The spark was the state unit chief Nana Patole’s decision to appoint Atul Londhe as the MPCC’s chief spokesman. Sawant, who was the media in charge for more than ten years, has sent a letter to the high command with a plea to relieve him from the responsibility of spokesman and assign him a new job. Sawant will continue to work in his capacity as the state Congress general secretary.

Sawant was agitated over the appointment of Londhe, who had quit the Nationalist Congress Party and joined the Congress in November 2016, as the chief spokesman. In the new arrangement, Sawant as the spokesman will have to take tips from Londhe before arguing the party’s official line in the press, media and social media. Sawant was clearly not comfortable with the changes and preferred to step down as the spokesman.

One week ago, around 300 Congress party workers from Palghar, Dahanu, Boisar and Wada have submitted their resignation to Rahul Gandhi and the All-India Congress Committee in charge of Maharashtra HK Patil, over the appointment of Praful Patil as the new Palghar district chief by MPCC(I) Nana Patole.

The letter states that Patole was instrumental in appointing Patil as the new district chief without even consulting or discussing with office bearers at Palghar. It alleges that Patole has brought casteist colour to the party as they both belong to the Kunbi caste.

“Patil was earlier with Kunbi Sena and supported the Bharatiya Janata Party Lok Sabha candidate Vishwanath Patil in 2014. He later switched sides once Patole joined the Congress and Patil was given the prime post,” said a party worker.

“We are paying the price of being loyal to the Congress party and it is up to Rahul Gandhi to decide whether the party needs loyalists or opportunists, who joined the Congress for their selfish needs,” he added.

A copy of the letter has also been sent to senior Congress leader KC Venugopal. In the just-concluded Palghar Zilla Parishad and Panchayat Samiti bypoll, Congress was drubbed heavily and finished fourth with some candidates even losing their deposits.


 

Delhi CM Kejriwal announces aid of Rs 50,000 per hectare for damaged crops

Addressing the press conference, Chief Minister said, “Farmers’ crops have been damaged by unseasonal rains. Farmers are sad, don’t be sad. As always, the government is with you. I have issued orders that farmers who have lost their crops will be given compensation of Rs 50,000 per hectare.”

Kejriwal further said that all Sub-Divisional Magistrates (SDM) and District Magistrates (DM) are conducting surveys which will be completed within two weeks, following which, the farmers will get the compensation in their bank accounts within two months. “A few days back, some farmers had come to meet me. Their crops were damaged due to unseasonal rain. I want to say that there is no need to be sad. In the last six-seven years, when the crops were ruined, we supported you. I want to say that this son of yours is with you. I can understand the pain of the farmers,” he stated.

The chief minister further alleged that the compensation given at the rate of 50,000 per hectare is the highest in the country. The unseasonal rains in the month of October have caused a lot of damage to the crops as the farmers suffered heavy losses in rural areas of Delhi.

The India Metrological Department (IMD) had attributed the unseasonal rains to the western disturbance.


 

Lakhimpur Kheri tragedy: SC slams UP govt, says police ‘dragging its feet’ in case investigation

up government, up govt, supreme court, sc, lakhimpur kheri, lakhimpurThe Supreme Court on Wednesday slammed the Uttar Pradesh government and said that it was getting an impression that the Uttar Pradesh Police was “dragging its feet” in its investigation into the October 3 violence in Lakhimpur Kheri where eight persons, including four farmers, were killed during a farmers’ protest. “We think you (UP Police) are dragging your feet. Please dispel that impression,” a Bench of Chief Justice of India NV Ramana and Justices Surya Kant and Hima Kohli observed.

The observation of the Bench came after noting that the statements of only four witnesses have been recorded under Section 164 of the Code of Criminal Procedure. The apex court adjourned the hearing in the Lakhimpur Kheri case to October 26 and asked the SIT probing the case to record statements of other witnesses also under Section 164 CrPC.

The top court questioned Senior Advocate Harish Salve, appearing for the Uttar Pradesh government, why the statements of other witnesses were not recorded. Salve then requested the Bench for time to record statements of witnesses and the case was adjourned to October 26.

The Bench pointed out that the Special Investigation Team will have to identify the vulnerable witnesses and provide them protection and record their statements under Section 164 CrPC, as it will have more evidentiary value. At the outset, Salve informed the apex court that he had submitted a report on the incident in a sealed cover.

The Bench responded that it never said anything about the report in a sealed cover. Salve said, “A concern was stated that the State was going soft on the accused, now everybody is arrested and they are in jail. As of today, 10 accused are arrested. There are two crimes which were driving into farmers and the other one in which a person was lynched.”

The top court after perusing the report of the UP government questioned why out of 44 witnesses, statements of only four were recorded. The statements of other witnesses were being recorded, but the courts had shut (due to Dussehra break), Salve said. It asked Salve how many accused are in judicial custody and how many are in police custody. Salve replied that out of the 10 accused (in crime related to driving of vehicle into the farmers), four were in police custody.

The Bench then asked Slave, “What about the other six? You did not seek custody so they were sent to judicial custody. What is the situation in this case?” Questioning the UP government on why police custody of other accused was not sought, the Bench said, “Until and unless they are interrogated by police, you won’t find out.”

Salve apprised the apex court that the phones of the accused had been seized and the videos have been sent for forensic examination. “If the forensic reports come, there may not be a need for further questioning,” he added. The apex court was hearing a case where two lawyers had written a letter to the CJI seeking a high-level judicial inquiry into the incident.

The apex court had on October 8 expressed dissatisfaction over the steps taken by the Uttar Pradesh government in the killing of eight persons. Ten people, including Ashish Mishra, son of Union Minister of State for Home Affairs and Bharatiya Janata Party (BJP) MP Ajay Kumar Mishra ‘Teni’, have been arrested so far in connection with the case.

The top court had said it is “not satisfied” with the action taken by the Uttar Pradesh government in the Lakhimpur Kheri violence and also questioned the State on why accused Ashish Mishra was not arrested so far. Ashish Mishra had allegedly mowed down farmers with his car.

The top court had said that the Uttar Pradesh government is not proceeding in the manner, in which it should proceed against the accused while adding that the killing of eight people in Lakhimpur Kheri is a “brutal murder” and the law must take its course against all accused. The top court had asked the Uttar Pradesh government whether in other murder cases the police issue summons instead of arresting the accused.

Not arresting the accused is sending a “wrong message”, the Bench had observed as the police has not arrested Ashish Mishra. The Bench had further observed that transferring the case to CBI for investigation is also not a solution.

Two advocates — Shiv Kumar Tripathi and CS Panda — had sent the letter petition before CJI seeking punishment for politicians allegedly involved in the ghastly incident. The letter had stated, “Having regard to the seriousness of the killing of the farmers at district Lakhimpur Kheri in Uttar Pradesh, it is incumbent upon this Court to intervene in the matter as flashed in the press.” A single-member Commission of Enquiry with headquarters at Lakhimpur Kheri has been constituted to investigate the death of eight persons in Lakhimpur Kheri. Uttar Pradesh government has appointed retired Allahabad High Court judge Pradeep Kumar Srivastava as a single-member Commission to inquire about the incident and enquiry to be completed within a period of two months.

Local farmers blame Union Minister of State for Home Affairs Ajay Kumar Mishra ‘Teni’ and his son for the violence that left eight dead, including four farmers a local journalist and others. They were mowed down by a vehicle that was part of the convoy of Minister in Lakhimpur Kheri in north-central Uttar Pradesh. Videos are also being circulated on social media where a Mahindra Thar was seen knocking down protesters from behind.

The Minister and his son deny the charges. Ashish Mishra and 20 others have been booked for murder but have not been arrested yet.


 

Right to seek ‘default’ bail indefeasible part of right to personal liberty: Delhi HC

The high court said the right of the accused to be set at liberty takes precedence over the right of the State to carry on the investigation and file a charge sheet.

As per law, once the maximum period, that is, 60, 90, and 180 days from arrest, provided for an investigation in a case is over and no charge sheet is filed, the accused becomes entitled to be released on bail, which is called the ‘default’ bail.

Justice Manoj Kumar Ohri said the order of remanding an undertrial to custody or its extension is held to be a judicial function requiring due application of mind.

“The right to seek default bail under Section 167(2) CrPC is a fundamental right and not merely a statutory right, which flows from Article 21 of the Constitution. It has been held to be an indefeasible part of the right to personal liberty under Article 21 of the Constitution, and such a right cannot be suspended even during a pandemic situation.

”The right of the accused to be set at liberty takes precedence over the right of the State to carry on the investigation and submit a charge sheet,” it said.

The court said the rights of an undertrial under the Constitution cannot be allowed to be defeated on technicalities of procedure, and laid down a slew of directions to ensure that their right to seek default bail is not defeated and the custody of an accused is not extended mechanically.

The judgment came on a petition by an accused challenging a trial court’s order dismissing his revision plea seeking default bail on account of the failure of the prosecution to file a charge sheet within the statutory period of 90 days from arrest in a case of dowry death and causing harassment to a married woman.

The high court released the man on default bail on furnishing of a personal bond of Rs 25,000 and a surety of the like amount and directed him not to try to tamper with the evidence or leave Delhi without prior permission.

The man was arrested in the dowry death case on January 18, 2020, and was sent to judicial custody by a magisterial court and his custody was extended from time to time.

While the period of 90 days from arrest expired on April 18, 2020, the man applied for default bail through e-mail on April 20 last year as the physical functioning of courts was restricted due to the nationwide COVID-19 lockdown, however, no response was received.

“…when the petitioner was produced before the jail visiting magistrate on April 15, 2020, the concerned magistrate without any application of mind and rather unmindful of the fact that 90 days were expiring on April 18, 2020, mechanically extended the petitioner’s judicial custody till April 29, 2020,” the high court noted.

The high court noted that owing to the peculiar situation prevailing in the country on account of the lockdown due to COVID-19 when the physical filing of the bail application was not possible, an application was filed on behalf of the petitioner accused through an e-mail sent on April 20, 2020, at around 1.16 pm at the e-mail address provided to the council.

“Nothing more was required to be done by the petitioner. The listing of such an application was not in his hand. Sending an e-mail on behalf of the petitioner, in the opinion of this court, amounted to availing of his right to seek default bail. The contention raised on behalf of the State that the application never came to be listed or was abandoned by the petitioner, being meritless, is rejected,” the high court said.

The court was informed that the charge sheet in the case was filed physically before the duty magistrate on April 20, last year and it was not mentioned in the status report filed by the prosecution whether the charge sheet was filed before the filing of the application for default bail or later.

The high court directed that while extending the custody of an undertrial, the magistrate or concerned court shall not mechanically extend the period of custody for the maximum period of 15 days.

It said the custody shall be extended while keeping in mind the 60th, 90th, or 180th day, depending on the nature of offence and applicability of any Special Act, of completing the investigation and submission of the charge sheet.

“As a necessary corollary, the undertrial prisoner shall be produced before the concerned court on the next day, that is, on the 61st, 91st, or 181st day as the case may be, so that he can be duly informed of his fundamental right to seek default bail if no charge sheet is filed in the maximum period prescribed or the permitted extended period of investigation,” it said.

The court also directed for modification in the present format of ‘Custody Warrant’ and said it shall include a column indicating the day on which the right of ‘default bail’ will accrue to the undertrial.

“Considering the seriousness of the issue involved, this court deems it apposite to seek a response from the Registrar General of this Court as well the DG (Prisons) as to the steps being undertaken so that an undertrial is informed of his right to seek ‘default bail’ and that such right is not defeated, but rather timely exercised. The response and suggestions, if any, shall be submitted in light of the ‘Inter-operable Criminal Justice System (ICJS)’, a platform which came into existence under the aegis of the e-Committee, Supreme Court,” the high court said.

Raj and the mahants had a discussion for half an hour. After this, while talking to the media, Raj Thackeray responded that the image of Balasaheb is seen in him. “Raj Thackeray does what he says, if ideologies match on the issue of Hindutva, then MNS should tie-up with the BJP,” said Guru Maa Kanchan Giri.

She said they had a discussion about the formation of a Hindu Rashtra. “We held a discussion about Hindu Rashtra as well as about his opinions about north Indians. He has affection for north Indians,” she said. She added that the people of Bihar and Uttar Pradesh should live without fear in Mumbai as she saw Raj Thackeray’s love for north Indians. She said Raj was planning to visit Ayodhya in December.

Sanatan Sanstha spokesperson Chetan Rajhans said, “Raj Thackeray’s meeting with Sadhvi Gurumaa Kanchan Giri and Jagadguru Suryacharya Maharaj at Krishnakunj is an important political step. Guru Maa is a supporter of Kanchan Giri’s political movement for Hindu Rashtra. Raj Thackeray has recently made Chhatrapati Shivaji Maharaj’s Emblem the official identity of MNS. It is clear from this that Raj Thackeray will do politics in the direction of Hindutva. Hindutva politics is not new to Raj Thackeray. He is also a strong political spokesperson, so if he follows the path of Hindutva, then surely the Hindutva and Hindu Rashtra movement will benefit.”

Hindu Mahasabha Spokesperson Pramod Pandit Joshi said, “Undoubtedly Raj Thackerey’s ancestral family roots are of staunch Hindutva ideologies. Prabodhankar Thackerey was an executive member of Hindu Mahasabha. Raj Thackeray succeeded as Balasaheb Thackerey’s descendant leader, but family equations have spoiled it all. Recently, Sadhus Sanyasan who met Raj and invited him to Ayodhya has nothing to do with the ‘Ramanuja’ tradition, they are bogus. In fact, Raj Thackerey should be invited by the Priests and Gurus of Ayodhya Shirin. Raj is a popular personality and these Kanchangiri Guru Maa type low profile people take some news space and mileage out of such meetings. Prabodhankar’s grandson who has grown up under Savarkar’s ideological influences needs no political stunts, he will be heard from where he speaks. BJP does have any Hindutva sentiments; they silently shook hands with Congress to finish Hindu Mahasabha.”

Niranjan Nalkur, a businessman said, “The leader who deserved to take lead in the Shiv Sena was Raj Thackeray who by default should have been installed by Bal Thackeray. However, family politics took over and Balasaheb’s son got the benefit of what he did for the Marathi Manoos. Raj got sidelined and eventually took a back seat. Now that he is seeking support from the BJP and vice versa, he will prove to be a useful leader to lead Maharashtra from the front. There are many disdained Shiv Sainiks who if given a chance will opt to join MNS and ditch Shiv Sena. The day is not far when this will happen and Raj will overpower the Shiv Sena which has earned a bad name in the eyes of the Maharashtrians.”

Jagatguru Suryacharya has invited Raj to come to Ayodhya. Raj has accepted the invitation and has decided to go to Ayodhya on Diwali. It is believed that Raj is going to Ayodhya to strengthen Hindu Rashtra.


 

Maharashtra allows Restaurants and eateries to function till midnight

The Maharashtra government has permitted all restaurants and eateries to function till midnight, according to a government notification issued by the state’s Chief Secretary Sitaram Kunte on Tuesday.

The notification comes a day after Chief Minister Uddhav Thackeray chaired a meeting with the state’s COVID Task Force and directed officials to prepare guidelines for extending the operational hours for restaurants and shops.

“… all restaurants and eateries may be allowed to function till midnight and all other establishments that have been allowed to function by the government may be allowed to function till 11 PM,” the notification said.

The state government has allowed the reopening of amusement parks, theatres, and drama theatres from October 22.

However, water rides in amusement parks have still not been permitted, it added.

“We are slowly relaxing the restrictions and the number of patients seems to be decreasing. We are also reopening cinemas and theatres from October 22. There is a constant demand to extend the working hours of restaurants and shops,” a statement quoting Thackeray had said.

Hinduism recognizes all religions as different paths to God. Hinduism gives freedom of faith to Hindus. Right from its inception, Shiv Sena has been a secular party. Hindutva or secularism are the only matters to woo the people with the main principle being to grab power. Power is the main and only aim of all politicians. Principles are only the faces to be shown to people.

The Bombay of the 1960s was part of a state that had just been born after a deadly linguistic reorganization of borders. Then the newly restructured state, however, was caught in a curious economic condition. While industrial growth and employment opportunities rose in the state in significant ways, there was a parallel increase in the number of job seekers. It was Bombay, particularly, that was caught in this battle, with the city witnessing a phenomenal increase in the number of university graduates, with not as many jobs for them to cash on.

In these circumstances of pressure on the part of the educated Maharashtrian youth, there arose a weekly cartoon, the Marmik or “straight from the heart”, that was put across in the most pungent and cynical way, the woes of the “Marathi Manoos”. Bal Thackeray embraced Hindutva as a strategy because the politics on the issues of Marathi-speakers was not paying off.

In 1985, Bal Thackeray understood that Marathi is a good cause for popularity, but it does not have elective merits. On the plank of Marathi, you cannot win elections across nations. Then he came up with Hindutva. So, it was a well-calculated move and he embraced Hindutva…and won the successive elections. Since then, Balasaheb’s outfits became saffron, he started sporting tilak, he was wearing Rudraksha around neck and hand. This complete saffron makeover became overnight popular among Hindutva zealots.

Eventually, Shiv Sena never had a core Hindutva agenda and that is the reason there was no point in attacking Uddhav for abandoning the ideology. On the other hand, Raj had a gift on a Platter, which is left in Hindutva for other parties to cash in; he has moulded it to his advantage by changing the symbol of his political party Maharashtra Navnirman Sena. BJP has already got the credit of being the saviour of Hindutva and hence no other parties will get credit based on Hindutva any more.

Bal Thackeray, the founder of Shiv Sena started his political career with the Marathi agenda and later on took up the Hindutva agenda. Marathi agenda and Hindutva agenda are not contradictory. Chhatrapati Shivaji Maharaj established Hindu Rashtra by fighting the Mughal during the Mughal period. Lokmanya Tilak who gave the slogan of “freedom is my birthright” and who was a Maharashtrian, was an advocate of Hindutva ideology. Bal Thackeray was called Hindu Hridaya Samrat or King of Hindu Hearts. So, the loyalty of Raj Thackeray to Hindutva ideology remains unquestionable.

Shiv Sena’s alliance with the Secular Parties was an experiment motivated by the need to teach BJP a lesson. The two cousins have completely lost their credibility and nothing will help them. Uddhav Thackrey is working under congress and NCP rule. Raj Thackeray campaigned for congress during the 2019 elections. Raj Thackeray’s politics of dadagiri was having tacit support from congress. It helped Congress to divide the votes of Shiv Sena and thereby Rule Maharashtra for 15 years from 1999 to 2014. After the BJP Government came to power the clout of Raj Thackrey declined.

The core vote bank of Shiv Sena is Marathi Manoos and Hindutva supporters. Raj’s party also eyed for this vote Bank concentrating more on Marathi Manoos. Since Shiv Sena is allying with Congress its Hindutva votes will fade away. That is what MNS is eyeing. But since BJP has a firm grip on Hindutva credibility MNS will get nothing. A lot of Marathi Manoos is also Hindutva sensitive and thus that will also go with BJP. Only a small fraction of regional Marathi interest votes will be divided among SS, MNS and NCP. Here NCP will have a better chance to fare as it will also get Muslim votes. Thus, the scope of both Thackeray parties is set to decimate whenever elections happen.

Angelina Jolie, Salma Hayek, Richard Madden, Kit Harington and ‘Eternals’ cast dazzle at the exciting Premiere!

Marvel Studios presents Diwali entertainer “Eternals”, the 25th movie in the Marvel Cinematic Universe and an all-new adventure introducing 10 Super Heroes never seen before on screen, releasing this Diwali 5th November in 6 languages – English, Hindi, Tamil, Telugu, Kannada and Malayalam.

The excitement for the Eternals, which is set to hit the big screens next month cannot be measured as it is immense. There are too many reasons to be excited for the Marvel saga that brings to us the celestial being for the first time.

Ahead of the same, the film recently enjoyed a star-studded premiere event in Los Angeles on October 18. The lead cast including Angelina Joli, Salma Hayek, Richard Madden, Kit Harington, Gemma Chan and more were seen in attendance for the special premiere, which got stellar positive reactions on Twitter too!

While Salma Hayek stole the show in a gorgeous black gown with a plunging neckline and a thigh-high slit, Angelina Jolie got her full family at the premiere. Among the men, Richard Madden looked sharp in his velvet suit whereas Kumail Nanjiani went traditional as she chose to go for a purple-and-gold sherwani for the event. Taika Waititi also attended the premiere!

Eternals is helmed by Oscar-winning director Chloe Zhao and will be the 25th movie in the Marvel Cinematic Universe. The film, which introduces 10 superheroes to the audiences, will release in India this Diwali on November 5 in English, Hindi, Tamil, Telugu, Kannada and Malayalam.
