HC asks Bar Council to financially help a poor, elderly lawyer

Hearing the plea of a 72-year-old woman lawyer who claimed to have no source of livelihood and that she is sick and infirm, the Bombay High Court asked the Bar Council of Maharashtra and Goa to immediately give her Rs 5,000 as financial aid.

A bench of Justices V M Kanade and B P Colabawalla also asked Maharashtra government and the Centre to inform the court within four weeks if they had introduced any scheme for aged persons who did not have any source of income.

The court was hearing a letter written by the lawyer to Chief Justice Mohit Shah who had suo motu converted it into a petition and placed before a bench headed by Justice Kanade.

The letter said that she had no income of her own and that her children and relatives were not looking after her.

The lawyer also claimed that she needed money and food in order to survive and urged the court to provide her immediate financial help.

Advocate Hiten Venegaonkar and Advocate General Anil Singh, who appeared on behalf of the state government, said funds could also be given from Sanjay Gandhi Niradhar Yojna and handed over a government circular to the court in this regard.

Looking at the circular, the judges said disbursement of funds under this scheme was too meagre and would not suffice. They also advised the government to look into the issue and raise the financial aid under this scheme.

The court was informed that another scheme was Annapurna Scheme under which 10 kgs foodgrains was distributed free of cost to the beneficiary.

However, the woman lawyer’s representative, who was in the court, said she had no cooking devices at home and would not be able to use the free ration supplied by the state.

The court then asked the government lawyers to disclose various schemes under which financial help could be given to the woman lawyer.

Social audit of Mumbai railway network reveals service gaps

A social audit on the Mumbai suburban rail network found that the killer distance between railway station platforms and railway footboard continues to exist on 93 per cent of stations.

“We chose ten suburban railway stations on Central, Harbour and Western lines to do a first ever social audit of the suburban railway network which highlighted various issues that need to be dealt with full willpower and commitment,” Moneylife Foundation’s Sucheta Dalal said.

“Hawkers and beggars were found on foot overbridges at 53 per cent of stations and 57 per cent of railway stations do not have railings to prevent crossing of tracks,” the report stated.

“Sixty three per cent of railway stations had ambulances parked outside premises and only 17 per cent of stations had an acceptable level of sanitation. Most stations did not have adequate signage. However, there are many large and colourful advertisements and hoardings,” the report said.

“The report is a feedback from citizens and commuters from Mumbai and hence we placed it in public domain as well as submitted it to the railway minister, besides general managers of Central Railway and Western Railway,” Dalal said.

The social audit was carried out with the help of two foreign students namely Ricky Vella and Leanne H Truong from the University of Western Sydney in Australia, with help from railway activists.

Samir Jhaveri, a railway activist who is part of the Safe Rail Group, run by the Moneylife Foundation, said, “This report shows the clear picture of the suburban railway system and railway officers must act accordingly”.

HC to hear Salman’s appeal against conviction from July 30

The Bombay High Court today said it will hear the appeal filed by Bollywood actor Salman Khan against the five-year sentence awarded to him in the 2002 hit-and-run case from July 30 on a regular basis.

Salman’s lawyer Amit Desai sought adjournment of hearing till August 3, but Justice A R Joshi did not consider his plea and decided to hear the 49-year-old actor’s appeal from July 30.

In a related development, the judge also dismissed an intervention plea for granting a stay on the hearing on the ground that the applicant had no locus standi in the matter.

A murder convict, whose appeal has not been heard since 2009, had filed the intervention application. His contention was that the matters involving celebrities were being heard out-of-turn, whereas those of others were kept pending and such convicts have to languish in jail.

He has also filed a separate petition making the same allegation about appeals of celebrities being heard urgently.

His lawyer Aparna Vatkar prayed that his appeal may be heard expeditiously.

Prosecutor S S Shinde, however, said he had no locus standi (right to be heard) in this matter. The applicant can pursue his other petition which is before another bench, said Shinde.

The court accepted the prosecutor’s plea and rejected the application. The judge said that both the sides in Salman’s case had agreed to expeditious hearing and, therefore, the applicant had no right to intervene.

The actor, who is on bail, did not come to the court today. His sister, Alvira, was, however, present.

Salman was convicted by a sessions court on May 6 and sentenced to five years’ imprisonment on various counts, including ‘culpable homicide not amounting to murder’.

A man was killed and four others were injured when the actor’s Toyota Land Cruiser ran over them while they were asleep on a pavement outside a bakery in suburban Bandra on September 28, 2002.

Four killed, five hurt in Mumbai tree collapse

Four persons were killed and five were injured in suburban Santacruz in a tree collapse incident.

The tree collapsed on a wall in Wakola area and the wall crashed on the shanties built next to it, crushing those inside, Fire Brigade said.

Four persons were killed and five were injured in the incident, it said.

The injured were admitted to nearby municipal hospitals.

The city has been receiving frequent showers over the last one week.

Alert sounded in Mumbai, elsewhere in Maharashtra

In view of the terrorist attack in Gurdaspur district of Punjab this morning, intelligence agencies have issued high alert in four prominent cities of Maharashtra.

“Intelligence agencies have sounded a high alert for Mumbai, Pune, Aurangabad and Nagpur cities. Intelligence agencies have told us that there should be high security for a few days in places like malls, railway stations and cinema halls as there could be a possible terror attack in one of these cities in the coming days,” said minister of state for home Ram Shinde.

As for Mumbai, city police commissioner Rakesh Maria said that all the concerned units and the special units of the city police apart from police stations have been asked to be alert.
State anti-terrorism squad chief Vivek Phansalkar said, “All our units in the state have been alerted and told to keep a tab on every suspicious person or group.”

A police source said that officers had got in touch with some accused or convicts who are in jail in terror-related case to get clues about possible strike in Mumbai.

In Nagpur, police have already increased security ahead of the scheduled hanging of Yakub Memon, the convict of 1993 Mumbai serial blasts case, on July 30.

Four heavily armed terrorists wearing army uniform went on a rampage attacking a bus and a police station complex, leaving five persons, including a policeman, dead and several injured in Gurdaspur district bordering Pakistan.

Shiv Sena workers protest alleged misbehaviour of police

Scores of Shiv Sena workers along with Ambarnath Sena MLA Balaji Kinnikar held a protest at the Hill Line police station in the district against the alleged misbehaviour of police with a local Sena leader.

The protest was held on Sunday night.

MLA Kinnikar alleged that last night police misbehaved with a local Sena leader Raju Chikne who was involved in a road accident.

“The police constables who were patrolling the area took Chikane to the police station where a senior officer reportedly abused Chikane. He was also beaten up by the police,” Kinnikar alleged.

Kinnikar said that some Shiv Sena leaders contacted Joint Commissioner of Police V V Lakshi Narayana who rushed a ACP rank officer to the spot to control the situation.

When contacted officials at the concerned police station did not reveal any details about the incident.

Mr. Badal knows it all?

In a suspected terror attack gunmen fired indiscriminately in Punjab’s Dinanagar town in the frontier district of Gurdaspur, leaving seven dead, including police officials. Dinanagar town is close to the Jammu and Kashmir border. No doubt that there is going to be a political discourse on the instant militant attack on a police station in Gurdaspur with allegations and counter allegations. However, what is alarming and need to be focus of all debates by the pundits of the subject, is the sudden switch in the pattern of operation of, presumably, Pakistan based terrorist groups. Though, it is premature at this juncture to presume, but it appears handiwork of Pakistan sponsored terrorism. Now here the question arises that where do these terrorists come from, possibly not from the Punjab borders. It is also possible that the group infiltrated in J & K and then came down to Punjab and thereby given a food for thought to our thinkers on the subject. In either case it is a new dimension, design of which need to be understood by us and acted accordingly.

Moreover, Badal is very expert on the game of creating terror and cash in during elections time. If you read history of Punjab specially a book Galant Defender by AR Darshi, you will know the true faces of many Punjab’s politicians. There is an old man named Bapu Surat Singh on hunger strike. His motive is to get out of jail Sikh prisoners who have completed their jail terms. Badal is tight lipped on this issue and also sent his team of politicians to North America to publicize his good deeds and they got huge Opposition here. So, now he knows that people’s minds needs to be diverted from these issues because Bapu Surat Singh is getting unconditional support from maximum Punjabis across the globe. Otherwise what the heck terrorists will get from a small town like Dinanagar? I am just writing the possibility of this attack. This can be more of politically motivated. Whosoever is the culprit, but the sufferers are common people.

There are couple of other dimensions to be considered, Badal has tested this same strategy couple of months ago with a Sikh religious tour of relics of Gurus, the gurus were attacked by some unknown elements and that became national news. During that time, Badal was in the mid of controversy because a teenage girl died after she and her mother jumped off a running bus after being allegedly molested by a helper of the bus. According to the information, 38-year-old woman was travelling with her 16-year old daughter on a bus (registration number PB 10C 1813) belonging to Orbit bus company (which is owned by Badal). The woman was injured while her daughter got killed. After the attack on Sikh Gurus the molestation news went out of the headlines and Badal once again managed to get some sympathy and attention with religious attack.
Now just assume this situation if attackers proved to be Muslims, then the issue will be in national media and Badal can say we are under fear of Jammu and Kashmir’s terrorism. So, we must get some help. And whatever he milks from centre will be shown as his victory and hard work. On the other hand if the attackers are found to be Sikh, which I doubt they might but still, then he will promote in mainstream media that pro-Khalistanis are again trying to disturb peaceful Punjab.

On the other hand, Badal is under criticism for his silence on some really important Sikh and Punjab issues. They needed a strong issue or incident to divert attention of people. Punjab is stuffing with many issues and people are angry with the government. It has a collateral damage but it works 99 times out of 100. This attack will give Badal double advantages, one he can pressurise and threat BJP that they cannot control Punjab if militancy comes back. Two, he can put as many opponents behind the bars in the name of law and order that people will stop raising voice against him and the issue of Bapu Surat Singh hunger strike will be ignored if not forgotten. So, he will be benefitted in either situation. Our country is in danger with dirty politics than the terrorists. These traitor politicians know how to twist the issues to their advantage at the cost of few lives.

Five people, including two Punjab police personnel, were killed and several injured in an early morning (suspected) terror attack. As usual, our Prime Minister Narendra Modi held a high-level meeting with Defence Minister Manohar Parrikar, Finance Minister Arun Jaitley and other senior government functionaries to take a stock of the situation. However, all of them were busy in spreading their emotions on social networking sites.

The incident took place at around 5-30 a.m. when the terrorists, who are suspected to have sneaked in through the Indo-Pakistan border in Jammu, first targeted a bus ferrying civilians and then stormed into the police station. Following an alert, combing operations led to discovery of five improvised explosive devices on the railway tracks connecting Dinanagar to Pathankot. The National Security Guards has also been rushed in to carry out bomb detection and disposal operations. These kinds of attacks must be condemned. However, we as a citizen of this country should also look in to the issue around us. Such attacks in remote place killing innocent people early in the morning have no reason or motive. As usual, we wind up the topic on assumptions and eyewash…the actual preparatory always get scot free.

Gurdaspur terror attack ends, all 3 terrorists, 4 security men and 3 civilians killed

Gurdaspur-terror-attackTerror returned to the Punjab on Monday (July 27) morning after more than a decade leaving behind a trail of death and destruction. A group of heavily armed terrorists launched a suicide attack at a police station in Dinanagar in Gurdaspur district of the Punjab in the morning reviving fears of Khalistani terror groups making a comeback in the state.

The attack site in Dinanagar, which is very close to the international border with Pakistan, saw security forces and the three terrorists engaging in an almost 12-hour gunbattle before all the attackers were killed. Three home guards and one Punjab Police Superintendent of Police Baljeet Singh along with three civilians were also killed.

According to intelligence sources the attackers were from Pakistan based terror group Lashkar-e-Toiba.

Though there was no official word on who the attackers were, but they are suspected to have sneaked into India from Pakistan through the unfenced border between Jammu and Pathankot or Chak Hira in Jammu district.

Director General of Punjab Police Sumedh Singh Saini said, “The terrorists were carrying sophisticated weapons. We have recovered ‘Made in China’ grenades from them. They were wearing combat fatigues.”

An alert has been sounded along the international border in Punjab and Jammu as the terrorists are suspected to have infiltrated from there, the sources said.

Union Home Minister Rajnath Singh spoke to Punjab Chief Minister Parkash Singh Badal and National Security Advisor Ajit Doval about the situation. Later, he met top officials to review the security situation in the wake of the attack.

Singh said he will make a statement on the issue on Tuesday in Parliament, where members on Monday sought a detailed government response.

Meanwhile, Pakistan has denied any involvement in insurgencies in Punjab and Jammu and Kashmir. “We condemn in the strongest terms the terrorist incident in Gurdaspur, India, today, in which a number of precious lives have been lost. There are reports of others having suffered injuries. Our thoughts are with the bereaved families. Pakistan reiterates its condemnation of terrorism in all its forms and manifestations. We extend heartfelt sympathies and condolences to the Government and people of India and wish the wounded speedy and full recovery,” it said.

Goa crime branch arrests AM Wachasundar, its first in the Louis Berger bribery scam

The Goa crime branch on Monday arrested Japan International Cooperation Agency (JICA) project director AM Wachasundar, its first in the Louis Berger scam allegedly involving the previous Congress government in the state. JICA was a part of the consortium behind the water development project in 2010.

Wachasundar served as a chief engineer in the Public Works Department in Goa and was later appointed as the JICA project director.

The Goa crime branch has submitted a report to the Chief Minister’s Office saying it has been able to establish the money trail. The crime branch says Wachasundar was allegedly fixing deals between Louis Berger and two ministers in the previous Congress government.

Amid the controversy, former Congress minister Churchill Alemao, who was allegedly bribed by the US firm, has claimed that he’s being framed in the case, calling it a political conspiracy.

Alemao was the Public Works Department minister at the time the US-based company had won a water project in the state.

Earlier on July 21, the Goa crime branch had started the investigation into the Louis Berger bribery scam over allegations of kickbacks for a water development project sanctioned under the Congress government in Goa in 2010.

Ex-union minister PK Thungon gets 4.5 yrs jail in corruption case

Former Union Minister PK Thungon was on Monday awarded a four-and-a-half year jail term by a Delhi court in connection with a case lodged in 1998 pertaining to misappropriation of Rs. two crore released by the Centre.

Besides the prison term, Special CBI Judge Ajay Kumar Jain also imposed a total fine of Rs. 10,000 on 68-year-old Thungon, a former Chief Minister of Arunachal Pradesh.

The court awarded three-and-a-half years imprisonment to the two other convicts, Tali AO and C Sangit, while fourth convict Mahesh Maheshwari was awarded two-and-a-half years jail term in the case.

It imposed a fine of Rs. 6,000 on Tali AO and that of Rs. 4,000 each on Sangit and Maheshwari.

During arguments held earlier in the day, CBI had sought “approporiate sentence” for Thungon and the three other convicts.

The agency prosecutor told the court that Thungon had held high office having been the Chief Minister of Arunachal Pradesh and a Minister of State at the Centre, but he still committed the crime.

“An appropriate sentence should be awarded to Thungon while keeping in view his stature. The three other convicts helped him in the conspiracy, so appropriate sentence should be given to them,” the prosecutor submitted.

He also said that four other cases were still pending against Thungon.

Thungon’s counsel contended before the court that all the other cases pending against his client were arising out of a single FIR lodged by CBI in an alleged housing scam case and that he was the only one to look after his ailing wife who is suffering from various serious ailments.

The court had on July 21 convicted Thungon, who was the then Minister of State Ministry, Urban Affairs and Employment, Tali AO, C Sangit and Mahesh Maheshwari in the case and sent them to jail.

All the four convicts were brought to the court today from the prison.

Thungon and three others were convicted for offences under sections 120 B (criminal conspiracy) read with 419 (cheating by personation), 420 (cheating), 467 (forgery of valuable security), 468 (forgery for purpose of cheating) and 471 (using as genuine a forged document) of IPC and under relevant provisions of the Prevention of Corruption Act.

According to CBI, in pursuance to the proposal of Nagaland government, the then Planning Commission had sanctioned an amount of Rs two crore in 1994 for renovation and upgradation of minor irrigation projects for the state and the money was to be released in two instalments of Rs. one crore each.

It had said that the accused had misappropriated the funds.
