Bhima Koregaon Case: NIA moves SC against Bombay HC’s order to bail granted to Anand Teltumbde

The National Investigation Agency (NIA) on Tuesday approached the Supreme Court against the Bombay High Court order granting bail to Dalit rights activist and scholar Anand Teltumbde, booked under the Unlawful Activities (Prevention) Act in the Bhima Koregaon case.

A bench of Chief Justice of India DY Chandrachud and Justices Hima Kohli and JB Pardiwala said it will hear the case on November 25.

Solicitor General Tushar Mehta, appearing for NIA, mentioned the matter for a listing of the case on Thursday.

“The petition is by NIA. There is a bail order. The order stayed for a week, that is on Friday,” SG told the bench while mentioning. The bench then said it will hear it on Friday.

CJI Chandrachud asked the Solicitor General to serve a copy of the petition to advocate Aparna Bhat, who is appearing for Teltumbde on caveat.

On November 18, the High Court granted bail to 73-year-old Teltumbde, however, stayed its order for a week so that the NIA, the prosecuting agency, can approach the Supreme Court.

The prosecution’s case is that provocative and inflammatory speeches were made at the event that was allegedly backed by the banned terror outfit Communist Party of India (Maoist), which later led to violence at Koregaon Bhima village near Pune in 2018.

Teltumbde had surrendered before the NIA office in Mumbai on April 14, 2020, after the Supreme Court denied him any relief. He is now lodged at the Taloja Central jail.

Teltumbde, an Indian Institute of Management (IIM) graduate who taught at the Indian Institute of Technology (IIT), was booked in the case for his alleged links to the banned CPI (Maoists). He has been charged with several sections of the Indian Penal Code and the UAPA.

Maha govt withdraws plea from SC against HC order on FIRs against Arnab Goswami

The Eknath Shinde led-Maharashtra government on Monday withdrew from the Supreme Court an appeal filed during the previous Uddhav Thackeray government against an order by the Bombay High Court staying the probe in two FIRs filed against Republic TV editor-in-chief Arnab Goswami over alleged inflammatory remarks.

A bench comprising Chief Justice DY Chandrachud and Justice Hima Kohli was told by the counsel representing the state that the Eknath Shinde government wanted to withdraw the plea.

The bench, thereafter, allowed the Maharashtra government to withdraw the plea challenging the interim order of the Bombay High Court filed when Uddhav Thackerary was the state Chief Minister.

In 2020, the Bombay HC had stayed the investigation into two FIRs filed against Goswami for allegedly making inflammatory comments during news programmes about the Palghar lynching incident and migrants gathering in large numbers in Mumbai’s Bandra area during the Covid-induced lockdown.

The then Maharashtra government had opposed the High Court’s decision to stay the police probe against Goswami and approached the apex court.

Two FIRs were filed against Goswami – one in Nagpur, which was later transferred to NM Joshi Marg police station in Mumbai following directions from the Supreme Court, and another at Pydhonie police station.

The National Investigation Agency (NIA) has arrested the most-wanted terrorist Kulwinderjit Singh alias Khanpuria, who has been associated with terrorist outfits like Babbar Khalsa International (BKI) and Khalistan Liberation Force (KLF).

Having a bounty of Rs 5 lakh, Khanpuria, who was absconding since 2019, was arrested from Delhi’s Indira Gandhi International Airport on November 18 when he arrived from Bangkok, the NIA said on Monday.

The arrested terrorist was involved and wanted in many terrorist cases, including the conspiracy to carry out targeted killings in Punjab. He was also involved in a bomb blast case in Connaught Place, New Delhi and grenade attacks in other states in the nineties.

Investigations have revealed that Khanpuria is the chief conspirator and mastermind behind the conspiracy to carry out terrorist attacks in India by targeting establishments connected with Dera Sacha Sauda and those belonging to police and security in Punjab.

Besides, the NIA said, Khanpuria was also targeting senior officers of Bhakra Beas Management Board, Chandigarh, with an overall objective of creating terror in Punjab and across the country.

“Khanpuria had also carried out reconnaissance of some of the targets.”

The case was initially registered on May 30, 2019, at Police Station State Special Operation Cell, Amritsar and re-registered by the NIA on June 27, 2019. Khanpuria, along with his handlers and associates, based in India and abroad in different South-East Asian countries, had planned and conspired to commit terrorist attacks in India, said the NIA, adding “Khanpuria later managed to flee from India.”

“While he was based abroad, he first collided with Harmeet alias PhD, and now with wanted Pakistan-based ISYF Chief Lakhbir Singh Rode to use his India-based terrorist associates for targeting the identified individuals as well as establishments,” the counter-terrorism agency said.

Khanpuria was declared a proclaimed offender (PO) by the NIA Special Court, Punjab, following which, a LookOut Circular (LOCu) was issued and a Red Corner Notice was issued by Interpol against him.

The NIA had also declared a cash reward of Rs 5 lakh for information leading to his arrest. He was charge-sheeted as an absconder on November 21, 2019.

Notably, four co-accused conspirators of Khanpuria had already been arrested after the recovery of arms and ammunition from their possession.

External Affairs Minister S Jaishankar on Monday expressed solidarity with Indonesia over the loss of lives in an earthquake and wished the injured a speedy recovery.

He said that India stands in solidarity with Indonesia and its thoughts are with the bereaved families.

“Saddened to hear news about the loss of life and property in Java, Indonesia from the earthquake. My thoughts are with the bereaved families. Wish the injured a speedy recovery. India stands in solidarity with Indonesia at this difficult time,” Jaishankar tweeted.

At least 46 people died in an earthquake that hit Indonesia’s main island Java on Monday, Channel News Asia reported citing an Indonesian government official.

On Monday morning, a shallow 5.4 magnitude earthquake hit Indonesia’s western province of West Java, stated the United States Geological Survey (USGS).

The earthquake’s epicentre was on land in Cianjur, about 75km southeast of Jakarta, and at a depth of 10km.

According to CNA citing several reports, about 700 people were injured in the West Java town.

“The latest data showed that 46 people were killed. Victims kept coming from many areas. Around 700 people were injured,” Herman Suherman, the head of the administration in Cianjur, told broadcaster Kompas TV.

He also earlier told another local broadcaster, Metro TV, that many of the injured “had fractures from being trapped by the ruins of buildings”.

Java is a volcano-dotted island that lies between Sumatra and Bali. It is situated at the geographic and economic centre of Indonesia.

Rajiv Gandhi assassination convict says, “will fight legally…” over center’s review petition

RP Ravichandran, one of the six convicts in the assassination case of former prime minister Rajiv Gandhi, said that he would fight legally the review petition filed by the Central government in the Supreme Court against the November 11 release order.

Ravichandran went to the Viduthalai Chiruthigal Katchi (VCK) party head office on Monday and was welcomed by the party President.

“Today I came to meet VCK chief Thirumavalavan at his Chennai office. I thanked him as they (VCK) were with us for our freedom,” Ravichandran said.

VCK Party President Thol Thirumavalavan welcomed Ravichandran and gave him sweets and expressed his happiness.

Notably, the Central government on Thursday filed a review petition in the Supreme Court against the November 11 order allowing the release of six convicts in the former Prime Minister Rajiv Gandhi assassination case.

A bench of BR Gavai and BV Nagarathna passed the order while taking into consideration the good conduct of convicts in prison.

The apex court had noted that they had been behind bars for a very long period. Seeking a review of the top court’s order, the Centre said, “The order granting remission to the convicts who had assassinated the former Prime Minister of the country was passed without affording an adequate opportunity of hearing to Union of India.”

Talking about his release, Ravichandran said, “I am happy that I have been released from prison. I was in prison for years and I am going to see this world freely.”

On November 11, the Supreme Court ordered the release of six convicts including RP Ravichandran and Nalini Sriharan, who were serving life imprisonment in connection with the assassination in the case.

Earlier soon after coming out of the jail, Ravichandran said that the people of north India should see them as “victims instead of terrorists or killers”. He said that time will judge them as “innocents”.

Speaking to media from Madurai Central Prison, Ravichandran said, “The people of north India should see us as victims instead of terrorists or killers. Time and power determine who is a terrorist or a freedom fighter but time will judge us as innocent, even if we bear the blame for being terrorists.”

Ravichandran and Nalini had approached the apex court seeking release from prison-like fellow convict AG Perarivalan. This came after the Supreme Court, on May 18, had evoked its extraordinary powers under Article 142 of the Constitution to release AG Perarivalan, who was one of the seven convicts in the assassination case.

The Tamil Nadu government had earlier recommended the premature release of convicts saying that its 2018 aid and advice for the remission of their life sentence is binding upon the Governor. Ravichandran and five others were serving life sentence terms in the assassination of former Prime Minister Rajiv Gandhi.

They were set free by the SC on the grounds of having good conduct in jail. Rajiv Gandhi was assassinated on May 21, 1991, at Sriperumbudur Tamil Nadu by a woman suicide bomber of the Liberation Tigers of Tamil Eelam (LTTE) group during a public rally.

The seven convicts were sentenced to death for their role in the killing. They included Nalini Sriharan, RP Ravichandran, Jayakumar, Santhan, Murugan, Robert Payas, and AG Perarivalan. In 2014, the then Chief Minister of Tamil Nadu J Jayalalitha recommended the release of all the seven convicts in the case.

The Eknath Shinde government on Monday appointed ministers Chandrakant Patil and Shambhuraj Desai to coordinate with the legal team regarding the court case on the border dispute between Maharashtra and Karnataka.

Chief Minister Shinde also announced the pension scheme for freedom fighters will cover those in the areas claimed by Maharashtra but in the administrative control of the neighbouring state.

He added his government was positive about extending the benefits of the Mahatma Phule Jan Aarogya Yojana to people living in these areas.

Maharashtra, since its inception in 1960, has been entangled in a dispute with Karnataka over the status of the Belgaum (also called Belagavi) district and 80 other Marathi-speaking villages, which are in the control of the southern state.

Shinde, who appointed Patil and Desai after holding a meeting regarding the ongoing case, said, ”Late Balasaheb Thackeray was always a staunch supporter of state’s demand to make Belgaum a part of Maharashtra. We have concentrated our focus on solving the issue. If required, the number of lawyers would be increased. We will soon meet Prime Minister Narendra Modi and Union home minister Amish Shah regarding the issue.”

The CM also asked a delegation of residents of Belagavi and neighbouring areas to maintain proper communication with the Karnataka government regarding providing of necessary facilities as well as usage of Marathi in day-to-day affairs in the disputed areas.

The state government has also appointed senior advocate Vaidyanathan to represent Maharashtra in the case in the Supreme Court.

While Patil is the higher and technical education minister, Desai holds the excise portfolio.

Sanjay Raut praises Rahul Gandhi amid Savarkar row

After differences emerged between Rahul Gandhi and Uddhav Thackeray’s Shiv Sena faction over the Congress leader’s comment on Veer Savarkar, Sanjay Raut appreciated Wayanad MP for enquiring about his health during the ongoing Bharat Jodo Yatra.

Terming it an act of “humanity”, Sanjay Raut said, “Rahul Gandhi called and checked on me yesterday despite his busy schedule amid Bharat Jodo Yatra. He said we were concerned about your well-being and said take care, we will work together again.”

Sanjay Raut appreciated Congress leader Rahul Gandhi’s act and said that such gestures are rare in times of political bitterness.

“I appreciate his empathy of feeling the pain of a political colleague who has spent 110 days in jail. In d times of political bitterness, such gestures are becoming rare. Rahulji is focusing on love and compassion in his yatra and is getting massive support,” he tweeted.

Sanjay Raut said that Rahul Gandhi is one such person who stays connected as friends. “Rahul Gandhi is one such person who stays connected as friends against ideological and political differences. I have friends in BJP as well but they were happy when I was in jail, this is politics of the Mughal era,” he said.

Earlier on Thursday, while addressing a press conference in Maharashtra on the sidelines of his ongoing ‘Bhaat Jodo Yatra’, Rahul Gandhi, reading from a letter purportedly written by Savarkar to the British, claimed the saffron ideologue betrayed leaders such as Mahatma Gandhi, Jawaharlal Nehru and Sardar Vallabh Bhai Patel by signing on a letter of apology to the British before independence.

“Veer Savarkar wrote to the British saying, ‘Sir, I beg to remain your most obedient servant’, and signed on it. Savarkar helped the British. He betrayed leaders like Mahatma Gandhi, Jawaharlal Nehru and Sardar Patel by signing this letter out of fear,” he had said.

Rahul’s remarks on Thursday drew a huge backlash, with a complaint being registered against Rahul at Thane Nagar police station.

Sanjay Raut had said Congress leaders in Maharashtra won’t support Rahul Gandhi’s comments on Savarkar.

“Coming to Maharashtra and saying things about Savarkar won’t be accepted. Congress leaders won’t support him. Bharat Jodo Yatra is against dictatorship and issues like unemployment, inflation and Congress is getting support,” Sanjay Raut said.

“Giving such a statement can cause strife in MVA. We believe in Veer Savarkar and we want to ask the fake Hinduvaadi that we are demanding Bharat Ratna for Veer Savarkar for 10 years. Even though BJP is in power, why are they not fulfilling our demands?” Sanjay Raut had asked.

The remark had drawn outrage from the Bharatiya Janata Party (BJP), with the party’s national spokesperson Sambit Patra claiming that the statement was consistent with the Congress’ habit of insulting national icons such as Subhas Chandra Bose and Sardar Patel.

11 years ago, Niranjani Pillai was killed in the same manner as Shraddha Walker

11 years ago, a murder case like the Shraddha Walker case rocked the nation. Sumit Handa, murdered his NRI Indian wife, Naranjani Pillai, in south Delhi and stuffed her body in a bag and set it on fire in Haryana in 2011, October. Sumit Handa was suspicious of disloyalty, a supposed video call with a male friend and constant fights had apparently provoked Handa into stabbing his wife in the abdomen, strangling her with the laptop charging cord and stashing her body in the bathroom of their flat. He even changed the floor tiles of the bathroom where he had kept the dead body so that no blood stains could be found.

Niranjani Pillai was a 27-year-old South African lawyer. Sumit met Niranjani’s father Rama Pillay in 2003 when he was working with a travel firm in India. In 2005, he moved to South Africa after he was employed by Pillay. There he met Niranjani and married her in 2007 and they had a child in 2010. In July 2011, the family shifted to India and in September stayed in Agra in the house of Handa’s parents. In October, Handa got a job in Delhi and the family shifted to the capital along with Handa’s sister who wanted to help them in raising the child. However, a week before the murder, the accused sent the child and his sister back to Agra. Niranjani was very beautiful, and Handa was very possessive. He was very suspicious too. One day he killed her and stuffed her body in a suitcase. Handa waited for more than two hours at the spot where he burnt the body and left the place after collecting a part of the ashes.

Handa tried to mislead the police and registered a complaint on November 2 that his wife had fled with someone and her gold jewellery, cash and clothes were missing from their home. He wrote e-mails requesting her to return and showed these to the cops in his defence. Police received information that the murderer was Handa himself which led to his apprehension and interrogation.

It took the cops 20 days to recover the murder weapon-a knife, in addition to pieces of bones which formed crucial evidence. Key testimonies came from a friend whose help Handa had sought in disposing of the body, petrol pump employees who sold him fuel, which was used to burn Pillai’s body and a cab driver who refused to drive him to Haryana.

Meanwhile, in the latest update on the Shraddha murder case, a 2020 image of injured Shraddha surfaced online with cuts on her face, swollen eyes and bruised cheeks. Now, this has raised the question of whether Shraddha was assaulted by her live-in partner Aaftab for years. The Delhi police investigation revealed the couple had frequent fights. Besides, Poonawala continued to meet several women on the dating app after killing Walkar.

According to another official who visited the crime scene, the accused had removed the evidence from inside the house quite professionally. Meanwhile, a Delhi Court allowed the police to take the Narco test on Wednesday and Aaftab gave his consent for it on Thursday. When the judge asked if he was aware of the implications of the narco test, the accused said “yes”.

Like Aftab and Shradha, even Naranjani Pillai and Sumit Handa used to squabble over several issues. On Oct 30, they badly quarrelled and Handa in a fit of rage stabbed his wife in their rented flat in Vishwakarma Colony, Pul Prahladpur. On 18th May, Aftab and Shradha had a bad fight, Aftab pushed Shradha and strangled her to death.  Aftab brought a fridge to keep Shradh’s body in pieces. Sumit also cut Nalini in pieces and stuffed the body in the bag, blood-stained clothes in another bag and took them to Rai in Haryana. There he poured petrol over the body and the bags and burnt them.

After a lot of drama, he disclosed that he murdered Naranjani by stabbing her with a knife and then strangulating her with a wire. He then took the body in a bag and destroyed it along with blood-stained clothes. Aftab used to sleep every day in the same room where he had chopped the body after killing Shraddha. He used to see the face after keeping it in the fridge. Aftab cleaned the fridge after disposing of the body parts.

Twenty-eight-year-old Poonawala strangled Walkar in May and sawed her body into 35 pieces which he kept in a 300-litre fridge for almost three weeks at his residence in South Delhi’s Mehrauli before dumping them across the city over several days past midnight. Aftab dumped Shraddha’s phone, her last location being traced so that it can be retrieved. Police are searching for the weapon used to chop her body into pieces. He used her Instagram account until June to give an impression of her being alive, said Delhi Police. Even after 11 years, police could not trace any evidence and Sumit came out on bail. Let’s see which way Aftab’s case goes.

FIFA World Cup 2022: Ecuador defeats Qatar in opening game; Valencia scores brace

Enner Valencia scored a brace to help Ecuador defeat Qatar in the opening game of the 2022 FIFA World Cup at the Al Bayt Stadium in Al Khor, Qatar on Sunday.

The group A game saw the hosts being dominated by the South Americans, with the match seeing the maiden instance where the opening goal of a World Cup was scored through a penalty kick.

Ecuador’s captain Enner Valencia set the FIFA World Cup on fire with a goal within three minutes of the football extravaganza kicking off.

The striker received the ball off a kick by Felix Torres and headed it into the net, sending the Ecuadorian fans into festivity.

However, the celebration was short-lived as the referee ruled the goal as off-side. A VAR check confirmed that the goal was off-side.

Ecuador kept on attacking and kept possession of the ball with them, while the Qatari players seemed to be chasing the ball. Valencia made a superb run in the 16th minute of the match inching towards the goal but a tackle from Qatar’s goalkeeper Al Sheeb saw him going down and winning a penalty for his team.

Sheeb was given a yellow for his tackle on Valencia by the goalkeeper and a penalty was also awarded to Ecuador.

The Ecuador captain was spot on with the penalty kick as he sent the ball into the right-bottom corner, scoring his fourth career World Cup goal and giving his team a 1-0 lead over hosts Qatar.

Qatar players found it difficult to settle down against the South-American team as the team lost possession continuously, failing to pass the ball cleanly.

Another yellow card for Qatar came to Almoez Ali for his tackle on the Ecuadorian captain. Ecuador continued to dominate the hosts and scored again through Valencia in the 31st minute.

Right-back Angelo Preciado sent a brilliant cross from the left and the Ecuadorian captain guided the head to perfection at the bottom left corner of the net with his head, scoring his second goal of the match. There was another check for offside after the second goal but the decision came in the favour of Ecuador as they took a 2-0 lead over Qatar.

Seeing Valencia creating trouble for Qatar, the hosts started to guard the player often bringing him down with their tackles. Qatar’s Karim Boudiaf was given the yellow card for his tackle on none other than Valencia.

Valencia kept taking the hits and had to walk off the field in the 43rd minute, after getting hit on his knee. Qatar had a superb chance to score a goal in the dying minutes of the first half but the chance went begging as Almoez Ali could not get clean contact with the ball.

The first half ended with Qatar trailing 0-2 in their first match of the 2022 FIFA World Cup. Qatar seemed better with their passing in the second half with a few threatening runs but lacked the finishing touches. They played better football in the second half but did not look like scoring, not posing any significant danger to Ecuador.

Qatar came close to scoring in the 86th minute with Mohammed Muntari making an excellent run and taking a shot at the goal, missing by a few inches. Neither of the team was able to score in the second half with the match ending with a scoreline of 2-0 in Ecuador’s favour.

With this win, Ecuador became the first team to beat the host nation in the opening match of the World Cup in the 92-year history of the tournament.
