Have withdrawn controversial circular on sedition: Government to HC

The Maharashtra government on Tuesday informed the Bombay High Court that it has withdrawn its controversial circular issued on August 27 to prevent misuse of section 124-A of IPC which deals with sedition.

State Advocate General Srihari Aney made this statement before a division bench of justices VM Kanade and Shalini Phansalkar Joshi, in response to two petitions challenging the constitutional validity of the circular.

Justice Kanade sought to know as to how the circular was issued.

To this, the AG replied that the state government would conduct an exercise to find out how this happened.

He also informed that Chief Minister Devendra Fadanvis, at a recent meeting of officials at Mantralaya, had decided to withdraw the circular.

However, the AG did not mention whether the government would come out with a fresh circular.

Outside the court, Aney told reporters that it was for the government to decide whether it will issue fresh circular.

The BJP-led Maharashtra government had last month admitted that the circular — which had triggered a row for ostensibly trying to invoke sedition charge for criticising political establishment — got lost in translation and had promised to bring a revised version.

The high court had earlier restrained the government from acting on the circular.

One petition was filed by famous cartoonist Aseem Trivedi, who was himself arrested on charges of sedition earlier. The other one was filed by advocate Narendra Sharma.

The bench had asked the state to file its reply, failing which the court would treat these petitions as unconverted and decide them at the admission stage itself.

The circular, which sparked a row, had laid down certain conditions required to be considered for initiating action against a person under section 124-A of IPC which deals with sedition.

The state came out with a circular on August 27 laying down conditions to be observed while invoking sedition charge. It was challenged by Trivedi and others.

According to the petitioners, the circular was unconstitutional and violated fundamental rights of citizens.

Trivedi was arrested on September 8, 2012, on an FIR under section 124A (sedition) and other provisions of IPC for cartoons published on ‘India Against Corruption’ website.

However, on a PIL, the Bombay high court had granted him bail. Later, the state government, on the advice of the Advocate General, had dropped the charge though the case under other provisions of IPC continued against him.

Woman constable’s husband held for raping minor girl

The husband of a police constable attached to Naupada police station here was arrested on Tuesday for allegedly raping a minor girl who worked at their house as a domestic help, police said.

Jaipal Govind Pardeshi, 28, who works at a security agency, was nabbed today on charges of raping the 14-year-old girl who was working as a domestic help at his house in New Police Quarters area, Assistant Police Inspector S A Waidande of Thane Nagar Police station said.

According to the complaint lodged by the girl, she was introduced to the constable, posted at Naupada police station, by her grandmother who did cleaning errand at the police station.

She took the girl to the police station on few occasions where she did some petty works. The woman constable also used to teach the girl, and she soon began working as domestic help at the former’s residence and also did baby-sitting, he said.

The constable in return funded the girl’s education who studied in class VI at a nearby school.

On October 24, when the constable had gone for night duty, her husband allegedly raped the girl, Waidande said, adding, he repeated the crime on Monday.

According to the girl’s complaint, the accused also threatened her against speaking about the incident.

The victim, however, mustered courage to narrate her ordeal to her friends in the colony who informed about it to their parents.

Later, some women of the neighbourhood took the girl to police station and a case was registered.

The accused has been booked under IPC section 376 (2) (f) – rape on a woman when she is under 12 years of age – and relevant sections of Protection of Children from Sexual Offences Act (POCSO), police said.

Mumbai court convicts driver for rape, murder of TCS techie

A special women’s court in Mumbai on Tuesday convicted a 29-year-old driver for the rape and murder of an Andhra Pradesh-based woman software engineer in suburban Kurla here last year.

Special Judge Vrushali Joshi convicted accused Chandrabhan Sanap after agreeing with the prosecution, which examined 39 witnesses in the case.

Sanap was convicted under IPC Section 302 (murder), Section 376 (rape) and Section 201 (causing disappearance of evidence of offence).

The court is likely to hear the arguments on sentencing on Wednesday.

Mumbai Police’s crime branch had arrested Sanap in early March last year about two months after the murder of the 23-year-old techie, who was a native of Machilipatnam in Andhra Pradesh and was employed as assistant system engineer with IT major TCS at its office in suburban Goregaon.

Investigators caught Sanap after an exhaustive scrutiny of 36 CCTV footages at the railway station and grilling of about 2,500 people.

The victim went missing from Lokmanya Tilak terminus near Kurla after arriving by train from Andhra Pradesh in the early hours of January 5, 2014.

According to police, Sanap spotted her sitting alone at the railway station and offered to drop her off at Andheri on his two-wheeler.

Subsequently, he took her to an isolated spot and strangled her when she resisted his attempt to rob her.

The decomposed body of the techie was found off the Eastern Express Highway in suburban Bhandup on January 16, 2014.

Sanap, who worked as a porter here and then as a driver in Nashik, is a history-sheeter.

Officials may head for Bali in 2 days to bring Chhota Rajan

Security agencies are likely to send a team of officials in the next two days to bring back gangster Chhota Rajan from Indonesia where he is in custody since Sunday. The sources are tightlipped about the exact arrangements to bring him back because of security concerns arising out of his fierce rivalry with underworld don Dawood Ibrahim and his gang.

They said agencies are working on more than one plan to bring back 55-year-old Rajan, once known as Dawood’s right hand man, factoring various permutations and combinations. When asked whether a team has been dispatched already to bring Rajan back, CBI sources did not reply but later said no details can be shared at this stage and everything will be done as per law.

Meanwhile, Rajan is believed to be living in Sydney on genuine documents issued to him there but with fake details such as name, age, address. Rajan was travelling with the identity of Mohan Kumar with passport number G9273860 when he was apprehended at the Bali airport, after arriving there on a Garuda Indonesia flight GA715, by the Indonesian Police on a tip off from Australian authorities, they said.

PM Modi attacks ‘grand alliance’, likens it to ‘3 Idiots’

Modi-PMPrime Minister Narendra Modi on Tuesday launched a blistering attack on the grand alliance, likening it to “3 idiots”, as he dared Nitish Kumar to seize “convicted” RJD chief Lalu Prasad’s properties and questioned Congress president Sonia Gandhi’s silence on sting videos of JD(U) and RJD MLAs accepting bribes.

Addressing back to back election rallies in Sitamarhi and Bettiah, Modi rubbished Chief Minister Nitish Kumar’s good governance claims, citing sting operations which allegedly showed two JD(U) MLAs, including a minister, and an RJD legislator accepting bribes.

Modi said it was part of a plan to “sell” Bihar and questioned Congress President Sonia Gandhi’s silence on it.

“Madam Soniaji, you also answer this. Speak something. What do you have to say about this exchange of money in front of camera. Do you think this was a small transaction? Do you think it should have been bigger? Do you think they took the money but did not distribute the share?”

“The Congress party is engaging in all sorts of baseless allegations to mislead you (the people) but is keeping its mouth shut when Bihar is being sold,” Modi said, addressing a rally in Bettiah.

Taking Nitish Kumar head on over his ‘Bihari’ versus ‘Bahari’ (outsider) pitch, Modi said, “Prime Minister cannot be called an outsider as he has equal stakes in all states of the country like a Chief Minister has in all districts of his state.”

Seeking to corner Kumar on the corruption issue, Modi latched on to the sting vides of two JD(U) MLAs taking bribe.

“Nitishji used to say he will seize property of the corrupt and open a school there. Leave others but ensure this in case of the person with whom you have allied–Lalu Prasad, who has been convicted by the court. Seize Lalu’s property and open a school there. At least work truly once,” he said.

Modi also hit back at Nitish who had yesterday mouthed a limerick set to a film song to attack him, while equating the JD(U)-RJD-Congress alliance to ‘3 Idiots’. He also advised the JD(U) leader to perfect the art of “Mushaira” and practise it at leasure after the Bihar polls.

“I have been noticing that Laluji entertains well and Bihar is getting some entertainment after many years. But these days there is an intense rivalry going on between Laluji and Nitishji on many issues–protecting the criminals, doing nepotism, breaking off from truth. Now the competition is also in the field of entertainment.”

Taj Mahal more stunning than I expected: Mark Zuckerberg  

Social networking giant Facebook’s founder Mark Zuckerberg on Tuesday visited the Taj Mahal in Uttar Pradesh’s Agra city and said: “It is even more stunning than I expected.”

“I’m in India for our Townhall Q&A tomorrow (Wednesday), and I decided to visit the Taj Mahal. I’ve always wanted to see this,” Zuckerberg posted on Facebook along with his picture in front of the monument to love.

“It is even more stunning than I expected. It’s incredible what people can build — and what love can motivate us to build,” he added.

Zuckerberg, who hosted Prime Minister Narendra Modi last month in the US, is scheduled to hold a Townhall Question and Answer session at the IIT-Delhi on Wednesday.

The event is being seen as a very positive one, especially after Zuckerberg described Indians as “one of our most active and engaged communities” on the social media.

“More than 130 million people use Facebook in India. I’m looking forward to hearing directly from one of our most active and engaged communities,” Zuckerberg had said.

Intolerance: Scientists urge President to initiate suitable action

Voicing concern over incidents of intolerance, including the killing of Kannada thinker M M Kalburgi, a group of scientists has petitioned President Pranab Mukherjee, urging him to initiate “suitable actions”.

Holding that a highly polarised community is like a nuclear bomb close to criticality, they also appealed to the Centre and state governments to act against “anti-human, anti-civilisational act.”

“We, the scientists, are concerned about the recent developments with reference to intolerance, polarisation and spread of communal hatred resulting in the death of innocent people, rationalists,” they said.

The petition, signed by scientists and academicians including Naresh Dadich, former Director of Pune-based The Inter-University Centre for Astronomy and Astrophysics (IUCAA) and G Rajasekaran of The Institute of Mathematical Sciences (IMSc) besides some from Jawaharlal Nehru University and Harish-Chandra Research Institute, Allahabad, lauded the President advising people to show respect for all thoughts.

“We urge you to take serious note of these developments and initiate suitable actions,” it said.

In a separate petition to the Centre, state governments and people at large, they appealed to “stop the spread of communal hatred and polarisation in society,” pointing out that India had been a plural country where communities allowed space for each other.

Arun Shourie no longer party member: BJP on “weak PMO” remark

Arun Shourie, who had launched a stinging attack on the Modi government on Monday, is no longer a member of BJP, the party said as it sought to dismiss the criticism of its one-time influential leader who was also a minister in the previous NDA government.

BJP general secretary Arun Singh said Shourie’s membership ceased after he did not renew it during the recent membership drive.

All members have to renew their membership after every six years and Shourie did not do so this time round, he said.

“Arun Shourie is no more a BJP member. He did not renew his membership,” he said.

At a press conference in the party headquarters, Union Minister Venkaiah Naidu rejected Shourie’s attack on the government, saying “his views are shared neither by the party nor by the public”.

“I do not agree with this. This is not the opinion of party nor public,” he said in a brief response.

Shourie, a strong supporter of Modi during the Lok Sabha election campaign last year, had said the Centre believes that managing economy means “managing the headlines” and that people had started recalling the days of former Prime Minister Manmohan Singh.

“The way to charaterise policies of the government is — Congress scaled plus a cow,” he had said.

Rejecting the charge, Naidu said there has been “no scam, no scandal and not even one mistake” under the government and BJP had been winning elections across the country.

“We are a democracy, he (Shourie) has his opinion, but the country’s opinion is different,” Naidu said, adding the people were supporting the Prime Minister in all parts of the country.

Kerala House will serve beef from Wednesday noon

Politics over beef found a new address as the Kerala House in Delhi took buffalo meat off its menu after a “raid” by 20 policemen over a complaint from a fringe group. Amid raging controversy after row over allegations that beef curry was served at Kerala House in Delhi, beef will be served in Kerala House from Wednesday noon, said sources on Tuesday.

After a day of protests against what many saw as bullying, Kerala House decided to bring back buffalo meat, sending a message that reinforced Kerala Chief Minister Oommen Chandy’s strong words in a letter to the Prime Minister.

“I would like to inform you that the Kerala House staff canteen serves authentic vegetarian and non-vegetarian Kerala cuisine and the items in the menu are entirely within law,” Mr Chandy wrote to PM Narendra Modi, accusing the Delhi Police of overstepping its brief.

On Monday evening, the official guest house of Kerala in the capital swarmed with policemen after a call from activists of the Hindu Sena group, who had visited the canteen and noticed “beef fry” scribbled in Malayalam on a handwritten menu.

Kerala Chief Secretary Jiji Thomson has categorically denied that cow meat was served at Kerala House and said they will wait for “police action” in the wake of their complaint over the incident. “I totally deny that cow meat was served in canteen of Kerala House. Only buffalo meat is served,” Thomson said.

Chandy also called inquiries made by the Delhi Police into Kerala House’s beef procurement illegal and unlawful. Police officials had questioned Kerala House and canteen staff on where the meat was being sourced from.

“Kerala House is where all the ministers and government officials stay. Delhi Police should not have entered the premises. The raids were wrong. This is not a commercial establishment,” he said.

However, in the light of the events on Monday, Kerala House has temporarily taken buffalo meat off its menu. Noting that the Resident Commissioner of Kerala House has lodged a police complaint, Thomson further said “we will wait for police action”.

“I was told that some persons gate-crashed into Kerala House, the police had also entered. The resident commissioner has made a complaint to the DCP over their (gate-crashers’) entry. We will wait for the police’s action now,” he said.

A PCR call complaining about beef curry being served at Kerala House near Jantar Mantar had thrown police into a tizzy on Monday.

Police said that a team had to be sent there to avert any “untoward incident” after the call complaining about beef on the menu was received by police control room at around 4:15 PM on Monday. The caller had claimed to be from a fringe right-wing group.

“The policemen took no chance and the input was immediately passed on to Parliament Street police station, from where a team was sent to Kerala House to deal with any potential violence,” a police official had said.

Justin was thrilled to be the big winner at the awards ceremony in Milan, Italy, where he performer his hit track What Do You Mean? and he told Nick it’s time to put his past misdemeanours behind him and focus on the future.

Justin is relieved that his new music has been so well received because in the past he hasn’t always put out the songs he wanted to.
