Talabira-II.

Ramdev courts trouble, seeks votes for Uma Bharti at yoga camp

Overlooking the directive by the Election Commission, yoga guru Baba Ramdev has sought votes for Bharatiya Janata Party’s candidate from Uttar Pradesh’s Jhansi constituency, Uma Bharti.

At a yoga camp here, Ramdev urged his supporters to cast their ballots in favour of Bharti. He later defended his act, saying the event was non-political.

Last week, the Election Commission had asked district election officers not to grant permission for activities like yoga camps if there was possibility of their misuse for political campaigning.

“It has come to notice of the commission that in certain places while permission was sought by certain organisations to organise non-political activites like yoga shivirs etc. the platform was used for political campaigning in clear violation of the condition for which permission was granted,” the poll panel had said.

The Congress had complained to the poll panel about alleged political message at a yoga camp held by Baba Ramdev in the national capital.

This is not the first time Baba Ramdev has come forward to support Bharti.

Last month, the yoga guru had announced that if the BJP agreed to field Bharti from Rae Bareli, he and his followers would campaign for her.
