He has also raised questions on the religion of Sameer Wankhede, the Narcotics Control Bureau (NCB) officer who is born Muslim but forged documents, including a caste certificate, to pass off as a Scheduled Caste (SC) person to get recruitment under quota after clearing the UPSC exams.

Malik alleged that the former Maharashtra Chief Minister Devendra Fadnavis is instrumental in bringing Wankhede to NCB with the motive to harass Bollywood actors who are not in support of BJP.

Devendra Fadnavis responding to another allegation of Malik, that he appeared in a music video financed by a drug peddler who is currently in jail, Fadnavis called the claims “laughable” and hit out at the NCP leader saying he is waiting for Diwali to be over to present evidence of the minister’s relations with the criminal underworld. The music video in question had the former Chief Minister’s wife Amruta Fadnavis as the singer.

Fadnavis said in a press conference that “Those who have relations with the Underworld should not speak about me. I will present evidence of Nawab Malik’s relations with the Underworld. I am just waiting for Diwali to pass,” He further stated that he would send the evidence to NCP chief Sharad Pawar as well.

Alleging that Malik was just trying to put pressure on the NCB to get the anti-drugs agency to weaken the charge sheet against his son-in-law, the former Chief Minister said, “He has lit a tiny firecracker before Diwali but I will light a big one after the festival.” The Maharashtra cabinet minister’s son-in-law Sameer Khan was arrested by the NCB earlier this year in a drugs case and was later granted bail by a court.

Later, talking to reporters, Fadnavis said the creative team of River March, an organisation working for the conservation of rivers in Mumbai, had hired this person four years ago. Fadnavis was then the Chief Minister of the state. He claimed that he and his wife were associated with the cause of river rejuvenation.

“The pictures were clicked during the shooting of a theme song. There are photos along with the team, not only with my wife but also with me. But, Nawab Malik consciously shared the photograph of my wife. This reflects his mentality,” the leader of opposition in the state assembly said.

Fadnavis pointed out that the team which produced the video had already clarified yesterday that Jaydeep Rana, the person listed as the “Finance Head” of the video in question, was hired by its creative team.

“Neither my wife nor I have any relations with that person. He is making allegations against the BJP based on just one picture. His son-in-law was caught with drugs, does that make NCP a party of drug suppliers?” he said.

Now people are anxiously waiting for the expose bomb that Fadnavis is going to drop on NCP leaders after Diwali.


 

Ex-Maharashtra Home minister Anil Deshmukh appears before ED

They said the federal probe agency will record the statement of the 71-year-old NCP leader under the Prevention of Money Laundering Act (PMLA) in connection with the criminal investigation being carried out by it in the alleged Rs 100 crore bribery-cum-extortion racket in the Maharashtra Police establishment that led to Deshmukh’s resignation in April.

Deshmukh had skipped at least four summons issued by the ED in the case but after the Bombay High Court last week refused to quash these summons, he appeared before the agency.

The ED case against Deshmukh, who was earlier the home minister in the MVA government, and others came after the CBI booked him in the corruption case related to allegations of bribe made by former Mumbai Police commissioner Param Bir Singh.

On 19 February 2021, a victim had left her home at 8 am to attend her tailoring lessons in Kaushambi. She spoke with Raju over the phone and planned to meet him. After her class got over, she met with Raju at around 11 am and went on his motorcycle. The victim and the accused were in love and known to each other for quite some time. When the two reached a culvert of a local river in a secluded place, the accused expressed his desire to have sex with the victim. Despite her stiff resistance, the accused forced him upon her.

Meanwhile, three men reached the spot, abused and beat up Raju, snatched his mobile and allegedly raped the victim. The two took each other’s names while committing the alleged crime, enabling the victim to identify them. Taking note of the material placed on record and contents of the FIR, the court termed Raju’s behaviour as unacceptable and “unbecoming of a boyfriend.”

The court said, “The moment the applicant submits that the victim is his beloved, it was his binding duty to protect the dignity, honour and reputation of his girlfriend. If a girl is a major one then to have sex with her consent is not an offence, but certainly, it is unethical and immoral and also not in consonance with the established social norms of the Indian society,” the judge noted in his order.

The court observed that Raju remained a silent spectator when the co-accused was brutally assaulting “his beloved in front of him.” He made no effort to put up stiff resistance to save the “soul and body” of the victim from “further butchering by the flesh vultures.” The only duty he performed as a “chivalrous boyfriend” was that he accompanied the victim to the police station to lodge the FIR, the court remarked.

Before the court, the accused argued the FIR was registered belatedly, as it was lodged only a day after the alleged incident. The time taken gave ample time to the victim to cook up an imaginary story to falsely implicate the accused. The accused also took the court through the victim’s statements under sections 161 (given to the police) and 164 (recorded before the magistrate) of CrPC, admitting Raju was her boyfriend and the two had consensual sex.

On Raju’s plea of not knowing the co-accused, the judge said it cannot be said with certainty that the application had no association or connection with them. In this case, if the co-accused were not known to Raju and they confiscated his mobile, they all assaulted and hit him too, how one can expect he can save the girl to resist, even though he might have resisted but he alone against three men hardly has any scope of escape.

Well, he took the girl to the police station, helped her register a complaint, he was with her all the time that was his concern for her. Raju forcing sex on the girl in an isolated place was uncalled for. If you remember in the Nirbhaya case, the act of a boyfriend of Nirbhaya incited the event. They both were somewhat in intimate moments with each other and that invited trouble for the girl.

Sex is common in India in privacy. It is still taboo for Indian society but with the advent of new dating apps, truly madly etc, people starving for sex are getting companions more easily. There are no restrictions for 18+ boys and girls to book Oyo hotels in India. So, sex has become a common thing nowadays.

In this case, the girl met her boyfriend with mutual agreement, night time she chose to go with him to a remote place, and this has given a chance to her so-called boyfriend to demand sex. Thereafter whatever happens is a brutal tragedy. The Allahabad High Court has denied bail to a man for allegedly sexually assaulting his girlfriend and standing as a mute spectator while she was being allegedly raped by two more men. In its order dated 21 October, a single-judge bench of Justice Rahul Chaturvedi rejected the accused Raju’s defence that the victim is his girlfriend and both had consensual sex. The judge remarked having consensual sex with a girl who is a major is not an offence under the law, but is “unethical, immoral and against established Indian norms.

However, at the same time, the judge chided Raju for failing in his duty to protect his girlfriend when she was being allegedly sexually harassed by the co-accused. The court even refused to accept Raju’s contention that he was not associated with the two other accused, saying it was too early to conclude the same.

Raju was charged under Sections 376-D (taking advantage of his position to rape the victim), 392 (punishment for robbery), 323 (punishment for voluntarily causing hurt), 504 (whoever intentionally insults and gives provocation to any person to commit an offence) and 506 (criminal intimidation) of the Indian Penal Code (IPC), and under POCSO Act.

If a girl is major, then having sex with her consent is not an offence, but certainly, it is unethical and immoral, and also not in consonance with the established social norms of the Indian society,” he said.

The Allahabad High Court, while rejecting the bail plea of a gang-rape accused, held that consensual sex with a major is not an “offence” but is “unethical, immoral, and against established Indian tradition.”

Adv. Jayesh Wani (Defence Lawyer) said, “The constitution is not a voice of the majority, it is to secure the rights of the minority. Women belong to the weaker section of society. The Hindu Marriage Act is for the security of women. This means the constitution is written looking at the present prevailing conditions of 1950 working with the past historical influence. The concepts are notwithstanding with the 21st century. Unfortunately, if a woman complains about an accused, then till the trial goes on, he has to remain in custody till the Court makes a Judgement may he be acquitted or found guilty.”

Adv Dr Yusuf Iqbal Yusuf said, “Consent is paramount for any sexual relation. However, in qua consensual relationship with a minor, it must be understood that as per law, a minor is incompetent to contract and also incompetent to consent to any relationship. Therefore a minor’s consent for a sexual relationship is voidable at the instance of the minor. Whereas two consenting adults are open to having relationships.”

Adv. Bhaskar Sarode said, “It is an agreed relationship firstly from both the sides, then afterwards as the relationship gets perturbed then FIR’ get registered. For Blackmailing and trod down him or avenging him the complaint is done. Many times assurance of marriage is given and then the man turns away and then the woman feels she is cheated and me too feeling engulfing her. Some are extortionists they have a racket and Honey trap is led.”

HC grants bail to Aryan Khan with conditions; will have to appear before NCB every Friday, surrender passport

The Bombay High Court on Friday issued the detailed order with bail conditions for Aryan Khan, Arbaaz Merchant and Munmun Dhamecha — arrested in the drugs-on-cruise case. In the detailed order, the Bombay High Court asked Aryan and the two others to surrender their passports to Narcotic Drugs and Psychotropic Substances (NDPS) court, and not leave the country without permission from the special court.

“Each accused be released on bail on furnishing a personal bond of Rs 1 lakh with one or more sureties of like amount,” the bail order said. The court asked all three applicants to appear before the NCB Mumbai office every Friday, between 11.00 am to 2.00 pm to mark their presence.

Aryan’s bail order stated that “he should not indulge in any similar activities, not try to establish contact with co-accused” and should not make any statement regarding the court proceedings before media. Earlier today, Advocate Satish Maneshinde, who is representing Aryan Khan said that he will be out of jail by today evening.

On Thursday, Aryan Khan, Arbaaz Merchant and Munmun Dhamecha were granted bail by the court yesterday the hearing of three days in the case.


 

Why NCB didn’t take action against person who organised Mumbai cruise party? asks Minister Nawab Malik

The Maharashtra Cabinet Minister alleged Khan was let off by NCB Zonal Director Sameer Wankhede because he is probably a friend of Wankhede.

Addressing a press conference, Malik said, “Almost a month ago, a person (Kiran Gosavi) who was involved in arresting an innocent youth is now behind the bars. Another person (Sameer Wankhede) who was leading the raid is now knocking doors of the court, requesting to transfer the case investigated by the Mumbai Police to CBI or NIA.” He added, “Now the situation has completely changed in a month time.”

The Mumbai Police have given assurance that Wankhede would be provided 3-days’ notice before his arrest, said Malik. The Minister also claimed that he never personally attacked Wankhede’s mother and he has high regard for his mother and wife.

After the Bombay High Court announced bail for Aryan Khan, Arbaaz Merchant and Munmun Dhamecha, Malik had put out a tweet, saying “Picture Abhi Baki Hai Mere Dost”. Aryan Khan was arrested on October 3. An NCB team busted an alleged drugs party on the Cordelia Cruise ship which was on its way to Goa on October 2. A total of 20 people were arrested in the case.

Meanwhile, Narcotics Control Bureau zonal director Sameer Wankhede approached Bombay High Court seeking interim protection against arrest over the inquiry against him by the Maharashtra government. He demanded a probe by CBI or any central agency in the matter. The arguments on the matter were heard by the Division Bench of Bombay HC. Recently, Sameer’s sister Yasmeen also filed a police complaint seeking registration of an FIR against Maharashtra minister Nawab Malik for allegedly defaming her. In her two-page complaint submitted to the Oshiwara police, Yasmeen claimed her family was being targeted on social media and that Malik had also called their family trip to the Maldives a “vasooli (extortion) trip”. She alleged that Malik was trying to defame her and her family members.

Later, Sameer’s wife Kranti Redkar wrote a letter to Maharashtra CM Uddhav Thackeray. In the letter, she said, “Being a Marathi person, I expect some justice from your side as my personal life is unnecessarily being dragged into a controversy. Had late Balasaheb Thackeray (father of Uddhav Thackeray) been alive today, he would not have tolerated such a personal attack on a woman’s dignity.” But Kranti forgot the breach of privacy caused by her husband to all selective targets he picked.

In the shocking development, Mumbai-based advocate Jayesh Wani has approached the MRA Marg police station in Mumbai and filed a cheating and forgery complaint against Sameer Wankhede. He has alleged that Sameer Wankhede took away the opportunity of someone from a scheduled caste by submitting a fake caste certificate to get into the civil services.

Sameer Wankhede has also filed a petition in the Bombay High Court seeking CBI investigation in his case if there has to be any probe. This is against the probe launched against him by the Mumbai Police. Wankhede was seeking interim protection. Wankhede said he is being personally attacked by the State. The Bombay HC has disposed of the plea filed by NCB top officer Sameer Wankhede seeking a CBI probe into extortion allegations against him. This is against the probe launched against him by the Mumbai Police.

Wankhede is given four corner fights along with his wife, sister and father. For two days they are making rounds in media studios. Nawab Malik has thrown many allegations at them, and they were reckless with all those accusations.

The Mumbai Police have received four applications so far alleging extortion by Sameer Wankhede and other officials, and have launched an enquiry to verify these claims. One of the applications was sent by NCB independent witness Prabhakar Sail who had alleged that he had overheard K P Gosavi, another witness in the cruise ship raid case, talking to one Sam D’Souza over the phone about a demand of Rs 25 crore including Rs 8 crore for Sameer Wankhede. Sail has sent the application against NCB officers to the Mumbai Police.

Earlier in the day, Maharashtra minister Nawab Malik accused Wankhede of illegal phone tapping and announced that he will hand over a letter on the official’s ‘misdeeds’ to the agency head. Mumbai NCB has summoned Prabhakar Sail, a witness in the drugs on cruise case, for questioning. He will be questioned by the NCB team reaching Mumbai from Delhi tomorrow, in connection with his allegations of corruption.

The Maharashtra government told the Bombay High Court that it will not arrest NCB’s zonal director Sameer Wankhede without giving him prior notice of three working days, in connection with the allegations of extortion and corruption levelled against him. Wankhede also moved the Bombay High Court, seeking interim protection from arrest or any coercive action against him.

After all this high-end drama, Aaryan Khan will go home. The other accused too will go to their place, but Wankhede has to run to the polls in various inquiries and allegations, one thing is sure that the coming time won’t be easy for Wankhede as his own deeds will haunt him.


 

Bombay HC grants bail to Aryan, Arbaaz and Munmun in the cruise drug case

Aryan Khan, son of superstar Shah Rukh Khan, was granted bail by a single bench of Justice N W Sambre over 20 days after his arrest in the case of seizure of banned drugs aboard a cruise ship off the Mumbai coast.

“All three pleas are allowed. I will pass detailed orders by tomorrow evening,” Justice Sambre said.

Aryan Khan’s advocates then sought permission to submit cash bail to which the court refused and said surety is to be given.

“I could have given the order also tomorrow. But I gave it today,” Justice Sambre said.

The legal team of the 23-year-old Aryan Khan, who is presently in judicial custody and lodged at the Arthur Road prison in central Mumbai, will now try to complete the formalities for his release by Friday.

“The detailed order will be given tomorrow (Friday). Hopefully, all they will come out of the jail by tomorrow or Saturday,” said Former AG Mukul Rohatgi, who was representing Aryan Khan in the court.

Aryan Khan, Merchant and Dhamecha were arrested by the Narcotics Control Bureau (NCB) on October 3 and booked under relevant sections of the Narcotics Drugs and Psychotropic Substances Act (NDPS) for possession, consumption, sale/purchase of banned drugs, conspiracy and abetment.
