There was a protest rally in Jalgaon, North Maharashtra today. It was against rising cases of Love Jihad, killing of cows. It was organised by a number of right-wing organisations, such as Hindu Janagagruti Samiti, Sanathan Sanstha, Brahman Samaj, Maheshwari Samaj, Hindu Rashtra Sena, VHP and RSS members are also participating in it. One of the chief demands of the rally includes a law against religious conversion. The Supreme Court’s recent remarks on religious conversions cast a spotlight on the long-standing debate about what the fundamental right to follow one’s religious faith entails. On December 5, a Bench led by Justice M.R. Shah said acts of charity or good work to help a community or the poor should not cloak an intention to religiously convert them as payback. The Bench has been hearing a plea from advocate Ashwini Kumar Upadhyay seeking a special law against forced conversions and alleging that “mass conversions” of socially and economically underprivileged people are being carried out.

The National Family Health Survey 2015-16 listed 12.6% of marriages as inter-caste and only 2.6% interfaith, meaning that social dynamics have been essentially frozen in place. India does not structurally favour inter-religious marriage but it must now consider conversion for marriage a crime. This is not simply an extension of conservative control over gender and intimacy, it is a process of racialising different religious communities, freezing them as separate ethnic groups. Regimes fixated on ethnic purity invoke ‘traditional religious values’ to disguise their need for racialised citizens, not dissimilar to Israeli apartheid – here, arguments based on fear of demographic change are already making their way into judgements related to the ‘love jihad’ laws.

On 1st December 2022, the Vishwa Hindu Parishad launched a nationwide campaign against ‘love jihad’ and forced religious conversion, seeking a national law against these alleged activities and accelerating its efforts as a vigilante group and self-styled paramilitary force to fight it. This comes alongside the central government taking a formal stance (in an ongoing Supreme Court petition) denying any incongruence between Article 25 and the enactment of anti-conversion laws. Within days, the Gujarat government also filed an affidavit in the Supreme Court supporting stricter regulation of conversions.

Objections from Christians and Muslims across India reflect patterns of harassment and wrongful incarceration that derive legitimacy from these laws. At least 302 attacks against Christians took place in the first seven months of 2022, according to the United Christian Forum. Uttar Pradesh reported the highest tally of 80 incidents, many of which invoked forced conversions as justification. Fatehpur, for example, where local VHP and Bajrang Dal chapters have accused Christians of “conversion rackets” for several years, saw unprecedented levels of police action on these claims throughout 2022.

The anti-conversion laws are reconfiguring RSS cadres and Hindu right-wing organisations’ fight against conversions and interfaith relationships, into spaces of legitimate action. Recent activities include demanding data from the government regarding how many Hindus have converted under the Act (mandatory public notices are trespassing on privacy), openly conducting ward/district level drives to make regions ‘conversion-free’, increased mobilisations against the construction of churches and mosques, even demolishing these structures if deemed necessary, and accelerating coercive drives to convert Muslims, Christians and Adivasi communities to Hinduism.

Many activists were accused and arrested in the Elgaar Parishad case. The initial investigation focused on the people and groups who had organized the Elgaar Parishad. Gujarat MLA Jignesh Mewani and former JNU student Umar Khalid were among those who had participated in Elgaar Parishad and made speeches. Jignesh Mevani got bail as soon as he was arrested but Umar Khalid had to remain there for years and now, he is free. Pune police claimed that while carrying out the investigation; it had stumbled upon material that provided clues about the operations of a larger underground network of banned Naxalite groups.

Varavara Rao is an accused in the Elgar Parishad case of 2018 and has been behind bars since then. He was granted bail in 2021. One of the bail conditions was that he should not leave the jurisdiction of the Mumbai court where the trial would be held. Court has now issued a notice to the National Investigation Agency (NIA) in a plea filed by Telugu poet Varavara Rao seeking permission to get his cataract surgery done in Hyderabad.

In June 2018, the Pune police arrested five activists and lawyers from Pune, Nagpur and Delhi, claiming that these activists allegedly had links with the banned Naxalite organization, CPI (Maoist) and had played a role in organizing the Elgaar Parishad. Later that year, in August, the Pune Pune police carried out simultaneous at the houses of eight prominent activists in Delhi, Mumbai, Hyderabad, Goa and Ranchi. Its bid to arrest the activists was foiled by judicial intervention, but three months later, it managed to arrest four of them, including Chhattisgarh-based Sudha Bhardwaj, and Hyderabad-based Varavara Rao. They have been in jail ever since. The others, Anand Teltumbde, a Goa-based academic and professor, and Delhi-based Gautam Navalakha have managed to obtain judicial reprieve against their arrests.

In the courts, the Pune police have claimed that the arrested activists had active links to the CPI(Maoist), which destabilised the country and worked against national security. It had even claimed that the arrested people were associated with a plot to assassinate Prime Minister Narendra Modi but no such claims could be proven by agencies or cops.

The Elgaar Parishad was an event held on 31 December 2017 to commemorate the two-hundredth anniversary of the Battle of Koregaon Bhima. It was organised by a coalition of 260 non-profit organisations at Pune’s Shaniwarwada Fort and had approximately 35,000 people in attendance. The program consisted of a number of cultural performances, speeches and slogans. On 1 January 2018, violence broke out at Bhima Koregaon, where lakhs of Dalits had converged to commemorate the battle. One person was killed, and three others were injured.

In the months following the event, a number of people present at the event were arrested under laws such as the Unlawful Activities (Prevention) Act (UAPA). This included Surendra Gadling, Rona Wilson, Mahesh Raut, Sudhir Dhawale and Shoma Sen. However, Justices BG Kolse-Patil and PB Sawant refuted their claims. The Justices said that the two of them were the main organisers and sole funders of the event and that they had held a similar event against communalism and Hindutva in October 2015 at the same venue. Every year on the first day of January, thousands of people belonging to the Dalit community (Mostly Mahars) gather near the ‘victory pillar’ in Koregaon to celebrate an event that took place 2 centuries back.

Dalit groups observe this day as a victory over the forces of the upper caste Peshwas. This year the event turned into a violent episode, as the Dalits and Upper casts rightists clashed very badly. However, according to various think tanks and prominent personalities, Elgaar Parishad has no connection with Naxalites. Prakash Ambedkar has also stated that the objective of Elgaar Parishad was to bridge the growing divide between Marathas versus OBC and SC/STs. He finds no reason for linking Elgaar Parishad’s activities with Maoists or Bhima Koregaon violence. Then the Maha Vikas Aghadi government in Maharashtra said it would re-examine the Elgaar Parishad case.

So far, The National Investigation Agency (NIA) has submitted several draft charges against the accused in the Elgar Parishad-Bhima Koregaon case under various sections of the Unlawful Activities (Prevention) Act (UAPA) and the Indian Penal Code (IPC) before a special court in Mumbai. The draft states, the accused attempted to “wage war against the governments of India and Maharashtra.” The accused recruited students from various universities, including Jawaharlal Nehru University and Tata Institute of Social Science for the commission of terrorist activity and there, was a specific allegation against Anand Teltumbde that he “knowingly caused evidence to disappear with the intention of screening the offenders from legal punishment. But so far none of these claims are proven against them. Most of them are senior citizens languishing in jail.

Naxalite violence has declined over the last decade and efforts are on to rid the country of the Naxal menace before the 2024 Lok Sabha elections, Union Home Minister Amit Shah said on Saturday.

Shah was speaking at a rally at Indira Stadium in Korba city of Chhattisgarh, a state affected by Maoist violence.

Sounding the poll bugle, the BJP leader also urged people to vote out the Bhupesh Baghel-led Congress government in the state in the Assembly elections this year.

People should vote for the Bharatiya Janata Party if they wanted to see Narendra Modi as Prime Minister once again in 2024, he said, while blaming the Baghel government for a `rise’ in crime and corruption.

“Naxalite incidents declined to 509 in 2021, from 2,258 in 2009 when the Congress was in power at the Centre,” Shah said.

The Narendra Modi government not only ensured that the youth (in Naxalite-affected areas) who used to pick up weapons got access to education and employment but also worked to eliminate those who wielded weapons, he said.

“Our government’s effort is to make the country free of Naxalism before the 2024 parliamentary polls,” he added.

Taking a swipe at the Congress government, he said, “I want to ask Bhupesh Baghel what he will tell people if they ask him what he has done in his five years’ rule…. not that he has done nothing. He has worked to increase corruption, incidents of rape and crimes, and the cutting of forests of tribals.”

Shah also alleged corruption in the management of the District Mineral Foundation (DMF) funds under the Baghel government. “The Modi government started DMF for the development and welfare of people (in mineral-rich areas)… Chhattisgarh received Rs 9,243 crore by way of DMF, but what has this government done with that money? I can tell you where it has gone. See the houses of Congressmen in your area. Those who used to move around on scooter now have an Audi car. Their houses have turned into three-storey buildings …Congress committed corruption in DMF funds,” the union minister alleged.

Shah urged people to teach a lesson to Congress by voting it out of power and said a BJP government will seek account of every single rupee from Bhupesh Baghel. “If you want to add momentum to the vehicle of development then you have to put a double engine in it. There is already one engine (referring to the Modi government) and you need to put another by electing the BJP in this year’s Assembly elections. Whatever that has not been done, will be completed in five years,” he said.

Seeking to woo the Other Backward Classes (OBC) which account for 52 percent of the state’s population, Shah said the Congress did nothing for them but the Modi government constituted the OBC commission and ensured that they get constitutional rights.

“The Modi government provided reservation to OBCs in NEET examination. It provided 27 per cent quota to OBCs in admissions in Central schools, Sainik schools and Navodaya Vidyalayas. A venture capital fund was created for OBC business persons,” he said.

A man wanted in more than 50 serious offences across Maharashtra was arrested by the police in Thane district, police said on Friday. Acting on a tip-off, a patrolling team of the Khadakpada police in Kalyan nabbed the accused on Wednesday, assistant police inspector Anil Gaikwad of the Khadakpada police station said.The accused used to allegedly pose as a policeman and rob people, and was a habitual offender wanted in several cases, he said.

Anjali Singh and her friend Nidhi went to a party where they consumed alcohol and it is not necessary that the family is aware of what their children are doing. As expected, to probably avoided the social stigma the family of Anjali Singh, who was hit and dragged by a car, rejected the statements of Nidhi that she was drunk at the time of the incident, and said they had never seen or heard of Nidhi, while police quizzed seven people present at a New Year party attended by the two women before the accident.

A post-mortem report stated that Singh had sustained 40 injuries over her body due to the drag. Her “brain matter” is missing and she had multiple contusions, abrasions and lacerations, the doctors found. The family doctor of the victim also rejected Nidhi’s claims that she was heavily drunk on the night of the incident, saying the autopsy report did not find any trace of alcohol in her stomach. Police, however, said Nidhi will be their prime witness as they recovered more CCTV footage to piece together the events of the night when Anjali met her brutal death.

According to the footage recovered so far, it has been found that Anjali and Nidhi stepped out of the hotel at 1.16 am, then had a fight and subsequently left the hotel at 1.32 am. However, a CCTV grab recovered near Nidhi’s residence shows that she reached her home around 1.37 am, just five minutes after leaving the hotel, raising questions over police’s claim that the accident happened around 2 am. A senior police officer said the CCTV device near Nidhi’s residence was set 50 minutes late, hence the discrepancy. They have seized the DVR and that will explain the glitch. Further, these are CCTV footage from different locations and installed by different entities, so there may be differences in time.

Police visited Nidhi’s residence, a day after her statement was recorded, in which she had claimed that she had known Anjali only for 15 days and it was for the first time that they had gone out together. One of Nidhi’s neighbours told police that she came home around 2.30 am on Sunday…She had injuries on her legs and head and said she had an accident. During its investigation, police checked the hotel records and it was found that the room was booked in the names of Anjali and Nidhi, and their Aadhaar card photocopies were in possession of the hotel authorities.

 Seven men, suspected to have been at the party with Anjali and Nidhi, have been questioned till now. Police said they are also collecting call detail records and mobile phone dump data of the victim, the accused and Nidhi. Meanwhile, a team comprising four members of the Forensic Science Laboratory in Rohini along with Deputy Commissioner of Police (Outer) Harendra Kumar Singh re-examined the Baleno car that had dragged Anjali and recreated the crime scene.

The blood samples of the five accused were received to ascertain if it has traces of alcohol. Anjali’s post-mortem report, prepared by a three-member medical board, found “no injury present to the genitalia and semi-digested food material was present inside the stomach”. Special Commissioner of Police Shalini Singh, who is probing whether there were any lapses on the police’s part in handling the PCR calls received in connection with the incident, visited Sultanpuri police station to check and analyze the case files.

Also, more CCTV footage emerged where Nidhi is seen returning home around 2.30 am, about 45 minutes after they left the party venue leading to questions being raised about the timeline of the events on a fateful night.

During the interrogation of the 5 accused, the Delhi Police found out that the car that allegedly hit Anjali was being driven by Amit and not by Deepak. It was also discovered that two more people were involved in the incident. The names of the other two accused have been revealed to be Ashutosh and Ankush Khanna. Both the accused tried to protect the 5 others by tampering with evidence and giving misinformation. The police said both are on the run currently.

The body was found at around 4:15 am. The distance between the two points, where the incident took place and where the body was found is around 10-12 km, but it is not possible to say how long the body dragged. The Delhi Police is working around the clock to file the charge sheet as early as possible. A total of 18 teams of Delhi Police are investigating this case. The police at present are also exploring the legal process to take this case to a fast-track court. An investigation is also underway with regard to the delay in the Police PCR response.

Kerala HC dismisses accused’s bail plea in human sacrifice case

Citing a possibility of the influence of the witnesses, the Kerala High Court on Wednesday dismissed the bail plea of the third accused in the Kerala Human Sacrifice Case.

Single Bench of Justice Bechu Kurian Thomas has dismissed the bail plea of Laila Bhagaval Singh who is also the wife of another accused Bhagaval Singh.

While dismissing the plea, the Court observed that if bail is granted, there is the stark reality of justice being thwarted.

Court further observed, “the nature and gravity of the accusation are gruesome, apart from being shocking and the investigation is still continuing, and the final report has not yet been filed as of the date of hearing. Even though the petitioner has been under detention since October 11, 2022, Petitioner and other accused are also alleged to have committed another crime in an almost identical manner, and the said case is also under investigation. If the petitioner is released on bail, there is every chance that she may influence the witnesses. Thus the circumstances do not lean in favour of the grant of bail to the petitioner.”

“The active involvement of the petitioner in the crime and in another crime is asserted by the prosecution and the materials collected, prima facie reveal her involvement in the present crime. Merely because the accused is a woman, Court cannot ignore the other aspects like the nature and gravity of the offence, the possibility of influencing the witnesses, the likelihood of the offence being repeated and the danger of justice being thwarted. Though a beneficial provision as the first proviso, to section 437(1) CrPC is in existence, it does not mean that persons specified in the proviso should necessarily be released on bail,” the Court said further.

The three accused were arrested by the Kochi city police on October 11, last year, for murdering two women in a brutal manner in the name of human sacrifice in black magic rituals.

The incident took place on June 6 and September 26.

The accused persons are Muhammed Shafi, Bhagaval Singh and Laila Bhagaval Singh.

CM Yogi will hold a roadshow in Mumbai tomorrow

Committed to making Uttar Pradesh one trillion-dollar economy and having successfully completed roadshows abroad to invite foreign investors to the Global Investors Summit (GIS 2023) and introduce them to the opportunities available in various sectors in the state through his team of ministers and officials, Chief Minister Yogi Adityanath has himself taken charge now to bring massive domestic investments to the state.

The Chief Minister will start the domestic roadshows from Mumbai, the financial capital of the country, on January 5, meeting the country’s leading tycoons and bankers as well as prominent film personalities in the context of the upcoming Film City in Noida.

The roadshows will be held in nine cities of the country to introduce potential investors to the opportunities available and the favourable business climate in Uttar Pradesh. Prior to the roadshow and meeting with top industrialists and bankers, the Chief Minister will make a courtesy call on Maharashtra Governor Bhagat Singh Koshiyari.

After this, he will meet officials of various banks at Hotel Taj itself. Then the Chief Minister will participate in the GIS roadshow from 12 noon to 2 pm. In this roadshow lasting a couple of hours, representatives of various industry groups will be encouraged to invest in Uttar Pradesh.

They will be given information about the Ease of Doing Business and the Ease of Starting a Business in Uttar Pradesh. In the evening, CM Yogi will meet the producers, directors and artists of the film industry. It is noteworthy that in December, under the guidance of CM Yogi, eight delegations of ministers and senior officials visited 21 cities in 16 countries and received investment proposals worth Rs 7.12 lakh crore.

The roadshows in nine Indian cities are a continuation of that exercise. As per the schedule of CM Yogi, before and after the roadshow, will also have one-to-one meetings with various industrialists.

This meeting will be on the basis of Business to Government (B2G). As per the schedule, a total of 17 B2G meetings are scheduled. Amid economic turmoil, Pakistan govt approves energy conservation plan

Amid the growing economic turmoil in the country, the Pakistan government said on Tuesday that it had approved the energy conservation plan that will enforce the closure of markets at 8:30 pm and wedding halls at 10 pm. Pakistan Defence Minister Khawaja Asif made the announcement during a press conference flanked by other cabinet ministers. “The cabinet, on the recommendation of the power division, has allowed enforcing the energy-saving plan which will be applied to the entire country,” Asif was quoted as saying by Geo News.

Asif said that Prime Minister Shehbaz Sharif has directed to decrease the usage of electricity used by all federal government departments by 30 per cent. PM Sharif also directed against unimportant usage of electricity in offices.

This development comes as many observers and experts have been ringing alarm bells that Pakistan is dangerously close to default. On Sunday, former finance minister Miftah Ismail said “if Pakistan does default, God forbid – which, I believe can be avoided – it would take six months at the minimum to recover.”

“What would happen if such a thing happens to pass is that we will have to go back to the International Monetary Fund and other lenders, and will have to request them that we will pay any amount due to them this year in the year that follows,” he said in an interview with The Express Tribune newspaper. The Pakistan Finance Ministry last week forecasted that inflation will stay high as it warned that the cash-strapped nation is staring at ‘severe headwinds’ in the current fiscal year, the Dawn newspaper reported. “For FY23, economic growth is likely to remain below the budgeted target due to devastation caused by floods. This combination of low growth, high inflation, and low levels of official foreign exchange reserves are the key challenges for policymakers,” said the alert issued by Pakistan Finance Ministry in its Monthly Economic Update and Outlook.

According to the economic outlook, Pakistan’s overall fiscal deficit stood at 1.5 per cent of GDP during July-October 2022-23 as compared to 0.9 per cent of GDP last year. The Dawn report said the fiscal deterioration was because of higher expenditure growth on the back of higher markup payments while the government is facing the challenge of providing relief to people in flood-hit areas.

In a significant development in the Kanjhawala case, the Post Mortem Examination (PME) has ruled out any injury suggestive of ‘sexual assault’, the police informed on Tuesday. The PME was conducted by a three-member medical board at Maulana Azad Medical College (MAMC), New Delhi on January 2, in case FIR no. 2/23 Sultanpuri Police Station.

Special CP Law and Order, Delhi, SP Hooda told Agencies that the report states the provisional cause of death as “shock and hemorrhage due to antemortem injury to the head, spine, left femur, and both lower limbs”.
