Railway submits report to HC on platform height to avert mishaps

Railway-submitsThe Railway authorities submitted before the Bombay High Court a report of an expert committee to examine gaps between footboards of local trains and railway platforms here in view of mishaps occurring in the suburban route.

The committee has recommended in its report that the optimum height of suburban platforms was 900 mm and in any case should not exceed 920 mm as there was a risk that the rakes could hit the platform.

The report was placed before a bench headed by Chief Justice Mohit Shah, which decided to hear on March 20 the plan of action drawn up by Railway authorities to implement the measures suggested by the Committee.

Counsel for the Railways Suresh Kumar asked four weeks time to submit the action plan. However, the court said it would consider its plea for granting time on the next occasion.

The bench had taken up the issue suo motu, as a 16-year- old college girl Monica More, lost her arms after falling into a gap between the platform at the suburban Ghatkopar station while trying to board a train last month.

The tragic incident brought to the fore the risk lakhs of commuters face daily in boarding crowded suburban local trains, the “lifelines” of Mumbai.

The bench had asked the expert committee to inspect each and every platform on the Central and Western Railways routes and decide how much space should be left between the platforms and the footboards of trains so that mishaps could be avoided.

The report of the committee said that trials had been conducted by a Research Design and Standards Organisation (RDSO) team on all the platforms having 920 mm height using both varieties of suburban rake and mail/express rake.

The minimum clearance (gap between platform and footboard of rake) was 44 mm for air spring coaches and 34 mm for coil spring coaches in fully-loaded condition. Thus, special care will have to be taken in case of coil-spring rakes especially during monsoon, the report said.

The Committee said it has found that increasing height of platforms beyond 920 mm was not possible within the present design of platform coach interface.

HC issues notice to police, Lahane in atrocities case

Bombay-HCThe Bombay High Court issued a notice to police and T P Lahane, dean of state-run J J Hospital, seeking their replies to a petition challenging the anticipatory bail granted to Lahane in an atrocities case.
Justice A R Joshi was hearing the petition filed by Naresh Waghela, the sweeper against whom Lahane had allegedly made a casteist remark, seeking that the dean’s anticipatory bail be cancelled.

On February 14, Waghela had lodged a case alleging he was verbally abused by Lahane who also made a derogatory casteist remark.

According to the complaint, Lahane got into a fight with Waghela when the latter asked another sweeper to stop working as all the temporary class-four workers of the hospital were on strike demanding permanency of their jobs.

An FIR was lodged against Lahane under section 3(1) and 10 of Atrocities Act and under Indian Penal Code.

The sessions court had on February 27 granted anticipatory bail to Lahane on a cash surety of Rs. 15,000.

Waghela challenged this saying the sessions court should not have gone into the merit of the case while deciding the anticipatory bail application but should have looked into whether custodial interrogation was necessary or not.

The high court today issued notices to the police and Lahane and directed them to file their replies within three weeks

Air India takes back 13 sacked cabin crew members

Air-IndiaAir India has “unconditionally” taken back 13 of the 17 cabin crew members it had sacked recently for indiscipline and defying flight duty time limitation, allegedly following pressure from a section of the employee unions, AI sources said on Thursday.

A decision to revoke their termination was taken after the Shiv Sena-backed breakaway faction of the All India Cabin Crew Association held a meeting with AI chairman and managing director Rohit Nandan, they said.

“The management has taken back unconditionally all the 13 permanent in-flight staff, including a purser, whose services were terminated for gross indiscipline, due to pressure from the Shiv Sena-affiliated faction of the association,” the sources said in Mumbai.
Air India officials were not available for comments.

Coming down heavily on its erring cabin crew, the loss -making national airline had sacked 16 air hostesses, four of them on contract, and a flight purser over a period of nine days in February-March for not following Flight Duty Time Limitation (FDTL) norms.

While sacking the staffers, the Government-run carrier had said “Air India had been asking them to follow FDTL rules for over six months but they failed to do so and this forced the management to take this extreme step.” FDTL norms are guidelines governing issues like maximum daily flight duty period, including flying hour limitations, rest period, staff-on-duty travel and number of landings allowed per pilot as well as the crew.

NCP-backed All India Cabin Crew Association (AICCA), which claims to represent the 3,600 cabin crew members in the national carrier, had disapproved of the AI action.

The association, which till 2011 had the backing of Shiv Sena, suffered a split after its leader Kiran Pawaskar switched loyalty to Sharad Pawar’s NCP.

As against an industry average of 75 hours of monthly flying, AI cabin crew averages only 52 hours on international routes, while in domestic sector it is 55 hours.

Follow ‘alliance dharma’: Shiv Sena slams BJP

The veritable storm, which erupted in Shiv Sena days after its bête noire, the Maharashtra Navnirman Sena (MNS), decided to support the BJP in the state without joining the NDA or the saffron Grand Alliance, does not seem to have died down.

Launching a scathing attack at the BJP ahead of crucial General Elections, Shiv Sena said that there is a ‘trust deficit’.

In an editorial in Shiv Sena’s mouthpiece ‘Saamana’, party’s chief Uddhav Thackeray said that the Bharatiya Janata Party has angered its allies and should adhere to the “dharma” of the alliance.

“…Modi’s rise in Gujarat was possible because Bal Thackeray stuck to the dharma of alliance and did not align with Waghela…The BJP leaders who tried to reach out to the Sena deserters should read this history,” Uddhav said.

Uddhav also stressed that BJP wanted Modi to become prime minister of the country but for that “BJP needs to create an atmosphere of trust”.

“Our ideology of Hindutva is not to gain power. We don’t don the garb of Hindutva in hunger for power and there is no room for betrayal in Hindutva. Our ideology is Hindutva and will continue to be so irrespective of anyone being with us or not,” the editorial said.

Uddhav said, “If BJP wants power at the Centre with Modi as prime minister, it should create an atmosphere of trust. You don’t get trust if you don’t create one yourself for others.”

The Shiv Sena president also said his party was capable of fighting its own battles. “If you sidestep and betray friends who have stood by you through thick and thin, you will be self-inflicting the label of betrayal,” Uddhav said.

Referring to some reports appearing in media, Uddhav said the BJP has adopted a new policy of “tying up with one regional party and carrying out backdoor deals with another”.

Albeit the BJP has tried to mollify its oldest ally Shiv Sena, yet all such efforts seem to have failed. The mood in the Shiv Sena soured after MNS chief Raj Thackeray last Sunday announced support for Modi without joining either the NDA or the five-party saffron “Grand Alliance” in the state. He also announced the putting up of MNS candidates against Shiv Sena nominees, except in Pune.

The development stirred the politics in Maharashtra with Shiv Sena flexing its muscles over continuation of alliance. This prompted top BJP leadership, including Rajnath Singh and BJP’s PM hopeful Narendra Modi, to do firefighting by pacifying Uddhav. Uddhav also accused BJP of adopting self-defeating tactics.

“..The party is hitting its head against the wall and has hurt itself in the process. BJP should invoke provisions of the Domestic Violence Act to treat their self-inflicted injuries. After being told by us, Narendra Modi, Rajnath Singh, Rajiv Pratap Rudy have applied ‘zandu balm’, but what is the guarantee that there will be no domestic violence again,” the editorial said.

Uddhav said BJP owed its national identity to regional parties like Shiv Sena.

“Despite the Hindutva wave after Rathyatra, BJP could not form government on its own even though towering leaders like AB Vajpayee and Advani leading it. It was Pramod Mahajan who deftly handled the coalition of 30-32 parties,” Uddhav said.

Actor Saif Ali Khan booked for assaulting businessman two years ago

Actor Saif Ali Khan has been booked for assault in an incident that took place in February 2012. The trial will begin on April 30.

Mr. Khan was present at the court today and pleaded not guilty to the charges framed against him.

Mr. Khan allegedly punched NRI businessman Iqbal Sharma in a restaurant at the Taj Hotel in Colaba after Mr. Sharma sent over a note asking the actor’s group to talk softer. Mr. Khan was having dinner with actress Kareena Kapoor, now his wife, her sister Karisma Kapur and their friends Malaika Arora Khan, Amrita Arora, her husband Shakeel Ladak and producer-actor Bilal Amrohi. Mr. Ladak and Mr. Amrohi have also been charged with assault.

Mr. Khan apologized after the incident, saying: “It is our responsibility that we always behave the right way. So in one way, I would like to apologise about what happened and I think even this could have been handled in a different way. I get angry at things any normal person will get angry at. But it should not be displayed in public.”

Mr. Khan also said he acted in self-defence. His lawyer Mohan Jayakar said “Saif was provoked after women at the table were abused. Filthy language was used by Mr. Sharma.”

Mr. Khan was arrested the next day and released on bail after paying Rs. 15,000.

The actor was then just weeks away from releasing Agent Vinod, his first film as producer, co-starring Kareena.

Maharashtra Council polls: Shiv Sena candidate withdraws from race

Shiv Sena candidate Rahul Narvekar on Thursday withdrew from the biennial Legislative Council elections in Maharashtra, paving way for the rest of the candidates to be elected unopposed.

Narvekar visited the election office at Vidhan Bhavan and gave the letter of withdrawal of his candidature.

Today is the last day for withdrawal of nominations. The election for the nine seats of the Upper House of the state Legislature is scheduled to be held on March 20.

Chandrakant Suryavanshi, Haribhau Rathod and Shivajirao Deshmukh (Congress), Anand Thakur, Kiran Pawaskar and Hemant Takle (NCP), Vinod Tawde and Pandurang Phundkar (BJP) and Neelam Gorhe (Shiv Sena) are all now set to be elected unopposed.

The 287 elected MLAs and one nominated member form the Electoral College for elections.

With quota for winning candidate being 29, Shiv Sena with 45 MLAs fell short of numbers to get both its candidates elected.

The strength of various political parties in the Legislative Assembly is: Congress-81, NCP-62, BJP-46, Shiv Sena-45, MNS-12, PWP-4, SP-3, Jan Surajya Shakti, Bahujan Vikas Agadhi two each, Bharipa Bahujan Mahasangh, Lok Sangram, Rashtriya Samaj Party, Swabhimani Party one each and 24 independents.

Arvind Kejriwal, AAP members booked for causing chaos at Mumbai airport

In yet another trouble for former Delhi chief minister Arvind Kejriwal, he and some members of his Aam Aadmi Party (AAP) were on Thursday booked for causing disturbances in various parts of the city and at the airport during his road show yesterday.

Kejriwal and some members of his party, including Preeti Sharma, were booked under the Bombay Police Act 37 (3). They have been charged under Sections of 188, 141 and 143 by the Mumbai Police.

The AAP leaders have been blamed for causing great inconvenience to the common public during their road show on Wednesday.

AAP convenor Kejriwal was blamed for jumping a traffic signal. The party has also faced criticism for not taking prior permission from the concerned authorities for its road show.

However, the party has hit back, saying it is an attempt to malign the party.

The AAP has blamed police for the incident and said there was no personnel to clear the chasing cameras and though Kejriwal’s auto stopped at the traffic signal, police forced it to move forward.

Reacting to the charge that Kejriwal did not take due permission for his road show, the party said, “This (commute from the airport to Churchgate railway station) was no road show or event. The misreporting that we broke some law in this journey is malicious, to the say the least.”

The AAP also pointed a finger at police for isolating Kejriwal at the Andheri Railway Station, and forcing him to enter through a wrong entrance, while party volunteers were waiting for him at another entrance with full preparation to ensure that normal Mumbai commuters were not affected.

“This led to complete mayhem as there weren’t enough police to handle the craze that set off on seeing Kejriwal, many people tried to reach out to shake hands, wish him… And the situation became quite chaotic.”

Alleging misreporting on the issue of damage to scanners at Churchgate, the party said that “defunct scanners fell due to the media frenzy and surging supporters… They were down for a few minutes and immediately put back in place by our volunteers and no damage was caused”.

“AAP is really curious as to what levies will Home Minister (RR Patil) extract from the AAP for a momentary collapse of defunct scanners when he has failed to extract any levy from parties which burn and damage public property on a routine basis,” the party said.

“We state that whatever little disturbances that were caused during Kejriwal’s visit, were due to poor handling of law and order, of the overzealous media, who risked public safety in their quest for visuals,” it added.

Kejriwal is currently touring Maharashtra, and as part of his four-day visit to the state, he has arrived in Nagpur.

Malicious image circulated by opposition to malign me: Shewale

A malicious image was made viral across Mumbai, which has a picture of Shri Rahul Shewale, Shiv Sena-BJP-RPI candidate from Mumbai South Central constituency with a banner headline that reads – ‘Make late Shri Balasaheb Thackeray’s memorial in Indu Mills.’

This is a malicious campaign made by the opposition to damage Shewale, who is also chairman, standing committee of the BMC. “I have never issued this statement. This fake clip is made to create controversy with an eye on Dalit votes in South-Central,” said Shewale.

Since past 10 days, Shewale has been conducting record rallies in Chembur, Mankhurd, Govandi, Wadala, Dadar, Matunga and Shivaji park area. His rally in Dharavi received a huge turnout.

Born in Dharavi, Shewale has been relentlessly campaigning in the Dalit stronghold, which has upset the opposition. “The opposition is frustrated and raking up controversy. People are with Mahayuti. This fake image shows they want to instigate the Dalit voters against me,” explained Shewale.

Why the government is playing a rule game?

The search for the missing Malaysian Airlines flight MH 370 has made some headway as Malaysian officials identified one of the passengers travelling with a stolen passport. The officials said that their probe was focused on the stolen passports and they were probing the issue from a hijack and sabotage angle. The officials are still trying to identify the second individual. There are various statements and media releases but the fact remains that the plane is not yet traceable and has mysteriously vanished. The lack of any pro-active measures of our government only furthers the belief that we do not have what it takes to be an assertive regional power and grants substance to the suspicion that, additionally, we may be incompetent in the areas of surveillance, search and rescue compared to several other smaller nations in this part of the world. With five Indian people on board of the missing plane, our apathetic attitude is disgusting when one considers how the Government of India recently went hammer and tongs at a superpower merely to protect a certain high-ranking government official from a well-deserved prison sentence. Obviously, the lives of five ordinary Indians and the anxiety of their families does not mean as much for them. What a shame.

A Mumbai couple, Vinod Kolekar and Chetana, along with their son, Swanand, were on board the missing Malaysian Airlines flight from Kuala Lumpur to Beijing to visit their older son, Sanved, who is doing post-doctoral studies in the Chinese capital. Kranti Shirsath, 44, from Pune, one of the five Indians on board, was on her way to meet her husband in North Korea. The Kolekars, residing at Yoginagar in Borivali West, left for Beijing on Friday night after a stopover in Kuala Lumpur. Swanand, 23, had completed his engineering degree and was planning to do M.Tech. Vinod, 59, retired as engineer and is now a consultant. His wife, 55, took voluntary retirement from the laboratory of a major hospital in Mumbai. It is very exciting to see the responses of the Indian authorities on the situation. Why the government of India is playing a rule game in this crucial time? Though we have lost only a few lives from our country, it is very responsible act of the government to inform the public what steps have been taken so far to bring back those victims. The Indian Government should immediately dispatch its team to join the operation that has been going on for the cause of those Indian lives. If it is possible then Indian satellite should be connected in search operation. There is no need to monitor the flights by human intervention continuously. The data produced need to be analysed only in case of problems. This can be done by the Airlines to decentralise the effort.

The fact that no debri has been found so far leads to the guesswork that there is no rubble at all. For all we know, the plane has been hijacked and it’s transponder is switched off and the plane has been taken to an unknown destination. The fate of the passengers are not known and the plane maybe used for some other purpose, probably for crime, and much later we will come to know the fate of the plane and it’s passengers. It could be a scene straight out of science fiction, in an era where mobile phones and Facebook postings of private individuals are accurately tracked and archived; it is too difficult to conceive that designs for knowing movements of aircrafts have not been unified by its manufacturer. Are business interests of aircraft manufacturers more important than lives of passengers of ill-fated flights? US intelligence agencies and Boeing manufacturers definitely owe an explanation to the world’s citizens. This scheme should not cost much if the aircraft manufacturers provided the transmitters connected to the black box which receives all the vital parameters continuously in the planes .We are simply living with the old concept of sealed black box in the modern world where every plane has satellite linked phones.

It’s astonishing to note that even after 48 hours of losing contact with the plane; no agency is able to locate the possible crash site! With so many satellites and spying mechanisms and technology to the fore, isn’t there one method in the world to detect this kind of accident?

Delhi HC upholds death penalty of 4 convicts in December 16 gang-rape

gange-accusedThe Delhi High Court on Thursday upheld the death sentence of four convicts in the December 16, 2012 gang-rape case.

A division bench of Justice Reva Khetrapal and Justice Pratibha Rani also dismissed the appeals of the four convicts challenging the trial court verdict awarding them death penalty.

Welcoming the HC’s decision, the father of the victim hoped it would act as a deterrent in the future.

Former IPS officer Kiran Bedi, meanwhile, pointed out that now it is to be seen how soon the Supreme Court and the President finalise the decision. The perpetrators will be hanged to death one day, added Bedi.

A 23-year-old physiotherapy intern was gang-raped, and brutally sexually assaulted by six men, including a juvenile, in a moving bus. The accused then threw her and her male companion out of the vehicle, stripped of clothing, to die by the roadside on the cold December night.

The woman died of grave intestinal injuries on December 29, 2012 at Singapore’s Mount Elizabeth Hospital, where she was airlifted for specialised treatment.

One of the six accused was found dead in a cell in Delhi’s Tihar Jail. A juvenile involved in the crime was on August 31, 2013 sent by the Juvenile Justice Board to a reform home for three years, the maximum term under the juvenile law.

The trial court had on September 13, 2013 awarded the death sentence to Mukesh (26), Akshay Thakur (28), Pawan Gupta (19) and Vinay Sharma (20).

The court had then referred the case to the high court for confirmation of the sentence.

The chargesheet was filed on January 03 last year.
