Agusta Westland Case: ED alleges Christian Michel of passing confidential papers to his counsel

The Enforcement Directorate (ED) on Tuesday informed the Apex Court that British citizen Christian Michel, accused in the Agusta Westland VVIP chopper scam, has tried to pass confidential papers to his counsel at the time of legal access. The ED filed an affidavit in the top court opposing Michel’s bail plea in the case.

“It is submitted that during the course of Michel’s custodial interrogation, the accused has tried to pass confidential papers to his counsel at the time of legal access,” said the ED.

It said that further investigation in the present case is still ongoing and many crucial documents are required to be collected across jurisdictions for the purpose of the investigation therefore it is strongly apprehended that he might try to tamper with the witnesses or evidence and obstruct the judicial process.

“Christian Michel James during his custodial interrogation undertook to provide the bank statements of his companies and the agreements and other relevant documents. He was also interrogated in Tihar Jail, New Delhi after taking permission from the Trial Court and during that time he also undertook to provide the said documents through the assistance of his lawyers, however, no information has been provided till date,” the affidavit added.

“Michel is a key accused in the instant case and is accused of having played a pivotal role in the entire case, being a middleman engaged by M/s Augusta Westland for obtaining confidential information regarding the procurement process of VVIP helicopters by the government of India and was admittedly paid Euro 42 million for influencing the contract in its favour under the guise of five contracts (two of them revised time and again) through two of his firms namely M/s Global Trade & Commerce Ltd. London and M/s Global Services FZE, Dubai, UAE with M/s Finmeccanica, M/s Agusta Westland, M/s Westland Helicopters UK etc. to legitimize the illicit commission/kickbacks on the procurement of VVIP Helicopters by Ministry of Defense, India which constitutes a grave economic offence,” ED added in its affidavit.

The investigating agency told the bench that the role of Michel is clearly established and the offence of money laundering is squarely made out against him. Earlier, the apex court had issued notices to the Central Bureau of Investigation (CBI) and ED on the bail petitions of Michel in connection with the AgustaWestland VVIP chopper scam being probed by the agencies.

Advocate appearing for Michel had contended before the top court that the investigations are still not completed and he has undergone three years and six months as of now and before extradition, he was in Dubai custody.

Michel had challenged in the apex court the March 11 order of the Delhi High Court which had refused to grant him bail. In the High Court, ED and CBI had opposed the bail petition filed by Michel in connection with the VVIP chopper case.

CBI had said that he has a flight risk and it fears that because of the way the British government is helping him, he might flee and will never return. Michel had contended before the High Court that all the other accused in the case got bail in 60 days and he is the only one who hasn’t been given the bail and is suffering incarnation.

According to the bail petition, Michel said that as a bail condition he will be available to join the investigation and trial as and when required and has never sought to evade the process of law.

Earlier, the trial court had rejected his bail plea and had shown its displeasure with the British High Commission for sending a letter addressed to it stating that the medical condition of Michel and his pre-trial detention of two and half years may be taken into account when his bail application is considered.

Christian Michel James was extradited in 2018 after India won the extradition case in Dubai. Christian Michel, the alleged middleman in the deal, was deported from the UAE and is currently in judicial custody.

The Dubai-based businessman Rajeev Saxena was extradited to India on January 31, 2019, in connection with the Rs 3,600-crore alleged scam relating to the purchase of 12 VVIP helicopters from AgustaWestland.

Smriti Mandhana reaches career-best 3rd position in ICC women’s T20 rankings

Star India opener Smriti Mandhana has moved up one spot to clinch her career-best third position among batters in the ICC Women’s T20I Player Rankings after a matchwinning half-century against Pakistan in the ongoing Commonwealth Games in Birmingham on Monday.

Mandhana, who followed up a knock of 24 against Australia with an unbeaten 63 off 42 balls with eight fours and three sixes, has overtaken New Zealand’s Sophie Devine and reached within two rating points of Australia’s Beth Mooney. Meg Lanning continues to lead the rankings after regaining the top spot last week.

Mandhana, who was earlier top-ranked batter in ODIs, has been ranked third in T20Is in the past too, reaching that position for the first time in 2019 and having last held third position in October last year.

New Zealand’s Suzie Bates has gained two slots to reach sixth position after smashing a superb 91 not out off 64 balls against South Africa while Tahlia McGrath (up one place to 12th), India captain Harmanpreet Kaur (up four places to 14th), Pakistan’s Nida Dar (up three places to 40th) and South Africa’s Chloe Tryon (up five places to 47th) have also made notable progress among batters.

Australia all-rounder Ashleigh Gardner has moved up in all three lists after shining with the bat against India and with the ball against Barbados, who are representing the West Indies in the eight-team competition.

Gardner’s knock of 52 not out in the opening match has lifted her five places to 11th while her haul of two for six against Barbados has taken her from 45th to 26th. She has reached a career-best third position among all-rounders

In the rankings for bowlers, Australia left-arm spinner Jess Jonassen, who took four for 22 against India, has moved up two slots to fourth position in the list led by England’s Sophie Ecclestone. Australia fast bowler Megan Schutt and New Zealand all-rounder Amelia Kerr have moved up a slot each to take seventh and eighth positions while Barbados captain Hayley Matthews is up two places to ninth.

Performances of those playing for Barbados and who have represented the West Indies in the past reflect in the latest rankings as all matches in the Commonwealth Games have T20I status.

However, matches involving Barbados will be ignored for the team rankings since Barbados is not an ICC Member. All other matches other than those involving Barbados, will be rated in the usual way.

Others to move up the bowlers’ rankings include South Africa’s Nonkululeko Mlaba (up two places to 22nd), Sri Lanka spinners Oshadi Ranasinghe (up two places to 24th) and Inoka Ranaweera (up four places to 44th).

Meanwhile, India medium-pace bowler Renuka Singh has galloped 48 places to 49th after grabbing a career-best four for 18 against Australia.

ED attaches 3.35 cr assets in DA case

Directorate of Enforcement (ED) has provisionally attached immovable assets to the tune of Rs. 3.35 Crore in the case of CG Gowramma, Ex- Corporator (Azad Nagar), Bangalore in Disproportionate Asset case. 

ED initiated a money laundering investigation on the basis of the charge sheet filed by Karnataka Lokayukta Police, Bengaluru against C.G. Gowramma, the then Corporator of Ward No. 141, Azad Nagar, BBMP, Bangalore, and her husband C. Govindraju for the offense committed under Section 13(1)(e) read with 13(2) of the Prevention of Corruption Act, 1988 and Section 120(B) of Indian Penal Code in FIR registered by Karnataka Lokayukta Police, Bengaluru.

The investigation by ED revealed that C.G. Gowramma during this period as a Corporator misused her official position and generated Proceeds of Crime in collusion with her husband C. Govindaraju and laundered the generated proceeds of crime by crediting the same to their bank accounts in cash as well as by acquiring various immovable properties in cash.

C. G. Gowramma and her husband C. Govindaraju were alleged to have acquired disproportionate assets to the tune of Rs. 3.46 Crore during the check period from FY 2010-11 to FY 2012-13. The immovable properties,thus identified include agricultural land, residential plots as well as commercial sites

Jabalpur fire incident: FIR registered against four doctors and a hospital manager

The Jabalpur Police have registered an FIR against five people, including four doctors, in the Jabalpur Hospital fire incident that left at least nine persons dead, police said on Tuesday.

Superintendent of Police Akhilesh Gaur told agencies that the FIR was registered against five people in the connection with the hospital fire incident. The manager of New Life Multi-Speciality Hospital, identified as Ram Soni and four doctors: Dr Nishit Gupta, Dr Suresh Patel, Dr Sanjay Patel and Dr Santosh S have been charged under sections 304, 308, 334 of the Indian Penal Code. The sections pertaining to causing death and hurt through negligence.

“The premise of the hospital has been sealed and evidence is being technically analysed. We have got video records also that have been sent to the cyber team,” he further said.

At least nine people were killed in a massive fire at a private hospital in Madhya Pradesh’s Jabalpur on Monday, officials said. Chief Minister of Madhya Pradesh Shivraj Chouhan announced an ex gratia of Rs 5 lakh each to the nearest kin of the deceased.

“In this hour of grief, the bereaved families should not consider themselves alone, I and entire Madhya Pradesh are with the families. The state government will provide assistance of Rs 5 lakh each to the next of kin of the deceased and Rs 50 thousand each to the seriously injured. The government will also bear the cost of complete treatment of the injured,” the CM said in a tweet.

The Chief Minister further said that local administration and collector have been directed to keep an eye on the entire matter. Siddharth Bahaguna, Jabalpur SP said that around 9-10 people lost their lives in the fire that broke out due to a short circuit.

Prime Minister Narendra Modi on Monday expressed condolences to the families of the persons who died in the blaze.

“Anguished by the loss of lives due to a fire at a hospital in Jabalpur, Madhya Pradesh. Condolences to the bereaved families. I hope the injured recover at the earliest. The local administration is providing all assistance to those affected: PM @narendramodi,” tweeted the Prime Minister’s Office.

In a joint operation, Goa Police and Mumbai Crime Branch on Sunday arrested from Panaji a dreaded criminal of Mumbai, who was allegedly involved in over 30 heinous crimes.The man, caught with live firearm, has been identified as Vikrant, alias Vicky.


“In a late-night operation, Panaji Town Police Station and Navi Mumbai Crime Branch through their meticulous planning apprehended the most wanted and dreaded criminal of Mumbai, Maharashtra namely Vikrant alias Vicky Dattatrey Deshmukh,” Shobhit Saksena, Superintendent of Police (SP), North Goa, told reporters here.

Govt to fill vacancies in Armed Forces by Dec 2023, MoS Rai in Lok Sabha

The Union Government on Tuesday informed that it has decided to fill up the existing vacancies of the Central Armed Police Forces (CAPFs) and Assam Rifles by December 2023.

“There were a total of 84,659 vacancies in the Central Armed Police Forces (CAPFs) and Assam Rifles till July 31, 2022, and the government has decided to fill up existing vacancies by December 2023,” Minister of State for Home Nityanand Rai told the Lok Sabha on Tuesday.

Of the total, a maximum of 27,510 vacancies are noted in the Central Reserve Police Force (CRPF) followed by 23,435 vacancies in Border Security Force (BSF), 11,765 in Central Industrial Security Force (CISF), 11,143 in Sashastra Seema Bal (SSB), 6,044 in Assam Rifles, 4,762 in Indo-Tibetan Border Police (ITBP), said the Minister while giving a written reply to a query of three Lok Sabha members.

As per the instructions of the Department of Personnel and Training issued vide notification dated October 4, 2012, Rai said, “10 per cent vacancies in Central Armed Police Forces and Assam Rifles are reserved for ex-servicemen up to the level of Assistant Commandant to be filled by direct recruitment”.

Further, Rai said, in-principle approval has been given for reservation of 10 per cent of vacancies for ex-Agniveers in the recruitment to the post of Constable (General Duty) and Rifleman in the CAPF and Assam Rifles when the first batch of ex-Agniveers is available for recruitment after completing engagement period of four years in defence forces.

“The government has taken a decision to fill up existing vacancies in CAPFs and Assam Rifles by December 2023,” Rai said. He further stated that the examination for filling up of 25,271 posts of Constable (General Duty) has already been conducted.

To fill up the vacancies expeditiously in CAPFs and Assam Rifles, the Minister said the government has taken several steps like yearly recruitment for the post of Constable (General Duty) for which a Memorandum of Understanding (MoU) has been signed with Staff Selection Commission (SSC).

For coordinating recruitment to General Duty posts, a Nodal Force each for recruitment in the rank of Constable (General Duty), Sub-Inspector (GD) and Assistant Commandant (General Duty) has been nominated on long-term basis, said Rai.

He said that directions have been issued to all CAPFs and Assam Rifles to undertake recruitment against vacant posts in Non-General Duty cadres in a time-bound manner.

It is also directed for conducting timely meetings of the Departmental Promotion Committee (DPC) for filling up promotional vacancies, added the Minister.

China in recent years flexing its muscles in Indo-Pacific

In order to pursue its global strategy and goals which seek to advance its glory, China, in recent years, has been more ambitious and bolder.

Beijing has, in particular, focused on its need for a more comprehensive presence in all areas of the maritime domain and has paved the path for China to evolve into a maritime ‘great power’ through an increasingly-forceful approach that appears to be unmindful of national and regional sensitivities.

According to the agencies, as Indo-Pacific is a huge economic and commercial powerhouse housing some of the world’s largest and most powerful economies, China’s increasing assertiveness on maritime issues within the region, over the past few decades, has led to significant geostrategic flux in the region.

China’s endeavours in the Indo-Pacific are largely motivated by economic interests and the need to ensure the safety of its maritime trade, especially the import of crude oil.

A major part of China’s outreach-grand strategy in the Indo-Pacific region aimed at extending its global sphere of influence is the Belt and Road Initiative (BRI) while fostering new norms of international economic cooperation and promoting a more China-dominated rules-based order.

The BRI is widely recognized as Beijing’s ambitious strategy to dominate the region and the world by building infrastructural networks throughout Eurasia and Africa. Developing and enhancing marine connectivity and interconnections are crucial elements of the BRI. The “String of Pearls” is another significant theatrical strategy of Beijing.

By making investments in geopolitically significant ports from Sudan to Hong Kong, China is dominating vital choke points in the Indian Ocean region.

The neighbouring nations, especially India, are literally encircled by this strategy. Encirclement of India is an important geopolitical concern in the Indo-Pacific with regard to China’s aggressive maritime strategy, mentions the publication in European Times.

Questions about China’s long-term goals in the Asia-Pacific area are being raised due to the country’s massive military buildup and expansion of its naval and marine capabilities.

China’s Anti-access Area-denial (A2/AD) strategy aims to prevent an adversary’s access to a territorial region (anti-access) and deny their freedom of movement on the battlefield (are denial).

Beijing has made efforts to develop its effective A2/AD capabilities to deter possible access to its territories by potential adversaries.

In preparation for potential emergencies resulting from its territorial disputes in regions including the Taiwan Strait, the Spratly Islands, the Paracel Islands, and the Senkaku/Diaoyu Islands, Beijing is bolstering its defence capabilities at a tactical level through military drills, according to the agencies.

China’s continuous maritime expansionism, its indulgence in lawfare, which is formally supported by national maritime legislation, and its rising military might all work together to create significant threats and have a negative influence on the current rules-based system.

A fresh set of alliances, collaborations, and concerns have grown out of this crisis, many of which are impliedly or directly directed against China.

The Quadrilateral Dialogue, including India, United States of America, Japan and Australia, which held its second in-person meeting in May this year, has broadened its scope. However, there is still more to be done to promote “holistic maritime security”, mentions the publication.

Though Quad is not a security grouping or alliance and its leaders maintain that it is not directed against any other country.

However, many see it as a group to check growing Chinese activities which impinge on the freedom of navigation, sovereignty and territorial integrity in the region. Several announcements were made during the last summit meeting between the Quad leaders in Tokyo which are apparently aimed at the moves of Beijing.

Among various strategic announcements, the Indo-Pacific partnership for Maritime Domain Awareness is seen as a big takeaway.

The move will keep a check on illegal fishing in the Indo-Pacific and may use real-time high technologies including satellites to track illegal movement. This may not suit Beijing, according to the experts.

Police probing FIR against Sanjay Raut seek original audio from complainant to identify caller

The Mumbai Police probing the criminal intimidation case against Shiv Sena MP Sanjay Raut is awaiting the original audio recorded by the woman complainant and will submit it to the forensic science laboratory in Kalina to identify the caller, an official said on Tuesday.

A First Information Report (FIR) was registered against Raut on Sunday under various sections of the Indian Penal Code including insulting the modesty of the woman on a complaint lodged by a witness in a money laundering case being probed by the Enforcement Directorate, claiming she was threatened. Seven youth drown in Gobind Sagar lake, Himachal Pradesh

Seven youths from Banur in SAS Nagar district of Punjab died after drowning in the Gobind Sagar lake over the Satluj river in Androuli village of Bangana subdivision on Monday.

According to Additional Superintendent of Police Parveen Dhiman, the deceased have been identified as Pawan Kumar (35), son of Surjit, Raman Kumar (19), son of Lal Chand, Labh Singh (17), son of Lal Chand, Lakhbir Singh (16), son of Ramesh Kumar, Arun Kumar (14), son of Ramesh Kumar, Vishal Kumar (18), son of Basu, and Shiva Kumar (16), son of Avtar Kumar.

Chief Minister of Punjab, Bhagwant Mann, has offered condolences to the families of the deceased. “On the way to Baba Balak Nath, we got the sad news of the drowning of 7 youths from Banur from Punjab who stopped to bathe in the Gobind Sagar Lake… I express my heartfelt sympathy to the families… Prayers to God… May the departed souls rest in peace. Condolences to the families. Giving strength to believe…,” said Bhagwant Mann in a tweet.

Speaker of Punjab Legislative Assembly, Kultar Singh Sandhawan also consoled the families, saying in a tweet, “The death of 7 youths from Punjab in the Gobind Sagar Lake of Una district of Himachal has deeply shocked the mind. I share the grief with the families of the deceased youths and hope that such unfortunate incidents will not happen in the future don’t happen.”

Himachal Pradesh Chief Minister Jai Ram Thakur took to Twitter to share their grief. “The news that seven people died due to drowning in Gobind Sagar lake in Andoroli of Una district is extremely sad. May God place the departed souls at his feet and give strength to the bereaved family members. Peace!,” Thakur said.

Traffic hits as truck overturns near Ghodbunder road in Thane

A container truck loaded  with chemicals overturned on busy Ghodbunder road near Thane this morning  resulting in a huge traffic jam, officials said.

After the incident took place, a container with the chemical- hydrogen peroxide- leaked on the road, emitting a foul odour.  The truck was carrying 23,000 liters of hydrogen peroxide in 20 tanks from  Gujarat to Navaha Sheva when it overturned near the Gaimukh creek at around 7:15 AM.

The driver was injured in the incident and taken to a hospital.

Fire brigade personnel and a team of RDMC rushed to the spot and are trying to haul the tilted container back into the straight position, the official said.

“There are no cases of anyone affected due to the chemical leak,” he added.
