In the aftermath of the devastating incident near Bhushi Dam, where five individuals were swept away by a waterfall on Sunday, the Pune district administration has taken prompt measures to ensure the safety of tourists during the monsoon season and issued a prohibitory order at various picnic spots across the district.

Prohibitory orders have been imposed at popular picnic spots, waterfalls, and dams in Maval, Bhor, Velha, Junnar, Mulshi, Khed, and Ambegaon tehsils of Pune district, including the dams region, effective from July 2 to 31. These orders aim to prevent such tragedies and ensure a safe and enjoyable experience for tourists.

The administration has outlined a series of safety measures for hazardous tourist locations, which includes identification and demarcation of dangerous areas, the presence of lifeguards and rescue teams, installation of warning boards, etc. The order has been issued by Pune District Collector Dr Suhas Diwase under newly implemented section 163 of the Bhartiya Nagari Suraksha Sanhita and the Disaster Management Act, 2005

The order prohibits gatherings of five or more people restricted at the mentioned location, entering deep water bodies created naturally due to rains, taking selfies and creating reels at these sites, all vehicles banned from entering a one km radius of the waterfalls, and alcohol-drinking selling also banned at nominated places. The order also mentioned that any violators of the said rules would face action under the provisions of Section 223 of Bhartiya Nyaya Sanhita 2023 and the Disaster Management Act 2005.

Meanwhile, in the aftermath of the Pune family drowning incident, over 60 makeshift shops near Bhushi Dam were demolished during a joint anti-encroachment drive by the Lonavala Municipal Council and Central Railway on Tuesday.

Pakistani-origin Canadian businessman Tahawwur Rana is one step closer to facing charges in India for his alleged role in the 2008 Mumbai terror attacks. A federal court has highlighted that Rana’s extradition is consistent with the provisions of the US-India extradition treaty.

During a recent session at the US Court of Appeals for the Ninth Circuit, Assistant US Attorney Bram Alden presented compelling evidence, including associations with co-conspirators and fake visa applications. He emphasised the severity of the attacks which claimed 166 lives and left 239 injured.

Rana, currently detained in Los Angeles, has appealed against the decision. His attorney argues that extraditing Rana violates double jeopardy laws, pointing to an earlier acquittal in Chicago. However, Alden maintains that the treaty provisions support India’s right to prosecute Rana.

Vinod, who lost his wife, mother and 16-year-old daughter in the Hathras stampede, expressed his grief over the incident, saying that he lost everything.

Speaking to ANI, Vinod said, “I did not even know that all three had gone to the Satsang because he had gone somewhere outside.

Someone told him that there was a stampede in the satsang, after which I reached the spot and found out that my 16-year-old daughter, mother and wife had died. I could not even find my mother’s body.”

“I am left with nothing… Everything is gone,” Vinod added.

Kamla, the mother of another 16-year-old victim of the Hathras tragedy, expressed grief over the death of her daughter Roshni. She said, “I have been coming to Baba’s satsang for 20 years. Today, I went to attend satsang with my 16-year-old daughter and a stampede broke out around 2 in the afternoon. I and my daughter were slightly injured. She was fine but as soon as she reached the hospital, she fell unconscious; later, the doctors declared her dead.”

Kunwar Pal, uncle of the victim’s 3.5-year-old child, said, “The child had come here with his mother… His mother is still missing…We are residents of Aligarh…”

Meanwhile, the husband of the victim, Gudiya Devi, Mehtab, said, “I tried to stop her from attending the Baba’s Satsang many times but she did not listen. She had come for the Satsang with our daughter & two neighbouring women. The two neighbouring women and my wife died in the incident… My daughter is safe…”

Heera Lal from Aligarh, a family member of a victim, said, “My entire family travelled in a bus to attend Satsang. All his family members are fine except his sister-in-law, who got injured in the stampede.”

The stampede occurred at a religious event in Hathras on Tuesday, in which 116 people were killed and 18 people were injured, officials said.

Earlier, police conducted a search operation at Ram Kutir Charitable Trust in Mainpuri district in search of ‘Bhole Baba’, who conducted a Satsang in Hathras where a stampede took place on Tuesday.

“We did not find Baba ji inside the campus… He is not here…” said Deputy SP Sunil Kumar.

The Uttar Pradesh government has announced ₹ 2 lakh compensation to the family members of those who died in the incident.

Uttar Pradesh Chief Minister Yogi Adityanath has also ordered a thorough investigation into the incident.

Earlier, Prime Minister Narendra Modi expressed his condolences over the loss of lives in the stampede in Hathras and wished speedy recovery to the injured.PM Modi also spoke with Uttar Pradesh Chief Minister Yogi Adityanath following the tragic incident.

“The Uttar Pradesh government is engaged in providing all possible help to the victims. My condolences to those who have lost their loved ones. I wish for the speedy recovery of the injured,” PM Modi said in a post on X.

Hitting out at Rahul Gandhi over his remarks in the Lower House, Delhi BJP MP Manoj Tiwari said that the Parliament is not a place to mislead the public and spread fake information.

“Parliament is not a place to spread fake information or mislead the public. Rahul Gandhi had a lot of fake information in Parliament yesterday. At the time, concerned ministers exposed his lies. It is a part of the procedure to expunge from records the lies told on the floor of the house,” he said. Union Minister Rajiv Ranjan (Lalan) Singh called Rahul Gandhi “immature” and said that the way the LoP was speaking in Parliament looked like he was addressing a public rally.

“Rahul Gandhi is still immature. He has still not matured. He might have become the LoP but he is still not mature. He was speaking as if he were addressing a public rally. There were no facts or truth. He just levelled allegations. He should be mature if he has become the LoP,” Singh said. After Rahul Gandhi’s remarks against the central government led by the National Democratic Alliance (NDA) created a political uproar in the country, several portions of his maiden speech were expunged from the records of the Parliament.

The portions expunged include his comments on Hindus and PM Narendra Modi-BJP-RSS among others. Rahul Gandhi in his speech in Lok Sabha on Monday afternoon, during the debate on the motion of thanks on President Draupadi Murmu’s address accused the BJP and RSS of preaching and spreading violence and hatred. His remarks drew protests from the Treasury benches.

The Bharatiya Janata Party – led by Prime Minister Narendra Modi and Union Ministers Amit Shah and Rajnath Singh among others stood up to express their protest and rebut the Congress MP’s remarks. Bharatiya Janata Party (BJP) Maharashtra Legislative Council member Prasad Lad on Tuesday demanded the resignation of the Leader of Opposition (LoP) from the Uddhav Thackeray faction of the Shiv Sena, Ambadas Danve for using abusive language against him.

“I demand the resignation of LoP Ambadas Danve, as he used abusive words aimed at my mother and sister yesterday. I have spoken to the CM and DCM about this incident. Uddhav Thackeray should also ask his leader about this incident. I request the government take action against Ambadas Danve,” Lad said while addressing the media today.

In a significant development, a United Nations group has called for the immediate release of Pakistan’s former Prime Minister Imran Khan, terming his detention politically motivated. The United Nations Working Group on Arbitrary Detention reviewed Khan’s case during its 99th session in Geneva and concluded that his detention was carried out without a legal basis.

According to the group’s findings, at least two charges against Khan, including the high-profile Toshakhana corruption case and the cipher case, were strategically designed to exclude him from the political landscape. The charges allege that Khan deliberately concealed details of gifts received during his tenure as Prime Minister and held on to a diplomatic document from the United States threatening his government.

The UN body pointed out significant legal inconsistencies in these prosecutions, suggesting a calculated move to prevent Khan from participating in the forthcoming general elections. The group urged the Pakistani government to release Khan immediately, conduct an independent investigation into his arbitrary detention, and ensure he is compensated in accordance with international law.

Kishor Darade of the Shiv Sena secured a significant victory in the Nashik Teachers constituency during the recent biennial elections to the Maharashtra legislative council.

Falling in line with Rahul Gandhi’s remarks, the Shiv Sena (UBT) leader further added that the former said in the Parliament that ‘Hindutva’ is a much wider term. “He did not say anything wrong about the Hindus. Those who consider themselves Hindus should hear again that Rahul Gandhiji had said that ‘Hindutva’ is a much wider term and the Bharatiya Janata Party (BJP) won’t understand this”, he said.

“Abhayamudra is the symbol of Congress…The Abhayamudra is the gesture of fearlessness, is the gesture of reassurance and safety, which dispels fear and accords divine protection and bliss in Hinduism, Islam, Sikhism, Buddhism and other Indian religions…All our great men have spoken about non-violence and finishing fear…But, those who call themselves Hindu only talk about violence, hatred, untruth…Aap Hindu ho hi nahi,” the Congress leader said. “It is written in the Hindu religion; do not shy away from the truth, stand with the truth”, he added.

Gandhi’s remarks witnessed brickbats from the BJP leaders as they accused the Congress leaders of “spreading lies” and demanded an apology from his side. Meanwhile, PM Modi will deliver his reply to the Motion of Thanks on the President’s address in the lower house of Parliament later today.

There are many laws in place to address the criminal justice system but their implementation has been a challenge. So far, no abuser, rapist, or heinous criminal has been brutally punished, except in some rare cases. The three new criminal laws—Bharatiya Nyay Sanhita (BNS), Bharatiya Nagrik Suraksha Sanhita (BNSS), and Bharatiya Sakshya Adhiniyam (BSA)—were approved by Parliament last December to replace the Indian Penal Code (IPC) 1860, the Criminal Procedure Code (CrPC) 1973, and the Indian Evidence Act 1872, respectively.

The Indian Penal Code (IPC) was the official criminal code in the Republic of India, inherited from British India after independence, until it was replaced by Bharatiya Nyay Sanhita in December 2023. It was a comprehensive code intended to cover all substantive aspects of criminal law. The code was drafted under the sanctions of the first Law Commission of India, established in 1834 under the Charter Act of 1833 under the chairmanship of Lord Thomas Babington Macaulay. It came into force on the subcontinent during British rule in 1862. However, it did not apply automatically in the Princely States, which had their own courts and legal systems until the 1940s. The code has since been amended several times and is now supplemented by other criminal provisions.

The Bharatiya Nyay Sanhita (BNS), Bharatiya Nagarik Suraksha Sanhita (BNSS) and Bharatiya Sakshya Adhiniyam (BSA) take into consideration some of the current social realities and modern-day crimes, incorporating provisions such as zero FIR, online registration of police complaints, summonses through electronic modes such as SMS and mandatory videography of crime scenes for all heinous crimes. All fresh FIRs will be registered under BNS. However, cases filed earlier will continue to be tried under the old laws until their final disposal.

Union Home Minister Amit Shah, who proposed these necessary amendments to the laws, has decided to give priority to providing justice, unlike the colonial-era laws that gave primacy to penal action. Present laws are made by Indians, for Indians, and by an Indian Parliament and mark the end of colonial criminal justice laws. Home Minister Amit Shah emphasized that he had solicited suggestions from all MPs, ministers, Supreme Court judges, and High Court judges before passing the bills. Justice replaces punishment in the three new criminal laws that came into force today. The provisions are such that many groups would benefit. Many sections from the British era have been replaced by sections in sync with today. In the constitution, there are many laws and sections that do not go with today’s time or do not fit into the present era of the justice system. Such laws needed amendments.

Crimes relating to violence against women would be tolerated under the new law, but the question here is how much implementation would be done. The new law provides for recording the survivor’s statement at home and also mentions an online FIR facility that will shield her from social stigma. Earlier, there was also a facility for online complaints but the police department was not so upgraded that they bothered to check the online complaints. Looking at the geographical areas and crime rate, even the police department has a lack of staff, and the Indian judiciary is piled up with criminal cases that have been on trial for ages.

Earlier, there was no provision in the law for mob lynching cases. It has now been defined. This was a longstanding demand. Also, the BJP has completely removed the section on treason and introduced a new section for anti-national activities. Earlier, it was a crime to make a statement against the government. Now, a law will provide for action against attempts to harm India’s unity and sovereignty under the new criminal codes. Somewhere, this silent imposition of dictatorship means that the citizens who criticize the government or their policies may come under this bracket for action against them.

As per the new law, videography is now mandatory during search and seizure exercises so that no one can be framed. The e-statement of a survivor of rape or sexual harassment is legally valid now. The new laws are victim-centric. Earlier, police used to pick someone up and his family members had to go to court. Now it is compulsory to maintain a register and e-register at every police station that will list which criminal is in police custody. So, a habeas corpus plea in court won’t be needed. Searches and raids would also be videographed.

The main opposition has alleged that the news laws were not properly debated and that the legislation related to them was “forcibly” passed in Parliament after 146 opposition MPs were suspended. The opposition demanded a re-examination of the new criminal laws. Congress leaders emphasized that all religions talk about courage, citing Islam, Christianity, Buddhism, Jainism, and Sikhism to underline the importance of fearlessness. Leader of opposition Rahul Gandhi accused the BJP of launching systematic attacks on the Constitution and the fundamental idea of India, noting that millions of people have resisted the ideas proposed by the ruling party.
