Delhi HC directs Cong leaders to remove posts against Smriti Irani daughter, issues summons

The Delhi High Court on Friday issued summons to Congress leaders Jairam Ramesh, Pawan Khera and Netta D’souza in a civil suit filed by Union Cabinet Minister Smriti Irani.

The court also directed the congress leaders to remove the post, videos, tweets, retweets, and morphed pictures of the plaintiff and her daughter along with the allegations and stop their recirculation regarding allegations made against her and her daughter.

Union Minister Smriti Irani has filed civil defamation seeking permanent and mandatory injunction along with damages of over Rs 2 crore.

Justice Mini Pushkarna stated, “I am of the prima facie view that slanderous allegations were made against the plaintiff without verifying actual facts”. “Grave injury has been caused to the reputation of the plaintiff in view of the tweets and retweets carried out due to the press conference of the defendants”, the court added.

Plaintiff has made out a prima facie case and the balance of convenience lies in favour of the plaintiff and against the defendants.

I deem it proper to pass an interim injunction directing Jairam Ramesh, Pawan Khera and Netta D’souza to delete and remove the allegations made during the press conference from all social media platforms including Youtube, Facebook and Twitter inc.

They are also directed to remove the post, videos, tweets, retweets, and morphed pictures of the plaintiff and her daughter along with the allegations and stop their recirculation.

If defendants 1-3 fail to comply with the directions within 24 hours of this order, defendants 4-6 (social media platforms) are directed to take down the material, the court added.

Union Minister Smriti Irani has filed civil defamation seeking permanent and mandatory injunction along with damages of over 2 crores rupees and stated that congress leaders Jairam Ramesh, Pawan Khera and Netta D’souza conspired with other unknown individuals to launch a series of scathing and belligerent personal remarks to malign and defame a young child of the plaintiff who even not lives in the country.

On the Delhi HC proceeding on Friday congress leader, Jairam Ramesh tweeted that, “The Delhi High Court has issued a notice asking us to formally reply to the case filed by Smriti Irani. We look forward to presenting the facts before the court. We will challenge and disprove the spin being put out by Irani.”.

After the catastrophic breakout within the Shiv Sena, Thackerays had to lose power. Perhaps this was one shocker and eye-opener event for the family. All these while Thackeray’s never realized that the power was in their hand but their own party was slithering from them. Uddhav never attended people; Aaditya had a tremendous superiority complex. They were never open to visiting people or winning their hearts. In my 20 years of journalism career, this is the first time I could never get a chance to meet CM Thackeray. For the publicity and photo op, he met a few people of his own plot but not the common masses.

Even if we blame ED and central agencies, why were only these leaders on the radar? Why not Subhash Desai or other leaders? There has to be some fire to see the smoke. I don’t deny that the BJP has misused central agencies, but I also do not buy the logic that the ED is the sole reason to force these leaders to quit Shiv Sena. Internally all was not well and the anger mounted so much that the leaders rebelled. After realizing the mistake, Uddhav and Aaditya are running to the poll to communicate with Shiv Sainiks and save their souls. Otherwise, it was only Sanjay Raut who was battling it from four corners. Raut was a little irritating with his way of dialogue delivery but he was never disloyal to his party.

Now father and son touching the ground and reaching out to the people In Maharashtra, the effects of the Sena versus Sena political crisis can be seen at the district level, with Maharashtra Chief Minister Eknath Shinde announcing that he will be visiting the same districts, Nashik, Ahmednagar and Aurangabad, where Aaditya Thackeray’s Shiv Samvad Yatra was held last week. Maharashtra CM Shinde is on a three-day tour from today. Wherever he reaches he nullifies the stand of Thackeray. Eknath is a seasoned Sainik and he was skilled not only under Dighe but also Balasaheb, he has those peculiar traits of both. He knows where to divert the wind. All this while he got close to Sena leaders being a provider and protector, and Uddhav was left to CM post getting detached for the roots.

Over the past three weeks, he has actually begun to connect with people. Uddhav and his son Aaditya have been holding meetings with remaining party representatives, visiting party offices and trying to stimulate the party cadre that has remained loyal to him. Balasaheb was authoritative but was very possessive of his Sainiks and party leaders. In his era, some leaders rebelled but none of them could submerge the party. Uddhav lacks that robustness. Above all this is the era of social media. BJP and its followers successfully created the negative, anti-Hindu perception of Shiv Sena. Now no Navneet Rana is on the streets to recite Hanuman Chalisa and no protest against the loudspeakers in the mosque.  The IT and ED raids have stalled, by joining the BJP alliance all the corrupts are authenticated as honest. Now the only focus is on bow and arrow.

Kirit Somaya is calm, media trials have weakened, no ST workers protest, and all have been settled in the state as if someone has done the magic. I wish Uddhav could have cared for Shakhas, his ground-level Sainiks and those who unconditionally loved the family. The father-son duo now focusing on Mumbai which has been Sena’s stronghold. Out of 14 Sena MLAs in Mumbai, five have defected with Shinde while eight are still with Thackeray (one died and the seat remains vacant). Most Sena councillors have also stood by Thackeray so far. After Mumbai, the Thackerays decided to mobilise the party cadre and establish a connection with the people statewide. Thackeray’s close aides insist that the Sena’s voters have not shifted their loyalty. But this time they both should make every effort to reach out to their voters. In the 2014 assembly elections, even at the height of the Modi wave, Shiv Sena contested against BJP in a triangular fight and won 63 seats. In the 2019 assembly elections, they won 55 seats in alliance with BJP. Many seats Sena have won in the two successive elections have a traditional Shiv Sena support base which remains loyal to the party and not the MLA. That’s why Uddhav and Aaditya should connect with the people and ground-level workers.

At present Aaditya Thackeray’s future is not looking very good. It looks like he will have the same place as Rahul Gandhi in the current scenario. No credibility, no administrative experience. In coming years if they lose to BMC then nothing much remains for them. The ambience in Shiv Sena is hardly conducive to training future leaders of the country. Controversy and confrontation are never the hallmarks of leadership. Of the three types of behaviour, aggressiveness, assertiveness and passiveness is the way to go. Whereas Shinde as CM brilliantly seeping into the emotions of people, visited dilapidated Police quarters, he announced road repairs, he is talking about gutter, water and meter issues of people. Slowly people will disassociate him with the rebel tag.

For now, both the camps are keenly awaiting the Supreme Court’s hearing on August 1 when the top court is expected to deal with a bunch of petitions challenging decisions and actions taken by the rival camps. The court verdict will have a major impact on the political drama in Maharashtra that began on June 20. Speaking as a Marathi, born, living and voting every time in Maharashtra and knowing the mindset of the people around, we used to support Uddhav more than Raj because of the image Balasaheb Ji had in our mind, he was trustable and wouldn’t change his ideology at whatever cost unlike his son Uddhav.

Sri Lankan government initiates talks to form ‘All-party’ government

The Sri Lankan government has initiated a negotiation with opposition parties on Thursday in an attempt to form an ‘all-party’ government in the crisis-hit country.

Newly elected President Ranil Wickremesinghe has begun a conversation with the Sri Lanka Freedom Party (SLFP) and the talks are expected to complete in one week, the Daily Mirror reported citing the sources.

However, the main opposition party Samagi Jana Balawegaya (SJB) will not join the government. However, some of its MPs are contemplating joining the ruling side individually.

The National Freedom Front (NFF) led by MP Wimal Weerawansa also sent a positive signal to the president yesterday, pledging support to him.

MP Weerawansa said in writing the country is left with only two options, one to lead it down the path of an anarchical situation as in Haiti or to salvage it from the current mess at least at the last moment through consensus, reported Daily Mirror.

He said the president had taken genuine steps to resurrect the country from the present abyss and therefore his party was ready to guide that exercise regardless of past political differences or enmity.

The NFF submitted proposals for the president in this regard. The NFF supported MP Dullas Alahapperuma in the ballot for the selection of the president on July 20.

Nevertheless, the party took a different stand when it voted for the emergency regulations on July 27 in Parliament. The National Freedom Front had handed over a 12-point proposal to President Ranil Wickremesinghe.

In his proposal, Weerawansa outlined the important facts that have been proposed by his party to rebuild the nation.

He further calls for the establishment of an all-party government to address the various issues in the country, according to News Wire.

Wickremesinghe was elected to be the president of the South Asian country in a parliamentary vote on July 20 and was sworn in a day after. He was elected as the new Sri Lankan President after 73-year-old Gotabaya Rajapaksa had gone into hiding after crowds of protesters stormed his residence on July 9.

For the record, Sri Lanka has experienced an escalating economic crisis and the government has defaulted on its foreign loans. The United Nations warned that 5.7 million people “require immediate humanitarian assistance.” With many Sri Lankans experiencing extreme shortages of essentials including food and fuel, peaceful protests began in March.

The protests led then-Prime Minister Mahinda Rajapaksa to resign on May 9, and his brother, President Gotabaya Rajapaksa, to flee the country on July 13 and resign the following day.

Uttarakhand HC tells SDMA to keep watch on an artificial lake near Gangotri glacier

The Uttarakhand High Court has directed the State Disaster Management Authority (SDMA) to conduct annual surveys of an artificial lake formed near the Gangotri glacier from May to September.

A division bench of the high court comprising Chief Justice Vipin Sanghi and Justice R C Khulbe issued the order on Thursday while disposing of public interest litigation (PIL) filed by Delhi resident Ajay Gautam.

The PIL claimed the artificial lake may pose danger in the future as it is located right at the point where the Ganga originates in the form of the Bhagirathi from the snout of Gaumukh.

The survey should be conducted annually from May to September when the snow melts and the water levels rise, it said. All records related to the artificial lake during the period should be maintained online and published on the SDMA website, the high court said.

The PIL has claimed that the formation of the lake might cause a tragedy like the one in Kedarnath in 2013 that killed thousands of people.

New health warnings issued by centre for all tobacco product packs

The Central government on Friday notified new sets of specified health warnings for all tobacco product packs by making an amendment in the Cigarettes and other Tobacco Products (Packaging and Labelling) Rules, 2008. The amended rules will be applicable with effect from December 1, 2022.

“The Ministry of Health and Family Welfare, Government of India has notified new sets of specified health warnings for all tobacco product packs by making an amendment in the Cigarettes and other Tobacco Products (Packaging and Labelling) Rules, 2008 vide GSR 592 (E) dated 21st July, 2022 ‘The Cigarettes and other Tobacco Products (Packaging and Labelling) Third Amendment Rules, 2022’. The amended Rules will be applicable w.e.f. 1st December, 2022,” the official statement read.

All tobacco products manufactured or imported or packaged on or after December 1, 2022, shall display the images provided by the government with the textual Health Warning as ‘TOBACCO CAUSES PAINFUL DEATH’ and those manufactured or imported or packaged on or after December 1, 2023, shall display Image-2 with the textual Health Warning ‘TOBACCO USERS DIE YOUNGER’.

Any person engaged directly or indirectly in the manufacture, production, supply, import or distribution of cigarettes or any tobacco products shall ensure that all tobacco product packages shall have the specified health warnings exactly as prescribed.

Violation of the above-mentioned provision is a punishable offence with imprisonment or fine as prescribed in Section 20 of the Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003, the official statement said.

The existing specified health warning, as per the government data. – notified vide GSR 458(E) dated July 21, 2020, shall continue till November 30, 2022.

Bombay HC order to demolish high rise buildings near Mumbai terminals 2 airport

The Bombay High Court on Friday asked the Mumbai Suburban District Collector to demolish 48 high-rise buildings near the Mumbai International Airport for violation of height norms.

The HC order came in compliance with the orders of the Directorate General of Civil Aviation (DGCA). The portions constructed above a certain height are to be demolished as per the Bombay High Court order.

The high court was hearing public interest litigation (PIL) filed by advocate Yashwant Shenoy raising concerns over the dangers posed by high-rises near the Mumbai airport.

ISIS causing unrest in Afghanistan: Taliban

The Taliban’s acting Foreign Minister admitted that 1,800 ISIS terrorists were released last year and claimed that ISIS fighters have been subdued while on the contrary, ISIS has claimed responsibility for the recent deadly attacks on mosques, schools, and cars across Afghanistan. 

Muttaqi even contradicted his statement, saying “the ISIS prisoners had been causing unrest in the country during the previous 11 months.”

Addressing the Tashkent international conference, acting Foreign Minister of the Taliban Amir Khan Muttaqi informed that when the Taliban took control of Kabul, the Afghan capital, 1,800 ISIS terrorists were released from Bagram and Pul-eCharkhi prisons, the Khaama Press reported. 

During his address, Foreign Minister Muttaqi confirmed the release of the ISIS prisoners and said that the Taliban had grown strong enough to subdue ISIS fighters during the previous 11 months of their administration. 

The previous Afghan administration flew the ISIS members to Kabul after they were besieged by the Taliban in Jawzjan province in northern Afghanistan, Khaama quoted the acting minister as saying. 

Uzbekistan hosted an international conference on Afghanistan on July 25-26 which was attended by the representatives of 20 world countries. 

Earlier, US officials expressed concern over the release of the ISIS prisoners and said that their release by the Taliban from the prisons of Pul-e-Charkhi and Bagram had strengthened the group.

 In February, the nominee to head the US Central Command, Gen. Michael Erik Kurilla raised concern over the Taliban freeing Al-Qaeda and Islamic State (ISIS) prisoners and warned that the foreign terrorist groups are “reconstituting” in Afghanistan. 

All prisoners in detention centres and prisons in Afghanistan were pardoned after the Taliban took control of the country last August. Despite the Taliban’s claims that ISIS does not physically exist in Afghanistan and does not pose a threat, the group had claimed responsibility for deadly attacks on mosques, schools, and cars, the publication said. 

Since the Taliban took control of Afghanistan last August, the country has been mired in violence. The string of terrorist attacks took place in Afghanistan on April 21, 2022, including the attack against the Seh Dokan Mosque in Mazar-e-Sharif and a separate attack in Kunduz, both claimed by Islamic State in Khorasan Province (ISKP), an entity affiliated with Islamic State in Iraq and the Levant (ISIL/Da’esh).

 The attacks have resulted in dozens killed and many more injured and follow other recent attacks against civilians and civilian infrastructure, including in religious minority communities, across Afghanistan. Moreover, the law and order situation has deteriorated and Afghan citizens are living in perpetual fear of blasts and explosions.

Prime Minister Narendra Modi on Friday that reforms in drones, space and geospatial sectors are opening up new avenues.

“Removal of angel tax, removal of retrospective tax, and reduction of corporate tax – are encouraging investments and industry. The reforms in drones, space and geospatial sectors are opening up new avenues”, he said.

Addressing the gathering, the Prime Minister congratulated the students on getting their degrees. “Congratulations to all those who are graduating today in Anna University’s 42nd convocation. You would have already built a future for yourselves in your minds. Therefore, today is not only a day of achievements but also of aspirations”, he said.

Calling them the leaders of tomorrow, the Prime Minister also noted the sacrifices of the parents and support of teachers and non-teaching staff of the University.

The Prime Minister recalled the words of Swami Vivekananda in what was known as Madras 125 years ago about the possibilities for the youth of India.

The Prime Minister remarked that “the whole world is looking at India’s youth with hope. Because you are the growth engines of the country and India is the world’s growth engine.”

The Prime Minister also recalled former President Dr APJ Abdul Kalam’s association with Anna University. “May his thoughts and values always inspire you”, said the Prime Minister.

PM Modi noted that the COVID-19 pandemic was an unprecedented event. “It was a once-in-a-century crisis that nobody had any user manual for. It tested every country,” he said.

He remarked that adversities reveal what we are made of. “India faced the unknown confidently, thanks to its scientists, healthcare professionals and common people,” said PM Modi.

As a result, he said, every sector in India is bustling with a new life while adding that industry, investment, innovation and international trade, all are seeing India at the forefront.

The Prime Minister said India was the world’s second-largest mobile phone manufacturer last year. “Innovation is becoming a way of life. In just the last 6 years, the number of recognised start-ups increased by 15,000 per cent,” he said.

The Prime Minister informed that India received a record FDI of over 83 billion dollars last year and said that India’s start-ups too received record funding post-pandemic.

He added that above all this, India’s position in the international trade dynamics is at its best ever. In this era of tech-led disruptions, the Prime Minister said there are three important factors in India’s favour. He said that the first factor is there is a taste for technology. There is a growing sense of comfort with the use of technology. Even the poorest of the poor are adapting to it, he added.

“The second factor is there is trust in risk-takers. Earlier at social occasions, it was difficult for a youngster to say he or she was an entrepreneur. People used to tell them to ‘get settled’, meaning, get a salaried job. Now the situation is the opposite. The third factor is: there is temperament for reform,” he said.

The Prime Minister said that earlier, “there was a notion that a strong government means it should control everything and everyone. But we have changed this. A strong government does not control everything or everyone. It controls the system’s impulse to interfere. A strong government is not restrictive but is responsive. A strong government does not move into every domain. It limits itself and makes space for people’s talents”.

He gave examples of freedom and flexibility provided to youth by the National Education Policy and the scrapping of 25,000 compliances for ease of business.

The Prime Minister underlined the link between the progress of youth and the nation. He said in conclusion “Your growth is India’s growth. Your learnings are India’s learnings. Your victory is India’s victory.”

During the programme, the Prime Minister awarded gold medals and certificates to 69 gold medalists. Tamil Nadu Governor RN Ravi, Chief Minister MK Stalin, and Union Minister L Murugan were among those present on the occasion.

Anna University was established on 4 September 1978. It is named after CN Annadurai, the former Chief Minister of Tamil Nadu. It has 13 Constituent Colleges, 494 Affiliated Colleges spread over Tamil Nadu and 3 Regional Campuses – Tirunelveli, Madurai and Coimbatore.

World Bank says no new plans for financing for Sri Lanka

The World Bank does not plan to offer new financing to Sri Lanka, which is battling its worst economic crisis in decades, until the Indian Ocean nation has an adequate macroeconomic policy framework in place, the lender said on Thursday.

In a statement, the World Bank said Sri Lanka needed to adopt structural reforms that focus on economic stabilization and tackle the root causes of its crisis, which has starved it of foreign exchange and led to shortages of food, fuel and medicines.

“The World Bank Group is deeply concerned about the dire economic situation and its impact on the people of Sri Lanka,” it said.

The bank is repurposing resources under existing loans to help alleviate shortages of essential items such as medicine, cooking gas, fertilizer, meals for children, and cash for vulnerable households, it added.

The bank said it was working closely to establish control and fiduciary oversight to ensure fair distribution.

In the wake of the Gujarat hooch tragedy, Congress leader Rahul Gandhi on Friday expressed concern over the business of spurious liquor and drugs in the state and asked which ruling forces are giving protection to the “mafias” involved.

Forty-two people from Botad and the neighbouring Ahmedabad district have died so far after consuming the spurious liquor on July 25, while 97 people are still admitted to hospitals in Bhavnagar, Botad and Ahmedabad, Gujarat Minister of State for Home Harsh Sanghavi has said.

“In ‘dry state’ Gujarat, many houses were destroyed due to the consumption of spurious liquor. Drugs worth billions are also being recovered from there continuously,” Gandhi said in a tweet in Hindi.

“It is a matter of great concern, on the land of Bapu (Mahatma Gandhi) and Sardar (Vallabhbhai) Patel, who are these people who are indiscriminately doing the business of intoxication?” the former Congress chief said.

Which ruling forces are giving protection to these “mafias”, he asked.

Fifteen key accused, including the one who acquired the chemical and those who sold the liquor to people, have already been arrested in the case.
