“120 Somali pirates want to plead guilty in court”

Somali-piratesIn a major development, as many as 120 Somali pirates arrested by Mumbai Police in 2011 have told their Embassy officials that they want to plead guilty in the case.

If the plea is accepted by the court, then the pirates will be convicted and they can undergo the jail term in their country, an official said.

The prosecution informed about this development before the Mumbai sessions court last week.

“After the accused expressed their desire to the Embassy officials, who met them recently, they communicated it to the state Home department, while we informed it to the court last week,” said an official from Yellow Gate police station.

In all, 120 pirates were arrested between January and March 2011 and they were charged under relevant sections of the Indian Penal Code and Arms Act.

The first batch of 15 pirates was intercepted on January 28, 2011. They had held 20 Thai and Myanmarese nationals hostage in mother vessel ‘Prantalay 14’.

On February 6, 2011, the Navy and Coastguard had intercepted vessel ‘Prantalay 11’ and rescued 24 Thai nationals and arrested 28 pirates.

In March 2011, in two operations, two vessels – Vega 5 and Morteza – were intercepted and 77 pirates arrested from them.

The hostages hailed from countries like Pakistan, Mozambique, Thailand, Iran, Myanmar and Indonesia.

The court had framed charges against all the pirates in January 2012.

HC dismisses NSEL plea to quash invocation of MPID Act

Bombay High Court has dismissed a petition filed by National Spot Exchange Ltd (NSEL), embroiled in an alleged Rs. 5,600 crore scam, seeking quashing of invocation of provisions of Maharashtra Protection of Interest of Depositors In Financial Establishments (MPID) Act against it.

A division bench headed by Justice Ranjit More last month dismissed NSEL’s petition after observing that prima facie investigations by the city police’s Economic Offences Wing (EOW) reveal violation of the provisions of the MPID Act by the company.

“The material collected by the EOW during probe reveals that the petitioner did not carry out its operations as per the bye-laws and permission granted to it by the Government of India,” the court said.

The bench noted that a chargesheet has already been filed and further probe is also underway, and the petitioner has an alternate efficacious remedy to apply for discharge before the trial court.

In September 2013, a complaint was filed by Pankaj Saraf against NSEL with the police. Initially, FIR was lodged under various sections of the Indian Penal Code for cheating and criminal conspiracy. Subsequently, provisions of the MPID Act were invoked and a chargesheet was also filed in January 2014 against the accused persons.

NSEL’s counsel Aspi Chinoy contended that the company’s Commodity Spot Exchange only provided an electronic/ online trading for the purchase and sale of commodities. He argued that NSEL never received or accepted any deposit as defined in section 2(c) of the MPID Act.

Chinoy argued that the application of MPID Act against NSEL and its directors is “ex-facie illegal and without jurisdiction”.

The court, however, refused to accept this.

“From the statements recorded by the investigating agency, copies of which were placed before us for our perusal, it would prima facie reveal that NSEL represented to its traders and suppliers of the goods that they would be provided security free loan. The petitioner had assured its clients fixed returns at 14 to 16 per cent per annum,” the court said.

Auto driver kills wife, commits suicide in front of minor children

A 35-year-old man allegedly killed his wife before himself committing suicide in front of his three minor children in Mumbai, police said. Rajesh Jadhav, an autorickshaw driver, had a quarrel with his wife Amrapali at their home in a chawl in suburban Jogeshwari following which he allegedly strangled her, they said.

After killing his wife, Jadhav allegedly hanged himself to death at home, in the presence of his three children, a son and two daughters, the eldest being only three years old, police said. “Prima facie it looks like Jadhav first strangulated his wife and then hanged himself.

They had a big fight before the incident. All this happened in the presence of their three children. The eldest son is aged three,” Assistant Commissioner of Police Arun Chavan said.

The neighbours heard the screams of the family members at around 4.30 PM on Saturday. The incident probably occurred around that time, police said. However, the matter was reported to police by local residents at around 7.30 PM, they said.

Subsequently, a case was registered at Amboli police station. “We have sent both the bodies for postmortem,” Chavan said. Jadhav left behind a suicide note in which he purportedly mentioned that nobody should be held responsible for his acts, he said.

A probe is on into the incident, he said adding that a case has been registered.

Didn’t get Noble because I am black: Ramdev

Yoga guru Baba Ramdev on Saturday ignited fresh controversy by claiming that he was denied a Nobel Prize because of his skin colour. During a yoga camp on the last day of his five-day camp at Morhabadi ground in Ranchi, Ramdev was speaking about awards being returned in protest against rising intolerance in the country.

“Many incompetent and undeserving people seem to have got awards and some people are playing cheap politics on the pretext of returning their awards. The country’s image is being tarnished on the international platform,” he said, comparing his own contribution to the society in the field of yoga. “I would have received a Nobel Prize, but I have not because may be I am black,” he said.

Patanjali Yoga Peeth member Sanjay Seth said Ramdev made the comment in the course of his usual interaction with the public during yoga camps. Coincidently, chief minister Raghubar Das was also present at the camp when he made the statement. Ramdev left for Delhi later in the afternoon.
