Swamy seeks sanction from Lt Guv Jung to prosecute Kejriwal, Sisodia

In yet another attack on Arvind Kejriwal, Bharatiya Janata Party (BJP) leader Subramanian Swamy has written to Delhi Lieutenant Governor Najeeb Jung seeking sanction to prosecute the Delhi Chief Minister and Deputy CM Manish Sisodia.

Swamy has alleged that during Aam Aadmi Party’s 49-day governemnt in Delhi, Kejriwal and Sisodia had illegally favoured a company named SKN Associates.

Swamy’s application seeks sanction to prosecute the Aam Aadmi Party (AAP) leaders under Section13(1)(d) of Prevention of Corruption Act.

The letter says, during his first tenure as Delhi CM (December 28, 2013 to February 14, 2014 – 49 days) Kejriawl and then finance minister Sisodia had illegally favoured M/s SKN Associates Ltd, having registered office at E-71, SKN House, South Extension Part-1, New Delhi.

This company was a VAT defaulter and, just 10 days before he assumed office, this company’s name had figured in the list of VAT defaulters who were served show cause notice by Commissioner (VAT).

The BJP leader has sought sanction to prosecute Kejriwal under Prevention of Corruption Act alleging that as CM in his first tenure, he had helped AAP receiving donation from a private firm in lieu of illegally favouring it.

Swamy alleged that Kejriwal and Sisodia, instead of trying to recover the dues from the company for the state exchequer, started seeking donation from the tax defaulter for AAP.

Claiming that four subsidiary companies of SKN Associates had paid a total of Rs 2 crore to AAP, Swamy alleged the firm was given various contracts including supply of electrical equipment, air conditioning and LPG and CNG materials.

This is prima facie a misuse of office and misappropriation of public money and receiving quid pro quo in lieu of favour by Kejriwal and Sisodia for VAT defaulter/evader. This comes under Sec 13 (1)(D) of Prevention of Corruption Act, he alleged in the letter while seeking Jung’s sanction to prosecute the two AAP leaders.
