Powers should remain in hands of people

Anna Hazare, who is mute on burning issues of India, found slamming Thackeray govt seeking ‘Indirect Sarpanch Polls’ by calling it autocratic. Criticizing the Maha Vikas Aghadi government, Hazare stated that the indirect sarpanch polls were threat to democracy. The government is set to table the indirect sarpanch polls bill during the budget session of the Maharashtra Assembly to reverse an earlier decision under which people directly elected the village sarpanch (headman). The rule for direct election of sarpanch was brought in by the previous BJP-led Devendra Fadnavis government amending respective clauses of Maharashtra Gram Panchayat Act of 1958 to facilitate the election of a sarpanch (gram panchayat heads) directly from among the people of the village. But the Uddhav Thackeray-led government seeks its reversal which has been stalled by Governor BS Koshyari, who refused to sign the promulgation of an ordinance on this. Highlighting the importance of Gram Sabha polls, Hazare invoked Mahatma Gandhi’s thoughts on electoral democracy. Stating that once a person turns 18, he becomes a part of the Gram Sabha, Hazare said that it was a natural and organic body. Moreover, he reminded that the Gram Sabha voters who elect the Legislative Assembly MLAs and Lok Sabha MPs. He added that while the above-mentioned legislative assemblies changed every five years, the Gram Sabha was permanent. Elaborating on the various Gram Sabhas, he said each voter of the Gram Sabha change the MLAs and the members of the district, thus changing the village Gram Panchayat. He concluded that as the Gram Sabha was supreme, the sarpanch must be elected by the voters and not the political party representatives, as proposed in the bill.

Hazare believes that the current government did not believe in transparency and therefore, wanted sarpanches to be elected by councilors. He added that not only sarpanches but also the Chief Minister should be directly elected by the people. The former Devendra Fadnavis-led BJP government had scrapped the procedure of electing sarpanches from among the elected gram panchayat committee members, and had started a new process whereby sarpanches would be elected by the people through an election. Recently, however, the MVA government reinstated the old process but did not get the governor’s nod on the decision which is why its implementation was pending. Hazare is backing the direct election of sarpanches. He expressed his apprehension saying, “If the direct process is scrapped, there will be a direct threat to democracy and there are chances of increasing dictatorship in the state. It is not decentralization in the true sense. Powers should be in the hands of the people otherwise the importance of political parties will increase and it will affect democracy.”

The Gram Sabha is the fulcrum of the Panchayati Raj and village development. People use the forum of the Gram Sabha to discuss local governance and development, and make need- based plans for the village. The Panchayat implements development programs under the overarching mandate, supervision and monitoring of the Gram Sabha. All decisions of the Panchayat are taken through the Gram Sabha and no decision is official and valid without the consent of the Gram Sabha. The Panchayat Secretary after obtaining approval of the Sarpanch should organize the Gram Sabha. Gram Panchayat Sarpanch has to convene a Gram Sabha meeting when either 10 per cent members of Gram Sabha or 50 persons of Gram Sabha (whichever is more) submits their requisition for holding a Gram Sabha. However, those members have to inform the purpose for the meeting. A written request for the meeting must be handed over to the Sarpanch during office hours 5 days before the date of meeting. If the Sarpanch fails to hold the meeting on the requested date, the members who requested the meeting can then organize the Gram Sabha meeting. Gram Sabha has its own protocol and functionary, in such circumstances ‘indirect Sarpanch Polls’ is not vice idea. The term Gram Sabha is defined in the Constitution of India under Article 243(b). Gram Sabha is the primary body of the Panchayati Raj system and by far the largest. It is a permanent body. Gram Sabha is the Sabha of the electorate. All other institutions of the Panchayati Raj like the Gram Panchayat, Block Panchayat and Zila Parishad are constituted by elected representatives. The decisions taken by the Gram Sabha cannot be annulled by any other body.

The power to annul a decision of the Gram Sabha rests with the Gram Sabha only. Anna Hazare always had a brutal struggle against one or the other unreasonable arrogance of government. Indians keep oscillating between total apathy to mass hysteria when it comes to serious issues. While corruption is a serious issue, the mass hysteria often ignores the root causes of corruption. Causes for Indian corruption are too deep and it cannot be fought without fixing other basic issues. The struggle has to be a holistic one that tries to fix the problem in a more practical manner. All he asked us to do was open our eyes to reality. To stop living under the illusion that things will magically change without us doing anything. He brought us together in a fight against corruption in a way that no one has since the Gandhian era. He is the most peaceful protester ever. His methods may not be working in today’s times. But he is NOT undermining democracy or thrusting anything upon us. If anything he is doing us a favour. He’s asking us to question the authenticity of so many executive actions that affect US. That is our money which is lost in every scam that comes out. Political parties take the advantage of their power when they rule, they make amendments in rules or they integrate things that are suites to their survival. Hope Anna Hazare can restore democracy by making politicians accountable.

Hazare backs direct election of sarpanch

As per the new rule, elected gram panchayat members will pick the sarpanch from among themselves. Hazare added that for restoration of democracy sarpanch should be elected by people. He said that while the legislative assemblies changed five years Gram Sabha was permanent.

Hazare said, “The government doesn’t believe in democracy and therefore wanted sarpanch to be elected by councilors. If direct election process is scrapped then there will be a direct threat to democracy. There is a possibility of increasing dictatorship in the state. Powers should remain in the hands of people otherwise significance of political parties will increase and it will affect democracy.”

The erstwhile BJP government had taken a decision of electing a village sarpanch directly from among the people. On the other hand, the MVA government had decided that a sarpanch will be elected by members of gram panchayat who belong to political parties. Thackeray also reversed another decision about direct election in local-self government bodies like municipal councils. Maharashtra Governor Bhagat Singh Koshiyari has refused to sign an ordinance to reverse the former BJP government’s decision of direct election of sarpanch. The government is all set to table indirect sarpanch poll bill during the budget session of Maharashtra assembly.

“Not only sarpanch of the village but chief minister of the state should get selected through election process. Then only we can say that democracy means for the people and by the people,” added Hazare.

BJP leader Vikas Matkari has supported Anna’s stand of direct election of sarpanch. Already 9,000 gram panchayats have passed a resolution opposing the state government’s decision to allow members to elect a sarpanch from among themselves. It also suspended 600 expert directors appointed in the 302 agriculture produce marketing committee (APMC).

In the Delhi violence up till now 20 people, including a head constable died.

Speaking to reporters outside the Vidhan Bhavan Sule said, “The Centre should be held responsible for what has happened in Delhi. Union Home Minister Amit Shah must resign owning moral responsibility.”

She further stated, “It is a huge security lapse during US President Donald Trump’s visit. The home minister is responsible for it.”

Sule also urged Prime Minister Narendra Modi to conduct a “transparent” probe into the alleged security lapse.

“There should be an impartial probe into it…It is my humble request that the PM carries out a transparent inquiry into the security lapse,” she added.

Apart from Sule, Congress interim president Sonia Gandhi during the press conference at the national capital said Home Minister Amit Shah must resign. She also hit out at Delhi Chief Minister Arvind Kejriwal for not taking adequate steps to ensure peace in the national capital.

Since Sunday in the communal violence in Northeast Delhi, violence continued. Many shops, vehicles and houses were vandalised by protestors. The violence triggered after clashes between pro and anti-Citizenship Amendment Act (CAA) protesters.

On Delhi violence, former Maharashtra Chief Minister Prithviraj Chavan said, “The Godhra model has been replicated in Delhi.” In the Godhra riots at Gujarat, over 1,000 people, mostly from the minority community, were killed.

Another setback for BJP; MVA announces shutting down of Maharashtra International Education Board

Varsha Gaikwad, Maharashtra Education Minister, After coming into power the Maha Vikas Aghadi (MVA) government has been overturning the decision of the previous BJP-led government. Whether it’s being transferring accounts of police officers from private banks to public sector banks or to scraping the decision on the direct election of the Sarpanch. It’s very common in politics to take jibe or overturn the decision of opponents.

On Wednesday, the Maharashtra Education Minister Varsha Gaikwad announced the shutting down of the Maharashtra International Education Board (MIEB) started by the BJP government.

Varsha Gaikwad was responding to a question raised through a calling attention motion by Shiv Sena MLC Vilas Potnis on the MIEB in the state Legislative Council. Potnis also had asked details of the board, its functioning and training of teachers, among other things.

As per sources, other members of the upper house, including Congress MLC Sharad Ranpise, Kapil Patil representative of the teacher’s constituency and NCP legislator Satish Chavan demanded to shut down of the MIEB.

If you are feeling low or stressed, talk to your parents, or a friend, or a family member, or a teacher whoever you trust. Please do not feel depressed or frustrated. Depression or any form of frustration lowers your capability. You are not alone. Remember life always gives a second chance. Those asking about your marks today will hardly remember it 10 years henceforth. Failures are the biggest teachers and stepping stones to success.

Whatever said and done, students are under tremendous pressure these days.  With the present syllabus taxing the students with heavy load of work and too much strain and home work that includes project work children are put to test. To add salt to the wound, additional coaching classes and mid-term test makes the children work overtime and there is no time to rest. Such type of schedule takes a heavy toll on children as they break down during the academic year and some of them going to the extent of committing suicides as well.  The present education pattern is really taxing students and the students need to get some rest before they can think about their next move.

Of course schools are second home for children where they should learn the way of life apart from the education part. Freedom for students is needed but it should not cross the limits. With love, care and security, we can win the hearts of the students. Children are averse to criticism.

Parents are putting additional pressure on students and a parent who makes an effort to recognise his wards learning style and make use of the same in proper direction achieve maximum success. It is time for teachers to motivate and inspire children. It is up to parents to make all the difference and work for the betterment of children by working on a strict time schedule and a proper time table to impart knowledge to children.

A study of researchers at the Columbia University in NYC reported that bad parenting may put their children at high risk for anxiety and depression. The examination fever will not allow children to follow busy cricket season as well. Motivation of children should be motto of parents without exerting pressure on their children during the examination time.

Students are under tremendous pressure to perform well in the final examination. At this time the student-teacher relationship and the parent – student relationship should touch a new high to move things in a proper direction.

NPPA should have a profit-formula uniformly for all drugs

It refers to Madras High Court directing Income Tax Department to submit details of claims made by pharmaceutical-companies towards tax-deduction for gifts made to doctors, names of doctors and penalties paid by these companies for drug-overpricing.

Observations made by the Court made it clear that pharmaceutical-companies overprice drugs where prices of same medicine different multiple times according to popularity of brand-names owned by different pharmaceutical companies. Even World Health Organization (WHO) established that even essential drugs in India with lowest printed Maximum-Retail-Price MRP are exorbitantly priced over manufacturing-cost followed by abnormally high trade-margin between ex-factory price and MRP.

National Pharmaceutical Pricing Authority (NPPA) at regular intervals announcing of capping on profit-margins on some drugs. Instead NPPA should have a profit-formula uniformly for all drugs at a time when even generic medicines considered to be a cheaper version of respective branded medicines have exorbitant trade-margins of several hundred percent. Price-revision of any medicine must be allowed only once in a year say on First January unless approved as special case by NPPA.

Gimmick packaging other than in units of 1, 2, 5, 10, 20, 50, 100, 200 and 500 gms, mltrs or units must not be allowed unless approved by NPPA for dose-wise administration. Rule should be to emboss or print name of medicine in a manner that name is there on every capsule or tablet thus ruling out possibility of wastage of drug in case name-portion of strip is consumed.

The fatal virus seems to have spread to other countries as well. It is good to know that the government of India has taken swift and commendable steps by installing virus detection scanners at airports. Bhageerathi Amma: An inspiration for all

The latest edition of Prime Minister Narendra Modis‘ Mann ki baat ‘ will always stay etched in the hearts of the people especially for the PM’s mentioning of a  105-year-old centenarian, Bhageerathi Amma who hails from Kerala’s Kollam district who became the oldest equivalency learner.

The Prime Minister narrated the true and really inspiring life story of a woman who in her youth had to  face  a lot of struggles and sadly had to discontinue her studies at a very young age. She had to take a big responsibility – to look after her big family – and in the onus she had to sacrifice her studies. But the ‘student spirit’ in her urged her to study at a later stage. She resumed her education at an advanced age, wrote her level-4 exam and passed the examination conducted by Kerala literacy mission with really good marks, beautifully and brilliantly making the proverb  ‘where there is a will there is a way ‘ come cent percent true. Amma’s confidence, courage, determination and perseverance is truly an inspiration for the whole world.

Modi referring to the centenarians will power rightly commented that if we wish to progress in life and develop ourselves and if we wish to achieve something in life, the first pre-condition for that is the student within us must never die.

People like Bhageerathi Amma, as the PM says are the strength of this country and a great source of inspiration for all of us.

Aaditya took to twitter and wrote, “Shri @Dev_Fadnavis ji, normally I choose not to comment back. Kindly apologise abt bangles comment: bangles are worn by the strongest of all- the women. Politics can go on, but we need to change this discourse. Rather disgraceful coming from a fmr CM.”

Talking about Devendra Fadnavis remark, on Tuesday while addressing protestors at Azad Maidan where BJP launched a protest against Maharashtra government over issues related to farmers and women. Fadnavis had targeted Shiv Sena’s silence over the recent controversial statement made by AIMIM leader Waris Pathan during the protest rally in Karnataka.

On that Fadnavis hits out on Shiv Sena and said, “Shiv Sena might be wearing bangles but we are not. If someone says something then he will be given an answer in the same way. BJP has this much power.”

In the rally, Pathan had said, “They tell us that we have kept our women in the front – only the lionesses have come out and you are already sweating. You can understand what would happen if all of us come together.”

Till reports last came in already 13 persons have lost their lives during violence that erupted over the anti-Citizenship Amendment Act (CAA) protests in North-east Delhi.

Aslam Shaikh, Maharashtra Minister told Afternoon Voice, “The protest which has been going all over India is being supported by all communities. The opposition now has realised that all this is the work of miscreants. Their (BJP) MLAs are openly provoking and instigating the people to take law in their hands that is why the violence is taking place in Delhi.”

Abbas Kazmi- Advocate said,“What is going on in Delhi in the name of religion is pathetic and I don’t understand why the people in power sitting over there are doing nothing effective in fact to the extent that the police is roaming and helping the arsonists. It’s high time that effective steps should be taken and this bloodshed must be stopped. Otherwise it may spread all over the India.” 

More than 1000 armed battalions of Delhi cops were deployed in the national capital. Fresh incidents of stone pelting have been reported in Maujpur and Brahmapuri.Five shops have been burnt in Garni area. For controlling the rioters, police had to resort to firing tear gas shells. A tyre market in Gokulpuri was set on fire though no casualties were reported.

Abu Azmi, Samajwadi Party leader said, “Looking at the stand that people have been taking against the CAA law, the government is trying its best to suppress the voice of dissenting people. This is a wrong move on the part of the government. Instead the government should go to the people and pacify them.”

Kumar Ketkar, Rajya Sabha MP and former Journalist said, “I have personally visited Delhi and all I can say that all the protesters have been completely peaceful, passive and of a non violence kind. They were seen carrying tri-colour flags, they read preamble publicly and they did not even use an abusive word against anybody. Therefore this violence is definitely provoked deliberately and I feel it has been provoked by the government because they want to create ruckus and riots. I refuse to believe that any of the protesters believes in violence or took part in violent activities.”

Protestors had set a fire engine on fire as three firefighters sustained injuries. Mobs set on fire two vehicles in Jyoti Nagar area of north-east Delhi. Union Home Minister Amit Shah held a meeting with senior Delhi police officials and top Home ministry officials to discussed the deteriorating law and order situation in Delhi. He appealed to the public to refrain from spreading rumours and added that “political parties should cooperate with the police”. He asked the Police Commissioner of Delhi to have senior police officers to be present in Police control rooms to dispel the rumours. On his part, the Delhi Chief Minister Arvind Kejriwal held an urgent meeting with AAP MLAs and officials from violence affected areas.

Nawab Malik, Maharashtra cabinet minister and NCP leader said, “The way provocative statements are being made by the ruling party, it looks like that the government is making the opposition a party in all this violence that is going on even though it is playing an instigative role. I feel that the current situation is being created due to the negligence of the Home Department.”

Dr Bhalchandra Mungekar, Congress Rajya Sabha MP said, “Violence in Delhi on the CAA is beyond condemnation. It is just unacceptable. Being the capital of the country and absolutely cosmopolitan, such violence has no place in Delhi culture. Both the state government and the central government simply can’t run away from their responsibilities. They must ensure that for no reason whatsoever, such violence cannot be tolerated.”

Majeed Memon, NCP Rajya Sabha MP said, “It is very unfortunate to see and hear about the violence that is going on in the National Capital. We can only condemn that this violence is trying to defeat the very spirit of the people who are on the streets for so long. They are trying their best to protest peacefully but it seems that there is some conspiracy to create violence to destroy the protest that is going on. I wish to only condemn this violence and think that there can be possibility of some political and religious conspiracy that needs to be proved.”

Husain Dalwai, Congress Rajya Sabha MP said, “I don’t understand why all the violence is taking place under the Modi-led government. From the time Amit Shah entered politics, riots and protests are taking place all over the country. He is not the right person for the post of the home minister.”

Since the passage of the Citizenship (Amendment) Bill, 2019 (CAB), scores of Indians have gone on protest and this never-ending saga has turned out to be violent. The Bill was introduced by the Home Minister Amit Shah on the floor of the Parliament of India on December 9, in response to the exclusion of 1.9 million people, predominantly Hindus and Muslims in the National Register of Citizens for Assam. It was later passed into a law. This amends the Citizenship Act of 1955 to grant a swifter path to Indian citizenship under the assumption of religious persecution to any individual belonging to the specific minorities of Hindus, Sikhs, Buddhists, Jains, Parsis and Christians from Afghanistan, Bangladesh and Pakistan who entered India on or before 31 December 2014. The Act also seeks to relax the requirement of residence in India for citizenship by naturalisation from 11 years to 5 years for migrants covered under the Act. However, the Act does not mention Muslims and does not offer the same eligibility benefits to Muslim immigrants or immigrants belonging to other religions.

Reviewers have indicated that the amendment Act is unconstitutional. The major opposition political parties state that it violates Constitution’s Article 14, one that guarantees equality to all. They allege that the new law seeks to make Muslims second-class citizens of India while preferentially treating non-Muslims in India. Critics of the Act have stated that due to the National Register of Citizens (NRC), Muslims could be made stateless while the Citizenship Amendment Act would be able to shield people with Hindu, Sikh, Buddhist, Jain, Parsi or Christian identity as a means of providing them with Indian citizenship even if they failed to prove that they were citizens of India under the stringent requirements of the NRC. Some critics allege that it is a deliberate attempt at disenfranchising and segregating Muslims in line with the ethno nationalist Hindutva ideology of the ruling Bharatiya Janata Party (BJP).

Wikipedia, states that the Act also does not mention any benefit for various other refugees which form the bulk of the refugees living in India such as Sri Lankan Tamil refugees who faced persecution during the Sri Lankan Civil War, Rohingya refugees who were victims of the Rohingya genocide, Nepali refugees who faced ethnic cleansing in Bhutan and Tibetan Buddhist refugees who faced persecution in China. According to the Intelligence Bureau, the immediate beneficiaries of the new law will be 25,447 Hindus, 5,807 Sikhs, 55 Christians, Buddhists and Parsis. The passage of the Act sparked massive protests in India. Protesters in Assam and other northeastern states oppose the grant of Indian citizenship to any refugee or immigrant regardless of their religion, because they fear it would alter the region’s demographic balance. They have campaigned since the 1970s against all refugees and they fear that the new law will cause a loss of their political rights, culture and land. They are also concerned that it will trigger more migration from Bangladesh as well as violate the Assam Accord which was a prior agreement reached with the central government on migrants and refugees. After the act was passed, protests in the north-eastern region turned violent. Authorities had arrested over 3,000 protesters as of 17 December 2019 and some news outlets have described these protests as riots. Protesters say that the Act violates Clause 5 and Clause 6 of the 1985 Assam Accord.

Stone-throwing between rival groups, burning and vandalism marked unrelenting violence over the citizenship law protests for more than 24 hours in a part of Delhi in which nine including a policeman have been killed and over 100 injured. At least 70 of the injured that have been taken to hospital have gunshot wounds. Shops were burnt and people armed with sticks and rods were seen loitering on streets in Bhajanpura, Chand Bagh and Karawal Nagar in north-east Delhi which saw clashes between protestors for and against the controversial citizenship law spiral into unprecedented violence in the capital. The violence began hours before United States President Donald Trump arrived in the capital. In a video from Jaffrabad area, one young man in red shirt, holding a gun was seen confronting an unarmed Delhi Police officer intimidating him and forcing him to back away with his hands raised before firing repeatedly into the air.

In a chilling video shot on a mobile phone by an eyewitness standing on the roof of a nearby building, a lone officer who seems to be dressed in riot gear was standing in the middle of a main street as the gunman and at least six others approached him. The gunman walks right up to the police officer and shoves him away before firing in the air once more. As he fires, protesters on the other side of the road can be seen scattering in fear. The police officer can be seen raising his hands and slowly walking away, even as other people shout and throw stones at him. Since then, the violence has gone uncontrollable. Tensions remained high in north-east Delhi with shops and vehicles being torched and rioters running amok in several parts especially Maujpur, Brahampuri and other adjoining areas. The death toll in the violence that took a communal colour and spread to the neighbouring areas rose to nine including the police head constable Rattan Lal. Organised groups had attacked each other. Several journalists complained of “running for their lives” while reporting from the ground. Some of them also suffered injuries. Hope the government acts swiftly and controls the riots before too much damage is done to common man.
