The government’s proposal to make changes in the Trai Act by deleting provisions enabling the telecom regulator to make recommendations for new licences and services, among others, may prove to be a backward step, digital think-tank Broadband India Forum said on Friday.
The government in the draft has proposed to delete several provisions under Section 11 of the Trai Act which give it power to make recommendations to the government for telecom licences and services.
Telecom Minister Ashwini Vaishnaw, during his presentation on the draft bill, had said it proposes to simplify and bring clarity around the licensing framework.
“Lot of simplification has been done in terms and conditions of license. At present the terms and condition… is so complex that it requires a very good legal brain to understand them. To simplify those norms, a legal framework is required. That legal framework has been brought here. Its corollary comes from a series of provisos of Trai,” Vaishnaw said.
He said even for starting new service, there was a proviso in the Trai Act which mandated the need for recommendation of the regulator.
“The issues that were arising due to lack of clarity in the system, around what needs to be done in a particular sector or service, have now been clarified. For telecom network and service it will be licence, registration for telecom infrastructure and authorisation for wireless equipment. It has been clearly defined,” the minister said.
Broadband India Forum (BIF), whose members include companies like Amazon, Google, Meta, Indus Towers etc, said by curtailing the powers of the Trai, the authority will be reduced to one with extremely limited role and powers.
This does not bode well for the sector to have a neutral and independent approach towards facilitating progressive and positive growth for the entire ecosystem, it noted.
BIF President T V Ramachandran said in a statement that some of the provisions of the draft Indian Telecommunications Bill 2022, unfortunately appear to be prohibitive rather than facilitating or enabling the larger digital ecosystem in the country.
“The provisions seem to take us back to the pre-1997 era by diluting the powers of the Regulator viz. Section 11(1) of TRAI Act. This could lead to damage of investor confidence and undermining of the independence of the Regulatory Authority, owing to deletion of provisions which enable proper checks and balances,” Ramachandran said.
BIF said the Draft Telecom Bill provisions propose to take away Trai’s statutory independence, and seek to make it subservient to the government.
“The implications of the draft Bill may prove to be a backward step, taking us to the pre-1997 era, by diluting the critical role and powers of the independent regulator,” BIF said.
The think-tank further said the draft bill provisions for the government to take back spectrum after 5 years or withdraw existing exemptions through mere notifications, without any consultation or due process, could adversely impact the investor sentiment and investment potential in the sector.
BIF said the telecom bill’s proposal to bring Over-The-Top (OTT) apps, which provide internet based call and messaging service, under licensing regime will kill innovation and stymie the GDP growth.
“They (OTT Apps) are the backbone of the Digital Economy and by including such services as telecommunication services and subjecting them to Licensing, it could stifle the entire socio-economic ecosystem, kill innovation and stymie the GDP growth.
“Majority of the OTT Communication Services ecosystem is being developed by a number of startups, SMEs, members from academia and professionals. Subjecting such services to Licensing could harm the nascent startups ecosystem,” BIF said.
It said the draft bill has insufficient clarity around mode of assignment of shared spectrum for satellite communications applications, unlicensed spectrum for public Wi-Fi use or usage of unlicensed spectrum for innovative applications.

The government on Friday said retail prices of rice in the domestic market will remain under control, helped by a ban on exports of broken rice and sufficient stocks in its godowns.
The statement by the food ministry came a day after its factsheet alluded to a pricing pressure and rates of rice rising in the near term. By imposing the ban on export of broken rice, the government has “successfully ensured domestic food security, availability of domestic feed for poultry and cattle feed, while keeping a check over inflation as well as domestic price of rice”, the food ministry said in the statement on Friday. With effect from September 9, the Centre imposed a ban on broken rice exports and also a slapped a 20 per cent export duty on non-basmati rice, except for par-boiled rice.
“The domestic price of rice is in comfortable position and the prices will remain well under control…Due to the surplus stock of rice, the domestic price of rice will be under control as compared to international market and neighbouring countries where the price is comparatively high,” the ministry said.
The minimum support price (MSP) of paddy has been increased by 5.15 per cent to Rs 2,040 per quintal in 2022-23 compared to Rs 1,940 per quintal in 2021-22.
The ministry highlighted that all-India domestic wholesale prices of rice and wheat decreased by 0.08 per cent and 0.43 per cent respectively over the week.
On Friday, the average retail price of rice stood at Rs 37.65 per kg, as per the data compiled by the department of consumer affairs. Regarding the exports ban, the ministry said the restriction has been imposed to ensure adequate availability of broken rice for consumption by domestic poultry industry and for other animal feedstock; and to produce ethanol for successful implementation of EBP (Ethanol Blending Programme).
The government has not made any changes in the policy relating to par-boiled rice and basmati rice. Par-boiled and basmati rice constitute around 55 per cent of total rice exports from India.
“So, the farmers will continue to get good remunerative prices and dependent /vulnerable countries will have adequate availability of par-boiled rice as India has significant share in the global rice export,” the ministry said.
Around 217.31 lakh tonnes of rice is in government buffer stock, which is higher than the buffer stock norm and 610 lakh tonnes will be procured in 2022-23 marketing season starting October.
“The buffer stock maintained by the country is more than enough to meet the demand for the public distribution system,” it said. India, which commands 40 per cent share in the global rice trade, exported 21.23 million tonnes of rice in 2021-22 fiscal as against 17.78 million tonnes in the previous year.
During April-August period of this fiscal, 9.35 million tonnes of rice have already been exported. Due to the current geopolitical situation, the international price of rice was lucrative, leading to high export of rice as compared to the previous year, the ministry explained.
Earlier this week, the agriculture ministry released the first advance estimates for kharif season of 2022-23 crop year (July-June), stating that rice production may fall 6 per cent to 104.99 million tonnes. Paddy acreage is down by over 5 per cent so far due to deficient rains in some parts of the country.
Capital markets regulator Sebi on Friday cancelled the registration of stock broker Ficus Securities for mis-managing clients’ funds and securities. The stock broker flouted regulatory norms during the period April 2015 to January 2018, the Securities and Exchange Board of India (Sebi) said in an order.
On multiple occasions, Ficus used its clients’ securities for settlement of its own pay-in obligations and has also transferred clients’ securities to other entities or has pledged those securities to avail funds for itself, Sebi noted.
Further, clients’ securities were not available with Ficus as it had pledged them to avail loans from financial institutions and consequently was not settling the accounts of its clients on a monthly or quarterly basis.
It was noted that during the period of April 2015 till December 2016, Ficus transferred Rs 48.28 crore to Ficus Commodities and received Rs 48.94 crore during the said period from Ficus Commodities.
This transaction was done at the same time when Ficus was not in a position to repay or settle funds due to its credit clients.
The regulator found that Ficus used its connected entity, Ficus Commodities for diverting its clients’ funds which resulted in the violation of stock broker norms.
The various flagrant regulatory lapses were noticed in the way Ficus was operating, specially the way Ficus was mismanaging its clients’ funds and securities, Sebi said. “Ficus has not only failed to fulfil its avowed duty towards its clients, be it redressing their grievances or settling the funds due to its clients, but has gone to the extent of misutilising its clients’ funds and securities,” Sebi Whole Time Director S K Mohanty said.
Accordingly, the regulator has cancelled “the certificate of registration granted to Ficus Securities Pvt. Ltd” and the directive will come into force with immediate effect. It has been noted that Ficus has been expelled from the exchanges — BSE, NSE and MSEI– since March 2018 by declaring it as a defaulter.
Senior Nationalist Congress Party leader and former Maharashtra home minister Dilip Walse Patil on Friday said the action by the National Investigation Agency (NIA) against the Popular Front of India (PFI) across Maharashtra a day earlier took place as the Union home ministry may have had some inputs.
In a massive crackdown on the PFI, multi-agency teams spearheaded by the NIA had, on Thursday, arrested 106 leaders and activists of the radical Islamic outfit in near simultaneous raids in 15 states for allegedly supporting terror activities in the country.
Twenty activists of the outfit were held from Maharashtra. “The Union Home ministry may have got inputs that is why the raids were conducted across the country and not just Maharashtra,” Walse Patil told reporters here. Being asked about a “survey” of various aspects of the Muslim community being carried out by the state government, Walse Patil said the ruling dispensation should announce if it had plans to give reservations to the community.
“It is not clear for what this survey is being carried out,” he added.
The Maharashtra government has commissioned a detailed study to assess the social, financial and educational status of the Muslim community in 56 cities of the state, an official order said. As per a government resolution (GR) issued on September 21, the Tata Institute of Social Sciences (TISS) has been roped in to conduct the study for which Rs 33.92 lakh have been earmarked.
The study is being commissioned by the Minority Development Department being headed by Deputy Chief Minister Devendra Fadnavis. Queried on his party’s strategy for the Nagpur Municipal Corporation polls, Walse Patil said the NCP would contest on the maximum number of seats.
“If possible, we will fight as part of the Maha Vikas Aghadi (also comprising the Shiv Sena and the Congress) or we will contest maximum number of seats on out own. Because, in future, we want to contest Assembly seats in Nagpur also. The NCP will perform well in Vidarbha,” he said.
