SC directed Maha Govt to trace and pay compensation to legal heirs of missing persons of 1992 Mumbai riots

The Supreme Court on Friday has directed Maharashtra Government to trace legal heirs of the missing persons of the 1992 Mumbai riots and pay them compensation.

A bench of justices Sanjay Kishan Kaul, Abhay S. Oka and Vikram Nath passed these directions.

The court directed Maharashtra Government to submit a report to the Committee containing details of 168 missing persons including their names and addresses and will also place material regarding efforts made to trace family members of 108 missing persons who have been deprived of compensation in terms of the second Government Resolution.

The court directed that the State Government shall make all possible efforts to trace the legal heirs/family members of the missing persons.

The court also suggested that the Committee shall monitor this exercise, which will assist the legal representatives of the missing persons to complete the procedural formalities.

The State Government shall also submit to the Committee the record relating to compensation paid in terms of the Annexure to the First Government Resolution as well as in terms of the second Government Resolution by incorporating the specific dates on which the compensation was actually paid to the persons entitled to it, the court directed.

If further added that the State Government shall also provide a list of victims who have not been paid compensation in terms of both the Government Resolutions.

“The State Government shall pay compensation of Rs 2 lakhs to the legal heirs of the missing persons traced out hereafter, with interest at the rate of 9 per cent per annum from 22nd January 1999 i.e. from the expiry of the period of six months from the date of the second Government Resolution, till actual payment,” the court said.

The court was dealing with a petition seeking to pay compensation to the persons identified as MISSING in the 1992 Mumbai riots and the cases concerning them to be closed.

In December 1992 and January 1993, there were about 900 deaths, 168 persons were reported missing and about 2036 persons suffered injuries.

As a result of the serial bomb blasts of 12th March 1993, there were 257 deaths and 1400 people were injured.

The petition has also sought to declare that a public servant found guilty/indicted under the Commission of Enquiry Act, 1952 be liable to be summarily dismissed.

The top court directed the State Government to expeditiously implement all the recommendations made by the Commission on the issue of reforms in the police force which were accepted by it.

This year for a change people thought it would be the competition between AAP and BJP, but as we all know Narendra Modi will not lose the elections. BJP will cross the winning numbers and AAP will wind up with 7 to 8 seats. AAP had only one advantage and that was anti-incumbency and a new option for people against the old party. Congress votes may shift to Aam Aadmi Party but they won’t get a majority.

Hardik Patel, the face of the Patel agitation during the 2017 elections, left the Congress party to join BJP in June this year. The Patel community constitutes 12-14 per cent of the State population, and they will vote for BJP. As for the Congress, the party will be missing Ahmed Patel, a key strategist and a long-time aide of the Gandhi family, who played a big role in mobilising the cadre. Patel died of multiple organ failure in 2020. The seat tally for Congress is expected to be restricted to between 15 and 30, a drastic fall from 77 in 2017.

The Aam Aadmi Party, on the other hand, will eat up 10-20 seats of the Congress as even their minority votes are likely to be divided due to a lack of strong leadership in the State. Meanwhile, Akbaruddin Owaisi will play the spoiler for Congress and AAP, which will benefit BJP. Similar trends are visible in Himachal Pradesh too, where polls are scheduled on November 12. There too, BJP is expected to retain power and the anti-incumbency factor may not play much of a role. The Bharatiya Janata Party (BJP), now in power in Gujarat, Prime Minister Narendra Modi’s home state, for 24 years now and as the Election Commission (EC) today declared the schedule for the 2022 Gujarat assembly elections, the moot question is whether it will be back to power, creating a history of sorts, or no.

In 2017, BJP won by a narrow margin, bagging less than 100 seats, with the Congress as the chief Opposition that bagged 77 seats. The contest had come down to the wire, so to say, and it was largely PM Modi, who delivered the BJP to safe shores in Gujarat through his tumultuous campaigning and tireless canvassing. This time BJP will get seats in excess of 120 in a 182-strong state assembly. BJP this time will do way better than last time in 2017 since several factors are helping the party. Party may score 120 seats.

In 2017 BJP had strong opposition from Congress and in all the constituencies the party gave a tough contest. But now Congress has become too sober and too mellowed with most of their leaders leaving the party. The anti-BJP votes will get scattered between AAP and Congress, which will only help BJP. Also, so long as Modi and Amit Shah are in the party, Gujarat will never vote them out.

Rahul Gandhi, Sonia Gandhi and Mallikarjuna Kharge-led Congress are expected to get around 50 seats as the “Bharat Jodo Campaign” has melted many hearts for Congress. AAP will eat away Congress, and that will benefit BJP. The Modi factor is equally important. People still believe that if Modi is PM, everything will be fine in India. No doubt AAP will pose some threat to Congress and also BJP in some of the areas of Surat, north Gujarat and that too in the interior part. AAP will give their best but still not at the cost of the BJP.

Gujarat assembly elections are due in the year. All three parties BJP, Congress and AAP are making arrangements for their victory. In the meantime, many leaders from different political parties switched sides.

BJP is the biggest party congress is the second and AAP is the third party. By the number of seats, it could be possible that Congress and AAP may join hands together to fight with BJP. But at this stage, BJP is stronger in Gujarat. The upcoming Gujarat elections are very important and more critical to the opposition than the BJP and then still more important to Arvind Kejriwal and then extremely important for the Muslims and Christians.

The bookies of satta bazar have predicted the mega win for BJP in 2022 assembly elections in Gujarat.  The upcoming Gujarat elections, scheduled in two phases on December 1 and 5. Bookies are expecting nearly ₹40,000-50,000 crore businesses in the illegitimate market. Back in 2002, BJP had won 127 seats in the 182-seats State Assembly, under the leadership of the then Chief Minister Narendra Modi. This time BJP can win at least 120 seats.

Keval Jain a local voter said “BJP will come to the power only and only because of Modi. However, the fight would be fierce and exciting. Congress is not weak as it is shown in Gujarat. Congress is very strong in rural Gujarat regions and they have their loyal voters in Gujarat”.

Ketan Bhai Panchal a bookie said “The competition is tough, still some people are under impression that the Aam Aadmi party will succeed to power but this is PM Modi’s turf and BJP will not let things go from their hand so easily. AAP needs more homework and constant efforts to create their mark here”.

Prabhu Bhai Desai stated that “Unlike what media wants you to believe INC is not demolished completely in assembly level elections. The region in orange is mostly dominated by industrial hubs of Ahmedabad, Kutch (Bhuj), Vadodara, Surat which are more likely to vote for BJP. However Saurashtra region with considerable Patidar (patel) and regional population have predominantly voted for INC. With AAP making inroads in local body elections in Surat there is one way through which BJP might not get majority mark.”

AAP instead of pitching candidates in all constituencies should focus on north central and eastern belt where BJP dominates and be open to alliance with INC. This will break BJP votes while keeping INC dominance in the rest of the region the same. If somehow AAP comes to senses we might see it cutting BJP’s lead in the north central and eastern regions which are relatively safe hubs of Gujarat and pave way for regime change of regime.

Tomar said “Stubble burning is not a ”political issue” and state should work towards curbing it

Agriculture Minister Narendra Singh Tomar on Friday expressed concern over rising incidents of stubble burning in four major north Indian states including Punjab and appealed them to take steps to control it.

The minister said since 2018, the central government has provided funds and machines to the states for the management of stubble burning incidents. Stubble burning is not a ”political issue” and the states should work towards curbing it, he said.

The minister said that PUSA decomposer, developed by the agri-research body ICAR, is effective in controlling stubble burning, and appealed to state governments as well as farmers to make use of more such machines.

”Despite providing crores of rupees and 2 lakh machines, stubble burning incidents are rising and it is a cause of concern,” Tomar said addressing a day-long event on ‘Pusa decomposer’. Since 2018-19, the Central government has provided Rs 3,138 crore to four states — Punjab, Delhi, Uttar Pradesh and Haryana — for the management of stubble burning.

Out of which, more than Rs 1,400 crore has been given to Punjab, Rs 900 crore to Haryana, Rs 713 crore to Uttar Pradesh and Rs 6-7 crore to Delhi, he said.

Some states, especially Uttar Pradesh and Haryana have done good work and are moving towards a positive direction, he said.

At that time, it was said that had decomposer machines been deployed, stubble burning would have been effectively controlled. Thereafter, about two lakh machines were made available to the states, he said. These two lakh machines can help to control stubble burning, provided the states are determined, Tomar told reporters on the sidelines of the event.

BJP accused of using Central agencies to subdue democratic voices; Cong reacts after IT raids at MLA residence

Congress spokesperson Rakesh Sinha on Friday accused the Bharatiya Janata Party of being afraid of Congress and its supporters.

“I believe that Narendra Modi is the first PM of independent India who is afraid of Congress and its supporters and is trying to subdue its (Congress’) voice with the help of central agencies,” Congress spokesperson Rakesh Sinha said soon after the Income tax department started its raids at the residence of MLA Kumar Jaimangal Singh in Ranchi.

“Yesterday only, the CM was summoned by the ED and today Congress MLAs are being raided by IT, which proves that it is an attempt of BJP to demolish a democratic government in Jharkhand, which will never be successful in the state,” he added.

“I want to add that the people of Jharkhand are with the Mahagathbandhan government and you cannot establish your government in this state till 2029,” said Sinha.

Reacting to the allegations, BJP MLA CP Singh said that the people in the opposition are now agitated as the country is moving on the path of development under PM Modi’s leadership.

“People in the opposition are agitated because the country is on its path to becoming Vishwaguru and is continuously developing under the leadership of Prime Minister Narendra Modi,” BJP MLA CP Singh said mentioning that they will remain unafraid of them.

On the allegations of central agencies being used by the Centre, the BJP MLA said that if they work under someone’s direction, they will turn into puppets.

“The central agencies function on their own, no one controls them. If they start to work under someone’s direction, they will no longer remain as an agency and will become puppets. All the central agencies work unbiased and independently,” he said.

This came hours after the IT started its raids at the Bermo residence of Congress MLA Kumar Jaimangal Singh.

While these raids were underway, Jaimangal Singh told the media persons that the raids will be carried out at the premises of any leader who does not listen to the BJP.

“Income Tax raids are currently ongoing at my Bermo (Jharkhand) and Patna residences. Any leader who would not listen to BJP will be raided,” Congress MLA Kumar Jaimangal Singh told media persons.

SC lifted the stay imposed by HC on 30 per cent reservation to women having domicile of the state

The Supreme Court on Friday lifted the stay imposed by the Uttarakhand High Court on a 2006 order giving 30 per cent reservation to women having domicile of the state in state civil services.

A bench of Justices S A Nazeer and V Ramasubramanian issued notice in the matter and sought reply on the Uttarakhand government’s plea.

The Uttarakhand government had moved the top court against the high court’s August 24, 2022 order.

It had passed the direction while hearing a petition filed by more than a dozen women candidates from outside the state who were under the unreserved category.

The petition said they were not allowed to appear for the state services main examination despite securing more marks than the cut-off set for domicile women of the state in the preliminary test held on April 3 this year.

The plea submitted that the Uttarakhand government did not have the power to provide domicile-based reservation and that the Constitution only allowed reservation on the basis of domicile only by a law enacted by Parliament.

The time frame for completing the bullet train project is not fixed

Delhi minister Gopal Rai will conduct high-level meeting to discuss final stage of GRAP

Delhi Environment Minister Gopal Rai will convene a high-level meeting on Friday to discuss the implementation of curbs on polluting activities under the final stage of the Graded Response Action Plan, officials said.

Delhi’s 24-hour average air quality index spiralled to 450, just a notch short of the ”severe plus” category as the share of stubble burning in the national capital’s PM2.5 pollution soared to 38 per cent amid stagnant conditions and favourable transport-level wind speed.

As Delhi stood at the edge of a public health emergency, the Commission of Air Quality Management had on Thursday directed authorities to ban the plying of four-wheeled diesel light motor vehicles in the city and adjoining NCR districts and the entry of trucks into the national capital as part of anti-pollution measures under the final stage of the Graded Response Action Plan (GRAP).

However, BS-VI vehicles and those used for essential and emergency services are exempted, according to an order issued by the Commission for Air Quality Management (CAQM).

The order stated that the state government may take a call on the closure of educational institutions, non-emergency commercial activities and plying of vehicles on odd-even basis. Central and state governments may decide on permitting work from home.

Elon Musk has started lay offs at Twitter

Elon Musk will start laying off Twitter employees on Friday. As per an unsigned internal memo seen by The Verge, Twitter employees were notified in the email that the layoffs were set to begin.

Employees will receive an email by 9 AM PST on November 4th confirming whether they have been laid off or not, according to the internal memo, which also states that employee badge access to Twitter’s offices will be shut off “temporarily.” “We acknowledge this is an incredibly challenging experience to go through, whether or not you are impacted,” the memo read.

“Thank you for continuing to adhere to Twitter policies that prohibit you from discussing confidential company information on social media, with the press or elsewhere,” the memo added. Musk is expected to cut roughly half of Twitter’s roughly 7,500-person workforce.

The layoff comes a week after Musk became the Twitter owner.

Musk has already indicated that he would make job cuts at Twitter, telling employees at a town-hall meeting this summer that there needs to be “a rationalization of headcount” at the social network.

On October 30, asked by someone on Twitter to identify “the one thing that’s most messed-up at Twitter right now,” Musk replied, “There seem to be 10 people ‘managing’ for every one person coding” at Twitter.

In April, Twitter accepted Musk’s proposal to buy and make the social media service private. However, Musk soon began sowing doubt about his intentions to follow through with the agreement, alleging that the company failed to adequately disclose the number of spam and fake accounts on the service.

In July, in a surprising turn of events, Musk who had long been showing his interest to buy Twitter terminated the deal.

The Tesla CEO did so by alleging that Twitter violated their mutual purchase agreement by misrepresenting the number of spam and fake bot accounts on its platform.

After Musk put out the deal termination announcement, the market saw a sharp decline. Later, Twitter sued Musk accusing him of using bots as a pretext to exit a deal. Again, last week, Musk confirmed that he would move forward with the Twitter buyout at the originally agreed price of USD 54.20 per share.
