Bombay HC refuses to extend stay on Anil Deshmukh’s bail, ex-Maha minister likely to walk out of jail

Former Maharashtra home minister Anil Deshmukh is likely to walk out of jail on Wednesday as the Bombay High Court has refused to extend its stay on an order granting him bail in a corruption case registered by the Central Bureau of Investigation (CBI).

He has been in jail since November 2021 after the Enforcement Directorate (ED) arrested him in an alleged money laundering case.

Deshmukh, 73, who has denied the allegations levelled against him, is in judicial custody at the Arthur Road Jail in Mumbai.

Justice M S Karnik had granted bail to the Nationalist Congress Party (NCP) leader on December 12, but stayed the order for 10 days as the CBI sought time to challenge it in the Supreme Court.

The probe agency moved the apex court but the appeal would be heard only in January 2023 as the court is closed for vacation.

Last week, the high court had extended the stay till December 27 on the CBI’s request.

On Tuesday, the central agency sought another extension. Deshmukh’s lawyers Aniket Nikam and Inderpal Singh claimed the CBI was trying to “overreach” the earlier order of the HC which had stated that under no circumstances another extension will be granted.

“They are failing to make out any urgency in the Supreme Court, and coming here seeking stay. This cannot be permitted,” Nikam argued.

The vacation bench of the High Court, after hearing the arguments, said “no further extension can be granted”. With the court refusing to extend the stay, Deshmukh could be released on bail on Wednesday, his lawyers told to agencies.

The high court, while granting bail to Deshmukh, had noted that except for dismissed police officer Sachin Waze’s statement, no testimony recorded by the CBI indicated that money was being extorted from bar owners in Mumbai at the behest of the NCP leader.

Deshmukh approached the high court after a special CBI court rejected his bail plea last month. He sought bail both on medical grounds and merits of the case.

In April this year, the CBI arrested him in a corruption case. In October, the high court had granted him bail in the ED case. Former Mumbai police commissioner Param Bir Singh in March 2021 alleged that Deshmukh, the then home minister, had given a target to police officers to collect Rs 100 crore per month from restaurants and bars in Mumbai.

Former assistant police inspector Waze, who was arrested in the case of an explosives-laden vehicle found near industrialist Mukesh Ambani’s house in Mumbai last year, also levelled similar allegations.

The high court in April 2021 directed the CBI to carry out a preliminary inquiry. Based on this inquiry, the CBI registered an FIR against Deshmukh and others for alleged corruption and misuse of official powers. The NCP on Tuesday welcomed the court’s decision.

In a statement, NCP’s chief spokesperson Mahesh Tapase said, “It has been proved that Anil Deshmukh was wrongfully framed in a fake case and he will come out of the jail tomorrow (Wednesday) after spending more than one year behind bars. We will take his case to the people and make them aware of the injustice meted out to him. The allegations against Deshmukh were politically motivated and no “money trail” was found, he said.

The party extends its support to Deshmukh and we will continue to fight against the people who falsely framed him,” Tapase added.

All necessary legal pursuits will be done in Supreme Court, says govt in resolution

On Tuesday, Maharashtra Legislative Assembly at Nagpur, “All the necessary legal pursuits will be done in the Supreme Court to include Belgaum, Karvar, Nipani, Bhalki, Bidar cities & 865 Marathi-speaking villages of Karnataka in Maharashtra under any circumstances,” read the resolution tabled by Chief Minister Eknath Shinde.

“The Central government should urge the Karnataka government to implement the decision taken in the meeting with Union Home Minister and it should be given the understanding to guarantee the safety of the Marathi people in the border areas,” the resolution added.

Recently Chief Minister Eknath Shinde also shared a tweet on social media regarding the Maharashtra and Karnataka border dispute stating “A resolution of 865 Marathi speaking villages in Karnataka should be included in Maharashtra”.

Doctor’s body warns of a strike from Jan 2 over demands of filling vacant posts, clearing dues

The Maharashtra State Association of Resident Doctors (MARD) has warned of going on strike from January 2 if their demands of filling vacant posts and clearing pending dues from 2018 are not met.

In a letter to state medical education minister Girish Mahajan on Monday, MARD president Dr. Avinash Dahiphale has demanded the creation of 1,432 posts of senior resident doctors and payment of pending dues of dearness allowances from October 16, 2018.

“The creation of 1,432 posts of senior resident doctors is our first demand. If the proposal for the same is still pending with the state government, then why did it have the policy of bonded service for resident doctors passing out from government-run colleges,” the letter stated.

The association has also demanded clearing pending dues of dearness allowances from October 16, 2018, it said.

BJP legislators attend Sangh programme in Nagpur

Bharatiya Janata Party legislators on Tuesday attended the Sangh Parichay Varg (an introduction to the RSS) programme in Maharashtra’s Nagpur city, where the winter session of the state legislature is currently underway.

Maharashtra Deputy Chief Minister Devendra Fadnavis, who was among those who participated in the programme, later told reporters that the legislators were also given the book ‘Bhavishya Ka Bharat’, which is a compilation of the lecture series of Rashtriya Swayamsevak Sangh (RSS) chief Mohan Bhagwat.

“Since the last 25 years, BJP legislators have been visiting memorials and attending the Sangh Parichay Varg during the winter session in Nagpur as this is our place of inspiration. We get the energy of nationalism from here,” Fadnavis said after attending the programme held at Dr Hedgewar Smruti Mandir in Reshimbagh here.

On Tuesday while addressing a press conference BJP leader Gaurav Bhatia said, “ Congress is Kattar Paapi parivaar” as they are into corruption and lands are forcefully taken in their name and given to Robert Vadra.

He has also alleged that congress takes away the lands of farmers for their own purpose and it is also seen in Rajasthan.

In many places where congress party is into power many people’s land have been taken away.

In a tweet, the BJP leader also mentioned that in Haryana in the year 2008 -13 many lands of people were been forcefully taken.

Actor Tunisha Sharma’s last rites will be held today

The last rites of Actor Tunisha Sharma, who died allegedly by suicide on the sets of a TV serial, will be held on Tuesday at around 3 pm in Mira Road in Mumbai. The maternal uncle of Tunisha said that her body was brought from JJ Hospital to the mortuary of Pandit Bhimsen Joshi Hospital in Bhayandar West late last night.

Tunisha Sharma’s family will go to the hospital by 12 noon and Tanisha’s body will be brought to her Mira Road home. “Last night deceased’s mother was unwell, she felt dizzy when she saw Tunisha’s body,” said Tunisha’s maternal uncle. Tunisha’s family issued a statement saying, “Our beloved Tunisha Sharma. With a sorrowful heart we are informing you that Tunisha Sharma left us for heavenly abode on 24th December 22. We wish for everyone to come and offer their last prayers to the departed soul.” Her cremation will take place at Mira Road cremation ground. The last rites ceremony will begin at 3 pm in Bhayander East.”

According to Waliv Police, they received information that after the tea break, the actress went to the toilet and when she did not come back, the police broke the door open and found that she had hanged herself. No suicide note was recovered at the spot by police.

Earlier on Monday, the deceased actor’s mother accused Sheezan Khan, the prime suspect in her daughter’s death case of cheating on her and breaking his promise to marry her as she urged the police not to spare him. Vanita Sharma accused her daughter’s former boyfriend of cheating on Tunisha and said Sheezan broke up with the 21-year-old despite promising to marry her.

Releasing a statement, Tunisha’s mother said, “Sheezan cheated on Tunisha. Started a relationship with her first, promised her of marriage and then broke up with her.” “He (Sheezan) had involvement with another girl, while he was in a relationship with Tunisha,” she added. “He used her for three-four months,” Tunisha Sharma’s mother said, adding that Sheezan should not be spared. The ‘Ali Baba: Dastaan e Kabul’ actor had broken up with the actress 15 days before she was found dead inside a TV set toilet on December 24. The police on Sunday said following the separation, she went into depression. She is said to have been under a lot of stress.

Tunisha Sharma’s former boyfriend Sheezan Khan has reportedly told police that he was “so disturbed by the atmosphere in the country that emerged after the gruesome murder of Shraddha Walkar” allegedly by her live-in partner, that Khan decided to end their relationship, sources said on Monday. During his first day in police custody on Sunday, Sheezan told Waliv police that he ended the relationship with Tunisha after seeing repercussions emerging from the Shraddha Walkar case and told his former paramour that belonging to a different community stands in their way as did their age gap. During interrogation, Sheezan further revealed that Tunisha had earlier also attempted suicide after they broke up.

“Tunisha had recently tried to commit suicide a few days before her death, but at that time I saved her and told Tunisha’s mother to take special care of her,” police sources quoted Sheezan as saying.

On Sunday, a court in Vasai, Maharashtra, sent actor Sheezan Khan to police custody for four days in connection with Tunisha Sharma’s alleged suicide case.

Waliv police produced Khan in the court after his arrest in the case for abetment to suicide.

The case was registered against him under Section 306 of the Indian Penal Code. Waliv police received information on December 24 that after a tea break, the actress went to the toilet and when she did not come back, the police was called.

The police broke the door open and found the actor hanging. The police have sent the mobile phones of both Tunisha and Sheezan to the forensic lab so that the calls and chats between the two can be retrieved to understand what happened between the duo and what drove Tunisha to death after 15 days of breakup,” police sources said.

In another revelation, Waliv police said that Tunisha’s blood sample, ornaments and clothes will be sent to Kalina Forensic Lab for forensic examination. The police are now probing the reason behind her alleged suicide.

Opposition members staged a protest in Maharashtra Legislature against Abdul Sattar’s resignation over a land ‘regularisation’

Opposition members staged a demonstration by taking out a foot march like ‘warkaris’ in the Maharashtra legislature complex on Tuesday and accused the Eknath Shinde-led state government of indulging in corruption.

On Monday, both Houses of the Maharashtra legislature were adjourned for the day after the opposition stalled the proceedings demanding Agriculture Minister Abdul Sattar’s resignation over a land ‘regularisation’ order passed by him when he was a minister in the previous Maha Vikas Aghadi (MVA) government.

The Nagpur bench of the Bombay High Court last week issued a notice to Sattar who had ordered ‘regularisation’ of the possession of land reserved for public ‘gairan’ (grazing) in favour of a private person in the face of a civil court order.

Earlier, the opposition members had also demanded Chief Minister Shinde’s resignation after a Nagpur bench of the HC on December 14 ordered status quo on a decision taken by him of allotment of land meant for slum dwellers to private persons when he was a minister in the previous Uddhav Thackeray-led MVA.

Shinde had denied any wrongdoing and the HC on December 22 accepted the withdrawal of the order of regularisation issued by the CM recently and observed it was treating the matter as closed.

On Tuesday, opposition members led Leader of Opposition in the Legislative Council Ambadas Danve took out a foot march in the Vidhan Bhavan complex like ‘warkaris’ do while setting out on a pilgrimage to a temple of Lord Vitthal in Pandharpur town.

They rang bells and chanted slogans, accusing CM Shinde and some state ministers including Sattar of indulging in corruption. Leader of Opposition in the Assembly Ajit Pawar, Shiv Sena (UBT) legislator Aaditya Thackeray, Congress leader Nana Patole and others joined the demonstration.

BSE : Domestic Markets begins its day with gains

The domestic markets opened with gains on Tuesday morning as investors picked up cues from strong key indices of American and European equities.

Other markets in Asia were trading mixed on Tuesday morning.

S&P BSE Sensex went up 317.49 points to 60,883.91 while NSE’s broad-based Nifty 50 surged 106.50 points to 18,121.50 on Tuesday morning. Some of the most active stocks were Dalmia Sugars, Indian Overseas Bank, Union Bank of India, and Suzlon Energy on BSE while Morepen, J and K Bank, Ajanta Pharma, and Astro Micro were the laggards during the morning.

Some of the gainers on Nifty 50 were Tata Motors, Hindalco, ONGC, JSW Steel, and Tata Steel while Sun Pharma, Cipla, and Dr Reddy were some of the laggards during the morning trade. The Indian rupee opened marginally lower at 82.70 against the dollar on Tuesday against the previous close of 82.65.

In Asian markets, Japan’s Nikkei went up 137 points, Hong Kong’s Hang Seng declined 86 points while China’s Shanghai was up 17 points on Tuesday morning.

In European markets, FTSE rose over 3 points, CAC was trading in the green while Deutsche Borse went up 26 points.

In American markets, Dow Jones was up 176 points, Nasdaq surged 21 points while S&P went up 22 points while the Asian markets opened on Tuesday morning.

The barometer index, the S&P BSE Sensex on Monday advanced 721.13 points or 1.20 per cent to 60,566.42.

The Nifty 50 index added 207.80 points or 1.17 per cent to 18,014.60.

PSU bank, media and realty stocks were in demand while health care and pharma stocks declined.

In the foreign exchange market, the rupee on Monday edged higher against the dollar.

The partially convertible rupee was hovering at 82.6550, compared with its close of 82.8250 during the previous trading session.

Markets in Europe and Asia stocks traded mixed on Monday as investors watched the COVID situation in China.

Markets in Australia, New Zealand and Hong Kong remain closed for holidays. According to reports on Monday, China will no longer publish daily figures for COVID-19 cases and deaths, the National Health Commission (NHC) said on Sunday, ending a practice that began in early 2020.

Shares of New Delhi Television (NDTV) gained 1.44 per cent on Monday. Radhika and Prannoy Roy will sell a 27.26 per cent stake in NDTV to an entity owned by Adani, giving his conglomerate control over a 64.71 per cent stake of NDTV, regulatory filings by NDTV showed.

Tata Motors rose 1.73 per cent. The company announced that Delhi Transport Corporation (DTC) has signed a definitive agreement with its fully owned subsidiary, TML CV Mobility Solutions for the operation of 1,500 electric buses in the city of New Delhi.

Larsen and Toubro (L-T) added 1.25 per cent on Monday. L and T Construction secured significant contracts for its water and effluent treatment business on Monday. Godrej Properties’ shares added 2.99 per cent on Monday. The real estate developer announced that it has acquired 62 acres of land in Kurukshetra, Haryana. Punjab National Bank (PNB) on Monday rallied 7.75 per cent.

The public sector lender said it raised Rs 582 crore by issuing bonds.

Will bring resolution on border dispute tomorrow: Fadnavis

Deputy CM Devendra Fadnavis said that a resolution on the Karnataka-Maharashtra border dispute will be brought in the Assembly on Tuesday. “I want to assure that we will fight for even an inch of our land in court,” he said.

Fadnavis’ statement came after Leader of Opposition in Assembly Ajit Pawar said, “We had decided to bring a resolution on border dispute today, but it has been delayed. At a time when Karnataka CM is making provocative statements, our government is silently listening to him.”

Oppn demands revocation of Jayant Patil’s suspension

The Opposition demanded that the suspension of NCP MLA Jayant Patil be revoked. Patil had been suspended from the entire session last week after his misbehaviour towards the Speaker.

Meanwhile, Fadnavis said that CM Eknath Shinde is in Delhi and the government will decide on the Opposition’s demand after his return.
