HC declares Arunachal Pradesh Parliamentary Secretaries Act as ‘unconstitutional’

The Itanagar Bench of Gauhati High Court has declared the Arunachal Pradesh Parliamentary Secretaries (Appointment, Salaries, Allowances and Miscellaneous Provisions) Act, 2007 as “unconstitutional”.

The division bench, comprising Justice Monojit Bhuyan and Justice Rumi Kumari Phukon, on Wednesday, while hearing a public interest litigation filed by Kyoda Ram, pronounced the act as “unconstitutional” in line with the Supreme Court judgement of July 27 last year on the matter of appointing parliamentary secretaries.

“Parties are agreed that in view of the decision of the Supreme Court, the PIL does not survive for further consideration,” the judges stated while delivering the judgement.

The Pema Khandu-led BJP government in Arunachal Pradesh has at present 23 parliamentary secretaries.
