Life sentence reduced to 14 years for man who killed daughter

arrest-recordsrestIn a relief to a man who had killed his daughter with an axe, the Bombay High Court reduced the life imprisonment sentence imposed on him by a lower court to the period of about 14 years he had spent in jail and ordered his release.

The court ordered the release of Gata Mohansinh Jadav from Lajpore Central Prison in Surat (Gujarat) jail.

Hearing Jadav’s appeal, the High Court set aside the life sentence awarded by a sessions court at Dadra and Nagar Haveli in Silvasa district saying that the offence under section 302 IPC (murder) was not made out against him.

The court instead held him guilty under IPC section 304 part I (culpable homicide not amounting to murder).

“In our view the case would clearly fall u/s 304 Part I of IPC, because we are of the opinion that the appellant did not just have the knowledge that his act is likely to cause death but in fact the appellant intended to cause death of (his daughter) Shobhana,” said Justices V L Achliya and V K Tahilramani in a recent judgement.

“We say so on the basis of the weapon used, part of the body where the injury was inflicted, the force used while assaulting and the nature of the injuries. Looking at all these facts, we are of the considered opinion that the case would fall u/s 304 Part I of IPC,” said the judges.

Defence lawyer Arfan Sait argued that the case would fall under section 304 part II(culpable homicide not amounting to murder) saying the accused had knowledge that his act may cause death but had no intention to kill his daughter.

However, the court did not agree with his contention saying that the appellant had the intention to kill his daughter and hence he had hit the axe on her head.

Jadav stayed with his wife and three children at Naroli in Dadra Nagar and Haveli. At the time of incident, the daughter of the appellant, Shobhana, was 14-year-old. His wife and brother-in-law were eyewitness to Shobhana’s killing.

On December 17, 1996, Shobhana asked for money from her father to go on a school trip but he refused. She insisted and an argument broke out between the two. In a fit of rage, Jadav picked up an axe lying in the house and dealt a blow on the head of his daughter who fell unconscious. She was taken to hospital where she succumbed to her injuries.

Red beacon on car is ‘traditional right’: Mumbai Mayor

Mayor of Mumbai Sunil Prabhu on Wednesday asked the Maharashtra government to rethink its decision of “taking away” the “traditional rights” to use a red beacon by the mayor.
Prabhu, in a letter to Maharashtra Chief Minister Prithviraj Chavan, said that the mayor’s position was a legislative post which should be respected.

“I have written a letter to Maharashtra Chief Minister (Prithviraj Chavan) and conveyed my grievances to him. I have also told him how the traditional rights of the mayor are being taken away,” he told reporters in Mumbai on Wednesday.

Prabhu, who is also a Shiv Sena politician, said that it does not matter who the mayor of the city is, and what really matters, is that the mayor’s position is a legislative post, which should be respected.
“If ministers of state and the principal secretary can be allowed to move in a car with a red beacon, then why is the mayor not allowed to use one? The Municipal Corporation of Greater Mumbai (MCGM) has a sanctity of its own, and the mayor holds power equivalent to a principal secretary. That is why the Mayor of Mumbai should be allowed to use a red beacon,” he said.

Prabhu, who is the 74th mayor of the city of Mumbai said that he sincerely hoped that his feelings would be taken into account by the government of Maharashtra and he believed that the government would rethink its decision to uphold the “traditional rights” of the mayor.

Last year, the Supreme Court had come down heavily on the rampant misuse of beacons by those in power and directed authorities to ensure that even those holding constitutional positions used beacons on vehicles only when they are on duty.

After Narendra Modi Calls Uddhav Thackeray, Shiv Sena Ends Portfolio Protest

For the second time this week the ruling BJP’s biggest ally, the Shiv Sena, has set aside its reservations on an issue and reposed faith in Prime Minister Narendra Modi. The Sena’s lone minister in the new cabinet, Anant Geete, took charge of the ministry allotted to him.

Mr. Geete had refused to take charge of the Heavy Industries and Public Enterprises Ministry yesterday, demanding a change in portfolio. Mr. Modi spoke to Shiv Sena chief Uddhav Thackeray on the phone and resolved the issue, Sena leader Sanjay Raut said.

Sources said the Shiv Sena could now get more Minister of State posts in a cabinet expansion expected in a few weeks.

“It is true that we would have wanted a portfolio where we could have a direct connection with people but no one is upset. We discussed this with the PM and he has assured us that the Shiv Sena’s concerns will be addressed,” Mr. Geete told, and added “My immediate priority would be to change the perception of this ministry and improve the condition of the sick public sector enterprises.”

Mr. Geete had said yesterday, “Uddhav Thackeray will take a call tomorrow (Wednesday) on whether I should take charge of the ministry. We want a change of portfolio.”

On Monday, Mr. Thackeray had attended Narendra Modi’s swearing-in ceremony despite voicing misgivings about Mr. Modi’s invitation to Pakistani Prime Minister Nawaz Sharif for the function.

The two parties led an alliance that swept Maharashtra in the general elections winning 42 of the 48 seats – the Sena won 18, the BJP 23 and the Swabhimani Paksha Party won one seat.

Mr. Modi rewarded five of the BJP’s 12 partners who have won seats in the Lok Sabha, with a place each in his council of ministers. The BJP has 282 seats in the Lok Sabha and does not depend on its allies for a majority in the lower house. But it needs all the support it can garner in the Rajya Sabha or upper house.
Assembly elections are due in Maharashtra later this year and the BJP and Sena hope to replicate their success in the general election and overthrow the Congress-Nationalist Congress Party government that has ruled the state for over a decade.

Teenager rams car into pedestrians; one killed, 6 injured

A 62-year-old man was on Tuesday killed and six others got injured when a car being driven by a 19-year-old youth hit them near Golden Swan hotel in suburban Santacruz, police said.

The accused, Harse Premeji Patel, was driving a Maruti car and he rammed into five men and two women, all pedestrians, apparently after losing control of the vehicle, police said.

One of the victims, Narayan Tanu Pujari, later succumbed to injuries.

Patel has been taken into custody and will be produced before a court tomorrow, they added.

Undergraduate Irani: Can she give good governance?

HRD Minister Smriti Irani’s educational qualification has hit arguments on social network. First of all, people of this country are not in favour of giving cabinet berth to any loser and secondly, the one who never stepped in college can hold important HRD ministry. To defend its decision and Smriti Irani, BJP became aggressive and sited many examples, such as Bill Gates being less qualified person. I don’t know why they are dragging people like Bill Gates in this. Everybody can’t be a Bill Gates. You cannot hand over HRD Ministry to someone who is under-graduate like Smriti Irani because you want woman and young faces in the cabinet! Bill Gates became Bill Gates because of hard work and owns a successful company not thee ministries. Bill Gates has always achieved, he was not a looser, Smriti Irani has failed as a politician, people have disowned her and she lost two important elections. This is really a disrespect to people’s mandate. When people have bestowed a party clear mandate, then why compromise with the key position? By saying “achche din” we certainly do not mean days of good acting but real action on the field. The debate on Education is not top priority. If we think about the other side of the coin, since she is just Class XII passed, she can have better zeal to do something for poor and uneducated. Education is certainly important but one should not be criticised or their skills should not be under estimated just like that. Smriti needs to have that caliber to deal with such portfolio. Question is not about her qualification but also about her ability. Don’t forget that though Sonia was not a minister in UPA, she was running the Government including the PM. The question is not about her qualification but HRD Ministry is an important ministry which should be handled by an experienced leader. The Ministry is important and should be headed by senior BJP leader.

I hope the educated parties would encourage and stop criticising her for the betterment of India. Modi is the king and this success comes after an uncountable party meetings, very good campaigning strategies and good selection of people for contesting the MP seats by knowing the people’s pulse. From the common man’s perspective, an education minister should have a proper educational qualification. However, Modi will not like to see her criticised forever. We have to wait and watch the show. What the HRD Minister requires is not essentially a university degree but the basic outlook to bring about major reforms in the educational sector. She has to make primary education available to every child in the country regardless of the child’s status. There is a dire need to recast university education in line with what is obtained in Singapore and more research grants are to be given for encouraging research in fundamental sciences and other frontier disciplines. When Oxford University was looking for the President, it explored the entire globe of educationalists and invited one competent person to head. That was the importance given to the prestige of the University. Sometimes, a Headmaster in Haryana was made Vice-Chancellor and at a Public Function; he prostrated before the Chief Minister for honouring him. Some fellows would say, what is wrong in it?

Almost all those who achieved great heights are non-graduates. For example, Bill Gates, Dhirubhai Ambani in business, K.Kamaraj (Former Tamil Nadu Chief Minister) in politics and Sachin Tendulkar in sports. If one has in-born talent, he can do anything. Let’s assume Modi has given Smriti Irani a chance to prove herself. Television star-turned Union Minister Smriti Irani’s meteoric rise saw her come under the scanner on her first day in office. Curiously enough, the first salvo was fired by one of Prime Minister Narendra Modi’s most vocal supporters, activist Madhu Kishwar. Drawing attention to Irani’s educational qualifications, Kishwar tweeted: “Smriti Irani is merely Class 12 pass. She went on to become a fashion model on to TV serial bahu [daughter-in-law]. Is this qualification enough for India’s Education Minister?” With criticism about the appointment coming from within, Congress spokesman Ajay Maken waded in and ended up with pie on his face, courtesy his tweet: “What a Cabinet of Modi! HRD Minister (looking after Education) Smriti Irani is not even a graduate. Ms. Irani, however, steered clear of the controversy over her surprise inclusion. In a fleeting interaction with the media after taking charge, she stuck to the Ministry matters. Though, she lost the Lok Sabha election to Congress vice-president Rahul Gandhi in the Nehru-Gandhi pocket borough of Amethi by over a lakh votes. Ms. Irani appears to have been rewarded for making him sweat?

CGSI’s Consumer Camp receives overwhelming response

The Consumer Guidance Society’s Summer “Consumer Grievance Redressal Camp” was held at Tendulkar Hall, Moghul Lane, Mahim, Mumbai was a huge success. Above 80 complaints were heard and addressed by professionals from banking, telecommunications, insurance, consumer durable manufacturers and service providers in predefined time slots.

Former RTI Central Information Commissioner Shailesh Gandhi visited the camp and guided persons having grievances under the RTI Act. Mr. Gandhi explained ways and means to make the government function by using RTI. “If you have a law, follow it. I can’t see any reason why people are not doing so,” said Mr. Gandhi.

“It is our job to give proper guidance to the consumers and protect their rights by organizing such camps,” said Dr. M.S. Kamath, Hon. Secretary, CGSI.

PM Modi’s advice to ministers, don’t take relatives in personal staff

personal-staffLeading from the front and by personal example has been Narendra Modi’s style of working in Gujarat. The new ministers got their first lesson on the “Gujarat model” of governance when they were advised by the Ministry of Personnel, Public Grievances and Pensions department of Personnel & Training to not appoint their relatives as personal staff.

As per reports, the advisory, said to be the among the first documents signed by Modi after he assumed charge as PM, outlines rules that will have to be followed in the appointment of personal staff attached to ministers.

The most important operative part of the order – ministers will henceforth appoint secretaries and other personal staff only from the “general pool”.

Is it probably for the first time that ministers are being nudged by a prime minister to keep their relatives away from official work.

Earlier, many ministers have ignored the rules and filled their office with their kith and kin. The most notable example was that of former railway minister Pawan Kumar Bansal. He had appointed his son-in-law Vitul Kumar as his OSD and his sister’s son-in-law, Rahul Bhandari, as his personal secretary and also his nephew Vijay Singla.

It was Singla’s alleged complicity cash-for-postings scam that led to Bansal’s sacking as the rail minister.

By barring ministers from appointing personal staff of their choice, Modi has in a way ensured that no minister would be able to run his/her ministry as a personal fiefdom.

PM Modi is also said to have advised his ministers to cut down on expenses and establish a direct line of contact with the people.

Also, the decision once again highlights Modi’s commitment to run a clean government that will deliver on the promises he has made to the people of the country.

Will ensure speedy probe in black money issue: SIT chief Shah

Former Supreme Court judge Justice MB Shah, who is to head the Special Investigation Team (SIT) into the black money issue on Wednesday said there are a number of “complexities” involved but asserted he will ensure a speedy probe.

The Narendra Modi Cabinet at its very first meeting yesterday announced that a SIT headed by Shah will be constituted to unearth black money.

“A number of complexities would be there, but at present it is difficult for me to say which complexities I would face. But I will try to solve them as early as possible,” Justice (retd) Shah said.

Asked about the past record of delays in submission of inquiry commission/committee reports, the former judge said he will try to “finish the work as early as possible.”

“I was the Chairman of a Commission on illegal mining of iron ore (in Odisha and Goa). I submitted the first interim report within two months (of starting probe).”

“Thereafter, the Goa report within six months. And thereafter the further report of Odisha in next six months. So I am sure that I will finish the work (probe in black money issue) as early as possible,” he said.

Shah said he would be firm in dealing with big political and corporate personalties if they are found to be involved in stashing away black money in foreign banks.

“I have worked for many years as a judge – 15 years as a high court judge and then five years as a Supreme Court judge. I have never bothered about personalities and nobody has dared to touch me. It is as good as that. Do not worry about it,” he said.

He was asked how he would deal with the issue when big corporate and political personalities are said to be involved in stashing unaccounted wealth overseas.

On the initiative to set up the SIT, he said it was a direction of the Supreme Court and it had to be obeyed by the government.

“The matter was pending for the last two years. Thereafter, a stay order was granted on a review petition. The stay was vacated 15 days ago. Last week, the Supreme Court directed a probe into the issue as early as possible,” Shah said.

“Once the Supreme Court direction came, the government was bound to follow it. Once the review petition was dismissed, there was no alternative for any government. For the new government too it was (imperative) to find out black money.”

The SIT also comprises another former Supreme Court judge Arijit Pasayat as Vice-Chairman, and will be assisted by the Revenue Secretary, Directors of CBI, IB, RAW and ED, the CBDT Chairman and an RBI Deputy Governor.

Row Over Article 370: Does Omar Think Jammu and Kashmir Is His Parental Estate, Asks RSS

The Rashtriya Swayamsevak Sangh, or the RSS, has hit out at Jammu and Kashmir chief minister Omar Abdullah for his grim warning that his state will not remain a part of India if Article 370 was revoked from the Indian Constitution.

“J&K won’t b part of India? Is Omar thinking its his parental estate? 370 or no 370 J&K has been n will always b an integral part of India (sic),” tweeted RSS national executive member Ram Madhav.

The RSS leader also defended union minister of state in the Prime Minister’s Office Jitendra Singh, who triggered a first-rate controversy on his inaugural day in office by reopening the debate on the Constitutional provision that bestows special status to Jammu and Kashmir, and is the only instrument governing relations between the Union of India and the state.

Mr. Singh, a doctor by profession, has made his debut in the Lok Sabha by wresting the Udhampur seat from the Congress.

“The minister has merely reiterated the party line. He has called for a debate on the usefulness, or otherwise, of Article 370. Attempts to create a needless political controversy are uncalled for,” Mr. Madhav said.

Mr. Abdullah had attacked Dr Singh’s remarks on Article 370 as being “ill-informed and irresponsible.” He took to the micro-blogging site Twitter to register his protest. “Mark my words & save this tweet – long after Modi Govt is a distant memory either J&K won’t be part of India or Art 370 will still exist (sic),” he said.

The chief minister also rejected the Union minister’s clarification, issued last night, that he had been “misquoted,” and demanded an explanation from “higher-up.”

Mr. Abdullah continued with his attack on the BJP today, describing as “extremely dangerous” its efforts to seek the revocation of Article 370. He argued that only way to scrap the provision was on the back of the body called Constituent Assembly. “This is the body that ratified the relationship of Jammu and Kashmir with India,” he said, adding, “If you were to recall the Constituent Assembly, you would be reopening the debate on the Instrument of Accession.”

Will showcase India’s strengths to the world: Sushma Swaraj after taking over as MEA boss

BJP stalwart Sushma Swaraj took charge as the External Affairs Minister on Wednesday with the promise that she will showcase India’s strengths at the world stage and ensure good relations with all countries.

“My priority is to showcase our strengths to the world and further improve relations with other countries,” she said after assuming charge at her office in South Block.

Sushma also gave details about Prime Minister Narendra Modi’s talks with SAARC leaders.
“I assisted the PM in his talks with SAARC leaders. The talks were very successful,” she said.

“I see the talks with Pakistan in a positive light. To Pak PM the PM he repeated what PM had said that under the noise of bomb blasts it’s not possible to have normal talks,” she said.

Sushma added that India wants good relations with Pakistan but that can become possible only if there is no terror.

PM Modi also raised the issue of the speedy trail of 26/11 accused in Pakistan, she said.

On the talks with SAARC leaders, she said, “The PM Stressed on joint initiatives by SAARC nations, like tourism,” adding, “PM expressed the desire that SAARC countries shouldn’t bring up contentious bilateral issues.”

“PM Modi raised issues of Tamil fishermen and 13th amendment with Sri Lankan President,” she said on Modi’s talks with Sri Lanka President Mahinda Rajpaksa.
