Munde’s suit on MCA poll dismissed

A local court hearing a suit filed by late BJP leader Gopinath Munde challenging rejection of his nomination for election of Mumbai Cricket Association today dismissed it in view of his death.

“The court observed that in view of plaintiff’s death, no cause of action survives and the suit abates,” said Munde’s lawyer Vivekanand Gupta.

Munde died in a road accident in Delhi on June 3.

He had challenged the rejection of his nomination for the biennial presidential election of MCA, and also requested the court to restrain NCP chief Sharad Pawar, who won the prestigious election, from functioning as the president while the matter was before the court.

The city civil court on November 26 last year temporarily restrained Pawar from functioning as MCA chief, but the order was later set aside by the Bombay High Court.
