Court has acquitted a woman for killing her new born child in Thane

A court in Maharashtra’s Thane district has acquitted a 34-year-old woman accused of killing her newborn child, giving her the benefit of doubt. Kalyan court’s Additional Sessions Judge Shaukat S Gorwade, in the October 4 order, which was made available on Monday, held that the prosecution failed to prove the charge against the woman under Indian Penal Code Section 302 (murder).

Additional Public Prosecutor S R Kulkarni told the court that the woman, who already had two daughters, delivered a baby girl on April 15, 2018 and was discharged from hospital on April 17.

On April 21, 2018, the woman, hailing from Umbarde village in Kalyan town, went with her husband and newborn baby to the Civil Hospital where doctors declared the child brought dead.

The Khadakpada police conducted a probe into the matter and alleged that the woman strangulated and gagged the baby to death as she had delivered the third girl child. The police registered a case against her under IPC Section 302.

The judge in his order said the prosecution has not led any evidence to prove the nail marks found on the throat and neck of the deceased are of the accused. “Palpably, the accused and her husband were with the deceased when they brought the child to the hospital.

Therefore, there is doubt about the murder of the deceased.

There is no witness who can prove that the accused pressed the mouth and neck of the deceased and caused her murder. There is no chain at all which establishes a nexus between the crime and the accused,” the judge said.

Except the confessional statement of the accused, that too recorded by the police, is inadmissible in evidence, the court said.

There is neither oral nor documentary evidence brought on record by the prosecution to link the accused with the crime, it said. “Though the prosecution proved that the deceased died a homicidal death, the prosecution has not linked the accused with the crime. Hence, for want of evidence, the prosecution failed to prove that the accused had committed the murder of the deceased,” the court said. Hence, the woman needs to be acquitted, the court added.

Uttar Pradesh AIMIM president Shaukat Ali on Sunday said that the party will contest all the seats in future elections in the state, while also claiming that many leaders of the Samajwadi Party will join the Asaduddin Owaisi-led party in the future.

Speaking to Agencies, Ali said that the Muslims have always supported “secular forces” to defeat the BJP.

“The people are coming towards AIMIM now. We are contesting in East UP, Purwanchal, Central UP and Bundelkhand. Leaders of the Samajwadi Party will join AIMIM. The 2017 elections were polarised by the BJP through the media. The Muslims thought that the Samajwadi Party could defeat the BJP. Since independence, the Muslims have always supported secular forces to defeat the BJP,” he said. Stating that his party chief Owaisi never polarised by speaking on the “Hindu-Muslim issues”, Ali said that the party will keep fighting for the community. “Owaisi never spoke about Hindu-Muslim issues. ATMs were blacklisted in Muslim areas, so it became national news. It became a Hindu-Muslim issue. There are hardly any banks in Muslim areas in UP. No schools, no proper hospitals and medicines in these areas. We will keep fighting for all this,” Ali said.

He also questioned Samajwadi Party’s silence on the issues relating to Muslims and said that Akhilesh Yadav is silent when madrasas are surveyed in Uttar Pradesh.

“The Samajwadi Party is silent on Muslim issues. Even Akhilesh is silent when our madrasas are surveyed. No Muslim leader in Samajwadi Party, BSP or Congress talks about Muslim welfare. Only Asaduddin Owaisi does,” he said.

Last month, after the Uttar Pradesh government ordered a survey of Islamic educational institutions or Madrassas in Kanpur, Owaisi alleged that the government is targeting Waqf property which is a “systematic targeting of Muslims”. Attacking the Uttar Pradesh government, Owaisi alleged that there is a conspiracy behind madrasas’ survey.

While addressing the media persons in Hyderabad, he said, “Why are you (UP Govt) conducting a survey of Waqf properties only? Do it for Hindu Endowments Board properties too. I was saying there’s a conspiracy behind madrasas’ survey. It’s coming to the fore. UP govt is violating Article 300 (Right to property).”

Sena will have to contest Andheri by-polls with a new symbol till the decision of ECI is made.

Arvind Sawant stated that Sena will take a decision on the new symbol very soon.

Sena leaders stated that they had heard of freezing of symbols but banning the name of the party had happened for the first time. Other leaders from sena said that whatever decision is made by ECI we will go with it.

Maharashtra Minister Dada Bhuse while speaking to Afternoon Voice said, “We are yet to take a call on this front, and the final decision of submitting our choice to ECI will be done by CM Eknath Shinde.”

 Priyanka Chaturvedi said to Afternoon Voice that the script had not yet been received by the BJP. as they had mortgaged their brains.

Shinde faction had not yet submitted any symbol or name to ECI as they are seen either clueless or in wait and watch the situation.

BJP demands apology from Rahul Gandhi over his remarks on Savarkar

Congress leader Rahul Gandhi, who is on the ‘Bharat Jodo Yatra’ stirred a controversy after he made remarks about the freedom fighter Veer Savarkar.

While addressing a gathering, the Congress leader said, “Veer Savarkar worked for the British and also received a stipend for the same.”

After the remarks came in, the opposition has come down heavily on Gandhi, condemning his statement and demanding an apology for insulting Savarkar.

BJP MLA Ram Kadam was protesting in Mumbai and demanded an apology from Rahul Gandhi. He also said, “The Congress leader does not know the facts of Veer Savarkar and the Indian history.”

Kadam further slammed the former CM Uddhav Thackeray and said, “Why is Thackeray silent on this issue? Has he sidelined himself from the Hindutva ideology?”

Deputy CM of Maharashtra Devendra Fadnavis also said, “Veer Savarkar is an inspiration for the freedom struggle and the Congress leader should apologize for his remarks.”

Sachin Sawant, Congress leader, told Afternoon Voice, “The BJP has a lot of misconceptions about Savarkar and his history, but the truth can’t be hidden.”

“The Congress leaders have always been criticizing the Savarkar and their leaders are unaware of his role in the freedom fight and they also lack knowledge about his history,” said BJP leader Bhalchandra Shirsat.

The Uddhav Thackeray camp of Shiv Sena submitted a list of three names and symbols for the upcoming Andheri East Assembly constituency bypolls to the Election Commission.

Amid a row over Shiv Sena’s ‘Bow and Arrow’ symbol claim, the Election Commission (EC) on Saturday froze the symbol barring both the rival camps in the party from using it in the upcoming Assembly bypoll slated for November 3.

Following this, the Thackeray faction on Sunday submitted the options of ‘Trishul’, ‘Rising Sun’ and ‘Torch’ as symbols for the party to the Election Commission.

Further, the Thackeray camp suggested three names — Shiv Sena (Balasaheb Thackeray), Shiv Sena (Prabodhankar Thackeray) and Shiv Sena (Uddhav Balasaheb Thackeray) for the upcoming bye-elections.

“Our party’s name is Shiv Sena, if ECI gives any of the names related to Shiv Sena including ‘Shiv Sena (Balasaheb Thackeray)’, ‘Shiv Sena (Prabodhankar Thackeray)’ or ‘Shiv Sena (Uddhav Balasaheb Thackeray)’, that would be acceptable to us,” Shiv Sena (Uddhav faction) MP Arvind Sawant told media persons.

Meanwhile, the Shinde faction hit out at the rival Thackeray camp, saying it would not get any votes and was busy seeking public sympathy.

Minister in Chief Minister Shinde’s cabinet Deepak Kesarkar said, “They (Uddhav faction) have not done anything in the past 2.5 years. People would not vote for them, thus they are seeking sympathy. ECI is a constitutional authority, we should keep its respect, not insult them over Twitter.” “We have all the documents and we have a majority. We will get justice and the symbol as well,” added Kesarkar.

Thane Motor Accident Claims Tribunal has dismissed ‘false and frivolous’ claims filed by two brothers

The Thane Motor Accident Claims Tribunal (MACT) has dismissed “false and frivolous” accident claims filed by two brothers and ordered action against a tempo driver and two policemen who assisted the petitioners in filing of the claim.

MACT member H M Bhosale, in the October 6 order which was made available on Saturday, also imposed a cost of Rs 3,000 each on the two brothers, Avinash Arjun Chikhale and Devesh Arjun Chikhale.

The brothers in their petition informed the tribunal that on September 1, 2017, they were returning home in Virar town of neighbouring Palghar district in Maharashtra from Sakhlewadi on a motorcycle.

At a turn near Aptagaon in Panvel town of adjoining Raigad district, a tempo coming from the opposite direction dashed against their vehicle.

As a result, they fell and suffered injuries for which they were treated. They claimed a compensation for the injuries and treatment.

Both of them told the tribunal that they were employed. Avinash, then aged 19, earned Rs 8,000 per month while Devesh, aged 23, earned Rs 12,000 per month.

The respondents in the case were the owner of the offending tempo, which the petitioners claimed to have hit them, and the vehicle’s insurer.

The tempo owner did not appear before the tribunal, hence the matter was decided ex-parte against him.

The insurance company told the tribunal that the tempo was “planted” in the claim to get the benefit.

It is contended that as per the statement of Avinash recorded by police, some unknown vehicle dashed against their motorcycle.

This is a clear case of ‘hit and run’. The insurer submitted that the petition before the tribunal is not maintainable.

It also contended that the FIR was lodged 112 days after the accident. The police have not recorded the statement of independent witnesses.

The medico­legal certificates relied by the petitioners nowhere show that they were admitted with the history of road traffic accident.

The disparity in the time of accident and admission in the hospital shows the offending vehicle has been “planted”, the insurance company claimed. The tribunal in its order said “having regard to the aforesaid reasons, it is needless to state that the petitioners have not sustained injuries as a result of dash given by the offending tempo. They fell down from the motorcycle as Devesh lost the control. Therefore, the petitioners are not entitled for compensation and the claim petitions deserve to be dismissed.”

The MACT imposed a cost on the petitioners so that no such false claim should be presented before the tribunal. “This is a social legislation. It is the duty of everyone to see that only bona fide and genuine claims should come before the tribunal,” the order said. “The tendency to file a false claim is not only harmful to insurance companies, but it is a stigma on the institution in entertaining and dealing with such false claims. If such a tendency is allowed to develop or grow, it will certainly damage the image of the institution in eyes of the society,” it said.

The tribunal said a copy of this judgement shall be forwarded to Superintendent of Police, Raigad district, with a request to take necessary action against the tempo owner and to initiate departmental action against a police sub-inspector and a hawaldar.

NCP party reacted on EC order on use of Shiv Sena party name and symbol

The Nationalist Congress Party on Sunday said the Election Commission’s order on the use of the Shiv Sena party name and election symbol in an upcoming Assembly bypoll was surprising, but it did not mean the Uddhav Thackeray-led group was weak or demoralised.

The Election Commission on Saturday barred the Shiv Sena factions led by former chief minister Uddhav Thackeray and current Maharashtra CM Eknath Shinde from using the party name and its election symbol in the Andheri East Assembly bypoll.

In an interim order over the claims by the rival factions for control of the organisation, the commission asked them to suggest by Monday three different name choices and also as many free symbols for allocation to their respective groups.

The bypoll to Andheri East Assembly seat in suburban Mumbai, scheduled on November 3, has been necessitated due to the death of incumbent Sena MLA Ramesh Latke.

The Congress and the NCP have decided to support Ramesh Latke’s wife Rujuta Latke, the candidate of the Thackeray faction of the Shiv Sena, their coalition partner in the Maharashtra Vikas Aghadi (MVA).

The Bharatiya Janata Party (BJP), an ally of the Shinde faction, has decided to field Murji Patel, a corporator in the Brihanmumbai Municipal Corporation.

Speaking to reporters here, NCP’s chief spokesperson Mahesh Tapase said the Election Commission of India’s decision to freeze the Shiv Sena symbol and party name is surprising and painful. But, it is not the final decision of the Commission. “The Eknath Shinde-led (Sena) camp is not even contesting the by-election, still the use of the party name and symbol was restricted. The freezing of the symbol does not mean the (Thackeray-led) Sena workers have become weak or are demoralised. The Shiv Sena (Thackeray faction) along with the NCP and Congress will give a tough fight to the BJP,” he said. “This election will be a one-on-one contest as the BJP has fielded its candidate against the Uddhav Thackeray camp’s nominee,” he said.

The Thackeray-led Shiv Sena had on Saturday termed the EC’s order as “injustice”, while the group headed by CM Shinde said the order was appropriate.

The EC’s interim order came on the Shinde faction’s request seeking it be allocated the symbol as the Andheri East assembly bypoll is approaching.

“Muslim population is declining in the country” reacting to RSS Bhagwat’s remarks: Owaisi

AIMIM chief Asaduddin Owaisi has asked RSS chief Mohan Bhagwat to “not fret” as the Muslim population was “rather declining” in the country, asserting that Indian Muslims were the ones using contraceptives the most. His remarks came days after Bhagwat had called for a comprehensive population policy to ensure that the rising population do not become a burden but can be used as a resource. “Don’t fret. The Muslim population is not increasing. It’s rather falling… Who’s using condoms the most? We are. Mohan Bhagwat won’t speak on this,” Owaisi said.

Addressing the annual RSS Vijayadashmi festival, Bhagwat called for a “comprehensive policy on population” and said that it should be applied equally to all.

“Population control and religion-based population balance is an important subject that can no longer be ignored… So a comprehensive population policy should be brought and should be equally applicable to all. Only then rules pertaining to population control will yield results,” he had said. Owaisi also called out the recent viral video where minorities were purportedly beaten by officials on the streets. “You could have taken them to the police station. But you chose to rip off their esteem and hit them directly in the streets. In a nation of 133 crores where 30 crores Muslims exist, the dignity of a Muslim is lesser than a streetside dog,” he added. On October 5, the RSS chief inaugurated the annual Dussehra celebrations and stressed on the application of the population policy equally.

“It is true that the higher the population, the greater the burden. If the population is used properly, it becomes a resource. We also have to consider how many people our country can feed and support after 50 years. Population imbalance leads to changes in geographical boundaries,” said Bhagwat. He also advocated giving equal rights to women in all places. “Considering a woman as the mother is good, but restricting them to closed doors is not good. There is a need to give equal rights to women to take decisions everywhere. All the work that the mother power can do that man cannot do, they have so much power. And therefore it is important to enlighten, and empower them and give them the freedom to work and give equal participation in the work in this way,” he said. “Power is the foundation of peace. The presence of a woman chief guest has been discussed a long time,” the RSS chief added. Bhagwat said that the government’s policies are leading the country towards self-reliance.

“The government is pursuing policies which lead towards self-reliance. Bharat’s importance and stature increased in the community of nations. In the sphere of security, we are becoming more and more become self-sufficient. Our economy is getting back to the pre-pandemic levels, which is expected to rise further. The sportspersons are also bringing laurels to the country,” he said. Talking about the importance of the mother tongue in education, Bhagwat said that English as a language is “not necessary for a career”. “English is not necessary for a career. A career is built from different things. The government is paying attention to this by way of the New Education Policy (NEP). But do parents want their children to be taught in their mother tongue? Or chasing so-called financial gain or career, do they want their wards to become a part of a blind rat race? When expecting the government to institute the promotion of mother tongue, we should also consider whether we sign our names in our mother tongue or not,” he said.

The ICC Men’s T20 World Cup 2022 warm-up fixture between Sri Lanka and Zimbabwe has been rescheduled, ICC confirmed.

The ICC Men’s T20 World Cup 2022 warm-up fixture between Sri Lanka and Zimbabwe has been rescheduled and will now be played at the Melbourne Cricket Ground on Tuesday, 11 October.

“The match was to be played on Monday, 10 October at the same venue as per the original schedule but the change has had to be carried out following a change in Zimbabwe’s travel schedule,” ICC said in an official statement released by ICC.

The eight teams featuring in the first round of the 16-team tournament play their warm-up fixtures from 10-13 October in Melbourne. The Junction Oval is the other venue that will host practice matches for the first round.

The warm-up fixtures for teams who have direct entries in the Super 12s will be played at two venues in Brisbane – the Gabba and the Allan Border Field – on 17 and 19 October.

ICC T20 World Cup is one of the biggest and most exciting spectacles of the sport. Ahead of the upcoming edition of the tournament in Australia from October 16 to November 13 this year.

India reports 2,756 new COVID-19 cases takes total tally up to 4,46,12,013

India added 2,756 new coronavirus infections taking the total tally of COVID-19 cases to 4,46,12,013, while the active cases dipped to 28,593, according to the Union Health Ministry data updated on Sunday.

The death toll climbed to 5,28,799 with 21 fatalities which includes 16 deaths reconciled by Kerala, the data updated at 8 am stated.

The active cases comprise 0.06 per cent of the total infections, while the national COVID-19 recovery rate increased to 98.75 per cent, the ministry said.

A decline of 658 cases has been recorded in the active COVID-19 caseload in a span of 24 hours.

The daily positivity rate was recorded at 1.15 per cent while the weekly positivity rate was recorded at 1.28 per cent, according to the health ministry.

The number of people who have recuperated from the disease surged to 4,40,54, 621, while the case fatality rate was recorded at 1.19 per cent.

India’s COVID-19 tally had crossed the 20-lakh mark on August 7, 2020, 30 lakh on August 23, 40 lakh on September 5 and 50 lakh on September 16.

It went past 60 lakh on September 28, 70 lakh on October 11, crossed 80 lakh on October 29, 90 lakh on November 20 and surpassed the one-crore mark on December 19.

The country crossed the grim milestone of two crore on May 4 and three crore on June 23 last year. It crossed the four-crore mark on January 25 this year.

According to the ministry, 218.97 crore doses of Covid vaccine have been administered in the country so far under the nationwide vaccination drive. The five new fatalities reported in the last 24 hours include two from Maharashtra and one each from Delhi, Tamil Nadu and West Bengal.
