Forcible Sexual Relations Between Husband and Wife Not Rape: Delhi Court

Sexual relations between a legally wedded husband and wife, “even if forcible, is not rape”, a Delhi court has said while acquitting a youth who was accused of marrying a 21-year-old girl after serving her a sedative-laced drink and raping her.

“It is evident that the prosecutrix (girl) had willingly and in full senses solemnised her marriage with the accused and the marriage was registered in the office of Registrar of Marriages, Ghaziabad, on March 4, 2013. The parties engaged in physical relations with each other after the marriage.

“The girl was more than 21-years-old at the time. Thus the girl and accused being legally-wedded husband and wife and the girl being a major, the sexual intercourse between the two, even if forcible, is not rape and no culpability can be fastened upon the youth,” Additional Sessions Judge Virender Bhat said while absolving the youth of the charge of rape.

In the FIR, the girl had alleged that she came in contact with the accused, a UP resident, while working with a coaching centre in Delhi in 2013.

She had further told police that one day, the accused along with his father had given her a spiked drink which made her lose consciousness whereupon they took her to “the (said) registrar’s office at Ghaziabad and got the marriage documents signed by her”.

Thereafter, the girl had alleged, the accused committed rape upon her and left her with the threat that in case she disclosed the incident to anybody, they would not spare her.

She had also said that the accused in September, 2013, had even committed unnatural sex with her on several occasions.

The court, however, turned down the girl’s allegations and said, “There is no clinching or convincing evidence on record to show that the accused had administered any stupefying substance to the prosecutrix before taking her to the Ghaziabad court.

“The prosecutrix has nowhere deposed in her testimony that the accused had committed (unnatural sex) with her. The prosecution has, therefore, failed to establish the guilt of the accused.”

During the trial, the accused denied all the allegations levelled against him and pleaded innocence saying the marriage was solemnised in February, 2011, but he was framed in the case as the girl’s parents were against it.

Senior BJP leader Murli Manohar Joshi raised eyebrows today as he contradicted his own party on Narendra Modi’s Congress rival in Varanasi, Ajay Rai, against whom an FIR or First Information Report has been filed for poll violation.

Mr. Rai was seen wearing his party’s symbol, the hand, while standing in the voting queue.

Though the BJP demanded strict action against the Congress candidate, Mr. Joshi described Mr. Rai’s alleged violation as a minor issue. “It is not a big deal. Everyone takes their hand into the poll booth, should they cut it off?” questioned the BJP veteran, who contested from Kanpur after making way for Mr. Modi in Varanasi, which he had won in 2009.

Mr. Rai is the third prominent candidate in Varanasi, where the main contest is seen to be between Mr. Modi, the BJP’s prime ministerial candidate, and Arvind Kejriwal, the chief of the Aam Aadmi Party.

On April 30, the Commission had ordered an FIR or First Information Report against Mr. Modi for flashing his party’s symbol, the lotus, and making a speech near the booth in Gandhinagar where he voted.

The BJP, in the middle of a bitter confrontation with the Election Commission over the refusal of permission for Mr. Modi’s rally in Varanasi last week, used the Ajay Rai controversy to deliver a caustic message.

“We would like the Election Commission to ensure that when there is a violation of Model Code of Conduct, it must be properly take into the logical conclusion. So that there is no impression that different parties are being treated differently, that is our great agony,” said senior BJP leader Ravi Shankar Prasad.

Mr. Rai was defensive. “I didn’t flash it like others did,” he said, not naming Mr. Modi, “the symbol was pinned to the kurta I wore yesterday and it stayed on. I wore it very normally.”

Clashes in West Bengal on Final Day of Polling for National Election

Parties like the CPM and the BJP have accused ruling Trinamool Congress workers of intimidating voters as 17 of West Bengal’s 42 constituencies vote today, in a phase crucial for Mamata Banerjee.

As in previous phases, the state has seen a good voter turnout at 67.34 per cent by 3 pm, amid reports of violence. Four people were shot at on their way to a polling station in Basirhat constituency, 40 km from Kolkata, and about a dozen others allegedly suffered knife injuries.

A BJP councillor alleged that bombs were hurled at her as she returned from voting. She was unhurt but livid, accusing the Trinamool of trying to scare away voters.

Senior CPM leader Sitaram Yechury tweeted, “Armed attacks by (Trinamool) goons leaves 22 CPI-M workers seriously injured, 4 with bullet wounds. Central forces mere onlookers!!”

But the Trinamool alleged that it was the Left’s activists that had injured 11 of its workers. Accusing the media of exaggerated reports, Trinamool MP Derek O’Brien tweeted, “People are voting peacefully, fearlessly, wholeheartedly in Bengal. 2 local TV channels with ‘agendas’ making a mountain out of a molehill (sic).”

Mamata Banerjee’s party won 14 of its 19 seats from the region in and around Kolkata, that is voting. The CPM had won none. The other three seats were taken by the CPI, the Socialist Unity Centre of India (SUCI) and the Congress, which was then Mamata Banerjee’s partner.

Google boy: LKG student Jaitra has mastered world map, Chemistry’s periodic table

A student of LKG in Gwalior Jaitra Sharma has become the second Google boy after Haryana’s Kautilya Pandit.

Just like Kautilya, he possesses a sound knowledge of planets and solar system. Four-year-old Jaitra, also has the names of capitals of all the countries across the world on his fingertips. He identifies the places on the world map in seconds.

Born on September 28, 2009, Jaitra has mastered Chemistry’s periodic table that is usually taught to Class 11 students at a tender age of 4.

In an interview to a newspaper, Jaitra’s mother Shikha said,” We did not know about his talent to grasp things quickly. As he grew up, I learnt of it. His father then started teaching him. His memory is very sharp, he doesn’t forget anything.”

Earlier, Kautilya who hails from Kharhar village in Jhajjar district, came to be known as the Google boy after he learnt by rote information relating to geographical borders, planets in space, mineral resources when he was five years eight month old and studying in Class 1.

During an interview to a TV channel, a question-answer session was conducted with celebrities like Shivani Kashyap asking him questions to check his IQ. Kautilya replied to most of the questions correctly, with minor mistakes.

His father Satish Sharma and grandfather were present, as their son faced a barrage of questions.

Neurologist Dr Kapil Singhal, who was present at the live show, said, Kautilya possessed an IQ of above 150, same as was possessed by famous scientist Albert Einstein. “His analytical powers are very good and made me spellbound”, said Dr Singhal.

What is the root cause of corruption?

Corruption is social evil and is prevalent everywhere across the world. It is a kind of disease which is incurable. It is not possible to completely eliminate corruption from the grassroots level but it can definitely be controlled.

Few questions pertaining corruption is arising in my mind. Why does corruption take place? What is the root cause of corruption? What is the solution to curb corruption and is it prevalent only in the government sector? What measures the government are adopting to curb it?

According to me, corruption is rising on account of greediness and poverty. The ugly nexus between politician and police officials are responsible for corruption. Rich politicians indulge in corruption as they are greedy to earn more money. Police officials become corrupt due to paltry salary paid to them.

Expectations from the new government

The results of the Lok Sabha election will be announced on 16th May. The Congress thinks that their job is only to pass legislations but they are least bothered about its monitoring. They pass the buck of implementation of the policies on state governments. However, it has been observed that most of the time the people are unable to derive any benefits out of the scheme. “Hamne paisa bheja unhone kharch nahi kiya”. “Humne to kanoon lagu kiya aur hamara kaam khatam. It is poor governance. Good governance means that you must be able to see the results on the ground.

In our federal system, it is necessary that the states co-operate with the centre. Unfortunately, this is not happening and hence we are not able to achieve much progress at a faster pace. Persuasion is one of the methods to achieve the desired results. However, it does not work often because some of the state governments get very stubborn for narrow political gains.

People say, if Modi comes to power, he will promote dictatorship. A dictator is required when state governments simply do not comply to implement a welfare scheme passed by the centre. What happens when you try to control an unruly mob? You issue a shoot-at-sight order don’t you? The recalcitrant government should then be dismissed and hence the public must give a clear mandate while casting their votes.

The new government will need to enforce discipline which is a pre-requisite for any sustained developmental activity. Presently, anyone can talk all negativity on television channels which are easily accessible. We have to start working as lot of work needs to be done. Providing drinking water, electric power and constructing good roads are the bare minimum agenda. Containers should come out of the port efficiently and goods should be delivered to the doorstep in a speedy and secure manner. Neighbouring nations have already accomplished this task.

A limited conscription is very necessary to instill discipline and responsibility. No person should be made eligible to apply for IAS examination unless they have performed two years of national service. “Kaam karoge to paisa milega, mufat main nahin”, this message must be sent across to all. The bureaucracy must be strictly informed that they are being watched and they will suffer if they fail to perform. A benevolent dictatorship is beneficial in the current scenario.

MNS’s Marathi card wont’ work

BJP says that the MNS tactics to lure Marathi voters by removing the Gujarati pride posters from BEST bus won’t succeed.

Gopal-SetthiThe Maharashtra Navnirman Sena’s decision to remove the posters of Gujarat newspaper Sandesh from BEST buses mentioning about the role of Gujaratis in Mumbai’s development has not gone down well with the BJP. The saffron party has strongly responded that MNS strategy of playing the Marathi card won’t work as Maharastrians vote for development. MNS supremo Raj Thackeray has backed Gujarat Chief Minister Narendra Modi for the prime minister’s post but he is unwilling to be a part of the NDA.

When AV asked, BJP MLA from Borivali Gopal Shetty whether MNS activists removed the Gujarati newspaper posters just for the sake of luring Marathi voters he replied, “The MNS ploy to attract the Marathi voters won’t succeed this time. People have realised the Congress is likely to benefit if they vote for MNS hence they won’t vote for the latter. They also want to avert the split of Marathi votes.”

Gopal Shetty strongly condemned the MNS party activists move to remove the posters of Gujarati newspaper from BEST buses.

“MNS should refrain from indulging in vote bank politics. All of us are aware that every community has contributed for the progress of the state. The party should appreciate the role of other communities and motivate them which will take the state forward” added Shetty.

MNS Corporater Sandeep Deshpande who asked party activists to remove the posters said, “The Gujarati language newspaper advertisement speaks only about the contribution made by Gujarati community towards Mumbai’s development but ignores similar efforts made by the Marathi people. Is it true that only Gujaratis played a prominent role in the city’s progress? Aren’t Marathi people involved in the development of the city? Why they have failed to make the mention of Marathi people’s contribution in the advertisement.”

Congress spokesperson, Sachin Sawant talking to AV said, “MNS only raises the Marathi issue during the onset of election why they forget about the community on other occasions. The party should instead work for the welfare of Marathi people.”

NCP spokesperson Nawab Malik said, “The anti-Gujarati sentiments has been increasing day by day in the state which will only create communal tension in the city. Political parties should not indulge in vote bank politics.”

Few days back, Shiv Sena’s mouthpiece Saamna had published an editorial criticising Gujarati’s for not participating in the Maharashtra Day celebrations. This incident prompted Shiv Sena president Uddhav Thackeray and his son Aditya Thackeray to issue a clarification that Sena did not share the thoughts expressed in the editorial.

Nitesh Rane, Swabhimaan Sanghatana president and son of Congress stalwart leader Narayan Rane too had targeted the Gujarati community. He criticised the vegetarian habits of Gujaratis as a result of which Maharashtrians have been denied flats in the Gujarati dominated areas of the city. He claims that Mumbai offers more lucrative options and should “stop praising Narendra Modi”.

NCP leaders take stock of party performance in LS elections

NCP-leadersNationalist Congress Party (NCP) chief Sharad Pawar on Saturday held a meeting of his party leaders to review NCP’s performance in the Lok Sabha polls and the likely situation after the May 16 results.

Senior NCP ministers, including Deputy Chief Minister Ajit Pawar, attended the meeting. It was held at Deputy Chief Minister’s official residence Devgiri in south Mumbai.

“The meeting discussed issues like the impact of social media in these elections and also voting pattern in the 21 Lok Sabha constituencies NCP contested in Maharashtra. Cooperation extended by ally Congress was also discussed at the meeting,” a senior NCP minister told newsmen after the meeting.

“There was a general discussion on the political situation in the State ahead of the Assembly elections scheduled this year,” the Minister said.

On the subject of help extended by Congress, the issue of non-cooperation by Congress MLA Ramprasad Bordikar in Parbhani seat was discussed, he said.

The Jintur MLA was served a show-cause notice by MPCC after NCP complained that he was not helping latter’s candidate Vijay Bhamble in Parbhani.
Bhamble had contested the 2009 Assembly election against Bordikar as an independent.

Pawar wants the NCP to gear up for the state Assembly elections immediately after the Lok Sabha results are out, the Minister said.

Those who attended the meeting included state NCP president Bhaskar Jadhav, Assembly Speaker Dilip Walse Patil, and ministers Chhagan Bhujbal, Ajit Pawar, R R Patil, Ganesh Naik, Rajesh Tope, Sunil Tatkare, Fauzia Khan, Anil Deshmukh and Jaidutt Kshirsagar.

Indian vigilantes fight public urination

For those caught using the streets of Mumbai as a public toilet, the pavement is not the only thing to face getting wet.

Vigilantes have been patrolling the Indian city with a water tanker – and spraying anyone who urinates in public.

The vehicle, dubbed the ‘P***ing Tanker’, features a huge water canon, a logo of a person urinating and a large red sign, reading: ‘You Stop, We Stop’.

It also includes a large rooftop area, from which the masked vigilantes can blast unsuspecting members of the public with water.

The bright yellow tanker is believed to be the creation of an anonymous ‘anti-public urination activist group’, called the Clean Indian.

It aims to deter those who feel no shame relieving themselves in the streets of India’s most populous city by turning the tables and ‘taking a leak’ on them.

It also hopes to combat the health risk of public urination – which the activists claim remains a major problem in the country – ‘one spray at a time’.

The group has posted a video of the tanker at work on YouTube, with the caption: ‘You wont’ believe what we did to people using the outdoors as a toilet’ (sic).

But the footage has divided opinion – with many users claiming that a lack of public toilets in the state of Maharashtra is the underlying problem, not those peeing in the street.

One user wrote: ‘This is not the solution. Lack of availability of Public toilets is the problem that is causing general public to act like that.’

Munde rubbishes talk of Praful Patel joining BJP

Senior BJP leader Gopinath Munde on Sunday dismissed speculation that Union Minister and NCP stalwart Praful Patel was on his way to the saffron party. Talking to media here, Munde said there was “no place” for Patel in BJP.

He alleged that NCP chief (Sharad Pawar) was behind these rumours, which were reported by a Marathi newspaper earlier this week.

He also said as there was no place in NDA or BJP for Patel, it followed that there was no question of accommodating his “guru” (mentor) Sharad Pawar post-elections.

The senior BJP leader also said his party may win 235 to 240 Lok Sabha seats and would get a clear majority with the help of its allies.

In this scenario, NDA would not need the support of other parties to form the government, Munde said.

Asked about plans for himself, Munde said at present he would be at the Centre, but could return to Maharashtra if needed.

If Congress lost the election, the Gandhi family must take the responsibility, he remarked.

The state BJP leaders will meet in Mumbai on May 14 to discuss the coming Assembly elections in Maharashtra, he said.
